All other provisions of the original Agreement or prior Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows: 1. Introduction The following Scope of Work outlines changes to the Meeker Street Design and Construction standards level of effort for work not included within the original scope and fee dated January 5, 2017 and Supplement 1 dated July 10, 2017. This work is related to the additional effort required to complete the design standards for Meeker Street, and for integrating those standards into the existing Kent downtown standards. The Supplement below details the changes to the scope of work. B. Background Identified background documents remain the same. C. Assumptions The assumptions in the original scope of work remain the same, D. Proiect Deliverables Same as original scope of work E. Sca a of Work Task 1. ManagementtAdministrationlCoordination The original scope of work assumed a three (3) month schedule. The schedule was extended significantly to accommodate the efforts related to the Marquee on Meeker development. This modification provides additional project management for an additional four(4) month period. 1.4 KPG shall provide project management for the extended project duration (estimate four (4) months). This will include preparation of monthly status reports and up to three (3) meetings with City Staff to coordinate the development of Design & Construction Standards. Task 2. Same as original scope of work Task 3. Streetscape Design and Standards The original scope of work included the design standards document that would describe the Meeker Overlay District and design standards for streetscape, urban design and strategic City of Kent 1 of 3 KPG Meeker Street Design & Construction Standards 1 012 012 01 7 Supplement 2 placemaking elements. The expanded scope allows for additional drafts and responses to review comments, leading to completing the final document. 3.5 KPG shall provide review and response to comments from City staff in the development of the final document. This includes coordination with City staff in discussions with other departments, revisions to draft documents and completion of responses to the comment matrix, provided by the City. The level of effort assumes the preparation of up to two additional draft documents. 3.6 Based on the comments received, KPG will prepare the final document for submittal to the City Council. Task 4. Standard Construction Details and Specifications The original scope of work included standard plans for 5locations on the corridor, including streetscape elements, hardscape standards, sign and illumination, site furniture, utility grates and covers, and landscaping and retaining walls. The expanded scope allows for additional drafts and responses to review comments, leading to the final document. 4.4 KPG shall provide review and responses to comments from City staff in the development of the final document. This includes coordination with City staff in discussions with other departments, revisions to draft documents and completion of responses to the comment matrix, provided by the City. The level of effort assumes the preparation of up to two additional draft documents. 4.5 Based on the comments received, KPG will prepare the final document for the Meeker Street Standard Construction Details and Specifications, to be included in the Streetscape Design and Standards Document, for submittal to the City Council. Tasks 5-6. Same as described in Supplement 1 Task 7. Update and Develop Interim Plan for Meeker Street This new task will develop plan view layout of an interim plan that will allow sequencing of the proposed Meet Me on Meeker corridor improvements. This will ensure that the improvements will be continuous along the corridor and allow construction of improvements along property frontages that are unlikely to redevelop in the near future. This will also allow sections of the corridor to be completed using grant funds and provide the City with the flexibility in developer negotiations. 7.1 Prepare and participate in up to two meetings with City Staff to discuss and present the Interim Long Term Plan for Meeker Street. 7.2 Update the entire corridor plan to provide direction for integrating the the Meet Me on Meeker concept along properties that are not likely to redevelop, including updating the west end of the corridor with the Marquee on Meeker improvements, per AutoCAD plans provided to the developer by KPG. Assumptions: ❑ The corridor plan layout is based on centerline of ROW, ROW and property lines provided by the City City of Kent 2 of 3 KPG Meeker Street Design & Construction Standards 1 012 012 01 7 Supplement 2 ❑ The corridor plan will only show horizontal layout of roadway pavement and pedestrian amenities. Task 7 -Total $ 51.75 $ 592.25 EXHIBIT R INSURANCE REQUIREMENTS FOR CONSULTANT SERVICES AGREEMENTS Insurance The Consultant shall procure and maintain for the duration of the Agreement, insurance against claims for injuries to persons or damage to property which may arise from or in connection with the performance of the work hereunder by the Consultant, their agents, representatives, employees or subcontractors. A. Minimum Scope of Insurance Consultant shall obtain insurance of the types described below: 1. Automobile Liability insurance covering all owned, non- owned, hired and leased vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If necessary, the policy shall be endorsed to provide contractual liability coverage. 2. Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01 and shall cover liability arising from premises, operations, independent contractors, products-completed operations, personal injury and advertising injury, and liability assumed under an insured contract. The City shall be named as an insured under the Consultant's Commercial General Liability insurance policy with respect to the work performed for the City using ISO additional insured endorsement CG 20 10 11 85 or a substitute endorsement providing equivalent coverage. 3. Workers' Compensation coverage as required by the Industrial Insurance laws of the State of Washington. 4. Professional Liability insurance appropriate to the Consultant's profession. EXHIBIT B (Continued) B. Minimum Amounts of Insurance Consultant shall maintain the following insurance limits: I. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. 2. Commercial General Liabi& insurance shall be written with limits no less than $2,000,000 each occurrence, $2,000,000 general aggregate and a $1,000,000 products-completed operations aggregate limit. 3. Professional Liability insurance shall be written with limits no less than $2,000,000 per claim and $2,000,000 policy aggregate limit. C. Other Insurance Provisions The insurance policies are to contain, or be endorsed to contain, the following provisions for Automobile Liability and Commercial General Liability insurance: 1. The Consultant's insurance coverage shall be primary insurance as respect the City. Any Insurance, self-insurance, or insurance pool coverage maintained by the City shall be excess of the Consultant's insurance and shall not contribute with it. 2. The Consultant's insurance shall be endorsed to state that coverage shall not be cancelled by either party, except after thirty (30) days prior written notice by certified mail, return receipt requested, has been given to the City. 3. The City of Kent shall be named as an additional insured on all policies (except Professional Liability) as respects work performed by or on behalf of the Consultant and a copy of the endorsement naming the City as additional insured shall be attached to the Certificate of Insurance. The City reserves the right to receive a certified copy of all required insurance policies. The Consultant's Commercial General Liability insurance shall also contain a clause stating that coverage shall apply separately to each insured against whom claim is made or suit is brought, except with respects to the limits of the insurer's liability. D. Acceptability of Insurers Insurance is to be placed with insurers with a current A.M. Best rating of not less than ANII. EXHIBIT B (Continued) E. Verification of Coverage Consultant shall furnish the City with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsement, evidencing the insurance requirements of the Contractor before commencement of the work. F. Subcontractors Consultant shall include all subcontractors as insureds under its policies or shall furnish separate certificates and endorsements for each subcontractor. All coverages for subcontractors shall be subject to all of the same insurance requirements as stated herein for the Consultant.
