FOR AND IN CONSIDERATION of the delivery of Seventeen Thousand Five Hundred One
Dollars ($17,501 00), receipt of which is hereby acknowledged, the undersigned, authorized
representative of the City of Kent, a Washington municipal corporation("City"),does hereby release
and forever discharge MKB Contractors, Inc ("MKB") from performing corrective work on the East
bound approach slab, located on the East side of the 272°d Street Corridor Bndge("Approach Slab"),
which may have been required due to out of specification construction work known of as of the date
of this agreement, on a City project known as the 2 7 2nd Street Corridor Bridge.
IT IS UNDERSTOOD THAT THIS IS A FULL AND FINAL RELEASE, and full
compromise and settlement of any and all claims for corrective work the City may have against
MKB arising from out of specification construction work on the Approach Slab, which may have
been required due to out of specification construction work known of as of the date of this release.
This agreement specifically releases MKB from performing work necessary to match the adjacent
asphalt with the Approach Slab, when the need to do so is caused by the out of specification
construction work known of as of the date of this release This release does not apply to damages
that may be attributed to factors not linked to the out of specification construction work performed
on the Approach Slab known of as of the date of this release It is further agreed that this is not an
admission of liability on the part of the settling parties, but rather a compromise, the express purpose
of which is to preclude any additional claims and to avoid the uncertainties of claim disputes and
litigation.
THIS RELEASE is being executed after having had an opportunity to consult with an
attorney The undersigned states that this Release has been carefully read and is signed as that
person's free act and deed. This release will become effective on the last date entered below
