This MOU pertains to the City's Supported Employment Program. Background The City and the Union are parties to a collective bargaining agreement effective January 1, 2017, through December 31, 2019 (CBA). The CBA does not specifically reference the City's Supported Employment Program, or the basic work tasks otherwise performed by individuals qualified under that program. The following represents the parties' agreement concerning the employment of supported employees in areas occupied by Public Works and/or Parks bargaining unit members. Agreements 1. Non-Union Members: Employees hired into the City's Supported Employment Program are not members of the Union and are otherwise recognized as non- represented employees of the City. As such, the provisions of the CBA are inapplicable to employees hired through the Supported Employment Program, including access and participation in the Western Conference of Teamsters Pension Trust (WCTPT). 2. Hours of Work: Supported employees will be scheduled for work during the regular work hours for the work group to which the supported employee is assigned. The cumulative weekly work hours for all supported employees throughout the City will not exceed forty (40) hours. Union members will not be required to transport supported employees. . Supported employees are equally eligible for mileage reimbursement as other City employees for any travel required during the day for work for which their personal vehicles are used. 3. Job Duties: The job duties and work assignment area for each supported employee will be communicated clearly to work crew(s), and training on the supported employment program will be provided to crews prior to a new hire of a supported employee. 4. Recruitment: The Field Supervisor where the supported employment position is to be assigned will partner with Human Resources staff and be a part of the interview and selection process. 5. Job Coach: The job coach will be trained in the duties the supported employee is expected to perform. The job coach will be in line of sight of the supported employee, and unless mutually agreed to, will be present at all times during the selected hours of work. If issues or complications arise relating to the supported employment program, the parties agree to meet in Labor Management to discuss the details, B. This M[)Uwas prepared and/or reviewed by both parties. In the event ofam ambiguity in any term mfthis MDU, it shall be interpreted evenly, and not against the drafter. The principle of contra proherentacn shall not apply. C. This MC>U shall not be interpreted to create a past practice; nor does it waive either party's right to bargain over wages, hours, and working conditions as provided by statute and other applicable law.
