Payroll followed the contract in 17.2.B.3 and gave employees the additional holiday in 2010 to account for New Year's Day occurring on a Saturday. All AFSCME personnel received 104 hours in his or her 2010 leave banks, each employee received 88 hours in holiday leave and 16 hours in the personal leave bank, instead of the usual 96 hours in the individual's leave banks. For shift personnel, holidays shall be observed on the actual holidays. Therefore, the concern is that shift personnel may not have enough hours to cover the 96 hours of holidays in 2011 because each employee received an additional 8 hours in 2010 and were reduced 8 hours of holiday leave in 2011. As a remedy, the parties agree to provide all AFSCME personnel with the ability to rollover fifty-eight (58) holiday hours into 2011. The eight (8) additional hours would need to be used or cashed out in 2011. The rollover will return to fifty (50) holiday hours for 2012. This Agreement shall not be interpreted to create a past practice nor shall it set precedence for either party.
