ORIGINAL CONTRACT DATE: July 11, 2005
This Change Order amends the above-referenced contract; all other provisions of the contract that are
not inconsistent with this Change Order shall remain in effect For valuable consideration and by mutual
consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled "Description of Work,"is hereby modified as follows-
Consultant to prepare an Engineer's Opinion of Probable Construction
Cost for the short stairs at Mill Creek Canyon Earthworks Park in Kent as
described in the Consultant's proposal dated 1/11/07 attached and
incorporated as Exhibit A.
2. The c ontract amount and time for p erfonnance p rovisions o f S ection II"Compensation,"and
Section 11I, "Time for Completion," are hereby modified as follows:
Original Contract Sum, $3,000.00
including applicable alternates and WSST.

arising from or connected with any work either covered or affected by this Change Order, including, without
limitation, claims related to contract time, contract acceleration, onsrte or home office overhead, or lost profits.

1. Client has requested ENGINEERto perform additional services. ENGINEER shall provide Engineer's Opinion

A3172-Final Design for Stair#1 —Short Stairs. COST PLUS to Maximum Fee $650.00
The ENGINEER shall prepare an Engineer's Opinion of Probable Construction Cost. $650 00
ENGINEER's opinions of probable Construction Cost are to be made on the basis of
ENGINEER's experience and qualifications and represent ENGINEER's bestjudgment as an
experienced and qualified professional engineer generally familiar with the construction industry.
However,since ENGINEER has no control over the cost of labor,materials,equipment or
services furnished by others,or over Contractor's methods of determining prices,or over
competitive bidding or market conditions,ENGINEER cannot and does not guarantee that
proposals,bids or actual Construction Cost will not vary from opinions of probable Construction
Cost prepared by ENGINEER. If OWNER wishes greater assurance as to probable Construction
Cost,OWNER shall employ an independent cost estimator.
Completion Schedule.On or about January 12,2007.
