Background The City and the Union are parties to a collective bargaining agreement effective January 1, 2017, through December 31, 2019. At Appendix A, the CBA specifies target adjustments to be made on July 1, 2017, and January 1, 2018, to a number of position classifications based upon a salary survey study conducted in 2016. Target adjustments were mutually agreed upon by the parties and were based upon a market average that included cost of living increase of 2.5%. For example, if the average market comparison indicated that a position range should be increased by 5%, the cost of living increase of 2.5% was included in that 5% calculation, resulting in a market increase of 2.5% and a cost of living increase of 2.5% for a total 5% increase. In a subsequent salary survey for non- represented positions, the cost of living increase was not considered in determining the appropriate market adjustment to the position. For example, if the market average called for a 5% adjustment to the non-represented position, the position received the 5% adjustment, and the cost of living adjustment of 2.5% would be added to that 5% market average adjustment for a total adjustment of 7.5%. The adjustments made pursuant to this MOU are agreed upon in order to ensure consistency between the survey conducted for Union positions and the subsequent survey conducted for non-represented positions. Appendix A of the CBA provides in part as follows: *Target Market Adjustments 1/1/18: Crime Analyst AF 33 Senior Accountant AF 40 Senior Financial Analyst AF 36 The above section of Appendix A shall be replaced with the following: *Target Market Adjustments 1/1/2018 Crime Analyst AF 34 B&O Program Auditor AF 42 Corrections Officer AF 28 Corrections Sergeant AF 35 Custodian AF 15 Parking Enforcement Assistant AF 18 Paralegal AF 30 Payroll Business Analyst AF 37 Senior Accountant AF 41 Senior Financial Analyst AF 37 All other language of the CBA shall remain in full force an effect, and shall not be altered by this MOU. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter of the MOU. The principle of contra proferentem shall not apply.
