MEMORANDUM OF UNDERSTANDING
BY AND BETWEEN
THE CITY OF KENT (CITY)
AND
WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES,
AFSCME,AFL-CIO, LOCAL #2617 (UNION)
By signature below the parties agree to the following clarification of the use of
temporaries in accordance with the provisions of Article 1, Section 1.3 of the current Collective
Bargaining Agreement. It is understood that this agreement is solely for the express duration of
the existing agreement between the parties and shall not be extended beyond that timeline, unless
incorporated into the Collective Bargaining Agreement This agreement shall not be precedent
setting and shall not be deemed as a modification of any specific provision of the Collective
Bargaining Agreement, but shall serve as clarification for the issues as specified. This agreement
is a compromise and has been accomplished through a collaborative approach to the specific
issues, unique budgetary and financial environment as they exist Furthermore, this agreement
shall serve as a settlement to the Permit Center Temporary Grievance filed in 2002.
The parties agree to allow the use of temporary employees upon the resignation, termination
or retirement of an
employee whose position, when vacated, is either frozen or not authorized to
be filled for an extended period of time This use of temporaries may only be used when the City

is evaluating the services provided and determining how and where to make cuts This use of
temporaries shall not be used to delay filling a vacancy. Under the circumstances outlined
• above, the following additional conditions shall apply:
• All qualified employees in the affected work group shall have first opportunity for
overtime hours to perform the work of the vacated position;
• The temporary employee shall be limited to a three month duration, and
• The use of this temporary in the same position beyond the three month duration must be
approved by both parties.
By signature below, all parties agree with the provisions of this agreement.
