I. RECITALS 1.1 Under state law, money and other assets derived from the Illegal sale, delivery, or receipt of a controlled substance are subject to seizure and forfeiture by a law enforcement agency. Once forfeited, these funds may be used by the law enforcement agency to expand and improve controlled substances-related enforcement activity. The City desires to use $175,000 of these forfeited funds to replicate a Youth LINC Multidisciplinary Intervention Team in the Kent community, with later expansion possible in other South King County cities,through the work of CCYJ and its Suburban King County Coordinating Council on Gangs ("Steering Committee"). Through the Youth LINC Intervention Team, the City and CCYJ hope to reduce the incidence of youth gang involvement through coordinated Intervention and prevention services to gang-Involved and at risk youth and families; these services may include, but are not limited to mental health or substance abuse counseling; education, tutoring, or mentoring; job development, placement, and apprenticeships; and extracurricular activities such as art workshops and sports. 1.2 Since January of 2015, a pilot Youth LINC Intervention Team has been operating in the City of Renton and serving youth in the Renton, Tukwila and Highline School Districts. CCYJ's work with the City of Kent will be unique in that it Is the first time a local agency is providing significant seed money to replicate a Youth LINC Intervention Team in its jurisdiction in the hopes of reducing gang activity and assisting youth to achieve success. 1.3 Through this Agreement, the parties express their mutual intent and desire to create a Youth LINC Intervention Team based in the City Of Kent, for a preliminary one-year term. The $175,000 provided by the City in funding is a one-time only dedication of seed money from drug forfeiture funds. Should the parties desire to continue the Youth LINC Intervention Team beyond this initial one-year term, additional funding sources will become necessary, which may include adding other local governmental agencies as participating members. II. AGREEMENT NOW THEREFORE, in consideration of the mutual intent, desire, and promises of the parties and other good and valuable consideration, the City and CCYJ agree as follows: 2.1 Services Provided. CCYJ, through and in conjunction with Steering Committee, shall replicate in Kent the pilot program CCYJ established in January of 201S, specifically the multidisciplinary intervention team, Youth LINC. CCYJ shall provide project management services, and create and facilitate a Youth LINC Intervention Team to provide coordinated services to youth and their families ("program participants"), which shall be based on the Office of Juvenile Justice and Delinquency Prevention's ("OJJDP") Comprehensive Gang Model "CGM" , and the pilot program current) serving youth in the Renton Tukwila and Hf hline ( ) P� P 9 Y 9 Y � 9 School Districts, incorporating lessons learned from that pilot program. A summary of the CGM is attached and incorporated as Exhibit A. Overviews of the Youth LINC Intervention Team and the Implementation Plan are also attached as Exhibits B and C, respectively. AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE HAND INVOLVEMENT OF KENT YOUTH - 1 In replicating Youth LINC to serve youth and families in Kent, CCYJ will convene team members from local agencies and community service providers, leverage existing resources and programs, provide training, develop team policies and procedures, and manage all activities related to Youth LINC operation and coordinated service provision. These services Include: Youth LINC Team A. Employ a Youth LINC Project Manager whose role and functions shall include: I 1. Monitoring and coordinating all services provided through Youth LINC team members and program participants; 2. Facilitating the Intervention Team's operations and development of all individualized intervention plans for program participants; 3. Overseeing services delivery and managing all contracted services through Youth LINC team members; 4. Developing partnerships and negotiating collaborative relationships between all Youth LINC team members and other CCYJ community partners; 5. Reviewing program participant dosage structures in accordance with Youth LINC policies and the Comprehensive Gang Model; 6. Developing and maintaining information sharing and confidentiality protocols; 7. Holding regular Youth LINC Intervention Team meetings; B. Collecting data on each program participant's progress and outcomes with each team member and community partner; 9. Inputting data into the Washington Gang Reduction Information System; 10. Reviewing data with the Youth LINC team members at Intervention Team meetings; 11. Submitting monthly reports to the City in accordance with Section 2.4 of this Agreement; and 12. Monitoring and tracking In-kind services provided by Youth LINC team members and community partners for evaluation by Independent Evaluator. B. Develop and sustain a Youth LINC Intervention Team comprised of case managers, law enforcement officers, juvenile probation counselors, services providers, school staff, youth mentors, street outreach workers, and community service providers. C. Youth LINC Intervention Team members shall meet weekly, or as otherwise deemed appropriate by CCYJ, and work collaboratively to develop Intervention Plans, coordinate outreach to gang-involved youths, AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH - 2 i and strategize on how to engage these youth in services that will reduce risk factors and eliminate barriers to successful re-entry and goal achievement. D. Youth LINC Intervention Team members shall evaluate each program participant's progress, address any challenges, and determine the necessary steps for continued support through consensus-based decision- making. Project Implementation E. Enroll at least 60 gang-involved youth, ages 14-21, through the Youth LINC Intervention Team who reside, attend school, or engage in criminal activity in the Kent community. Based on these criteria, and to ensure a coordinated response to this multijurisdictional issue, youth without a physical address in the City of Kent may be enrolled in Youth LINC services as determined by the team. In the discretion of CCY3, Steering Committee, and the Youth LINC Intervention Team, youth below the age of 14 may be entered into the program on a case-by-case basis. F. Develop a written and individualized Intervention Plan for each gang- involved program participant that includes appropriate goals related to education, post-secondary planning, substance abuse and mental health intervention, successful probation completion, reduced or prevented criminal justice involvement, employment training, family therapy, and pro-social interest development according to each participant's needs, strengths, and interests. G. Target youth for the program who demonstrate additional risks based upon the following factors: (1) Self-Identifies as gang-Involved or associating with gang-involved peers; (2) Engages in or experiences family or peer violence; (3) At high-risk for gang involvement; or i (4) Current or past involvement with the juvenile justice system. H, As deemed appropriate and applicable, services provided through Youth LINC team members, community partners, or referrals to outside service or community-based organizations may include: (1) Crisis intervention; (2) Risk assessment and Intake; (3) Case management; (4) Employment services and job readiness; (5) Education re-entry support, GED program enrollment, high school credit retrieval and completion programs; i (6) Multi-systemic therapy (MST); AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH - 3 l (7) Functional family therapy (FFT); (8) Family integration therapy (FIT); (9) Aggression replacement training (ART); (10) Mental health counseling; (11) Substance abuse counseling and treatment; (12) Legal advocacy; (13) Immigration services; and (14) Involvement in community programs and pro-social activities through local community-based organizations. I. Receive and respond to referrals from King County Juvenile Probation; YMCA Alive & Free outreach workers; law enforcement; and other Youth LINC team members or community partners, Including schools and service providers; in accordance with Youth LINC's eligibility requirements for program participants. J. Provide outreach services through the YMCA's Alive and Free Outreach Network to all Youth LINC participants in accordance with existing contract for services between CCYJ and the YMCA. Partnerships K. Establish and maintain community partnerships for the purposes of providing intervention and prevention services to program participants. Tentative Youth LINC team members and community partners include, as appropriate and applicable: (1) Kent School District; (2) I-GRAD; (3) YMCA Alive & Free; (4) Kent Youth and Family Services; (5) Consejo Counseling and Referral Services; (6) King County Employment Education Training; (7) Multi-Service Center; (8) Glover Empower Mentoring (G.E.M.); (9) Kent Police Department; (SO) Green River Community College; and (11) King County Juvenile Probation. Project Evaluation L. Work with Independent Evaluator throughout the project to track outcomes, measure participant progress, and ensure fidelity to the evidence-based CGM. M. Prepare a final report that documents findings of the process, outcome evaluations, and recommendations for improvements or modifications. AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH -4 N. Share a draft of the final report and obtain Input from team members and community partners prior to issuing the final report, and once complete, distribute the final report to team members and community partners. 2.2 Goals and Outcomes. The overall goal of CCYJ and Steering Committee for replication of the Youth LINC Intervention Team is to reduce barriers to success for gang- involved youth and at-risk youth in the Kent community. This goal focuses on the social intervention, opportunities provision, and community mobilization strategies of the OJJDP's CGM. CCYJ, through Steering Committee, will work to achieve this goal through both policy initiatives and direct service provision through the Youth LINC Intervention Team. The team can serve up to 60 youth per program year. CCYJ will work collaboratively with the City, Youth LINC team members, community partners, and the independent project evaluator to develop mutually agreed upon, realistic outcome measures based on national best practices recommended by the CGM. The following is an overview of current Youth LILAC outcome measures that CCYJ and Steering Committee hope to replicate in the Kent community, which are provided by way of example only and may be revised based on current data specific to the needs of local youth and families: A. Youth LINC Team Outcomes: Team Outcomes will be evaluated on an ongoing basis throughout service provision. Tentative Youth LINC team outcomes include: (1) Receive 60 referrals of eligible youth living in or attending school in the Kent community. (2) 100% of Youth LINC program participants enrolled in services will have an individualized Intervention Plan. (3) 70% of active Youth LILAC program participants will be enrolled in case management services, as appilcable. (4) Ensure all active program participants are served by case management, outreach service providers, and any other subcontracted programs in accordance to guidelines provided in the CGM. (5) Document all program participant contacts in the Washington Gang Reduction Information System. (6) 60% of Youth LILAC program participants will be enrolled in employment readiness/internship/employment programs in partnership with King County employment and education resou rces. (7) Enroll 75% of Youth LINC program participants in at least one pro- social activity other than case management. (8) Maintain 70% fidelity to the evidence-based CGM throughout all Youth LINC service provision and team operation, as well as broader Steering Committee work. B. Youth LINC Program Participant Interim Outcomes: Interim outcomes will be evaluated after the completion of the first I months of this one-year Agreement. Tentative interim outcomes include: AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH • 5 (1) 60% of Youth LINC program participants will demonstrate reduced recidivism or juvenile justice involvement (as defined by successful probation completion, lack of new charges or cases). (2) 70% of Youth LINC program participants make progress toward their education goal while enrolled in services. i (3) 70% of Youth LINC program participants make progress toward their employment goal while enrolled in services. (4) 70% of Youth LINC program participants make progress toward their substance abuse (drug and/or alcohol) reduction goal, as applicable. (5) 70% of Youth LINC program participants demonstrate reduced gang-involvement and anti-social behaviors as compared to program enrollment (as determined by program participant self- assessment, and Youth LINC team member consensus). (6) 70% of Youth LINC program participants are enrolled in extracurricular or pro-social activities at Youth LINC member service agencies. C. Youth LINC Program Completion Outcomes: Program completion outcomes will be evaluated by the independent evaluator for each youth program participant, either at the completion of this Agreement's term or at the participant's completion of the Youth LINC Services continuum, if additional funding sources are acquired to continue the provision of services provided for in this Agreement, whichever event is later. Tentative program completion outcomes include: (1) 75%of Youth LINC program participants will demonstrate reduced recidivism and juvenile/criminal justice involvement. (2) 75% of Youth LINC program participants attend an educational program regularly. (3) 75% of Youth LINC program participants have completed the job readiness component provided by King County employment and education training. (4) 75% of Youth LINC program participants have met or are in compliance with community supervision/probation requirements. (5) 75% of Youth LINC program participants have successfully addressed their substance abuse needs, as applicable. (6) 75% of Youth LINC program participants exhibit reduced gang association and anti-social behaviors. i (7) 75% of Youth LINC program participants utilize and engage in community based pro-social activities. 2.3 Outcome Measures and Evaluation. Project staff, including Steering Committee/Youth LINC Program Manager,YMCA Alive&Free outreach workers, and other Youth LINC team members and community partners will enter program participant data into the AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH - 6 Washington Gang Reduction Information System database. Each program participant's Intervention Plan will be monitored and updated with current progress related to each Intervention Plan goal. The Youth LINC Intervention Team will review each program participant's Intervention Plan according to the guidelines established in the Youth LINC service delivery level system. An outside independent evaluator will obtain data records from the database in order to track program participant progress and measure outcomes. 2.4 Deliverables. The deliverables include the following reports,the format of which is to be mutually agreed upon by the parties, that are due to the City's contract administrator no later than the following dates, unless otherwise mutually agreed upon: A. Monthly progress reports by the 15th of each month. At a minimum, these monthly reports should summarize CCYJ's progress during the prior month to implement the Youth LINC Intervention Team in Kent, and CCYJ's goals for the following month. Once the Youth LINC Invention Team is implemented, the report should identify the number of program participants involved; the resources being utilized by the participants; any notable successes, obstacles, or struggles realized by those j participants, team members, or community partners; and CCYJ's goals and recommendations for the following month. Monthly progress reports shall be submitted to Kent Police Commander Jarod Kasner at jkasner@kentwa.gov. B, A final summary report due by the end of the one-year term provided for under this Agreement; this contract begins on April 1st, 2016, so final report will be due on or before April 15th, 2017. 2.5 Budget. The budget established for the services provided under this Agreement are as follows: Youth LINC Replication Program Staff/Supervision (CCYJ) 74 000 Administrative Costs $1 000 Youth LINC Team Operation &Supplies (team $6,000 training, materials, secure program participant data storage) Program Evaluation $15,000 Youth LINC Program participant Support Funds $19,000 (Individual/famlly needs, employment program placement) _ Street Outreach Services Ailve & Free 30 000 Community Program Contracts * $30,000 TOTAL $175,000 *CCYJ will determine contracted partner agencies based on program type; demonstrated community work; best and promising practices; and Comprehensive Gang Model Guidelines and recommendations. 2.6 Payments. CCYJ will invoice the City monthly for services provided under this Agreement and provide a final bill upon completion of all services in a total amount not to exceed the established budget of$175,000. The City shall not make any payments in advance or anticipation of the delivery of services to be provided under this Agreement. Each payment invoice shall: (1) describe the services provided during the month for which the invoice is submitted, and (ii) identify the above Youth LINC replication budget line item to which the services were assessed. Invoices shall be submitted to the following,either by email or through the US Postal Service: AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH - 7 i Attn: Cindy White Kent Police Department 220 Fourth Ave. S. Kent, WA 98032 cwhite@kentwa.gov The City shall provide payment within thirty (30) days of receipt of a proper invoice. If the City objects to all or any portion of an invoice, it shall notify CCYJ and reserves the option to only pay that portion of the invoice not in dispute. In that event, the parties will immediately make every effort to settle the disputed portion. Costs incurred on the project prior to the execution of the agreement are included in the project budget and will be reimbursed. Such costs do not exceed $2,500. 2.7 Term and Sustainability. The services provided under this Agreement are for a one-year term, or until the budget is fully expended, whichever date is later. Through this Agreement, the City will provide seed money to replicate the Youth LINC Intervention Team in the Kent community. Long-term success, however, depends upon creating Sustainability. In performing work through this Agreement, CCYJ and Steering Committee will seek additional sources of continued funding though the following potential sources: A. Washington State Gang Reduction Intervention and Prevention competitive grant funding; B. Office of Juvenile and Delinquency Prevention (OJJDP) Comprehensive Anti-Gang Strategies and Programs (CCYJ will submit a proposal in May of 2016); C. King County Council funding requests; and D. Other Steering Committee partner jurisdictions and agencies. 2.8 Independent Contractor. The parties intend that an Independent Contractor- Employer Relationship will be created by this Agreement. By their execution of this Agreement, and in accordance with Ch. 51.08 RCW, the parties make the following representations: A. CCYJ has the ability to control and direct the performance and details of its work, the City being interested only in the results obtained under this Agreement. B. CCYJ maintains and pays for its own place of business from which CCYJ's services under this Agreement will be performed. C. CCYJ has an established and independent business that is eligible for a business deduction for federal income tax purposes that existed before the City retained CCYJ's services, or CCYJ is engaged in an independently established trade, occupation, profession, or business of the same nature as that Involved under this Agreement. D. CCYJ is responsible for filing as they become due all necessary tax documents with appropriate federal and state agencies, including the Internal Revenue Service and the state Department of Revenue. E. CCYJ has registered Its business and established an account with the state Department of Revenue and other state agencies as may be required by CCYJ's business, and has obtained a Unified Business Identifier (UBI) number from the State of Washington. I AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH -8 F. CCYJ maintains a set of books dedicated to the expenses and earnings of Its business. 2.9 Termination. Either party may terminate this Agreement, with or without cause, upon providing the other party thirty (30) days written notice at its address set forth on the signature block of this Agreement. 2.10 Intellectual Property. CCYJ shall retain the copyright (Including the right of reuse) to all materials and documents prepared by CCYJ in connection with this contract, whether or not the work is completed. CCYJ grants to the City a non-exclusive, irrevocable, unlimited, royalty-free license to use every document and all other materials prepared by CCYJ under this agreement. If requested by the City, a copy of all drawings, prints, plans, field notes, reports, documents, files, input materials, output materials, the media upon which they are located (including cards, tapes, discs and other storage facilities), software programs or packages (including source code or codes, object codes, upgrades, revisions, modifications, and any related materials) and/or any other related documents or materials which are developed solely for, and paid for by the City in connection with the performance of this agreement, shall be promptly delivered to the City. The City may make and retain copies of such documents for its information and reference. The City does not represent or warrant that such documents are suitable for reuse by the City, or others, on extensions of the project or any other project. 2.11 Discrimination. In the hiring of employees for the performance of work under this Agreement or any subcontract, CCYJ, its subcontractors, or any person acting on behalf of CCYJ or subcontractor shall not, by reason of race, religion, color, sex, age, sexual orientation, national origin, or the presence of any sensory, mental, or physical disability, discriminate against any person who is qualified and available to perform the work to which the employment relates. CCYJ shall execute the attached City of Kent Equal Employment Opportunity Policy Declaration, comply with City Administrative Policy 1.2, and upon completion of the contract work, file the attached Compliance Statement. 2.12 Indemnification. CCYJ shall defend, indemnify, and hold the City, its officers, officials, employees, agents and volunteers harmless from any and all claims, injuries, damages, losses, or suits, including all legal costs and attorney fees, arising out of or in connection with CCYJ's performance of this Agreement, except for that portion of the Injuries and damages caused by the City's negligence. The City's inspection or acceptance of any of CCYJ's work when completed shall not be grounds to avoid any of these covenants of indemnification. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, In the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of CCYJ and the City, Its officers, officials, employees, agents and volunteers, CCYYs liability hereundershall be only to the extent of CCYJ's negligence. IT IS FURTHER SPECIFICALLY AND EXPRESSLY UNDERSTOOD THAT THE INDEMNIFICATION PROVIDED HEREIN CONSTITUTES CCYYS WAIVER OF IMMUNITY UNDER INDUSTRIAL INSURANCE, TITLE 51 RCW, SOLELY FOR THE PURPOSES OF THIS INDEMNIFICATION. THE PARTIES FURTHER ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER. In the event CCYJ refuses tender of defense in any suit or any claim, if that tender was made pursuant to this indemnification clause, and if that refusal Is subsequently determined by a court having jurisdiction (or other agreed tribunal) to have been a wrongful refusal on CCYJ's AGREEMENT FOR INTERVENTION AND PREVENTION SERVICES TO REDUCE GANG INVOLVEMENT OF KENT YOUTH - 9 part, then CCYJ shall pay all the City's costs for defense, including all reasonable expert witness fees and reasonable attorneys'fees, plus the City's legal costs and fees incurred because there was a wrongful refusal on CCYJ's part. The provisions of this section shall survive the expiration or termination of this Agreement. 2.13 Insurance. CCYJ shall procure and maintain for the duration of the Agreement, insurance of the types and in the amounts described in Exhibit D attached and incorporated by this reference. 2.14 Exchange of Information. The City will provide its best efforts to provide reasonable accuracy of any information supplied by It to CCYJ for the purpose of completion of the work under this Agreement. 2.15 Records and Documents. CCYJ acknowledges that the City is a public agency subject to the Public Records Act codified in Chapter 42.56 of the Revised Code of Washington, and documents, notes, emails, and other records prepared or gathered by CCYJ in Its performance of this Agreement may be subject to public review and disclosure, even if those records are not produced to or possessed by the City of Kent. Further,any documents provided to the City by CCYJ, or otherwise used by the City under this Agreement, may also be subject to production in response to a public records request. For that reason, care shall be taken by CCYJ before it provides or otherwise makes available to Kent any documents that CCYJ believes are confidential or that contain sensitive or proprietary information. Unless there is an exemption under state law that expressly authorizes the City to withhold or otherwise redact any records prepared, owned, used, or retained by the City, the City will be required to produce the record in response to a proper public records request. CCYJ agrees to cooperate fully with the City in satisfying the City's duties and obligations under the Public Records Act. 2.16 City's Right of Inspection. Even though CCYJ is an independent contractor with the authority to control and direct the performance and details of the work authorized under this Agreement, the work must meet the approval of the City and shall be subject to the City's general right of inspection to secure satisfactory completion. 2.17 Work Performed at COY's Risk. CCYJ shall take all necessary precautions and shall be responsible for the safety of its employees, agents, and subcontractors in the performance of the contract work and shall utilize all protection necessary for that purpose. All work shall be done at CCYYs own risk, and CCYJ shall be responsible for any loss of or damage to materials, tools, or other articles used or held for use in connection with the work. 2.18 Miscellaneous Provisions. A. Recyclable Materials_. Pursuant to Chapter 3.80 of the Kent City Code,the City requires its contractors and consultants to use recycled and recyclable products whenever practicable. A price preference may be available for any designated recycled product. B. Non-Waiver of Breach. The failure of the City to Insist upon strict performance of any of the covenants and agreements contained in this Agreement, or to exercise any option conferred by this Agreement in one or more instances shall not be construed to be a waiver or relinquishment of those covenants, agreements or options, and the same shall be and remain in full force and effect. C. Resolution of Disputes and Governing Law. If the parties are unable to settle any dispute, difference or claim arising from the parties' performance of this Agreement, the exclusive means of resolving that dispute, difference or claim, shall only be by filing suit exclusively under the venue, rules and jurisdiction of the King County Superior Court, King County, Washington, unless the parties agree in writing to an alternative dispute resolution process. In any claim or lawsuit for damages arising from the parties' performance of this Agreement, each party shall pay all its legal costs and attorney's fees incurred in defending or bringing such claim or lawsuit, including all appeals, in addition to any other recovery or award provided by law; provided, however, nothing in this paragraph shall be construed to limit the City's right to Indemnification under Section VII of this Agreement. D, Written Notice. All communications regarding this Agreement shall be sent to the parties at the addresses listed on the signature page of the Agreement, unless notified to the contrary. Any written notice hereunder shall become effective three (3) business days after the date of mailing by registered or certified mail, and shall be deemed sufficiently given if sent to the addressee at the address stated in this Agreement or such other address as may be hereafter specified in writing. E. Assignment. Any assignment of this Agreement by either party without the written consent of the non-assigning party shall be void. If the non- assigning party gives its consent to any assignment, the terms of this Agreement shall continue in full force and effect and no further assignment shall be made without additional written consent. F. Modification. No waiver, alteration, or modification of any of the provisions of this Agreement shall be binding unless in writing and signed by a duly authorized representative of the City and CCYJ. G, Entire Agreement. The written provisions and terms of this Agreement, together with any Exhibits attached hereto, shall supersede all prior verbal statements of any officer or other representative of the City, and such statements shall not be effective or be construed as entering into or forming a part of or altering in any manner this Agreement. All of the above documents are hereby made a part of this Agreement. However, should any language in any of the Exhibits to this Agreement conflictwith any language contained in this Agreement, the terms of this Agreement shall prevail. H. Compliance with Laws. CCYJ agrees to comply with all federal, state,and municipal laws, rules, and regulations that are now effective or in the future become applicable to CCYYs business, equipment, and personnel engaged in operations covered by this Agreement or accruing out of the performance of those operations. J. City Business License Required. Prior to commencing the tasks described in Section I, CCYJ agrees to provide proof of a current city of Kent business license pursuant to Chapter 5.01 of the Kent City Code. K. Counterparts and Signatures by Fax or Email. This Agreement may be executed in any number of counterparts, each of which shall constitute an original, and all of which will together constitute this one Agreement. Department of Justice, began designing a comprehensive approach to reduce and prevent youth gang violence. This effort resulted in the development and adoption of the OJJDP Comprehensive Gang Model (CGM). This model is now used as a national best practice for gang intervention and prevention throughout many communities in the United States. The CGM assumes that many factors contribute to gang Involvement. These include: poverty, lack of education and opportunity, socio-economic and geographic status, family histories of violence and trauma, and drug and alcohol use. The CGM posits that successful reduction in gang violence must be based on a theoretical understanding of gangs, as well as monitored data collection and evaluation of many different types and scales of interventions.The CGM includes five key strategies to address gang-involved youth and families. Communities committed to implementing the CGM are encouraged to use a combination of all five strategies in order to achieve a comprehensive, sustainable result. Each strategy is briefly outlined below. In addition to these strategies, the CGM encourages communities use both policy change and direct service provision to create multidisciplinary partnerships and leverage existing programs and resources to better serve the affected population. FIVE STRATEGIES I. COMMUNITY MOBILIZATION Community mobilization is the act of mobilizing members of a community around an issue. This CGM strategy requires participation of agencies and organizations that work with youth grassroots and cultural community groups, community members, parents, and youth. In order to begin this process, the model recommends that participating communities form a steering committee. This group is comprised of key organizational and community leaders representative of the larger population. The steering committee serves as the governing body of the project, and works to define the gang problem, develop a plan to address the problem, and implement the project. H. OPPORTUNITIES PROVISION Gang-involved youth and families need viable opportunities as a positive alternative to gang involvement and associated violence. The CGM encourages communities to establish realistic plans and strategies to provide education, training, and job prospects. These strategies are to be integrated with existing social service activities" such as mental health or substance abuse counseling. Community agencies and grassroots organizations play a key role in providing services such as tutoring, mentoring, apprenticeships, and job development and placement. III. SOCIAL INTERVENTION The CGM conducts social intervention through implementation of a multidisciplinary Intervention Team. This Team works to provide coordinated service delivery to gang-involved youth and families. Community agencies, Law enforcement, service providers, school representatives, probation staff and others are active participants in this team approach. The Team works together to leverage existing agency resources and provide or refer clients ' I to services such as such as tutoring and credit retrieval, internships and job placement, drug and alcohol counseling, and extracurricular activities such as arts workshops and sports. The CGM brings many youth- serving organizations together in a regularly-scheduled Intervention Team meeting.Team members review and enroll new referrals, create coordinated case management plans and ensures that clients benefit from an organized and well-documented network of coordinated services. Street Outreach staff are key members of the Intervention Team. Outreach workers connect face to face with hard-to-serve youth and function as a liaison between clients and team members. The outreach staffs role is to identify a client's needs and goals, provide mentorship, coordinate crisis responses to violence, assist the family in meeting basic needs and addressing conflict, and participate in team based case management provided by the intervention team. The main goal of Street Outreach staff is to advocate for clients and help them progress toward meeting their goals. IV. SUPPRESSION In the context of the CGM, suppression closely resembles community policing, and Includes formal and informal methods. Law enforcement works collaboratively with the Intervention Team to address safety concerns and collect data on gang related incidents consistently. Local law enforcement is also involved In ongoing gang crime data collection and analysis,joint police and community activities and continuing professional development. V. ORGANIZATIONAL CHANGE AND DEVELOPMENT Organizational change and development requires that policies and practices of key organizations, especially those represented on the Intervention Team and Steering Committee,conform to the goals and objectives of the CGM, Developing and adapting policies and practices to become more inclusive and community-oriented ensures the optimal use of agency resources. Key organization change and development strategies include legislative change, re-entry policy reform, uniform data collection across agencies and increased collaboration and resource sharing. IMPLEMENTATION In order to successfully implement the CGM,the community must acknowledge and commit to addressing an existing gang issue. Next a lead agency is chosen and a Steering Committee comprised of elected officials, policy makers, school superintendents,community leaders, service agency directors and Law Enforcement leaders is convened. The Steering Committee serves as the governing body for the project and guides all project activities and policy decisions. In the initial stage of implementation the lead agency or research partner will conduct a thorough assessment to understand the nature and scope of the current issues faced by the community. Based on the key findings of the community assessment,the Steering Committee and other representatives will develop a comprehensive plan that incorporates all five strategies of the model to address the problem. The Intervention Team is a key component of this comprehensive plan, and supplements the policy initiatives of the model with the provision of targeted direct service to gang-Involved youth and families. The Intervention Team may serve youth from outside the Renton supervision unit on a case by case basis as recommended by King County Juvenile Probation. Client Referral Process The Youth LINC Intervention Team will receive referrals from King County Juvenile Probation. King County Juvenile Probation identify youth as gang-involved during intake or at some point during probation. All youth identified as gang-involved are assigned to a specific set of specially trained Juvenile Probation Counselors (JPCs). Beginning in January 2015, youth identified as gang-involved in the pilot area (Renton Supervision l unit) will be referred to the Youth LINC Intervention Team by the assigned JPC for review and program acceptance. A. Minimum Scope of Insurance CCYJ shall obtain insurance of the types described below: 1. Automobile Liability insurance covering all owned, non-owned, hired and leased vehicles. Coverage shall be written on Insurance Services Office (ISO) form CA 00 01 or a substitute form providing equivalent liability coverage. If necessary, the policy shall be endorsed to provide contractual liability coverage. 2. Commercial General Liability insurance shall be written on ISO occurrence form CG 00 01. The City shall be named as an Additional Insured under CCYJ's Commercial General Liability insurance policy with respect to the work performed for the City using ISO additional insured endorsement CG 20 10 11 85 or a substitute endorsement providing equivalent coverage. 3. Workers' Compensation Coverage as required by the Industrial Insurance laws of the State of Washington. B. Minimum Amounts of Insurance CCYJ shall maintain the following insurance limits: 1. Automobile Liability insurance with a minimum combined single limit for bodily injury and property damage of $1,000,000 per accident. I 2. Commercial General Liability insurance shall be written with limits no less than $1,000,000 each occurrence, $2,000,000 general aggregate. C. Other Insurance Provisions The insurance policies are to contain, or be endorsed to contain, the following provisions for Automobile Liability and Commercial General Liability insurance: 1. CCYYs insurance coverage shall be primary insurance as respect the City. Any Insurance, self-insurance, or insurance pool coverage maintained by the City shall be excess of CCYJ's insurance and shall not contribute with it. Exhibit D - i of 2 2. CCYJ's insurance shall be endorsed to state that coverage shall not be cancelled by either party, except after thirty (30) days prior written notice by certified mail, return receipt requested, has been given to the City. 3. The City of Kent shall be named as an additional insured on all policies (except Professional Liability) as respects work performed by or on behalf of CCYJ and a copy of the endorsement naming the City as additional insured shall be attached to the Certificate of Insurance. The City reserves the right to receive a certified copy of all required insurance policies. CCYYs Commercial General Liability insurance shall also contain a clause stating that coverage shall apply separately to each insured against whom claim is made or suit is brought, except with respects to the limits of the insurer's liability. D. Acceptability of Insurers Insurance is to be placed with insurers with a current A.M. Best rating of not less than A:VII. E. Verification of Coverage CCYJ shall furnish the City with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsement, evidencing the insurance requirements of CCYJ before commencement of the work. F. Subcontractors CCYJ shall include all subcontractors as insureds under its policies or shall furnish separate certificates and endorsements for each subcontractor.
