AGREEMENT BETWEEN CITY OF KENT AND NORTH PARK NEIGHBORHOOD
COUNCIL FOR USE OF CITY PROPERTY
This Agreement is by and between the City of Kent ("City"), a political
subdivision of the state of Washington and the North Park Neighborhood Council
("Neighborhood Council"), duly created by Kent City Council Resolution 1808.
RECITALS
WHEREAS the City of Kent owns certain real property, King County Tax
Parcel No. 132204-9151 located at 801 3rd Avenue North ("Property"); and
WHEREAS the City will put the Property to future public use, but it is
presently vacant; and
WHEREAS the Neighborhood Council desires to use the Property for a
community garden to the benefit of its members;
NOW, THEREFORE, the parties agree as follows:
AGREEMENT
1. The City of Kent grants the right of entry and occupation of the
property to the North Park Neighborhood Council for purposes herein described.
2. The right of entry and occupation of the Property shall commence upon
the date this Agreement is executed by the City and shall terminate twelve (12)
months from that date. Provided, however, that this Agreement shall be subject to
automatic one (1) year extensions unless terminated by the City.
3. Use of the Property by the Neighborhood Council shall be limited to
gardening activities and shall be conducted under the following terms and
conditions:
a. Lawful food and flower crops for Neighborhood Council use only. No
crops may be offered for sale.
b. Hand gardening equipment only.
C. Organic gardening only, no herbicides or pesticides.
d. No pets on the property.

e. No unaccompanied minors on the property.
f. Property will be kept free of debris, weeds and trash.
g. Neighborhood Council members will supply all seeds, tools and organic
fertilizers.
h. Fencing is limited to "chicken wire" or other material which shall be
easily removable upon request by the City, and shall be no higher than
four (4) feet.
i. Because there is not a source of water on the Property, water shall be
delivered to the Property by the Neighborhood Council by hand. No
hoses will be allowed across 3rd Avenue, Cloudy Street or any other
public rights of way. Reasonable water conservation measures shall be
observed.
j. Noise will be kept to reasonable levels at reasonable times so as not to
disturb nearby residents.
k. Plants located within ten (10) feet of the sidewalk on Cloudy Street
and ten (10) feet from the edge of the paved street on 3 d Avenue
shall not be allowed to grow more than thirty (30) inches in height so
as to protect the sight distance on the streets.
5. The Neighborhood Council shall remove all structures, fences, refuse,
trash and debris and restore the property to at least its original condition by the
date of termination of this Agreement.
6. This Agreement conveys no interest in the Property and may be
terminated at any time by the City at the City's sole discretion and upon notice to
the Neighborhood Council.
7. Notices to the Neighborhood Council shall be to: Christine "Tina"
Burdell, President, North Park Neighborhood Council, 323 W. Cloudy St., Kent WA,
998032. Telephone number: 253-856-0272. Notice may be by mail or telephone.
The Neighborhood Council assumes responsibility for conveying notices to its
members and notice to the City if another person assumes contact responsibilities.
8. Each member of the Neighborhood Council who will participate in the
entry and occupation of the Property will execute this Agreement or a facsimile of
this Agreement which will be provided to the City before such new members occupy
the Property. New members may be added after full execution for purposes of the
assumption of risk and liability in Paragraph 9.

9. Each member of the Neighborhood Council executing this Agreement
hereby assumes all risks and hazards of the entry and occupation of the Property.
In the event of injury or damages, the undersigned Neighborhood Council members
release and hold harmless the City of Kent, its elected and appointed officials,
employees, agents and contractors from any and all claims, injuries, damages,
losses or suits, including attorney fees, arising out of or in connection with the
entry and occupation of the Property.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on
the dates set forth below.
