MEMORANDUM OF UNDERSTANDING between the CITY OF KENT and TEAMSTERS LOCAL UNION NO. 117 Affiliated with the International Brotherhood of Teamsters regarding Rehires This Memorandum of Understanding (MOU) memorializes the agreement between the City of Kent (City) and Teamsters Local Union 117 (Union). This MOU pertains to the City's rehiring of employees into the Teamsters bargaining unit. Background The City and the Union are parties to a collective bargaining agreement effective January 1, 2017 through December 31, 2019 (CBA). Neither the CBA nor City policy specifically references the City's practice for rehiring former employees nor what benefits may be restored if a former employee is rehired by the City within any particular period of time. The following represents the parties' agreement concerning the rehire of former employees into bargaining unit positions. Agreements 1. Eligibi0ity; An employee who has left the City's employment and is rehired into a bargaining unit position within two (2) years from the employee's separation date is eligible for benefit reinstatement in accordance with this MOU. 2. Seniority: Consistent with Article 3 (Seniority), Section 3.3 (Seniority Cancellation), rehires are not entitled to reinstatement of any seniority within the bargaining unit that they may have enjoyed prior to separation. 3, Benefits Eligible for Restoration: Employees who are rehired and eligible for benefit reinstatement will have the following benefits reinstated: a. Annual Leave: Annual leave accruals will be adjusted to give rehired employees credit for their prior years of employment. Adjustments are made by full calendar months. b. Longevity: Longevity will be adjusted to give credit to rehired employees for their prior years of employment. Adjustments are made by full calendar months. c. Sick Leave Balance: Sick leave will be adjusted to restore any sick leave earned prior to separation. 5. Miscellaneous: A. Any dispute regarding the interpretation or application of this MOU shall be handled in accordance with the grievance procedures set forth in the CBA. MOU Regarding Rehires Page 1 of 2 B. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter. The principle of contra proferentem shall not apply. C. This MOU shall not be interpreted to create a past practice; nor does it waive either party's right to bargain over wages, hours, and working conditions as provided by statute and other applicable law. By signing below, the parties agree that the above represents the parties' full and entire agreement with respect to the subject matter of this MOU. Dated this of November 2017.
