MEMORANDUM OF UNDERSTANDING
BY AND BETWEEN
THE CITY OF KENT AND AFSCME LOCAL 2617
This memorandum of understanding is intended to supersede the 1998-2000 labor agreement in regards
to Corrections Position Bidding Any item not specifically referenced in this Memorandum of
Understanding shall remain as provided for under the Collective Bargaining Agreement. The City and
Union have met to discuss this issue and have agreed to the following
• If this proposal is ratified by the members of the Union working in Corrections, the bidding for the third
cycle will start seven (7) days after signing of this memorandum. The remaining timelines shall be
adhered to with the adjusted dates (Sgt's first seven (7) days, etc)
• Effective with the September 2001 and January 2002 shift cycle, the City shall utilize the attached
rotation schedule allowing for six (6) Sergeants (rotation 3 and 4) Subsequent rotation schedules to
be used shall depend on whether the City has five (5) or six (6) Sergeants bidding in the cycle.
Attached are rotations 3, 4 and 5 for six (6) sergeants If on rotation 5 there are only five (5)
sergeants bidding, the existing rotation 5 shall be used [as opposed to the attached six(6) sergeant
rotation 5] In addition, the following outlines the parties' agreement to the number of Corrections
Officer position(s) to be frozen during any bid cycle:
• If sixteen (16) Corrections Officers are bidding during the process, all positions shall be available.
• If fifteen (15) Corrections Officers are bidding during the process, the City may select to freeze
either one (1) Grave or one (1) Swing shift. The actual position to be frozen shall be the 51h
option of the affected shift, once four(4) options have been chosen in the affected shift (i.e. if a
Swing shift is to be frozen, once 4 swing shift options have been selected, the remaining swing
shift option shall be frozen) Exceptions to this may be any position adjustments needed to
reserve position(s) to ensure male/female officer ratios
• If fourteen (14) Corrections Officers are bidding during the process, the City may select to freeze
one (1) Grave and one (1) Swing shift. The actual position to be frozen shall be as outlined
above
• If thirteen (13) Corrections Officers are bidding during the process, the City may select to freeze
one (1) Grave and one (1) Swing shift. In addition, the City may select to freeze one (1)
additional Grave or Swing shift. This results in a potential of three (3) frozen positions The
actual positions to be frozen shall be as outlined above The shift having two (2) frozen positions
shall have the frozen positions be the two positions remaining after three (3) have been chosen
Exceptions to this may be any position adjustments needed to reserve position(s)to ensure
male/female officer ratios.
• If less than thirteen (13) Corrections Officers are on staff to bid during a bid cycle, both parties
agree to reopen this section of the contract to discuss the impacts of shortage of staffing and
work schedules
• By agreement to this modified process the parties agree that there shall be no grievance for
failing to meet the June deadlines of the 2001 Third Cycle Bid as established in the Collective
Bargaining Agreement.
The above represents both of the parties' understanding and agreement with regard to this issue
