This Amendment is made between the City and the above-referenced Consultant or Vendor and amends
the original Agreement and all prior Amendments. All other provisions of the original Agreement or prior
Amendments not inconsistent with this Amendment shall remain in full force and effect. For valuable
consideration and by mutual consent of the parties, Consultant or Vendor's work is modified as follows:
1. Section I of the Agreement, entitled "Description of Work," is hereby modified to add additional
work or revise existing work as follows:
In addition to work required under the original Agreement and any prior
Amendments,the Consultant or Vendor shall:
Perform Special Inspections for Smoke Control System Acceptance Testing at the Kent Events
Center in accordance with the attached Exhibit A.
2. The contract amount and time for performance provisions of Section II "Time of Completion,"
and Section III, "Compensation," are modified as follows:

In accordance with Section VII of the Agreement, the Consultant or Vendor accepts all requirements of
this Amendment by signing below, by its signature waives any protest or claim it may have regarding this
Amendment, and acknowledges and accepts that this Amendment constitutes full payment and final settlement
of all claims of any kind or nature arising from or connected with any work either covered or affected by this
Amendment, including, without limitation, claims related to contract time, contract acceleration, onsite or home
office overhead, or lost profits. This Amendment, unless otherwise provided, does not relieve the Consultant or
Vendor from strict compliance with the guarantee and warranty provisions of the original Agreement.
All acts consistent with the authority of the Agreement, previous Amendments (if any), and this
Amendment, prior to the effective date of this Amendment, are hereby ratified and affirmed, and the terms of
the Agreement, previous Amendments(if any), and this Amendment shall be deemed to have applied.
The parties whose names appear below swear under penalty of perjury that they are authorized to enter
into this Amendment,which is binding on the parties of this contract.

EXHIBIT A: SCOPE OF WORK AND FEE PROPOSAL
SCOPE OF WORK FOR AMENDMENT NO. 1
SMOKE CONTROL SPECIAL INSPECTIONS
1. Develop a Draft Smoke Control Testing Program report identifying the test procedures and
methods to be used,and the items subject to inspections and testing, in accordance with IBC
Section 909.3. This document will be provided in electronic format,intended for internal project
team review and coordination, and will be finalized upon receipt of comments.
2. Review submittal documentation on hardware and installation of the smoke control elements.
3. Prepare a final Smoke Control Testing Program for submittal to the City of Kent AHJ. This report
may be revised one(1)time based on comments received from the City of Kent AHJ.
4. Participate in up to two(2)meetings in Kent to discuss the special inspection process and
schedule.EEI will review meeting minutes,prepared by others.
5. Attend up to three(3)days on-site to perform system testing.We anticipate the following
schedule:
• Day 1:Observe installation and operation of smoke control system mechanical
equipment,including fans and dampers,in accordance with IBC Sections 909.10.4,
909.10.5,909.18.2 and 909.18.5. Witness the components action and response to include
dampers,fans,duct traverse air flows,fan voltage,RPM,fan motor amps. IBC Section
909.18.7 requires testing by each initiating device to put the system into operation. The
general contractor shall coordinate all the pre-testing,and multiple subcontractors and
suppliers involvement prior to scheduling the final witness testing.
• Day 2: Witness data collection by air balance contractor with regard to airflow quantities
and velocities in accordance with IBC Sections 909.8.1 and 909.18.2.
• Day 3: Observe operation of the smoke control system through each fire alarm control
sequence in accordance with IBC Sections 909.12 and 909.18.7. These visits will include
inspecting and observing the function of equipment installed and operated by others,and
witnessing airflow measurements acquired by a certified air balancer,hired by others.
This schedule anticipates that the system has been balanced and completed a successful
pre-test,and excludes any re-testing.
6. Prepare one(1)daily inspection summary for each day,describing the system elements evaluated.
In addition, a nonconforming features summary will be prepared where the system or specific
elements were observed to fail to operate in accordance with the design parameters. It is
anticipated that these summaries will be maintained in a folder at the jobsite with the approved
smoke control design report and smoke control system testing program.
7. Prepare a final report summarizing the results of our special inspection.This report will be signed
and sealed by the architect of record,mechanical engineer-of-record,and electrical engineer of
record in accordance with IBC Section 909.18.8.3.Up to three(3)bound copies of this report will
be provided,upon request.
