ADDENDUM ONE TO TEMPORARY LIMITED LICENSE AGREEMENT FOR A
CONSTRUCTION STAGING AREA
THIS ADDENDUM ONE ("Addendum One") is entered into on the date
fully executed below by and between THE CITY OF KENT, a Washington
municipal corporation ("City") and GRANDVIEW APARTMENTS, LLC, a
Washington limited liability company ("Licensee"), and amends that certain
Temporary Limited License Agreement for a Construction Staging Area entered into
between City and Licensee on or about July 24, 2015 (the "License").
The City and Licensee agree as follows:
1. Amendment. Section 1 of the License is amended by amending the
scope of allowed uses as follows:
1. License Granted. In consideration of payment of
$2,888.35 per month until this License is terminated, and for mutual
benefits derived and other valuable consideration receipt of which is
hereby acknowledged by the City and Licensee, the City grants this
License ("License") for a period of two years from the Effective Date
(the "Term") for Licensee's use to temporarily store materials and
equipment for staging purposes and for Licensee's pre-leasing and
other marketing purposes, including establishment of a pre-leasing
construction trailer, during licensee's construction of the Grandview
Apartments development across and upon a portion of the City's
property located on King County parcel number 1522049170,
described in Exhibit A ("Property") and approximately shown in
Exhibit B and Exhibit C. This License is subject to all other terms
and conditions established below.
2. Ratification. All acts consistent with the authority of the License and
this Addendum One are ratified and affirmed, and the terms of the License and this
Addendum One will be deemed to have applied.
3. Entire Agreement. Except as amended by this Addendum One, all
provisions of the License will remain in full force and effect except as specifically
modified by this Addendum One.
IN WITNESS WHEREOF, the parties have executed this Addendum One,
which will take effect on the last date signed below (the "Effective Date").
