^ KENT CITY ART PROGRAM AGREEMENT
The Agreement dated June 12, 2007, between the City of Kent, hereinafter referred to as
"Owner" and Brice Maryman, located and doing business at 6705 35th Place South, Seattle,
Washington 98118, hereinafter referred to as "Artist".
WHEREAS: The Owner desires to enter into a contract with the Artist to develop a proposal for
artwork for the following project:
Bayer Earthworks Celebration, Kent, Washington
The Work under this Agreement is to design, develop, complete and present to the Owner on
the following:
1) Cornucopia Days Participation, July 11, 13, 14, 15 2007 as described in Attachment A.
2) Installation Chromatic Levy, September 8, 2007 as shown and described in Attachment
B.
3) Event Insurance as described in Attachment C.
4) Artist may choose to work with community to install and deinstall artwork, but artwork
must be completely removed by sundown September 9, or before if damaged.
5) Fabric used in artwork installation will be delivered to quilters for donation to children
impacted by Hurricane Katrina.
The Artist hereby agrees to enter into a contract for the commissioning of the artwork, including
design, fabrication, transportation, installation, documentation, public notice and payment of all
Washington sales or use taxes in a timely manner.
COMPENSATION. The City shall pay Contractor the total sum of$6,000 flat for the work to be performed
under this Agreement, upon satisfactory completion of all services and requirements specified in this
Agreement. A 15% deposit of $900.00 will be paid, by City of Kent check, within 15 day s of complete
execution of this contract. An additional 35% payment of$2,100 will be paid, by City of Kent check, to the
Artist upon completion of the Cornucopia Days participation project.The balance will be paid within 15 days of
the September 8 Celebration.
The Agreement constitutes the entire Agreement between the parties and may be amended
only if in writing and signed by both parties.

the last date entered below.

Description of Services for Cornucopia Day Events
For the Kent Cornucopia Day celebrations (July 11, 13, 14, 15 2007), the Artist agrees to
facilitate the following services in execution of the contract.
• Hiring of sewing sub-consultant to participate in crafting of"sandbags" by the
public, similar to the sewing of bean bags during similar City of Kent sponsored
events;
• Cutting and marking of fabric to use by community participants in the sewing of
sandbags;
• Provision of renderings and images to demonstrate the intent of the artists vision;
• Responsibility for recruiting and scheduling volunteers for sewing;
• Assist in marketing of Cornucopia Days event; and
• Acquisition of materials for sewing materials
Attachment B
Description of Services for Installation of the Chromatic Levy on September 8, 2007
On September 8, 2007, the Artist agrees to perform the following services in execution
of the contract in order to create an installation in celebration of Herbert Bayer's
Earthworks.
• Conceptualization and construction of Chromatic Levy, an art installation within
the Mill Creek Canyon Park land within the City of Kent;
• Provision of security for the artwork; and
• Photographing of the piece for future marketing purposes.
