MEMORANDUM OF UNDERSTANDING
BY AND BETWEEN
THE CITY OF KENT (CITY)
AND
WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES,
AFSCME, AFL-CIO, LOCAL #2617 (UNION)
This Memorandum of Understanding is reached and signed as a memorialization of a
question over the use of a temporary in the Permit Center. The parties have agreed to the
following provisions:
• The use of temporaries in the Permit Center is considered a clear violation of the terms of
the Collective Bargaining Agreement based primarily on the fact that this work group has
been directly affected by the layoffs.
• The use of temporaries in the Permit Center is allowed in this situation based on the
hopes and expectations of demonstrating and creating documentation for justification of
the need for the addition of regular staff positions in the Permit Center.
• Absolutely no subsequent agreement to use temporaries in the Permit Center will be
considered unless there is an addition in the regular staffing level of the Permit Center.
• All employees shall be offered the opportunity to work overtime to accomplish the
needed work based on the employee's ability to reasonably perform such work, before
temporary hours are given.
• The city shall use the recruitment process normally used for temporary position
recruitments for solicitation of applicants for these temporary positions.
• • The recall criteria of the contract shall be used for filling these temporary positions
(based on the assumption that laid off AFSCME employees express an interest in filling
the temporary positions).
• Additionally, in the Building Services Division, the current regular staff will be offered
overtime first prior to utilizing a temporary employee to perform plans review work. If
work still remains that needs done, the laid off Plans Examiner will be offered the work,
subject to the five (5) month temporary employee limitation of the contract.
This agreement was made as a compromise on this particular situation only and shall not
serve as a precedent for any matter. All provisions of the Collective Bargaining Agreement shall
remain in full force and effect.
By signature bellow, all parties agree with the provisions of this agreement.
