Building Systems, Inc. THIS AGREEMENT is made by and between the City of Kent, a Washington municipal corporation (hereinafter the "City"), and C.H.G. Building Systems, cinc. organized under the laws of the State of Washington, located and doing business at 1120 SW 16th Street, Suite A-4, Renton, Washington 98057 Phone: 425-255-5747 Fax: 425-255-4882 (hereinafter the "Contractor"). AGREEMENT The parties agree as follows: I. DESCRIPTION OF WORK. Contractor shall perform the following services for the City in accordance with the following described plans and/or specifications: Remove and dispose of existing gutters on City of Kent 212th Water Treatment Plant main building only located at 9001 South 212th Street in Kent. Existing down spouts are to remain and be re-used where practical. Supply and install new gutters where old gutters were removed. Contractor will match existing color as close as possible. See Exhibit A, Scope of Supply, which is attached and incorporated into this agreement by reference. Also attached is contractor's proposal dated 11/25/09. Contractor further represents that the services furnished under this Agreement will be performed in accordance with generally accepted professional practices within the Puget Sound region in effect at the time such services are performed. II. TIME OF COMPLETION. The parties agree that work will begin on the tasks described in Section I above immediately upon execution of this Agreement. Upon the effective date of this Agreement, Contractor shall complete the work described in Section I by May 31, 2010 . III. COMPENSATION. The City shall pay the Contractor a total amount not to exceed seven thousand four hundred ninety-eight and 56/100 ($7498.56), including any applicable Washington State Sales Tax, for the work and services contemplated in this Agreement. The City shall pay the Contractor fifty percent (50%) of the Contract amount upon completion and acceptance of the work by the City, and the remainder upon fulfillment of the conditions listed below and throughout this Agreement. PUBLIC WORKS AGREEMENT - 1 (Under$10K and No Performance Bond) A. No Payment and Performance Bond. Because this contract, including applicable sales tax, is less than $25,000, and pursuant to Chapter 39.08 RCW, the Contractor, in lieu of providing the City a payment and performance bond, has elected to have the owner retain the final fifty percent (50%) of the Contract amount for a period of sixty (60) days after the date of final acceptance, or until receipt of all necessary releases from the State Department of Revenue and the State Department of Labor & Industries and until settlement of any liens filed under Chapter 60.28 RCW, whichever is later. B. Defective or Unauthorized Work. The City reserves its right to withhold payment from Contractor for any defective or unauthorized work. Defective or unauthorized work includes, without limitation: work and materials that do not conform to the requirements of this Agreement; and extra work and materials furnished without the City's written approval. If Contractor is unable, for any reason, to satisfactorily complete any portion of the work, the City may complete the work by contract or otherwise, and Contractor shall be liable to the City for any additional costs incurred by the City. 'Additional costs" shall mean all reasonable costs, including legal costs and attorney fees, incurred by the City beyond the maximum Contract price specified above. The City further reserves its right to deduct the cost to complete the Contract work, including any Additional Costs, from any and all amounts due or to become due the Contractor. C. Final Payment: Waiver of Claims. THE CONTRACTOR'S ACCEPTANCE OF FINAL PAYMENT (EXCLUDING WITHHELD RETAINAGE) SHALL CONSTITUTE A WAIVER OF CONTRACTOR'S CLAIMS, EXCEPT THOSE PREVIOUSLY AND PROPERLY MADE AND IDENTIFIED BY CONTRACTOR AS UNSETTLED AT THE TIME FINAL PAYMENT IS MADE AND ACCEPTED. IV. INDEPENDENT CONTRACTOR. The parties intend that an Independent Contractor-Employer Relationship will be created by this Agreement. By their execution of this Agreement, and in accordance with Ch. 51.08 RCW, the parties make the following representations: A. The Contractor has the ability to control and direct the performance and details of its work, the City being interested only in the results obtained under this Agreement. B. The Contractor maintains and pays for its own place of business from which Contractor's services under this Agreement will be performed. C. The Contractor has an established and independent business that is eligible for a business deduction for federal income tax purposes that existed before the City retained Contractor's services and is a service other than that furnished by the City, or the Contractor is engaged in an independently established trade, occupation, profession, or business of the same nature as that involved under this Agreement. PUBLIC WORKS AGREEMENT - 2 (Under$IOK and No Performance Bond) D. The Contractor is responsible for filing as they become due all necessary tax documents with appropriate federal and state agencies, including the Internal Revenue Service and the state Department of Revenue. E. The Contractor has registered its business and established an account with the state Department of Revenue and other state agencies as may be required by Contractor's business, and has obtained a Unified Business Identifier (UBI) number from the State of Washington. F. The Contractor has a valid contractor registration pursuant to Ch. 18.27 RCW or an electrical contractor license pursuant to Ch. 19.28 RCW. G. The Contractor maintains a set of books dedicated to the expenses and earnings of its business. V. TERMINATION. The City may terminate this Agreement for good cause. "Good cause" shall include, without limitation, any one or more of the following events: A. The Contractor's refusal or failure to supply a sufficient number of properly skilled workers or proper materials for completion of the Contract work. B. The Contractor's failure to complete the work within the time specified in this Agreement. C. The Contractor's failure to make full and prompt payment to subcontractors or for material or labor. D. The Contractor's persistent disregard of federal, state or local laws, rules or regulations. E. The Contractor's filing for bankruptcy or becoming adjudged bankrupt. F. The Contractor's breach of any portion of this Agreement. If the City terminates this Agreement for good cause, the Contractor shall not receive any further money due under this Agreement until the Contract work is completed. After termination, the City may take possession of all records and data within the Contractor's possession pertaining to this project which may be used by the City without restriction. VI. PREVAILING WAGES. Contractor shall file a "Statement of Intent to Pay Prevailing Wages," with the State of Washington Department of Labor & Industries prior to commencing the Contract work. Contractor shall pay prevailing wages in effect on the date the bid is accepted or executed by Contractor, and comply with Chapter 39.12 of the Revised Code of Washington, as well as any other applicable prevailing wage rate provisions. The latest prevailing wage rate revision issued by the Department of Labor and Industries is attached. VII. CHANGES. The City may issue a written change order for any change in the Contract work during the performance of this Agreement. If the Contractor determines, for any reason, that a change order is necessary, Contractor must submit a written change order request to the person listed in the notice provision section of this Agreement, section XV(D), within fourteen (14) calendar days of the date Contractor knew or should have known of the facts and events giving rise to the requested change. If the City determines that the change PUBLIC WORKS AGREEMENT - 3 (Under$10K and No Performance Bond) increases or decreases the Contractor's costs or time for performance, the City will make an equitable adjustment. The City will attempt, in good faith, to reach agreement with the Contractor on all equitable adjustments. However, if the parties are unable to agree, the City will determine the equitable adjustment as it deems appropriate. The Contractor shall proceed with the change order work upon receiving either a written change order from the City or an oral order from the City before actually receiving the written change order. If the Contractor fails to require a change order within the time specified in this paragraph, the Contractor waives its right to make any claim or submit subsequent change order requests for that portion of the contract work. If the Contractor disagrees with the equitable adjustment, the Contractor must complete the change order work; however, the Contractor may elect to protest the adjustment as provided in subsections A through E of Section VIII, Claims, below. The Contractor accepts all requirements of a change order by: (1) endorsing it, (2) writing a separate acceptance, or (3) not protesting in the way this section provides. A change order that is accepted by Contractor as provided in this section shall constitute full payment and final settlement of all claims for contract time and for direct, indirect and consequential costs, including costs of delays related to any work, either covered or affected by the change. VIII. CLAIMS. If the Contractor disagrees with anything required by a change order, another written order, or an oral order from the City, including any direction, instruction, interpretation, or determination by the City, the Contractor may file a claim as provided in this section. The Contractor shall give written notice to the City of all claims within fourteen (14) calendar days of the occurrence of the events giving rise to the claims, or within fourteen (14) calendar days of the date the Contractor knew or should have known of the facts or events giving rise to the claim, whichever occurs first . Any claim for damages, additional payment for any reason, or extension of time, whether under this Agreement or otherwise, shall be conclusively deemed to have been waived by the Contractor unless a timely written claim is made in strict accordance with the applicable provisions of this Agreement. At a minimum, a Contractor's written claim shall include the information set forth in subsections A, items 1 through 5 below. FAILURE TO PROVIDE A COMPLETE, WRITTEN NOTIFICATION OF CLAIM WITHIN THE TIME ALLOWED SHALL BE AN ABSOLUTE WAIVER OF ANY CLAIMS ARISING IN ANY WAY FROM THE FACTS OR EVENTS SURROUNDING THAT CLAIM OR CAUSED BY THAT DELAY. A. Notice of Claim. Provide a signed written notice of claim that provides the following information: 1. The date of the Contractor's claim; 2. The nature and circumstances that caused the claim; 3. The provisions in this Agreement that support the claim; 4. The estimated dollar cost, if any, of the claimed work and how that estimate was determined; and 5. An analysis of the progress schedule showing the schedule change or disruption if the Contractor is asserting a schedule change or disruption. B. Records. The Contractor shall keep complete records of extra costs and time incurred as a result of the asserted events giving rise to the claim. The City shall have access to any of the Contractor's records needed for evaluating the protest. PUBLIC WORKS AGREEMENT - 4 (Under$1OK and No Performance Bond) i The City will evaluate all claims, provided the procedures in this section are followed. If the City determines that a claim is valid, the City will adjust payment for work or time by an equitable adjustment. No adjustment will be made for an invalid protest. C. Contractor's Duty to Complete Protested Work. In spite of any claim, the Contractor shall proceed promptly to provide the goods, materials and services required by the City under this Agreement. D. Failure to Protest Constitutes Waiver. By not protesting as this section provides, the Contractor also waives any additional entitlement and accepts from the City any written or oral order (including directions, instructions, interpretations, and determination). E. Failure to Follow Procedures Constitutes Waiver. By failing to follow the procedures of this section, the Contractor completely waives any claims for protested work and accepts from the City any written or oral order (including directions, instructions, interpretations, and determination). IX. LIMITATION OF ACTIONS. CONTRACTOR MUST, IN ANY EVENT, FILE ANY LAWSUIT ARISING FROM OR CONNECTED WITH THIS AGREEMENT WITHIN 120 CALENDAR DAYS FROM THE DATE THE CONTRACT WORK IS COMPLETE OR CONTRACTOR'S ABILITY TO FILE THAT CLAIM OR SUIT SHALL BE FOREVER BARRED. THIS SECTION FURTHER LIMITS ANY APPLICABLE STATUTORY LIMITATIONS PERIOD. X. WARRANTY. Upon acceptance of the contract work, Contractor must provide the City a one-year warranty in a form and amount acceptable to the City. The Contractor shall correct all defects in workmanship and materials within one (1) year from the date of the City's acceptance of the Contract work. In the event any parts are repaired or replaced, only original replacement parts shall be used—rebuilt or used parts will not be acceptable. When defects are corrected, the warranty for that portion of the work shall extend for one (1) year from the date such correction is completed and accepted by the City. The Contractor shall begin to correct any defects within seven (7) calendar days of its receipt of notice from the City of the defect. If the Contractor does not accomplish the corrections within a reasonable time as determined by the City, the City may complete the corrections and the Contractor shall pay all costs incurred by the City in order to accomplish the correction. XI. DISCRIMINATION. In the hiring of employees for the performance of work under this Agreement or any sub-contract, the Contractor, its sub-contractors, or any person acting on behalf of the Contractor or sub-contractor shall not, by reason of race, religion, color, sex, age, sexual orientation, national origin, or the presence of any sensory, mental, or physical disability, discriminate against any person who is qualified and available to perform the work to which the employment relates. Contractor shall execute the attached City of Kent Equal Employment Opportunity Policy Declaration, Comply with City Administrative Policy 1.2, and upon completion of the contract work, file the attached Compliance Statement. XII. INDEMNIFICATION. Contractor shall defend, indemnify and hold the City, its officers, officials, employees, agents and volunteers harmless from any and all claims, injuries, damages, losses or suits, including all legal costs and attorney fees, arising out of or in PUBLIC WORKS AGREEMENT - 5 (Under$1OK and No Performance Bond) connection with the Contractor's performance of this Agreement, except for that portion of the injuries and damages caused by the City's negligence. The City's inspection or acceptance of any of Contractor's work when completed shall not be grounds to avoid any of these covenants of indemnification. Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4.24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Contractor and the City, its officers, officials, employees, agents and volunteers, the Contractor's liability hereunder shall be only to the extent of the Contractor's negligence. IT IS FURTHER SPECIFICALLY AND EXPRESSLY UNDERSTOOD THAT THE INDEMNIFICATION PROVIDED HEREIN CONSTITUTES THE CONTRACTOR'S WAIVER OF IMMUNITY UNDER INDUSTRIAL INSURANCE, TITLE 51 RCW, SOLELY FOR THE PURPOSES OF THIS INDEMNIFICATION. THE PARTIES FURTHER ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER. The provisions of this section shall survive the expiration or termination of this Agreement. XIII. INSURANCE. The Contractor shall procure and maintain for the duration of the Agreement, insurance of the types and in the amounts described in Exhibit B attached and incorporated by this reference. XIV. WORK PERFORMED AT CONTRACTOR'S RISK. Contractor shall take all necessary precautions and shall be responsible for the safety of its employees, agents, and subcontractors in the performance of the contract work and shall utilize all protection necessary for that purpose. All work shall be done at Contractor's own risk, and Contractor shall be responsible for any loss of or damage to materials, tools, or other articles used or held for use in connection with the work. XV. MISCELLANEOUS PROVISIONS. A. Recyclable Materials. Pursuant to Chapter 3.80 of the Kent City Code, the City requires its contractors and consultants to use recycled and recyclable products whenever practicable. A price preference may be available for any designated recycled product. B. Non-Waiver of Breach. The failure of the City to insist upon strict performance of any of the covenants and agreements contained in this Agreement, or to exercise any option conferred by this Agreement in one or more instances shall not be construed to be a waiver or relinquishment of those covenants, agreements or options, and the same shall be and remain in full force and effect. C. Resolution of Disputes and Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. If the parties are unable to settle any dispute, difference or claim arising from the parties' performance of this Agreement, the exclusive means of resolving that dispute, difference or claim, shall only be by filing suit exclusively under the venue, rules and jurisdiction of the King County Superior Court, King County, Washington, unless the parties agree in writing to an alternative dispute resolution process. In any claim or lawsuit for damages arising from the parties' performance of this Agreement, each party shall pay all its legal costs and attorney's fees incurred in defending or PUBLIC WORKS AGREEMENT - 6 (Under$10K and No Performance Bond) bringing such claim or lawsuit, including all appeals, in addition to any other recovery or award provided by law; provided, however, nothing in this paragraph shall be construed to limit the City's right to indemnification under Section XII of this Agreement. D. Written Notice. All communications regarding this Agreement shall be sent to the parties at the addresses listed on the signature page of the Agreement, unless notified to the contrary. Any written notice hereunder shall become effective three (3) business days after the date of mailing by registered or certified mail, and shall be deemed sufficiently given if sent to the addressee at the address stated in this Agreement or such other address as may be hereafter specified in writing. E. Assignment. Any assignment of this Agreement by either party without the written consent of the non-assigning party shall be void. If the non-assigning party gives its consent to any assignment, the terms of this Agreement shall continue in full force and effect and no further assignment shall be made without additional written consent. F. Modification. No waiver, alteration, or modification of any of the provisions of this Agreement shall be binding unless in writing and signed by a duly authorized representative of the City and Contractor. G. Entire Agreement. The written provisions and terms of this Agreement, together with any Exhibits attached hereto, shall supersede all prior verbal statements of any officer or other representative of the City, and such statements shall not be effective or be construed as entering into or forming a part of or altering in any manner this Agreement. All of the above documents are hereby made a part of this Agreement. However, should any language in any of the Exhibits to this Agreement conflict with any language contained in this Agreement, the terms of this Agreement shall prevail. H. Compliance with Laws. The Contractor agrees to comply with all federal, state, and municipal laws, rules, and regulations that are now effective or in the future become applicable to Contractor's business, equipment, and personnel engaged in operations covered by this Agreement or accruing out of the performance of those operations. I. Counterparts. This Agreement may be executed in any number of counterparts, each of which shall constitute an original, and all of which will together constitute this one Agreement. All employees must read, study and follow the safety practices within this booklet. For your safety and the safety of others, do not ignore or violate any of these Safe Practices and Rules. CHG Job Site Specific Safety Plan STATEMENT OF MALICIOUS MISCHIEF CHG Budding Systems, Inc. is aware of the malicious mischief some employees engage in making fraudulent claims of injury. By using management evaluation techniques employees are screened in all work procedures to abate this problem. GENERAL SAFETY RULES A Cables, hooks, slings, bridles, chains and other rigging must be correct size for work. B All trusses and beams must be braced progressively to prevent buckling or overturning. C A basic erection plan and procedure is kept on site for review. D Generally, safety belts must be worn and tied off to independent life lines when working from elevated areas where there is a fall hazard E Barricades are required around excavations, holes or openings in floors, roofs, elevated platforms, certain types of overhead work and wherever necessary to warn people against falling objects. F Material Handling: 1. The weights to be handled must be known before proceeding. 2. Riggers must know the capacity and proper use of the handling device (crane, forklift, chain fall, come-a-long, clamp, choker, and shackle) before proceeding. 3. Tag Imes must be used to control loads. 4. A qualified person must provide the necessary instructions before work proceeds. 5. Never raise or sing a load over people. G All electric power tools must be properly grounded before using. H Check the insulation on all wires and cords regularly. If they are frayed, worn, cut, or broken, do not use them. I String temporary extension cords and power lines so that they will not create a tripping hazard and so they are protected from physical damage J Equipment Operation: 1. Do not get on or off any vehicle (e.g. aerial lifts and forklifts) while in motion, even slow motion. 2. Always conduct the required routine inspection of equipment prior to start up. 3. Watch clearances, especially at the back of the machine and always have a signalman when your view is obstructed. 4. Check braking systems, steering gear and loading devices at the beginning of each workday. 5. Be certain that warning horns and backup alarms are in working order at all times during operation of equipment. GENERAL INFORMATION 1 C.H.G. REPORTING OF ACCIDENTS It is your responsibility and duty as an employee to report unsafe acts, conditions and accidents in accordance with the applicable regulations and company procedures. Bring any unsafe observations to the attention of the site supervisor, and as soon as possible, who will investigate and institute corrective actions. Each work related accident shall be fully recorded, by the injured person and/or supervisor. Recording any injury in the First Aid Book will support your claim for compensation, should the need arise. 1. All incidents or accidents, regardless of seventy, causing damage to our property or the property of others as well as injury to Company employees or others, must be reported promptly to your supervisor. 2 All requirements under Occupational Health & Safety Acts, Workers Compensation Acts must be followed completely. CHG Job Site Specific Safety Plan PERSONAL PROTECTIVE CLOTHING I All employees shall take reasonable care to protect the health and safety of himself and of other workers present while he is working. 2. Proper safe working apparel, as per Occupational Health and Safety regulations shall be worn at all times. This includes hard hats, adequate footwear, regulations shirt sleeves, (min. 6") eye protection and hearing protecting, where required. Protective Clothing (cont'd) 3 All employees must obtain and wear a hard hat with adequate company identification at the job site or as per customer regulations. Hard hats must not be painted and the shells and suspension should be inspected regularly. (No foul wording or Graffiti.) 4 For your own protection, safety footwear should be worn at all times and as per customer regulations. 5 For your personal protection on the job, do not wear: a. Loose clothing or cuffs b. Greasy or oily clothing c. Torn or ragged clothing d. Neck chains, finger rings, or earrings. e. Short sleeved shirts or cut offs. 6. All personnel must comply with his maximum length of head and facial hair policies of our customers and Occupational Health and Safety regulations. EYE PROTECTION I Safety glasses and side shields shall be worn when the nature of the job presents an eye hazard such as drilling, using power tools (air or electric) or any job where flying particles are a possibility. 2 Safety glasses, face shield or cover goggles must be worn during grinding or welding operations. 3 Correct head, eye and face protection must be worn by all personnel performing welding and cutting. HEARING PROTECTION I All employees must wear properly fitted ear plugs or ear muffs where they may be exposed to excessive noise form construction activities which could lead to hearing loss 2 It is recommended that all employees wear hearing protection in areas where noise levels exceed acceptable limits (80 dBA). BREATHING PROTECITON Respiratory Protection Equipment Be aware of exposure to harmful concentrations of gases, vapor, smoke fumes, mists or dust created by permanent of temporary work processes, respiratory protective equipment designed to protect workers from hazard shall be provided. CHG Job Site Specific Safety Plan may contaminate with substances immediately hazardous to life, excess head or facial hair which prevents effective sealing of the face piece to the facial skin shall be removed. Unless protected by respiratory equipment, no worker shall enter any area: 1 Where a deficiency of oxygen may exist, or 2 Where the atmosphere is contaminated, or in danger of being contaminated by flammable or harmful vapors, gases or dust in sufficient quantities to create a hazard. PERSONAL CONDUCT Riding on Equipment Under no circumstances is a worker to ride on any piece of equipment unless he is properly occupying a place or seat designed for such a purpose. This is especially important around forklift, aerial devices, hoists, cranes and earth moving equipment, and other power mobile equipment. Horseplay Horseplay will not be tolerated. Serious personal injuries have resulted from playing practical jokes at the work site Employees must not engage in any prank, contest, feat of strength, unnecessary running or rough and boisterous conduct. Smoking "No SMOKING" regulations or restrictions must be adhered to and enforced. Alcohol and Drugs No person under the influence of, or carrying intoxicating alcoholic beverages is to enter or knowingly be permitted to enter a work site. No person under the influence of, or carrying an illicit drug is to enter or knowingly be permitted to enter a work site. BASIC RULES FOR EMERGENCY FIRST-AID TREATMENT A) Be familiar with the Project Emergency Plan, B) Avoid excitement or panic, C) If immediate action is necessary to save a life (artificial respirations, control of bleeding, etc.) give the proper treatment without delay. D) Make a careful examination of the patient. Standard First Aid and Personal Safety A Within the first two moths of employment as a permanent Leadman, Foreman, Superintendent, or Project Manager you should plan to attend a standard First Aid Course administered by the American Red Cross. All other field employees are strongly encouraged to take a course in CPR (Cardio Pulmonary Resuscitation). B Your decisions and actions will vary according to the circumstances that produced an accident or sudden illness, the number of persons involved, the immediate environment, the availability if medical assistance, emergency dressings and equipment and help from others. CHG Job Site Specific Safety Plan C First aid begins with action, which in itself has a calming effect. If there are multiple injuries or if several persons are hurt, priorities must be set. Enlist the help of fellow workers to make telephone calls, to keep others at a distance if necessary and to perform other duties. Provide lie support to victims with life threatening injuries, then care for those with less critical injuries. D. Sometimes prompt action is needed to save a life At other times there is no need for haste, and efforts will be directed toward preventing further injury, obtaining assistance and reassuring the victim, who may be emotional upset and apprehensive, as well as in pain. E Telephone, or have someone else telephone, the appropriate authorities regarding the accident (911). Give your name, the location of the accident, the number of persons involved and the telephone number where you can be reached. Describe the problem, indicate what is being done and request the assistance needed, such as an ambulance, the fire department, the rescue squad or utility company personnel. Do not hang up the receiver until after the other party hangs up because he may wish to clarify some information A. Urgent care In case of serious injury or sudden illness, while help is being summoned, give immediate attention to the following first aid priorities. I Effect a prompt rescue. 2 Ensure that the victim has an open airway and give mouth-to-mouth, if necessary. 3 Control severe bleeding 4 Give first aid for poisoning, or ingestion of harmful chemicals (check label on container). B. Additional first aid directions Once emergency measures have been taken to ensure the victims safety, the following procedures should be carried out. I Do not move a victim unless it is necessary for safety reasons. Keep the victim in the position best suited for his condition or injuries, do not let him get up and walk about. 2 Protect the victim from unnecessary manipulation and disturbance. 3 Avoid or overcome chilling by using blankets or covers, if available. 4 Determine the injuries or cause for sudden illness, after immediate problems are under control. a Find out exactly what happened Information may be obtained from the victim or from persons who were present and saw the accident or saw the individual collapse. b Look for an emergency medical identification, such as a card or bracelet, which may provide a clue to the victim's condition. 5 Examine the victim methodically but be guided by the kind of accident or sudden illness and the needs of the situation. Have a reason for what you do. a Loosen constrictive clothing, but do not pull on the victim's belt in case spinal injuries are present. b Open or remove clothing if necessary to expose a body part in order to make a more accurate check for injuries. Clothing may be cut or ripped at the seams, but utmost caution must be used or added injury may result. c Note the victim's general appearance, including skin discoloration and check all symptoms that may give a clue to the injury or sudden illness. d Check the victim's pulse e Check to see if the victim is awake, stuporous or unconscious. If victim is unconscious, look for evidence of head injury. In a conscious person, look for paralysis of one side of the face or body. See if the victim shows evidence of recent convulsion. (He may have bitten his tongue.) g Check the expression of the victim's eyes and the size of his pupils. h Examine the victim's trunk and limbs for open and closed wounds or fro signs of fractures. 6 Carry out the indicated first aid: a Apply emergency dressings, bandages, and splints as needed. b Do not move the victims unless absolutely necessary. c Plan action according to the nature of the injury or sudden illness, the needs of the situation and the availability of human and material resources. d Utilize proper first aid measures and specific techniques that, under the circumstances, appear reasonably necessary e Remain in charge until the victim can be turned over to qualified persons or until the victim can take care of himself or can be placed in the care of relatives. f Do not attempt to make a diagnosis of any sort or to discuss a victim's condition with bystanders or reporters. g Above all, as first aid worker, you should know the limits of your capabilities and must make every effort to avoid further injury to the victim in your attempt to provide the best possible emergency first aid care. Basic Rules for Emergency First-Aid Treatment Send for the police, fire department, or ambulance, if they are needed. Give proper first aid in the following order: 1) Artificial Respiration 2) Control of Bleeding 3) Physical Shock 4) Open Wounds and Burns 5) Fractures 6) Transportation FIRST AID Basic first aid concentrates on breathing, bleeding and burns. Breathing If the casualty is not breathing, start artificial respiration immediately. CHG Job Site Specific Safety Plan Bleeding If the casualty is bleeding from an external wound, control the bleeding immediately. 1) Apply direct pressure to the wound with a clean, lint free dressing. 2) Lay the casualty down in a comfortable position. 3) Elevate the injured part if possible. The simple formula for the control of bleeding is R.E.D. 1) Rest, Elevate, Direct Pressure. Burns 1) For minor burns, flush the area with cool water to relieve pain and swelling, cover the burn area lightly with a clean, lint free, loose dressing and get medical help. 2) In the case of serious burns, cover the injured are with a clean, damp dressing and get medical help. 3) Do not apply creams, locations or ointments. 4 Do not rick blisters or pull clothing struck to the burned areas. p P 9 Shock(nonelectric) Persons suffering from serious injuries may lapse into"shock". Signs of shock include drowsiness, paleness, clammy skin and weak pulse Medical help is required. 1) Reassure the victim that help is coming. 2) Place victim on back with feet elevated unless injuries make this difficult. Otherwise place victim in comfortable position that allows for easiest breathing. 3) Loosen clothing around neck, waist and chest. 4) Keep the victim warm. 5) Watch for signs of breathing trouble. Cardiopulmonary Resuscitation (CPR) In addition to restoring breathing, it may be necessary to restore a victims heart beat. This may be done by CPR for which special training is required. Do not attempt CPR unless you have been trained to do so Every project should have a well equipped and maintained first aid kit. Many jurisdictions have mandatory requirements in this regard. Service crews should keep a first aid kit in the service vehicle. SAFE OPERATING PROCEDURES Illumination 1) All areas where workers must work, pass through, or be present, including areas of access and egress, must be adequately lit. 2) Suggested lighting levels: General construction work areas -5 foot candles Areas during concrete placement, excavation, field maintenance, and refilling of vehicles and equipment. 3 foot candles Access Ways -5 foot candles Active storage areas, waste storage areas, and loading platforms. -5 foot candles 3) Missing or burned out bulbs must be replaced. 4) Dark areas should not be entered without the assistance of portable lighting or flashlights. Temporary Wiring 1) Temporary wiring for construction or demolition projects must be installed in accordance with the Electrical Code and Consumer Codes, as amended by the jurisdiction in which the project is located. Temporary Wiring (cont'd) 2) Temporary lighting should have all panel covers in place. Service panels should be protected before being energized 3) Temporary wiring must have a permit and be inspected and approved when initially installed and should be monitored regularly Fixed Temporary Lighting This refers to the electrical system installed for the purpose of illumination during construction. Branch lighting circuits should be kept entirely separate from power circuits except for a common supply Minimum temporary lighting requirements do not include provisions for portable hand- held lamps to illuminate their immediate work area. 1) Lamps should be installed in suitable locations to illuminate the entire area. Where this is not practical, additional lights should be installed over and above the minimum requirements. 2) All temporary lighting should be inspected regularly and burned out or missing lamps replaced promptly. Any lights that become obstructed by new work such as ceiling, ducts, piping, equipment and partitions, should be relocated. CHG Job Site Specific Safety Plan 1) All portable extension cords must be of the outdoor type, rated for 600 volts, and have an insulated grounding conductor. 2) Defective cords must be repaired or replaced immediately. 3) Extension cords should be protected during use to prevent damage from sharp edges, movement of materials, flame cutting and other operations 4) Extension cords used in hazardous areas such as metal enclosures or damp locations should be equipped with approved ground fault protection. Ladders 1) All portable ladders must be equipped with non-slip bases. 2) Ladders should be set up on a firm level surface. If the base is to rest on soft uncompacted or rough soil, a mud sill shall be used. 3) Straight ladders shall be tied off or otherwise secured to prevent movement. If this is not possible, one worker should hold the base of the ladder while it is being used. 4) When a task must be done while standing on an extension ladder, the length of the ladder should be such that the worker stands on a rung no higher than the fourth from the top. 5) When climbing up or down, workers should always face the ladder. 6) Unless suitable barricades have been erected, or other adequate protection provided, ladders should not be set up in passageways, doorways, driveways or other locations where they can be struck or bumped by persons or vehicles 7) Ladders should not be erected on boxes, carts, tables, scaffold platforms or on vehicles. 8) Straight ladders should be set up at an angle such that the horizontal distance between the top support and the base is not less than one-quarter or greater than one-third the vertical distance between these points. 9) Metal ladders, or ladders with a wire reinforcing, must not be used where there is any chance of electrical contact. 10) Wooden ladders should be unpainted or finished with a clear nonconductive wood preservative. 11)All ladders erected between levels must be securely fastened, extend (3 ft.) above the top landing and afford clear access at top and bottom. 12) Ladders with weakened, broken, bent or missing steps, broken or bent side rails, broken, damaged, or missing non-slip bases or otherwise defective, must not be used and should be tagged and removed from service. 13) Ladders should not be used horizontally as substitutes for scaffold planks, runways or any other service for which they have not been designed 14) Workers on a ladder should not straddle the space between a ladder and another object. 15) Three points of contact should always be maintained when climbing up or down a ladder (two feet and one hand or one foot and two hands). Scaffolding 1) The erection and dismantling of scaffolds must be carried out under the supervision of qualified personnel. 2) Upon completion of erection of scaffolding the scaffold shall be tagged `operational" by qualified personnel. At no time will the scaffold be modified by any personnel other than the scaffold crew Scaffolding (cont'd) 3) Workers erecting or dismantling a scaffold more than 10 ft. high must be tied off with a safety belt and lanyard. 4) Scaffolds must be erected with all braces, pins, screw lacks, base plates and other fittings installed, as required by the manufacturer. 5) Scaffolds must be adequately braced horizontally and vertically. a) Most tubular frame scaffolds should have braces on every section in the vertical plan. b) Horizontal bracing is provided to some extent by the scaffold platform and base plates on the scaffold legs. However, where scaffolds are several sections high or where they are on casters, most manufacturers recommend that horizontal bracing be used 6) Scaffolds must be equipped with guardrails consisting of a top-rail, mid-rail, and toe board. 7) Scaffold platforms must be at least 20 inches wide and there must be no space larger than 10 inches between vertical uprights. 8) Scaffolds must be tied to a budding at vertical intervals not exceeding three times the least horizontal dimension, including the dimension of any outrigger stabilizing devices. 9) Where scaffolds cannot be tied into a building, guy lines adequately secured shall be used to provide stability. 10) Scaffold frames should be effectively pinned together where scaffolds are over two frames in height or where they are used as rolling scaffold towers. 11) Scaffold planks must be securely fastened to prevent them from sliding. 12) Scaffold planks must be of good quality, free form defects such as loose knots, splits or rot, rough sawn, measuring (2"x 10") cross-section, and No.1 spruce or better when new 13) Scaffolds must be erected, used and maintained in a reasonable plumb condition. 14) Scaffold planks must be installed so that they overlap by at least (6") but not more than (12"). 15) Scaffolds must be equipped with a proper ladder for access. Vertical ladders must be equipped with (6") standoff brackets and a ladder climbing fall protection device or safety cage when they are more than (16 ft.) high. CHG Job Site Specific Safety Plan 16) The scaffold platform must be kept free of ice, snow, oil, grease or other slippery material. 17)Wheels or casters on rolling scaffolds must be equipped with braking devices and securely pinning to the scaffold frame Working from Scaffolds 1) Scaffold platforms must be fully planked. 2) Guardrails consisting of a top-rail, mid-rail and toe board are required whenever the working platform is 10 ft or more above the floor level. 3) Wheels and casters must be locked when personnel are working on the scaffold 4) If the scaffold is more than 10 ft. high, it must not be moved with personnel on it unless; a. They are tied off by means of a safety belt and lanyard to an independent support b The floor is smooth and level. Manlifts 1) A manlift device should only be operated by a worker who has been instructed in; operating the machine, the daily inspections and maintenance required by the manufacturer, the types of working surfaces on which the machine is designed to be used, the maximum rated working loads, special conditions or limitations of the machine, the significance of alarms and the location of emergency controls. 2) A manlift device which is not working properly or which has sustained damage to critical components should not be used until repaired by qualified mechanic. 3) In the raised position, a manlift device should only be used on surfaces specified by the manufacturer. 4) A manlift device should not be driven in a raised position close to holes, depressions, trenches or similar hazards. 5) A manlift device should not bear more than its rated working load and where possible, the loads should be distributed over the platform. 6) When manlift platforms are used to lift materials, ensure that the materials are firmly secured to the platform. 7) Do not place make shift platforms such as boxes or proper access equipment such as ladders and scaffolds on a manlift platform to gain access to areas above. 8) Overhanging loads should not be lifted on a manlift platform. 9) A manlift platform or any part of a manlift device should not be moved closer than (10 ft.) to overhead power lines unless the device is equipped for live electrical line work and the workers on the platform are qualified for such work or as per local government legislation. 10) A manlift device should not be used for pulling, pushing, or dragging materials. Only manufacturer's platform extension device should be used. 12) Planks or similar platform materials should not be used to bridge a gap between manlift platform and other work areas. 13) Workers should always maintain 3-point contact (one hand and two feet or two hands and one foot) when getting on or off the platform of a manlift device. 14)Workers aloft in a manlift must be tied o ff with an approved full body harness and lanyard. 15) For all types of off-slab devices, the terrain on which the device is placed on or which it will travel over must be firm enough to support the device and its rated working load. 16) A manlift device should not be used under high wind conditions. This is especially important for smaller scissor lifts and boom type devices. 17) When the manlift is not being used, turn off the power system to prevent exhaust fumes from accumulating in an enclosed work area. Aerial Devices 1) Vehicle mounted aerial devices must not be moved unless the aerial device is fully retracted and slowed. 2) Workers must not go aloft unless a trained person on the ground is immediately available to assist in lowering the aerial device in case of emergency. 3) While aloft, workers must not climb from an aerial device to another elevated position. 4) Workers aloft in an aerial device must be tied off to the boom with an approved full body harness and lanyard. 5) An aerial device must not be moved closer to a live line conductor than the minimum distances listed in the table below unless: a A signal man is provided to advise the operator of his proximity to the live line conductor, and b Assurance is obtained in writing from the electrical authority that the conductor is effectively guarded. CHG Job Site Specific Safety Plan conductors. 7) Mechanically operated aerial ladders must not be raised or lowered, extended or retracted while a worker is on the ladder 8) Only one worker at a time must be aloft on an aerial ladder Cranes and Hoists 1) Minimum clearance shall not be less than 15 feet to any overhead power line. 2) No riding on the blocks, hooks or ball of the crane or forks of a forklift. No riding on rough terrain lifting equipment. 3) Load limits of crane must not be exceeded. 4) Safety latches are required on all hooks. 5) Additional care and precaution should be taken when working on or around lighting equipment or entering swing area. 6) Shall have competent signal man in view of operator and to use standard signals for all hoisting and boom movements and to ensure safety. 7) Inspect hooks, slings, shackle and chokers before using. 8) Keep hands clear of loads, and tag lines when load and conditions require. 9) Keep out from under loads—do not position yourself where swinging loads can trap you. 10) Report all unsafe rigging equipment to your supervisor. 11) All crane and hoist operators must be qualified to operate equipment. Shoring in Trenches and Excavations 1) All earth trenches more than (4 ft.) deep must be shored with either timber or a prefabricated trench box or be cut with embankment slopes of 1 to 1 (45 degrees) or as per local government. 2) Ladders must be used for getting into or out of a shored trench and be placed so that a worker is protected at all times when using a ladder. 3) Buried services such as gas lines, water lines, sewers and electrical services must be located excavation starts. Contact local utility location service. and marked before e ( h' ) 4) When timber shoring is used, it must be installed progressively as the trench is being excavated. 5) Excavations which workers are required to enter should be kept reasonable free of water. 6) Tools, equipment, and excavated soil must be kept at least(2 ft.) from the edge of excavation or trench or as per local government legislation. CHG Job Site Specific Safety Plan Barricades and Guardrails 1) Hazardous areas should be cordoned off with barricades. 2) Guardrails consisting of a top-rail and toeboard must be provided: a) At all floor edges where workers may fall more than 10 ft. b) Around all floor or roof openings where workers may fall more than 10 ft., unless such openings are protected by adequate coverings. c) Around the working platform of all scaffolds, 15 ft. or taller 3) When barricades, guardrails or opening covers must be removed for work to proceed, permission to remove them must be obtained from the supervisor. When guardrails or opening covers are temporarily removed, workers in the area must be protected by a safety harness and lanyard tied of f to the project. Barricades, guardrails and covers must be replaced immediately after work is complete. Temporary Bracing 1) No temp bracing will be removed unless permission is given by superintendent. Working Beside Unprotected Openings & Edges A worker must wear his safety harness with the lanyard tied off to a fixed support whenever his feet are more than (15 ft.) above the next level of whenever he works above operating machinery, hazardous substances or objects regardless of the possible fall height. Safety Harnesses and Lanyards 1) All safety harness and lanyards must be ANSI approved. Both the harness and the lanyard will carry ANSI labels and be inspected on a regular basis. 2) Lanyards must be a minimum of(5/8") diameter nylon or equivalent. Lifelines All lifelines must be: 1) 3/4"diameter polypropylene or equivalent. 2) Used only by one worker at a time. 3) Free from any danger of chafing. 4) Free of cuts, abrasions and other defects. 5) Secured to a solid object (remember, the arrest load can be as high as 5,000 pounds). 6 Lifeline and lanyard must be rigged so that a worker may not fall more than 4 ft. NOTE: Check all lifelines and lanyards to ensure they are following interruption in work. Powder Actuated Tools 1) The employer should not supply or require workers to use high-velocity power-actuated tools. Only low-velocity, light or heavy duty ANSU approved tools should be used. 2) Powder-actuated tools must be used by workers who have a valid operators license and have been instructed to operate the tools properly and safely. Work in Confined Spaces 1) Before work begins In any manhole, vault or confined space, the air must be tested by a person properly trained to use the appropriate gas detection equipment. This testing must be done by qualified personnel. 2) Where proper tests competently performed Indicate a safe atmosphere, workers may be allowed to enter. 3) Where proper tests competently performed indicate a hazardous level of fumes, gases, or oxygen deficiency in any confined space, entry must not be allowed until the space has been adequately ventilated and subsequent tests Indicate a safe atmosphere 4) Where possible, mechanical venting should be continued in any confined space found to contain hazardous levels of fumes, gases, or oxygen deficiency, even after mechanical venting has corrected the hazard. The confined space must also be continuously monitored while personnel are working here. 5) Where mechanical venting has corrected hazardous levels of fumes, gases or oxygen deficiency In a confined space but cannot be continuously provided, workers entering the confined space must wear a rescue harness attached to Individual lifelines and a worker must be posed at the entrance prepared and equipped to provide rescue In case of emergency Authorized Personnel Only competent personnel appointed by the employer or a regulation authority shall have access to areas containing or structures supporting energized apparatus or conductors. Material Handling 1) Whenever practical, heavy lifts should be done with mechanical lifting devices. 2) When manual handling Is required, dollies, trucks and similar devices should be used. 3) Know your physical limitations and the appropriate weight of materials you are trying to lift. Get help when a lifting task may be more than you can safely handle. Lifting 1) The majority of personnel accidents which occur in the Industry are caused through the lifting of objects. There are several principles which should be applied to prevent straining of the muscles during the lifting operation. a) Fully utilize the strong leg muscles for lifting rather than the weak back muscles. b) Use the body's weight to Initiate movement In the desired directions. c) If the object to be lifted proves too large or too heavy seek assistance. d Do not over strain yourself It might lead to serious injury. CHG Job Site Specific Safety Plan Office Safety I) Do not overload electrical circuits. 2) Electrical extension cords are not to be used where they may create a hazard. i.e., work areas, walkways, hallways, etc. 3) Do not put liquids, coffee, pop, water on top of electrical equipment—calculators, computers, Dictaphones, etc. 4) Do not leave drawers on desks and filing cabinets open while unattended. 5) Keep office neat, tidy and clean. Housekeeping, Storage and Tool Maintenance 1) Waste material and debris should be removed from work and access areas on a regular basis or at least once a day. Waste material and debris should not be thrown from one level to another but be carried down, lowered into containers or deposited in a disposal chute. 2) Material should be piled, stacked or otherwise stored to prevent tipping and collapsing. 3) Material to be lifted by a crane or other hoisting device must not be stored under overhead power lines. 4) It is the employer's responsibility to supply and maintain shop tools and other power equipment in good repair It is the worker's responsibility to use such tools properly and to report any defect to his supervisor. 5) Large tools such as pipe vises and benders should be set up out of the way, so as not to create a hazard to either the public or fellow workers. Safety Mindedness 1) Safety is a permanent requirement. a) Read—understand—apply safety regulations. b) Be safety minded—safety depends on you. 2) Recognized Danger is an avoidable danger. Accidents 1) They don't lust happen; they are caused. They can be prevented by: a) Keeping your mind on the job you are doing. b) Applying safety regulations. c) Using equipment in serviceable conditions. 70% of all accidents are due to human error. YOUR SAFETY Habit 1) To get used to danger means to overlook it; habit makes one indifferent and careless. The Other Person 1) Always be aware of the other person who may not be observing the rules of safety. HAZARDOUS MATERIALS Transporting Flammable Liquids 1) Gasoline and other highly flammable liquids must not be carried in the passenger compartment of a vehicle. 2) Gasoline and other flammable liquids must be transported and stored in approved containers bearing the UL label. 3) Ensure that the containers are not damaged and that caps or fittings are properly secured after filling. 4) Flammable liquids must be transported in an upright position, braced or otherwise secured to prevent overturning. 5) Do not use gasoline as a cleaner. 6) Gasoline engines should be shut off and allowed to cool before refueling. PCB's 1) Employees shall NOT clean, touch, handle to transport PCBs in any way without written consent from management and Government Authorities. Oxygen and Acetylene 1) Leather gauntlet gloves and goggles with the proper shade of lenses (no safety glasses), must be worn by workers using an oxyacetylene cutting torch. 2) Oxygen and acetylene cylinders must be secured in an upright position at all times during storage, use and transportation. 3) Cylinders should be stored in a well ventilated area preferably outside with overhead protection from the weather. 4) Protective cap must be in place when the cylinders are not in use or when they are being moved. 5) Fire extinguishers must be available where oxyacetylene cutting is being done. 6) Cylinders must not be placed where they may become part of an electric circuit or be inadvertently struck by a welding rod. 7) Cylinders must be hoisted in properly rigged racks on baskets to keep them secure and upright. 8) Workers involved in oxyacetylene work should not carry propane lighters. CHG Job Site Specific Safety Plan 9) Oxygen or acetylene torches must not be used to blow dust from work surfaces, clothing, or skin. 10) Do not move cylinders, without first closing the valves. 11) Do not use regulators, hoses or torches unless they are working properly. 12) Use only a spark lighter to ignite torches. Never use matches or cigarette lighters. 13)Supply hoses must be protected from traffic. 14) A leaking gas cylinder must be removed to an outdoor location away from ignition sources and marked to be readily identifiable. The supplier should be notified about the defective cylinder. 15) Keep acetylene cylinders away from heat sources. The surrounding temperature should be kept below (130 degrees F). 16) Empty cylinder should be identified and stored separately from full cylinders. Acetylene cylinders should be stored separately from oxygen cylinders. 17) Cylinders should not be placed where materials or equipment can strike, fall on or knock them over. Propane 1) Unless designed for horizontal use, propane cylinders must be kept in an upright position. 2) Propane cylinders should be stored in a well ventilated area away from heat sources— preferably outdoors and above grade. 3) When not in use, propane cylinders and hose connected devices should not be left in trenches or other low-laying areas. Propane is heavier than air and can settle in dangerous concentrations at the bottom of trenches, manholes, vaults, basements, sumps and other below grade areas. 4) Only Approved hoses and fittings must be used to connect a cylinder to tools and equipment. 5) Never look for leaks in a propane cylinder or hose with a match or torch. Use soapy water. Fire Prevention Fire prevention is more than firefighting. By observing a few points we can reduce the need for firefighting. These are: 1) Good housekeeping (neatness, tidiness and disposal) is essential. Rubbish should not be allowed to accumulate but should be regularly disposed of into recognize bins with lids or other approved-type containers. These should be emptied on a regular basis. 2) Open fires are prohibited on all jobs. This includes outdoor fires and fire in cans or buckets within buildings. 3) Know the location of firefighting equipment, fire alarms and telephones that can be used in an emergency. 4) Shut off the power before attempting to put out an electric fire. 5) Use carbon dioxide or dry chemical multipurpose extinguishers for electric fires. Never use water on an electric fire 6) Have a fire extinguisher handy when cutting or welding. Do not drop hot metal or slag on combustible metal. 7) Do not use gasoline or kerosene to start fires. If it is small and the proper fire extinguisher is nearby, put it out. 9) If a fire is too much for you to handle, send someone to the construction or customer's office immediately to report it Stay a safe distance from the fire. Warn others. Post lookouts for the firefighters to direct them to the fire. The office has a procedure set up to handle major fires immediately upon being notified. Fire Extinguishers 1) Portable extinguishers are classified according to their capacity for handling specific types of fires 2) Fire extinguishers must be readily accessible, properly maintained, regularly inspected and promptly refilled after use. 3) Always aim nozzle of the fire extinguisher at the base of the fire. Classes of Fires a) Class"A" Extinguishers—For fires in ordinary combustible materials such as wood, paper, and textiles where a quenching, cooking effect is required. b) Class"B" Extinguishers—For flammable liquid and gas fires, such as oil, gasoline, paint and x1'9 grease where oxygen exclusion of flame interruption is essential. 9 equipment c Class C Extinguishers For fires involving electricalwirin g and where the non-conductivity of the extinguishing agent is crucial. CHG Job Site Specific Safety Plan In all states you also have a responsibility, as an employee, to use that information with sufficient care to protect the safety and health of yourself and those you work with Employee responsibility has been established in numerous prosecutions related to occupational safety all across the U.S. The consequence of misusing chemicals and other hazardous materials are almost always unpredictable. It is a matter of increasing public concern that the potential for harm receives everyone's fullest attention. EXEMPTIONS AND EXCEPTIONS 1) Any matter or product that does not meet the classification of the Controlled Products Regulations. Exemptions and Exceptions(cont'd) 2) Manufactured articles; products mad of wood or tobacco; products packaged for the consumer, hazardous waste; and materials or products governed by federal acts for; Explosives, Food and Drugs; Pest Control Products, and Atomic Energy Control. Dust All dust can be harmful. Even nuisance dusts can cause respiratory and eye irritations if the levels are high enough. Where the dust cannot be controlled using engineering methods, for example, local exhaust ventilation, and approved respirator designed for the specific dust must be worn, Respiratory protective equipment approved by NIOSH bearing a T.C. number is acceptable. If in doubt, ask the supplier or an office of the Board. Asbestos When material containing asbestos is being cut or shaped the dust must be removed by a local ventilation system which discharges the air through a high efficient particulate air filter. (HEPA filter). Portable vacuum cleaners that discharge the air through a HEPA filter are available. Never use a regular vacuum cleaner Never dry sweep the dust. When cleaning up insulating materials that contain asbestos, the same removal procedures must be followed. All waste materials containing asbestos must be placed in impervious bags or similar containers and sealed for transfer to approved disposal sight. Carbon Monoxide Mobile equipment operating in an enclosed area can produce dangerous levels of carbon monoxide. Such areas must be well ventilated to keep the levels below those permitted by OSHA regulations. Oil and gas fueled heaters used on construction sites also produce carbon monoxide. These must have good air supply to burn properly and to remove the carbon monoxide. Carbon monoxide cannot be filtered out of the air breathed using simple air purifying respirators fitted with a chemical absorbing cartridge. Full face piece and canister type respirators must be made available and used by workers, where required. Hydrogen Sulfide Hydrogen Sulfide (H2S) has a rotten egg smell. In low concentration it is above 50ppm or if the concentration is unknown, only a self-contained breathing apparatus must be used. Do not use these in confined spaces without wearing adequate protection, such as respirator fitted with an organic vapor chemical cartridge. Ensure that the space is continuously ventilated with large amounts of fresh clean air. Many of these chemicals enter the bloodstream through lungs causing headache, nausea, dizziness, even unconsciousness. Repeated exposure may have long term effects Some of these chemicals will also harm the skin, and/or enter the body through the skin. Wear gloves or remove the substance from the hands as soon as possible. If there is a danger of splashing into the eyes and/or face, use eye or face protection. Repeated skin contact may cause skin disease or produce allergic reaction. Incentive Program C.H G. Building Systems, Inc. considers the personal well being of each employee a primary factor in creating a positive work environment that is beneficial to all. Needless injuries and deaths occur by the thousands every year and it is hoped that we will not become a part of the grotesque statistics. C.H.G. Building Systems, Inc. has a working incentive program at every job site and/or for every employee. In order to create positive attitudes and actions toward safety, employees will be rewarded according to accident trends. The program will be a planned event on company time. Each employees progress will be reviewed monthly by the Safety Director. All employees will be provided with feedback regarding their status. All employees will be rewarded for success in the program. Rewards will be as often as possible. Discipline Program C.H.G. Building Systems, Inc takes safety violations very serious. Failure to abided by any rule, regulation, or policy set forth by this program or any federal or state agency shall result in disciplinary measures, up to and including termination of employment with C.H.G. Building Systems, Inc. Disciplinary measures shall vary depending upon the severity and/or frequency of the offense(s) DANGEROUS ACTS SHALL NOT BE TOLERATED ON OUR JOB SITES In eneral, violations shall correspond with the following: 1st Offense: Verbal warning 2"d Offense: Receipt of written violation notice. 3'd Offense: Removal from the job site and/or termination of employment. *Acts constituting a serious violation may result in immediate termination. We have tried to cover all of the basics and hopefully given each of you food for thought to incorporate your skills and your knowledge, training and ability to help us make your work environment as safe and pleasant as possible. By working together, we can perform in a safe manner, so as to prevent undue accidents to people, equipment and property. A copy of Material Safety Data Sheets (MSDS's) on hazardous substances used in your work place will be made available to you upon request. You are required to keep this booklet in your possession for ready reference at any time you need to refresh your memory.
