This Change Order amends the above-referenced contract; all other provisions of the contract that are
not inconsistent with this Change Order shall remain in effect. For valuable consideration and by mutual
consent of the parties, the project contract is modified as follows-
1. Section I of the Agreement, entitled "Description of Work," is hereby modified as follows•
Provide all labor,materials, and equipment necessary to:
Provide bidding and construction administration phases of work for the West
Fenwick Park Improvement project as described on the Consultant's proposal
dated February 16,2007 attached and incorporated as Exhibit A.
2. The contract amount and time for performance provisions of Section 11 "Compensation," and
Section III, "Time for Completion," are hereby modified as follows-

including applicable alternates and WSST.

Pursuant to Section XIII, entitled "Modifications," of the Contract executed by the parties, the
Contractor accepts all requirements of this Change Order by signing below. Also, pursuant to the above-
referenced contract, Contractor agrees to waive any protest it may have regarding this Change Order and
acknowledges and accepts that this Change Order constitutes final settlement of all claims of any kind or nature
arising from or connected with any work either covered or affected by this Change Order, including, without
limitation, claims related to contract time, contract acceleration, onsite or home office overhead,or lost profits.
The parties whose names appear below swear under penalty of perjury that they are authorized to enter
into this contract modification, which is binding on the parties of this contract
3. The Contractor will adjust the amount of its performance bond (if any) for this project to be
consistent with the revised contract sum shown in section 2, above.
IN WITNESS, the parties below have executed this Agreement,which will become effective on the
last date written below.

Dear Perry,
Per our discussion,we have prepared the following contract amendment proposal for the West Fenwick
Park project Listed below are the additional tasks and fees associated with the bidding and construction
administration phases of work
Additional Work Items
1- Assist the City during the Bidding Phase with answers to Contractor questions and Addendum
Items Assist the City with review of the Contractor Bids Maximum allowed time 4 hours
2- Attend one Pre-Construction Conference 4 hours
3- Conduct Site Observation Visits during the construction period to review Contractors work and
provide recommendations to the City Provide written Site Observation report for each site visit
Maximum allowed time 45 hours
4- Assist the City in the review of Requests for Information, Substitution Requests, Change
Proposals, and Application for Payment Max allowed time 20 hours
5- Assist the City with punch lists and project closeout Max allowed time 4 hours _
Fee
Bidding and Construction Administration Services will be provided on a Time and Materials not to
Exceed Basis of$9,856 00
