This Change Order amends the above-referenced contract; all other provisions of the
contract that are not inconsistent with this Change Order shall remain in effect. For valuable
consideration and by mutual consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to
add additional work or revise existing work as follows:
In addition to work required under the original Agreement and any
prior Amendments, Contractor shall provide all labor, materials, and
equipment necessary to:
1. Extend the handrail 18 LF (three panels) south from STA 73+36
RCL to overlap the existing pedestrian wall on the bridge for safety and
aesthetic reasons.
2. Terminate the handrail on either side of the luminaire pole located
at STA 72+38 RCL to allow approximately 6 inches of additional
sidewalk width.
3. Revise the handrail at the PSE vault located at STA 73+05 LCL from
a removable straight handrail in front of the vault to a permanent
handrail wrapping around the vault allowing for easier access and
provides fall protection.
2. The contract amount and time for performance provisions of Section II "Time of
Completion," and Section III, "Compensation," are hereby modified as follows:

In accordance with Sections 1-04.4 and 1-04.5 of the Kent and WSDOT Standard
Specifications, and Section VII of the Agreement, the Contractor accepts all requirements of this
Change Order by signing below. Also, pursuant to the above-referenced contract, Contractor
agrees to waive any protest it may have regarding this Change Order and acknowledges and
accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order,
including, without limitation, claims related to contract time, contract acceleration, onsite or
home office overhead, or lost profits. This Change Order, unless otherwise provided, does not
relieve the Contractor from strict compliance with the guarantee and warranty provisions of the
original contract, particularly those pertaining to substantial completion date.
All acts consistent with the authority of the Agreement, previous Change Orders (if any),
and this Change Order, prior to the effective date of this Change Order, are hereby ratified and
affirmed, and the terms of the Agreement, previous Change Orders (if any), and this Change
Order shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are
authorized to enter into this contract modification, which is binding on the parties of this
contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this
project to be consistent with the revised contract sum shown in section 2, above.

x. PROPOSED CHANGE
This Change makes the following revisions to the handrail shown on Contract Drawing 30 of 37:
1. Extend the handrail 18 LF (three panels) South from STA 73+36 RCL to overlap the
existing pedestrian wall on the bridge. Set the southernmost base plate for the end post
just inside (east side) the wall. Allow for expansion in the railing segment crossing the
bridge deck expansion joint.
2. Terminate the handrail on either side of the luminaire pole located at STA 72+38 RCL.
Locate the handrail base plate as close to the luminaire pole as necessary to prevent the
passage of a 4" sphere between the luminaire pole and the handrail.
3. Revise the handrail at the PSE Vault located at —STA 73+05 LCL from a removable
straight handrail in front of the vault to a permanent handrail wrapping around the vault
and mounting to its outside edge.
This Change also adds a bid item to provide compensation to the Contractor for additional costs
associated with this Change.
11. REASON AND BACKGROUND FOR CHANGE
Item 1. Contract Drawing 30 of 37 calls for the handrail to match the existing railing at
73+36.93. The existing railing was scratched, dented, and had bases and anchors that were not
as strong as the new railing being installed. For both safety and aesthetic reasons, the City
elected to have the remained railing, approximately 15 LF, removed and replaced with the new
railing being installed under this Contract.
Item 2. Contract Drawing 30 of 37 calls for the handrail to pass in front of the luminaire at STA
72+38. The City elected to terminate the handrail on either side of the luminaire, which
provided approximately 6 inches of additional sidewalk width.
Item 3. Contract Drawing 30 of 37 calls for the handrail to utilize the existing base plates on the
PSE vault at STA -73+05 LCL, and to make the railing removable. Between the project bid and
start of construction, PSE replaced the vault lid, removing the existing base plates. While
redesigning the railing to work with the new lid, the City elected to install a railing around the

outside edge of the vault. This change makes accessing the vault easier and provides fall

7/29/2015—Handrail Shop Drawing and Enginee-ed Calculations approved by City.
9/24/2015—RFP 005 is issued to Marshbank Construction, Inc(MCI),proposed changes included terminating the
handrail on either side of the luminaire pole at 72+38 RCL and the addition of 18 LF of railing by the driveway at 70+35
RCL.The RE team put together an Independent Cost Estimate(ICE).
10/6/2015—MCI Serial Letter 011 sent to the City regarding the proposal requested in RFP 005.
10/19/2015—The City issued FWD 012,directing MCI to perform the work noted in RFP 005 after reviewing the pricing
proposed in MCI Serial letter 011.
11/20/2015—the City issued RFP 007 to MCI requesting a proposal to install the handrail on top of the new PSE vault lid,
wrapping around the outside of the lid instead of a removable straight section in front of the vault.
1/27/2016—the RE team completes the ICE for RFP 007
2/4/2016—the City issues FWD 016 to add 18 LF of railing to the South termination point on the West side of Central.
3/29/2016—MCI provided Serial Letter 024 and 024,responding to RFP 007 and FWD 016. MCI and stating the payment
for the additional 18 LF of railing was not sufficient due to small batch pricing.
4/4/2016—The City reviewed the pricing provided in MCI Serial Letter 024 and 025,and agreed to the costs.
5/11/2016—MCI submitted SUB 028 shop drawings for the handrail at the PSE Vault.
5/18/2016—The City reviewed the submittal,and noted the handrail anchorage is different from that originally
submitted and evaluated by the handrail engineer of record.The submittal was returned at Amend and Resubmit.
6/13/2016—MCI provided an additional price quote,for the redesign of the handrail as the one provided by the City in
RFP 007 would not work.
6/17/2016—MCI provided a conceptual drawinF'of the proposed new mounting design for the handrail at the vault.
6/22/2016—The City reviewed the new mounting design with PSE,who agreed to allow the mounting of the railing to
their vault as proposed.The RE Team also provided an ICE for the additional costs.The City verbally agreed to MCIs cost
proposal and verbally directed them to proceed.
7/6/2016—MCI submitted SUB 032—Revised PSE Vault Handrail Layout and Calcs to the City.

RFP 005 outlined changes to the handrail located on the south end of the project. Item one proposes
adding 18 if at STA 70+53 to 70+35 RT. For the additional footage, this work can be performed at
existing bid item pricing for B1-1295.
Item two proposes adding two end sections at 72+38 RT due to a conflict with an existing luminaire
pole. We propose an additional $350 per each end section for labor and materials to revise the handrail
layout. This cost will cover the added fabrication and installation time required to build this break in the
handrail system.

Subject: Handrail Extension at Bridge Date: Feb 4, 2015
Scope: Make the following changes to the Contract Documents:
o Contract Drawing 30 of 37: Extend the Handrail 18 LF (3 panels) South to overlap the
existing pedestrian wall on the bridge, setting the base plate for the southernmost post
just inside (East) of the wall. Allow for expansion in the railing segment crossing the
bridge deck expansion joint.
® Contract Drawing 30 of 37: Per FWD 012, revise the railing to end and begin on either
side of the luminaire pole at approximately STA 72+38 RT. Rotate the base plate
connection to the railing post as shown in the design clarification attached. Mount the
railing base plate as close to the luminaire base plate as necessary to prevent the
passage of a 4" Sphere.

The following work will be measured and paid for in accordance with the Contract Documents for the
noted existing bid items:

Review Comments:
1) The drawing submitted shows 1-1/8"of concrete between the center of anchor bolt and
outside edge of concrete.This is less than the condition evaluated in the engineering
calculations provided under submittal 7.1, and requires re-evaluation by the Engineer of
Record.
Considerations:
o The depth of the concrete lid is 8 inches.
o To achieve the required breakout strength, longer anchor bolt length may be a part of
the solution.
o There is concern about the small section of concrete between the anchor bolt and the
outside edge of the lid breaking out during the drilling of the bolt holes.
♦ Longer anchor bolts on the inside and shorter on the outside may limit the
possibility of concrete breakout.
♦ Shifting the outside anchor bolts toward the center of base plate may also limit
concrete breakout.

1. Burly Products shall have no liability for late delivery caused by delayed or inaccurate field dimensions, delayed
shop drawing approvals,delayed approvals of any kind, delayed construction caused by others nor be held liable for
circumstances beyond our control such as accidents,fires or floods.
2.We are not responsible for any errors occurring through the use of our drawings by other trades.We assume no
responsibility as to measurements or details affecng anyone's work but our own.Approval of this job is based on
approval for fabrication or dimensions shown on our drawings.
3. Burly Products performance on design,ordering of materials, manufacturing and shipment time line will not start
until we receive shop drawing approvals and complete field verifications.
4.Cancelation of any or all of an order is subject to a cancelation charge and full payment for work completed prior
to cancelation. Interruptions caused by buyer or affiliate of buyer will be subject to additional charge and can delay
delivery schedule.
S. Burly Products bid is good for 15 days after award of project only to the addressed buyer and is revocable at any
time for any reason. Bid is binding only when Burly Products receives and signs purchase order referencing bid and
orjob number.
6.All field verifications must be provided 8 weeks prior to delivery.
7.Orders will be shipped in 1 shipment from Burly Products to project site or address specified by the buyer. Burly
Products will invoice for material on hand in our plant or stored off site or delivered to a job site and not yet
installed. If Burly Products chooses to ship multiple shipments each shipment will be invoiced separately and
immediately. If Buyer requires multiple shipment for project scheduling reasons, buyer shall pay the freight for all
additional shipments.
8. Unless otherwise agreed shipping will be F.O.B. Origin,freight prepaid-seller pays and bears freight charges buyer
owns goods in transit,files claims if any.
9. Payment terms are net 30 from time of invoice. Late charges will be assessed at a rate of 1 1/2%per month plus
any collection and/or attorney's fees accrued. Burly Products may stop work,cease deliveries or terminate the
contract for non-payment extending beyond credit terms. Payment to Burly Products is not contingent upon owner
payment to the general contractor and/or general contractor payment to sub contractor. Payments are due without
reference to project progress or project completic ;. Burly Products reserves the right to delay or refuse shippment
to customers with delinquent accounts regardless of the project or contract requirements.
10.This agreement shall be entered into in accordance with the laws of the state of Idaho. If any dispute shall arise
from this agreement it may be resolved before the Circuit Court of the state of Idaho in Kootenai County. Both
parties entering into this agreement consent to the jurisdiction and location of that court.Any suit against Burly
Products shall be filed within 90 days of delivery to seller.
11. Burly Products warrants to the original purchaser all goods sold to be free of defects in materials and
workmanship under normal use for a period of 90 days after delivery.Seller makes no warranty concerning paint or
other finish applied.Warranty shall be void on any goods misused, abused, modified by someone other than seller
or not installed in accordance with applicable codes or sellers instructions.Sellers liability to warranted items is
limited to repair and or replacement or at its option refund of purchase price

Dennis and I spoke about the handrail mounting re-design. His concern is damage to the railing while opening the lid, as
they are heavy and difficult to gently rest on the railing.After confirming the railing,material is galvanized steel, Dennis
was CK with the re-design.
As we discussed, I will let MCI Know they can proceed,with a note that stamped engineering calculations are required.

Hello Dennis,
I am Cameron Bloomer, an engineer on the City of Kent's Central Ave project.We have been working with.Brian Swart
on a solution for installing a handrail on one of PSE's vaults, located just North of the green river bridge on Central Ave.
Brian is on vacation, and his voicemail told me to contact you if we need anything.
PSE didn't have any concerns with the use of 5/8" anchor bolts being installed in the top of the lid to support the railing.
Due to a thin concrete section between the outside edge of the lid and the anchor bolts,the handrail designer has
suggested we mount the base plates on the side of the vault lid, as shown in the attached drawing.Anchor bolts would
be the same 5/8" diameter, and stamped engineered calculations will be submitted to us prior to installation.
Does PSE have any concerns with us moving the anchor point to the side of the vault lid? Please call if you have any
questions or need any background information.
