SETTLEMENT AGREEMENT AND RELEASE
THIS AGREEMENT AND RELEASE ("Agreement") is entered into
between the City of Kent, a Washington municipal corporation ("City"), and
Yvonne Diehl ("Diehl").
RECITALS
A. Diehl owns certain real property located at 13633 SE 272rd Ct.,
Kent, Washington, 98042.
B. In February 2009, Diehl cut trees down that were located on ,
City property adjacent to and south of Diehl's property.
C. The parties have agreed to enter into this Agreement rather
than continue their dispute over this matter.
AGREEMENT
1. Diehl agrees to pay the City $833.34 on June 1, 2010, $833.34
on July 1, 2010, and $833.32 on August 1, 2010. If payment is properly
made as provided for in this Agreement, no penalties will attach.
2. City agrees to release Diehl from future claims related to Diehl's
February 2009 tree cutting on City property.
3. Each party, for itself, its heirs, successors, and assigns,
releases, acquits, and forever discharges the other party and its agents,
employees, officers, servants, successors, heirs, executors, administrators,
and all other associated persons, firms, corporations, associations, or
partnerships of any and all claims, actions, costs, and compensation arising
from or relating to the above described February 2009 tree cutting on City
property.
4. The parties to this Settlement Agreement and Release
understand that this is a full and final release and full compromise and
settlement of any and all claims of every nature and kind, known or
unknown, suspected or unsuspected, involving the above described February
2009 tree cutting on City property. It is further agreed that this is not an
admission of liability on the part of the settling parties but rather a
compromise, the express purpose of which is to preclude any additional
claims and to avoid the uncertainties of litigation and dispute resolution.
5. Each of the undersigned states that this Settlement Agreement
and Release has been carefully read and is signed as the free act and deed of
the respective individuals or corporation he or she represents.
