WHEREAS: The Owner desires to enter into a contract with the Artist to develop a proposal for artwork for the following project: Bayer Earthworks Celebration, Kent, Washington The Work under this Agreement is to design, develop, complete and present to the Owner on the following: 1) A site-specific performance for the 25'Anniversary of the Herbert Bayer Earthworks at Mill Creek Canyon on September 8, 2007, as described in Attachment A. The Artist hereby agrees to enter into a contract for the commissioning of the artwork, including design, fabrication., transportation, installation, documentation,ptablic notice and payment of all Washington sales or use taxes in a timely manner. COMPENSATION. The City shall pay Contractor the total sum of$6,000 flat for the work to be performed under this Agreement, upon satisfactory completion of all services and requirements specified in this Agreement. A 15% deposit of $900.00 will be paid, by City of Kent check, within 15 day s of complete execution of this contract. An additional 35% payment of$2,100 will be paid, by City of Kent check, to the Artist on August 1, 2007.The balance will be paid within 15 days of the September 8 Celebration. The Agreement constitutes the entire Agreement between the parties and may be amended only if in writing and signed by both parties. (253) 856-6050 (facsimile) Attachment A: Description of Proposed Performance for Bayer Earthworks Celebration Live Contemporary Dance Performance Choreography by Alex Martin Accompanied by Live Music (traditional percussion and found instruments) Music by Mike Bayer Two performances to be held on Saturday, September 8, 2007 ■ A celebration of the beautiful design and simple forms of the Earthworks, through movement phrases and spatial patterns that draw the eye into the ground and into the relationship between earth, water, and sky --- ■ Simple images reflecting a basic human narrative: shelter - storm - flood - rebuilding ■ While following the performance, audience members will be guided through the land to create a journey in space as well as in time ■ As with all of my works, a keen attention to movement detail and technique in performance will dovetail with a sense of purpose and a sense of play ■ The performers will enact a fully engaged interaction with the physical environment— borrowing at times the attitude of parkour(free running) outdoor sport techniques ■ Live music (percussion) will underscore the rhythms of the work • Audience members, in addition to visiting, viewing, and hearing the work, will be lead into their own gentle interaction with the landscape and the materials and instruments of the performance ■ Audience members will be invited to contribute to the performance
