GeoEngmeers-MVC Erasion Repair Arno 2/Knox AMENDMENT - 2 OF 2 EXHIBIT A MERIDIAN VALLEY CREEK MODIFIED RIVERBANK REPAIR DESIGN 133RD AVENUE SE; MERIDIAN VALLEY COUNTRY CLUB i KENT,WASHINGTON MAY 30,2017 FILE NO.0410-194-01 f INTRODUCTION GeoEngineers prepared construction design drawings and specifications for the Meridian Valley Creek Riverbank Repair under a contract with the City of Kent dated July 17, 2015. The City installed temporary measures to resist channel migration and erosion in November of 2016, that included the placement of erosion control fabric on the channel bank.The channel responded with continued bank erosion.The City requested an updated scope of services for modified construction design drawings and specifications to address the changed condition in Meridian Valley Creek. The following scope of work and project understanding is based on our conversation with Matt Knox of the City and photographs of the site taken in November, 2016 and May,2017. SCOPE OF SERVICES Our specific scope of services for the Meridian Valley Creek bank erosion mitigation design project includes: 1. Perform a site reconnaissance to collect field data and mark the required survey extents at the 13316 Avenue SE site.We assume site access will be coordinated by the City.We recommend members of the Mukelshoot Tribe attend the site visit for clarification on project objectives and anticipated channel response. 2. Develop draft final design drawings for review by the City for the 1331d Avenue SE site. We anticipate the design will consist of minor regrading and stabilizing the existing riverbank, stabilizing the upland embankment,and toe protection. 3. Provide supplemental specifications to the standard Kent Special Provisions and an opinion of estimated construction costs. 4. Provide 100 percent design drawings for the 1331d Avenue SE site following the City's review of the draft final design.The design drawings will be signed and stamped by an engineer licensed in the State of Washington. 5. Provide up to two site visits during construction of the repair at the 1331d Avenue SE site.The purpose of our visits will be to observe and inform the selected contractor regarding execution of the bank stabilization. We will provide revised recommendations in the field,as appropriate. City of Kent May 30,2017 Page 3 ASSUMPTIONS AND EXCLUSIONS We assume that the City will complete a topographic survey of the 1331dAvenue SE site, including project limits staked by GeoEngineers during our field visit.We assume that the City will provide electronic AutoCAD files of the survey including key site features and topography at 1-foot contour intervals associated with the eroding bank(toe of bank,top of bank). I We assume the permits acquired with the original design are applicable to the modified design and planned construction in 2017.We have excluded JARPA drawing submittals for the Hydraulic Project Approval(HPA). 1 No US Army Corps of Engineers permit is expected be necessary because there is no dredging or filling proposed for this project. Our scope of services does not include preparing or submitting permit applications. We assume the City will coordinate with the Mukelshoot Tribe as required for approval of the design drawings. There are no intended third party beneficiaries arising from the services described in this proposal and no party other than the party executing this proposal shall have the right to legally rely on the product of our services without prior written permission of GeoEngineers. UNINTENTIONAL FAILURE TO DISCLOSE HAZARDS If the Named Insured unintentionally fails to disclose all existing hazards at the inception date of the Named Insured's Coverage Part, the Insurer will not deny coverage under this Coverage Part because of such failure. 26. WAIVER OF SUBROGATION- BLANKET Under CONDITIONS, the condition entitled Transfer Of Rights Of Recovery Against Others To Us is amended to add the following: The Insurer waives any right of recovery the Insurer may have against any person or organization because of payments the Insurer makes for injury or damage arising out of: 1. the Named Insured's ongoing operations; or 2. your work included in the products-completed operations hazard. Condition 4.Other Insurance is amended to add the following subparagraph 4.b.(1)(c): This insurance is excess over: (c) Any of the other insurance whether primary, excess, contingent or any other basis that is insurance available to the Named Insured as a result of the Named Insured being a participant in a consolidated (wrap-up) insurance program, but only as respects the Named Insured's involvement in that consolidated (wrap-up) insurance program. C. DEFINITIONS is amended to add the following definitions: 0 Consolidated (wrap-up) insurance program means a construction, erection or demolition project for which the prime contractor/project manager or owner of the construction project has secured general liability insurance s covering some or all of the contractors or subcontractors involved in the project, such as an Owner Controlled e Insurance Program (O.C.I.P.) or Contractor Controlled Insurance Program (C.C.I.P.). Residential structure means any structure where 30%or more of the square foot area is used or is intended to be used for human residency, including but not limited to: 1. single or multifamily housing, apartments, condominiums, townhouses, co-operatives or planned unit developments;and 2. the common areas and structures appurtenant to the structures in paragraph 1. (including pools, hot tubs, detached garages,guest houses or any similar structures). However, when there is no individual ownership of units, residential structure does not include military housing, college/university housing or dormitories, long term care facilities, hotels or motels. Permitting of the project last year required more time than anticipated and full construction was not possible before the end of the fish window in 2016. The wet winter that we experienced caused additional erosion requiring additional design work. This amendment will cover the additional design work and construction support to allow construction this summer. The original bid to complete conceptual and permitting plans was for $18,838.00. Amendment #1 added $13,322 bringing the total to $32,160. This amendment (#2) adds $14,323 bringing the total design and construction support contract to $46,483.
