The City's inspection or acceptance of any of Contractor's work when completed shall not be grounds to avoid any of these covenants of indemnification. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the City, its officers, officials, employees, agents and volunteers, the Contractor's duty to defend, indemnify, and hold the City harmless, and Contractor's liability accruing from that obligation shall be only to the extent of the Contractor's negligence. THE PARTIES FURTHER ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER. Kent, WA 98032-5895 Date: 03/27/2017 To: Memorandum for Record Thru: Dave Brock From: Bryan Bond RE: Contract, East Hill Well - Cleanout and Redevelopment In October of 2016 the pump motor at the City of Kent's East Hill Well #1 failed. East Hill Well accounts for approximately 30% of the City's Water supply. This is a critical site for the City and needs to be returned to service before Summer. Following the pump failure, components were removed from the well, inspected, and found to need replacement. Components were ordered with an expected lead time of 4 months. With the well pump removed we used the opportunity to have a video inspection done on the well. The results of that inspection showed significant encrustation on the well casing. We will use this opportunity to have the well cleaned while awaiting the components. The cost to clean-out and re-develop the well was estimated to be under $25K. Following the City's procurement process, we solicited bids from three (3) contractors listed below who have experience with working on Municipal wells. • Charon Drilling Inc.- $20,202.75 • Hokkaido Drilling - $24,090.00 • Holt Services - Non Responsive Bids were due as of 04:00 PM on 03/24/2017. Two contractors submitted on time with the lowest bid being Charon Drilling Inc. at $20,202.75. After review by Dave Brock, Sean Bauer, and Bryan Bond and having no concerns with Charon Drilling Inc., they were selected to perform the cleanout and redevelopment of the well. CITY OF KENT EQUAL EMPLOYMENT OPPORTUNITY COMPLIANCE STATEMENT This form shall be filled out AFTER COMPLETION of this project by the Contractor awarded the Agreement. 1, the undersigned, a duly represented agent of Charon Drilling, Inc. Company, hereby acknowledge and declare that the before-mentioned company was the prime contractor for the Agreement known as East Hill Well that was entered into on the April 20, 2017 (date) between the firm I represent and the City of Kent. I declare that I complied fully with all of the requirements and obligations as outlined in the City of Kent Administrative Policy 1,2 and the Declaration City of Kent Equal Employment Opportunity Policy that was part of the before-mentioned' Agreement.
