MEMORANDUM OF UNDERSTANDING
betweenthe CITY OF KENT, the CORPORATION OF THE PRESIDING BISHOP
OF THE 'CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS, and the
COMMUNITY GARDEN.LEADERSHIP GROUP, implementing a Community ,
Garden Volunteer Program

This Memorandum of Understanding ("MOU"), entered into by the City of Kent i
("CITY"), the Corporation of the Presiding Bishop of the Church of Jesus Christ of
Latter-Day Saints ("LANDOWNER"), and the Community Garden Leadership Group
("CGLG"), to provide for the planning and implementation of a community garden
volunteer program for the "P-Patch located at 64th Avenue South and West James
Street in Kent, Washington 98030 ('"PROPERTY.'
Now Therefore, and in consideration of the terms, conditions and obligations made
herein, it is agreed as follows:
I
1. Purpose of MOU. The purpose of the MOU is to formalize a cooperative
arrangement between the City, the Landowner, and the CGLG for the
purpose of providing for the assistance of the CGLG in overseeing the
community garden located on the Property.
2. Responsibilities of the City. The City has the following responsibilities:
a) Process community garden applications
b) Administer payments and refunds
g c) Advise the CGLG of the current gardeners
d) Rototill the gardens annually
e) :Pay water bills
f) Provide and maintain a portable restroom
f g) Remove yard waste in the compost bin upon request and at the end of

3.'` Responsibilities of the Landowner. The Landowner has the following
responsibilities:
a) Maintain an agreement with the City for the non-exclusive use of the
Property_
b) Provide water service
4. Responsibilities of the CBLG. The CGLG has the following day-to-day
operational responsibilities, including but not limited to:
a) Maintain the community garden's common areas and tool shed in good
condition and working order
b) Remove any rocks from inside the fence and place in the bins to allow the
Landowner to mow

c) Assist during the new gardeners' orientation
d) Administer purchasing and dispersing compost or organic materials
according to the Landowner's and City's directives
f) Advise the City of angardeners failing to

g) Advise the City of any abandoned plots (no activity for'30 days)
h) Assist in the annual year-end closing of the community garden and in
clearing debris, allowing storage of reusable stakes and tomato frames in j
the tool shed
i): Call 971-1 in the event there is a threat to any person's life or safety, and
follow up with a call to the City's representative and the Landowner's
representative identified in the Notices section below
j) Ensure that gardeners properly secure the,gate(s)
k) Notify the City of any issues with the lock(s) or gate(s)
5. Duration. This MOU shall become effective on March 2, 205 and shall
remain in effect through March 1, 2016, with automatic extensions annually
unless terminated as described in Section 6.
6. Termination. Any party may terminate its participation in this MOU with or
without cause by giving the other parties thirty days prior written notice. If
the non-exclusive agreement between the Landowner and the City
terminates, this MOU will terminate automatically:
