Kent, WA 98032-5895 Subject: Proposed Supplemental Agreement for Additional Contaminated Soil Assistance,N.2nd Ave. & Smith St. Dear Mr. Brooks: Geomatrix Consultants, Inc. (Geomatrix)proposes to amend our existing scope of work under the Consultant Services Agreement (PO #56438) to assist the City of Kent(the City) with environmental compliance issues at City property on the SW corner of North 2nd Avenue and Smith Street. The proposed amendment is based on our understanding that an additional 5 cubic yards of suspected contaminated soil has been excavated in the course of installing Puget Sound Energy utilities to the new Town Square Plaza site. The soil has been stockpiled on and covered by plastic to prevent migration of contaminants. We will refer to this as the third stockpile. Scope of Work: The following tasks will be completed by Geomatrix under this scope of work: 1. Collected a sample of the third stockpile for characterization of gasoline and diesel contamination, volatile organic compounds, and polychlonnated biphenyls (PCBs). Geomatrix will have the samples analyzed at the Analytical Resources, Incorporated (ARI) laboratory on a standard(14-day) turnaround basis. 2. Communicate the results of the analyses to the City and Waste Management, Inc. (WMI)for a waste profile by WMI. Geomatnx will contract with WMI to haul the soil for disposal (depending on the Waste Profile assigned by WMI,this may be to the Alaska Street transfer station in Seattle, for ultimate disposal of the soil at a Subtitle D landfill). If WMI concludes that the soil is compatible with the existing waste profile for the first stockpile, then Geomatrix will ensure that WMI hauls and disposes of the stockpile at the same time as the first stockpile. If the soil is not compatible with the first stockpile, a minimum 30-ton hauling/disposal charge by WMI will apply. The City of Kent will be responsible for loading the soil onto the WMI trucks at a mutually-agreeable time. 3. Geomatrix will incorporate the third stockpile information into the brief environmental report covering the sampling of both stockpiles, analytical results, and final disposition of the contaminated soil and submit one copy each, to the City and the Washington State Department of Ecology. One Union Square,600 University Street.Suite 1020 Tel 206 342 1760 w geomatnx com Seattle.Washington 98101-4107 Fax 206 342 1761 Mr. Perry Brooks Geomatrix August 23 2007 Page 2 of 2 City of Kent Responsibilities: For the purposes of this proposal, scope of work, and budget, we assume that: • All necessary permits are in place and the City will transfer the permits to Geomatrix, as needed; • The City will manage the actions of other contractors involved in the pile disposal, and any traffic control planning and implementation on this project; and • The City will issue all necessary notifications (e.g. water service shut down) and coordinate all necessary activities with other parties Schedule: To expedite the soil removal, Geomatrix will sample the third stockpile on Friday, August 24, 2007, based on verbal authorization from the City. We will await formal approval of this amendment to the scope of work before proceeding further. The final report will be completed within 3 weeks of receiving final analytical results, and weight tickets from WMI regarding the final amount of soil disposed at the disposal facility. Budget Estimate: Our estimated additional budget to complete this work will not exceed $4,423.00, as detailed in the enclosed Attachment 2. This budget includes the contingency that the third stockpile must be removed in a separate trip by WMI (under a minimum 30-ton charge, approximately$2075); if it does not, then the third stockpile may be compatibly removed by WMI along with the first stockpile in one trip, at approximately$700 additional hauling/disposal cost. We will not exceed this budget without the City of Kent's prior authorization. Any changes, new finds, or other factors outside our scope of work or conditions that may increase the cost above the proposed budget will be brought to the attention of the City. We will invoice based on time and materials in accordance with the attached Schedule of Charges and Conditions (Attachment 3) and our pending standard consultant Agreement.
