This is in reply t� letter of January 8 about the land in Kent
under lease No. NP 16953,, from Burlington Northern to the City of
Kent.
I enclose a copy of the latest supplement to the lease and a map
on which hatching indicates the land now under lease. That land
might otherwise be described as follows:
That portion of the SEkN Ek of Section 24, Township 22
North, Range 4 East, W.M. , in the City of Kent, King
County, State of Washington, lying east of First Avenue
South, south of West Meeker S reet, north of West Cowe
Street and west of a line parallel with and distant 10
feet west, measured at right angles, from the center
line of the westerly main track of Burlington Northern
Inc.
Also, that portion of said SEbiEk, in said City, lying
east of First Avenue South, north of West Meeker Street,
west of a line parallel with and distant 10 feet west,
measured at right angles, from said center line and
south of a line parallel with and distant 10 feet south.
easterly, measured at right angles, from the center line
of the first track which crosses First avenue North north
of West Meeker Street; except any portion within 10 feet
from the center line of the side track as now constructed
west of said main track.
Burlington Northernls west property ,line is approximately 55 feet
east of First Avenue South between West Gowe Street and West Titus
Street. I dontt know who owns the land at the northeast corner of
First and Titus.

Gentlemen:
Your attention is directed to the rate of rental which you pay for
premises occupied under Lease No. (HP) 16953 at Kent, Washington.
The rental no longer reflects a fair return on market value of the
leased property and considering present day values, the rental must be
increased to $5 per month, payable annually.
Lease No. (NP) 16953 is thus hereby supplemented to provide that
effective May 1, 1980, the rental shall be $5 per month, payable annually
in advance and future billing will reflect this change. Specifying a
rental rate on a monthly or annual basis and payment thereof in advance
does not imply nor will it serve to convert said lease to a definite
term.
It has also been determined that the rate of return on special assess-
ments specified in said lease is no longer adequate and, therefore, in
the event of future special assessments the rental herein stipulated to
be paid shall be automatically increased by an amount equal to twelve
percent (12%) per annum on the total amount of the assessment chargeable
against the demised premises.
This letter will serve as a supplement to Lease No. (NP) 16953 which will
continue in effect in accordance with its terms except as hereby
supplemented and amended.

Gentlemen:
Your attention is directed to the rate of rental which you pay for
premises occupied under lease No. (NP) 16953, at Kent, WA.
In view of the economic changes which have occurred during the
past several years, the rental in said lease no longer reflects an
adequate return on the value of the property occupied under said
lease.
Considering present day values, the current money market and
other related factors, we have concluded that the rental for the
subject property must be increased to $30 per year, payable
annually in advance.
Lease No. (NP) 16953 is thus hereby supplemented to provide that
effective May 1, 1977, the rental shall be $30 per year, payable
annually in advance and future billing will reflect this change.
Specifying a rental rate on a monthly or annual basis and payment
thereof in advance does not imply nor will it serve to convert said
lease to a definite term.

SUBJECT: NP Lease 16953
While checking the Burlington Northern Lease #NP 16953 ,
it was discovered that payment had not been made on the
lease since April 1956 . The lease requires five
dollars for each five year period payable in advance.
The payment in 1956 paid the lease through April 1961 .
On February 6 , 1974 purchase/order #17392 was written
to Burlington Northern for $15 . 00 to pay the lease
through April 1976 . On March 8 , 1974 they refunded
$10 . 00 of this amount to the City of Kent. A telephone
call was placed to Mr . Jim Gordon of Burlington Northern—
He returned the call today, stating that we should keep
the check. The file has been lost in Saint Paul , Minn-
estoa office , and their computer shows that we are paid
through April 1976 . He stated it would be cheaper for
them if we just kept the check. They will bill us in
1976 for the next five year period.
The check is being deposited today to the credit of
account 105-533-100-392 .

relative to the Town of Kent desiring to construct a
small stone block building about 81 x 81 x 16► on the
west end of the parking strip civered by lease No.
16953 in their favor.
The Railway Company has no objections to
the construction of a block building at the proposed
location, providing, however, that it is understood
that it is for an indefinite term only. We do not
want to give the Town the impression that this is a
permanent structure as we may desire to use the
premises covered by said lease for other purposes.

line of 1st.Avenue, North.
Will you please have the enclosed supplement
signed by the proper officer of the Town of
Kent in the presence of witnesses and return
it to this office for completion by the Rail-
way Company. This will permit us to grant
the Power & Light Company authority to place
this pole.

Dear Sir:
Referring to lease No. 16953 in favor of the Town
of Dent, covering portions of our right of way at Kent, Wash-
ington, which lease was issued to the Town May 1, 1906 for
the purpose of maintaining a park thereon.
We have recently received an application from one of
our shippers to use that portion of the premises now included
in your lease which lies north of our so-called "Oliver Spur„,
that is, which lies north of the most southerly spur track
across the leased premises.
The Town now maintains a park on the right of way be-
tween Gowe Street and meeker Avenue, upon which you have the
band stand and also between Meeker Street and the above men-
tioned spur track.
The area north of this spur track has never been de-
veloped by the town and this is the area we wish to eliminate
from your lease. To accomplish this we enclose herewith form
of supplement. Will you please have both copies executed as
indicated and returned to this office for completion.
