This Memorandum of Understanding (MOU) memorializes the agreement between
the City of Kent ("City") and AFSCME Local #2617 ("Union") in Labor/Management
regarding e ee e ardin Terri N 's Leave of Absence.
• Terri Nee was on a medical leave of absence due to a medical condition.
Her medical leave of absence expired on March 10, 2008. She used
accrued leave as needed during her medical leave of absence.
• Effective March 10, 2008, Ms. Nee was placed on a conditional general
leave of absence pending the parties' agreement, which has subsequently
been reached as follows:
1. Due to the extenuating circumstances of her leave status and
medical condition, the parties have agreed to allow Ms. Nee to
continue to be on a general leave of absence through September
10, 2008 in accordance with City policies and procedures.
2. During her general leave of absence, she is anticipated to exhaust
all her accrued leave. The parties have agreed to allow Ms. Nee to
be eligible for and use shared leave. This use of share leave during
a general leave of absence is an exception to current policies and
procedures per this MOU and shall not set a precedent on either
party for future similar or dissimilar situations.
3. In addition, the time line for the use of temporary employees, as
defined in Section 1.3 - Temporary Employees of the labor
agreement, is extended for Michelle L. Coty, or any temporary
hired by the Fire Chief to backfill for Ms. Nee, to September 10,
2008 or the date Ms. Nee returns to work from her general leave of
absence.
This agreement shall not be interpreted to create a past practice nor shall it be
interpreted as creating a pattern of action on the part of the City.
By signature below, the parties agree that the above represents the parties' full and
entire agreement with regard to these matters.
