The parties agree to the following: 1. Contract Extension. The parties have agreed to rollover all language of the current collective bargaining agreement ("Agreement") and Memoranda of Understanding ("MOU's") except for the items listed below, which shall supersede the current Agreement. The current Agreement will therefore be extended and will expire on December 31, 2009. 2. Wages. Effective January 1, 2009, members of the bargaining unit will receive two and eight-tenth of one percent (2.8%) for the Cost of Living Adjustment ("COLA"). Effective July 1, 2009, members of the bargaining unit will receive an amount equivalent to the remainder of five and six-tenth of one percent (5.60/o), which is approximately two and seventy two one hundredth of one percent (2.720/o), for COLA for 2009 in addition to the two and eight-tenth of one percent (2.8%) received on January 1, 2009. 3. Negotiation for Successor Agreement. In March 2009, the parties agree to commence negotiation for a successor Agreement. 4. Recruitment and Retention. During the life of this Agreement, through December 31, 2009, the parties agree to continue reviewing wage adjustments necessary to address recruitment and retention issues for bargaining unit positions. 5. "Me Too for Wages. If any other non-public safety employee group, i.e. AFSCME or non-represented, receive a more favorable economic package for the 2009 calendar year, such favorable conditions shall apply in the same fashion to this bargaining unit. 6. Alternative Work Schedule. The parties agree that members of the bargaining unit shall have access to the nine-eighty's (9/80's) work schedule if the majority of the work group elects this option. This means the Parks Department employees shall continue their 9/80's schedule. Members working in the Public Works Department, except those work units who wish to be exempted from this schedule, shall change to a 9/80's work schedule starting on December 29, 2008. These alternative work schedules will remain in effect for the remainder of this Agreement unless they are modified by mutual agreement between the City and the Union through Joint Labor/Management Committee. With fourteen (14) calendar days' written notice, the City reserves its right to revert back to the normal five-eight's (5/8's) work schedule if issues of safety or departmental operating need arise to justify such change. It is understood that the parties will revisit this issue during the negotiation of the successor Agreement. 7. Personal Day Off. Regular full time employees of the bargaining unit shall receive one (1) eight-hour day off with pay. Regular part-time employees of the bargaining unit shall receive the equivalent one (1) day off with pay that is pro-rated based on the employee's budgeted percentage of a full time position. This day off with pay shall be separate from the vacation, sick leave, or holiday leave currently contained in the Agreement. This day off with pay shall have no cash value and must be used within the 2009 calendar year. Scheduling of this day off shall be subject to management approval to ensure that there will be no increase in overtime, no additional cost to the City, and no impact to the work unit's level of service. There shall be no carry over of the unused day off or any portion thereof unless unforeseeable events or the inability to maintain adequate staffing precludes the employee from taking the time off. Such carry over exceptions shall be reviewed and approved by the Employee Services Director on a non-precedent setting case-by-case basis, as is currently the practice for excess vacation accrual.
