Jensen Department: HR Contract Amount: on Approval Authority: ❑ Director ❑ Mayor ® City Council 1/1/2017 Meeting Date Detail: (i.e. address, location, parcel number, tax id, etc.): Removal of Assistant Building Official, addition pf Lead Combination"Building Inspector MEMORANDUM OF UNDERSTANDING by and between the CITY OF KENT and WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES, AFSCME, AFL-CIO, LOCAL #2617 Regarding REMOVAL OF ASSISTANT BUILDING OFFICIAL JOB CLASSIFICATION AND ADDITION OF LEAD COMBINATION BUILDING INSPECTOR CLASSIFICATION This Memorandum of Understanding (MOU) is entered into by and between the City of Kent ("City") and the Washington State Council of County and City Employees, AFSCME, AFL-CIO, Local #2617 ("Union") to memorialize an agreement reached between the City and the Union regarding both the removal of the Assistant Building Official position from the Union, and the addition of a Lead Combination Building Inspector position to the Union. The parties have agreed as follows: 1. The Assistant Building Official job classification will be removed from the Union's bargaining unit, and reclassified as a non-represented supervisory job classification titled, Assistant Building Services Manager. Any reference in the parties' collective bargaining agreement to the Assistant Building Official job classification will be null and void. 2. Those combination building inspector duties formerly performed by the Assistant Building Official will return to the Union and be performed by a Lead Combination Building Inspector. The Lead Combination Building Inspector is a new job classification that will be created, and whose work will remain within the Union. 3. The Lead Combination Building Inspector classification will be included in Appendix A of the contract, and is assigned salary range of AF 37. 4. The Assistant Building Services Manager position will be reclassified to be non-represented exempt, and set at salary range NRMC41. 5. The City prepared job descriptions for both of the new positions—the non-represented Assistant Building Services Manager and the Union Lead Combination Building Inspector job classification—and the Union approved of those job descriptions and the separation of duties for which they provide. 6. To the extent the terms of this MOU conflict with the parties' collective bargaining agreement, the terms of this MOU shall control. Any dispute regarding the interpretation or application of this MOU shall be handled in accordance with the grievance procedures set forth in the CBA. 8. This MOU shall not be interpreted to create a past practice, nor shall it be precedent setting in terms of how future similar issues will be resolved. 9. This MOU was prepared and/or reviewed by both parties. In the event of an ambiguity in any term of this MOU, it shall be interpreted evenly, and not against the drafter of the MOU. The principle of contra proferentem shall not apply. By signature below, the parties agree that the above represents the parties' full and entire agreement with regard to the removal of the Assistant Building Official job classification from the Union; its reclassification to a non-represented supervisory position titled, Assistant Building Services Manager; and the creation of a new Union position, entitled Lead Combination Building Inspector.
