HomeMy WebLinkAboutES06-016 - Other - AFSCME 2006-2008 Labor Agreement - 01/12/2009 - MOU - 1 Year Extension of the 2006-2008 Labor Agreement MEMORANDUM OF UNDERSTANDING By And Between THE CITY OF KENT And WASHINGTON STATE COUNCIL OF COUNTY AND CITY EMPLOYEES, AFSCME, AFL-CIO, Local #2617 This Memorandum of Understanding (hereafter referred to as the "Agreement") memorializes the agreement between the City of Kent ("City") and Washington State Council of County and City Employees, AFSCME Local #2617 ("Union"). This Agreement was ratified by the union membership on December 30, 2008 and approved by the City Council on January 6, 2009. This MOU shall supplement the current 2006-2008 collective bargaining agreement ("CBA") and become part of the CBA by this reference. The parties agree to the following with regard to extension of the current CBA for 2009: 1. CBA Extension: Extend the current CBA and all Memoranda of Understanding ("MOU's") in effect except for the items listed below, which shall supersede the current CBA and MOU's. The current CBA and MOU's will therefore be extended and will expire on December 31, 2009. 2. Successor CBA: The parties agree to continue to negotiate for a successor CBA, and to carry forth any tentative agreements between the parties not included herein toward the 2010 successor CBA. 3. Wages: Effective January 1, 2009, members of the bargaining unit will receive 2.8% for Cost of Living Adjustment ("COLA"). Effective July 1, 2009, members of the bargaining unit will receive an amount equivalent to the remainder of 5.6% (approximately 2.72%) for COLA for 2009 in addition to the 2.8% previously received on January 1, 2009. 4. Day Off with Pay: For the 2009 calendar year, regular full time employees of the bargaining unit shall receive one (1) eight-hour day off with pay. Regular part-time employees of the bargaining unit shall receive the equivalent one (1) day off with pay that is pro-rated based on the employee's budgeted percentage of a full time position. This day off with pay shall be separate from the vacation, sick leave, or holiday leave currently contained In the CBA. This day off with pay shall have no cash value and must be used within the 2009 calendar year. Scheduling of this day off shall be subject to management approval to ensure that there will be no increase in overtime, no additional cost to the City, and no significant impact to the work unit's level of service. Vacation leave request and approval procedures shall apply to the request and use of this day off. There shall be no carry over of the unused day off or any portion thereof unless management denies the use of such based on unforeseeable events or the inability to maintain adequate staffing.
