Viseth Department: ES Detail: (i.e. address, location, parcel number, tax id, etc.): S Publlc\RecordsManagement\Forms\ContractCover\adcc7832 1 11/08 f MEMORANDUM OF UNDERSTANDING BY AND BETWEEN THE CITY OF KENT AND AFSCME LOCAL 2617 This memorandum of understanding is intended to clarify the 1998-2000 labor agreement, Section 19 5, paragraph B with regard to use of Sick Leave on a Holiday The City and Union have met to discuss this issue and have agreed to the following Employees shall not be eligible for sick leave when off work on a holiday unless all of the following conditions apply • If the employee is required by management to work on holidays as a part of his/her normal work schedule as a condition of employment, • If the holiday work is not scheduled as part of an overtime basis, i.e working additional hours on a holiday to finish a pending project, and • The employee is off in accordance with Section 19 2 of the collective bargaining agreement on the employee's observed holiday as defined by Section 17 1 of the bargaining agreement Example 1 If a Corrections Officer is scheduled to work on Labor Day due to staffing requirements at the Corrections facility and he ends up being sick on Labor Day, he may use sick leave The use of sick leave in this situation is appropriate because the Labor Day is a normal scheduled workday for this c/o • Example 2 If a Multimedia employee is scheduled to come into work to monitor the City's cable channel for 4 hours on July 4th and ends up being sick, he may not use sick leave Although this employee was scheduled to work on a holiday, this work was scheduled as part of an overtime basis and is not considered part of his normal work schedule Employees in this category are customarily off on holidays The above represents both of the parties' understanding and agreement with regard to this issue Signed this lSt4l day of OJ rC� 200C) at Kent, Washington CITY OF KENT WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES LOCAL 2617 ue Viseth Rob M Sprague Employee Services Director Staff Represen e Do lvw N' Anh Hoang c e ey Labor Relations Manager Fbfesident P 1LaboAUNI0NIAFSC1V1E198-00 ContractWOMick on Holiday doc
