REPRESENTING THE POLICE ASSISTANT CHIEFS AND COMMANDERS AND POLICE
SERGEANTS AND OFFICERS

This Memorandum of Understanding ("MOU") is entered into between the city of Kent
("City") and the Kent Police Officer's Association ("KPOA") to memorialize an agreement relating
to the issue of whether the creation of or modifications to the Deadly Force Review Board are a
subject of mandatory bargaining.
During 2011, the Kent Police Department created the Deadly Force Review Board, which is
attached to this MOU as Exhibit A (Hereinafter "Policy"). The Policy will be maintained in the
Kent Police Department Policy Manual. By this MOU, the parties hereby acknowledge the
existence of the Deadly Force Review Board.
KPOA asserts that the Deadly Force Review Board as set forth in the Policy, and any changes to
the Policy, are a mandatory subject of bargaining. The City asserts that the Deadly Force
Review Board as set forth in the Policy, and any changes to the Policy, are not a mandatory
subject of bargaining.
The parties do agree, however, that prior to making any changes to the Policy, the City shall
disclose its proposed changes to KPOA, and provide KPOA with a reasonable opportunity to
comment on the changes and provide alternative changes for consideration by the City. The
parties further agree that, in the event the City and KPOA reach an impasse in regard to any
proposed changes to the Policy in the future, both KPOA and the City expressly reserve the right
to assert their respective legal arguments in regard to whether the Policy, or changes to the
Policy, are a mandatory subject of bargaining and neither party shall assert that the other party
waived any rights or legal arguments that it may have. Further, the parties agree that the
creation of this MOU or the fact that the City consulted with the KPOA during the preparation of
the Policy shall not be used as evidence that the Policy is a mandatory subject of bargaining.
By signature below, the parties agree that this MOU represents the parties' full and entire
agreement with regard to this matter.
