This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to
add additional work or revise existing work as follows:
In addition to work required under the original Agreement and any
prior Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:

2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order,
including, without limitation, claims related to contract time, contract acceleration, onsite or
home office overhead, or lost profits. This Change Order, unless otherwise provided, does not
relieve the Contractor from strict compliance with the guarantee and warranty provisions of the
original contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order', are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change
Order shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this
contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this
project to be consistent with the revised contract sum shown in section 2, above.

I've been requested to seek pricing for additional items of work on the Levee project.See plan sheet 15
of 24 for location.
1. Provide and install 200 LF—Galvanized hand railing-$245_/LF
Materials and style to match that installed on stairs,see plan sheet 16 of 24;
a Post spacing 8 feet instead of 4,12" post embed at each 18"deep x 12" diameter post !,
concrete base

To be placed on land side edge of 5 foot ramp shown on sheet 15 of 24, Lakes development
side of levee.
2. HMA Class%' -10 Ton @ $_155____/Ton
Pave a 30 foot long by full width of levee(20 foot) asphalt pad at the top of newly installed
stairs.Before you ask... I have no idea?
he Neely irrigation plan for pricing is attached as well. I'm still waiting on specific seed type to be
required, but I don't see why pricing cannot be started.
Items of work look to be as follows:
Existing Irrigation investigation: potholing for connections, repairs and the like: $2,500 F.A.
New irrigation installation and testing,complete: 1 L.S. $_26,000_L.S.
Topsoil Type A,to be placed per notes on plan: 40 CY.or less $_41.00_C.Y.
Hydroseed placement,first mowing:Approx.1/3 Acre $_1,300_L.S.
Iso, I informally asked Rebekah with Terra Dynamics to remove and replace several planted 6"
ttonwood logs from the last phase with a potted variety,size doesn't matter,just replaced. If you
could follow up on that I'd appreciate it.

Rebekah is out of town but I believe she and Andy were thinking it was right around two weeks of work so it
should be pretty close.
Likely depends on the restoration of existing and the extent of damage etc.sometimes end up chasing the
rabbit down the hole....
I think crew liming wise Andy should be able to move back to the levee sometime early next week mid latest.
She'll back Thursday so we'll put it in motion and keep you posted at the end of this week.

that Melvin, our regional bike patrol enforcer keeps telling me about?
Prices will improve, the current layout works just fine and SCl is very ready to finalize their contract. I believe a line
should now be drawn regarding this idea being outside the responsibility of this contract.
Any word on giving authorization for Neely?
