Dear Ben,
Heffron Transportation, Inc. is pleased to continue assisting the City of Kent with its Events Center
project As we have discussed, the original traffic analysis resulted in a requirement that large events
on weeknights(including hockey games) start at 7 30 P M However,now that the Center is open and
traffic issues have not materialized, the City would like to re-evaluate this requirement To that end,
we have prepared a scope of work and budget estimate to evaluate the post-opening traffic conditions,
and determine if a 7 00 P M start for large events would be acceptable
We have reviewed the upcoming schedule,and determined that data should be collected the first
week in March 2009 when there are several hockey games scheduled
Our scope of work and budget estimate are detailed in Attachment A We estimate that this work
would cost approximately $8,900 If the attached scope of work,budget, and standard contract
provisions are acceptable, please sign where indicated below and return this proposal to me We will
need authorization to proceed no later than February 20 in order to commission the required traffic

Proposal for Follow-up Analysis
Scope of Work
The purpose of this analysis is to determine if large events at the ShoWare Center could start at 7 00
P.M on weeknights without creating adverse traffic and parking impacts.
Task 1—Commission 7-day traffic counts We will commission 7-day traffic counts on James Street
adjacent to the ShoWare Center and on the two main driveways that access the ShoWare Center parking
lot These counts will be performed the first week of March 2009 when there are four scheduled home
games, of which one is a Wednesday game that starts at 7 05 P M and another is a Friday night game that
starts at 7 35 P.M. These counts will be compiled to show the net change between a game night and non-
game night on the James Street traffic. The driveway counts will be used to determine the arrival patterns
associated with the various games.
Task 2—Commission intersection count. We will commission an intersection turning movement
count at the intersection of 4ch Avenue/James Street(or another intersection) on Tuesday,March 3'—
the night when there is a 7 05 P M hockey game scheduled We will have this count performed from
4 00 I' M through 8 00 P M and then compile the traffic counts for each of the four hour periods
Task 3—Perform parking counts.We will perform hourly parking counts at the James Street Park-
and-Ride and the RJC on a non-event and an event night to determine whether these lots clear out in
time to provide parking for an earlier starting event.
Task 4—Evaluate traffic operations. Using the multi-hour traffic count collected in Task 2,we will
determine the level of service at that intersection for each hour Using the data from the 7-day counts,
we will also estimate how the conditions might change if the start time was 7 30 instead of 7 05 P M.
Task 5—Interview Kent Police.We will meet with Kent Police responsible for traffic control to
determine how traffic has operated with events This anecdotal information will be summarized for
the report.
Task 6—Document results. We will present the results of the data collection and analysis is a technical
memorandum The City will be given a draft to review before it is finalized

INSURANCE REQUIREMENTS FOR
CONSULTANT SERVICES AGREEMENTS
Insurance
The Contractor shall procure and maintain for the duration of the Agreement, insurance
against claims for injuries to persons or damage to property which may arise from or in
connection with the performance of the work hereunder by the Contractor, their agents,
representatives, employees or subcontractors.
A. Minimum Scope of Insurance
Contractor shall obtain insurance of the types described below:
1. Automobile Liability insurance covering all owned,non-owned, hired
and leased vehicles. Coverage shall be written on Insurance Services
Office (ISO) form CA 00 01 or a substitute form providing equivalent
liability coverage If necessary, the policy shall be endorsed to
provide contractual liability coverage.
2. Commercial General Liability insurance shall be written on ISO
occurrence form CG 00 01 and shall cover liability arising from
premises, operations, independent contractors, products-completed
operations, personal injury and advertising injury, and liability
assumed under an insured contract The Commercial General Liability
insurance shall be endorsed to provide the Aggregate Per Project
Endorsement ISO form CG 25 03 11 85. There shall be no
endorsement or modification of the Commercial General Liability
insurance for liability arising from explosion, collapse or underground
property damage The City shall be named as an insured under the
Contractor's Commercial General Liability insurance policy with
respect to the work performed for the City using ISO additional
insured endorsement CG 20 10 11 85 or a substitute endorsement
providing equivalent coverage
3. Workers' Compensation coverage as required by the Industrial
Insurance laws of the State of Washington.
4. Professional Liability insurance appropriate to the Consultant's
profession.
B. Minimum Amounts of Insurance
Contractor shall maintain the following insurance limits:
1. Automobile Liability insurance with a minimum combined single limit
for bodily injury and property damage of $1,000,000 per accident.
2. Commercial General Liability insurance shall be written with limits no
less than $1,000,000 each occurrence, $2,000,000 general aggregate
and a $1,000,000 products-completed operations aggregate limit.

3 Professional Liability insurance shall be written with limits no less
than $1,000,000 per claim and $1,000,000 policy aggregate limit.
C. Other Insurance Provisions
The insurance policies are to contain, or be endorsed to contain, the following provisions
for Automobile Liability and Commercial General Liability insurance.
1. The Contractor's insurance coverage shall be primary insurance as respect the City.
Any Insurance, self-insurance, or insurance pool coverage maintained by the City
shall be excess of the Contractor's insurance and shall not contribute with it

3. The City of Kent shall be named as an additional insured on all policies (except

and a copy of the endorsement naming the City as additional insured shall be attached
to the Certificate of Insurance. The City reserves the right to receive a certified copy
of all required insurance policies. The Contractor's Commercial General Liability
insurance shall also contain a clause stating that coverage shall apply separately to
each insured against whom claim is made or suit is brought, except with respects to
the limits of the insurer's liability.
D. Acceptability of Insurers
Insurance is to be placed with insurers with a current A.M. Best rating of not less than
A VII.
E. Verification of Coverage
Contractor shall furnish the City with original certificates and a copy of the amendatory
endorsements, including but not necessarily limited to the additional insured
endorsement, evidencing the insurance requirements of the Contractor before
commencement of the work.
F. Subcontractors
Contractor shall include all subcontractors as insureds under its policies or shall furnish
separate certificates and endorsements for each subcontractor. All coverages for
subcontractors shall be subject to all of the same insurance requirements as stated herein
for the Contractor.
