A. Purpose
The purpose of the Memorandum of Understanding (MOU) is to establish a
general understanding between the Department of Veterans Affairs Tahoma
National Cemetery (VA TNC) and the City of Kent Correctional Facility (KCF) for
the use of the KCF Work Crew (WC) at VA TNC. This MOU allows VA TNC and
KCF to meet their goals Of community service while simultaneously serving our
nation's veterans.
B. Mission and Objective
The mission of VA TNC is to honor veterans with a final resting place and lasting
memorials that corn mernorate their service to our Nation. The objective of this
MOU is to utilize the KCF WC to support this endeavor with recurring service for
grounds maintenance, This MOU will benefit VA TNC by achieving National
Shrine Standards and will help the KCF by providing work opportunities for its
WC.
C. Responsibilities
KCF will;
• Provide its WC for the purposes of performing work at VA TNC. KCF will
ensure individuals who have been convicted of a "violent offense" or "sex
offense" as those terms are defined in RCW 9.94A,030 will not be
considered for this work detail.
• Provide its WC to VA TNC at no cost.
• Obtain all necessary licenses and/or permits required to perform the work
associated with this MOU.
o Not hold VA TNC liable or responsible for any injuries or claims of injury
by those individuals serving on the KCF WC.
a Require, as a condition of participating in the WC, that WC participants
adhere to all VA TNC instructions regarding the work detail, including but
not limited to how work is to be performed and the maintenance of a
workplace free of sexual harassment, discrimination, and violence.
e Ensure all WC participants have been advised regarding the
consequences of fleeing during their WC detail, including from the
worksite and during transport to and back from VA TNC.
e Be responsible for any injury to their employees and the WC participants,
as well as for any damage to personal or public property that occurs
during the performance of this MOU caused by the negligence of WC
participants; provided, that under no circumstances shall the KCF be
responsible for any damages or injuries to persons or property caused by
the acts or omissions of VA TNC employees or non-WC volunteers of the
VA TNC.

Worst Craw Program
Maintain liability and property damage coverage through a policy of Self-
insurance for a limit as required by the laws of the State of Washington,
VA TNC will:
e Provide guidance, work assignments, personal protective equipment, and
other items necessary to the WC in order to accomplish the work detail,
• Provide a "Site Manager/Supervisor" who will complete the Site
Supervisor Orientation with KCF, and who will be on site at all times while
the WC is on site at VA TNC. The Site Manager/Supervisor will be able to
speak and understand English, and will be responsible for:
o Directing, overseeing, and coordinating the work involved,
o Staying abreast of all upcoming VA TNC functions including special
holiday events and interment activities.
o Ensuring work does not cause any committal service, ceremony,
procession, or visitation to be delayed, altered, or otherwise
impacted in such a way that the dignity, security, or safety of the
event or visitors is compromised.
e Follow KCF WC rules and guidelines, unless specifically noted otherwise
in writing.
a Bear responsibility for ensuring its employees interact with KCF WC
participants in a professional and respectful manner, including maintaining
a workplace free of sexual harassment, discrimination, and violence.
• Be responsible for the acts and omissions of VA employees performing
work related to this MOU.
Both VA TNC and KCF understand the VA National Cemetery Administration
honors veterans with a final resting place and lasting memorials commemorating
their service to our Nation, and that because National Cemeteries are national
shrines, the standards of work, appearance, and procedures performed by the
individuals at VA TNC must reflect respect and concern for those interred there.
Both VA TNC and KCF therefore acknowledge and agree:
a Due to the sensitive mission of VA TNC, personnel must exercise and
exhibit absolute decorum, composure, and stability at all times on VA TNC
grounds.
• Personnel appearance and conduct shall be professional and unobtrusive
at all times. Shirts and full length pants must be worn at all times. Shirts
may not exhibit inappropriate or disrespectful logos, such as but not
limited to logos associated with drugs or alcohol, sexual innuendo,
violence, etc.
• Smoking is not allowed on VA TNC grounds.
e The playing of radios and the use of cell phones, cassette recorders, etc„
is prohibited on site or in buildings. The WC is governed by the same
rules governing VA TNC employees. All individuals failing to Comply will
be removed from the site.

e Sexual harassment, violence, dangerous conduct, and disrespect will not
be tolerated and any offending individual(s) will be removed from the site.
e Personnel shall not sleep on VA TNC grounds, sit or stand on installed
grave markers, or put, place, or lean equipment or materials on grave
markers or on equipment other than that required for transport.
a All questions from VA TNC visitors shall be politely referred or directed to
VA TNC personnel,
• All workers will behave with appropriate decorum, courtesy, and respect
while within VA TNC grounds or at its perimeter or entrances. Shouting,
cursing, angry outbursts, sleeping, intoxication, dangerous conduct, and
violence or criminal acts of any kind will not be tolerated and is cause for
immediate removal from VA TNC grounds.
D. Business Hours and Days for Operation.
Normal VA TNC business hours /days of operation are 8:00AM
to 4:30PM, Monday through Friday, excluding the following federal
holidays;
New Year's Day Labor Day
Marlin Luther King's Birthday Columbus Day
President's Day Veterans Day
Memorial Day Thanksgiving Day
Fourth of July Christmas Day
VA TNC may have access to the KCF WC when needed on weekends or
federal holidays, provided, the provision of the KCF WC on a weekend or
federal holiday shall be subject to the pre-approval of KCF exclusively, and
may require a modification of the KCF WC schedule before or after the
weekend or federal holiday to accommodate KCF staffing needs,
E. Effective Date

This MOU will be effective for five (5) years from the date of signing this MOU by
the Cemetery Director and the representative of the KCF. This MOU may be
amended, superseded, or rescinded by mutual consent of the participating
entities and can be terminated by either party by providing written notice at least
30 calendar days in advance. This MOU may be extended for additional periods
by written agreement of the parties.
