THIS SUPPLEMENTAL AGREEMENT, is made and entered into this .¢ day of
av,6 1 2006, between the STATE OF WASHINGTON, Department of Transportation,
acting by and through the Secretary of Transportation (hereinafter called the STATE), and the
CITY OF KENT (hereinafter called the CITY).
WHEREAS, the parties hereto entered into AGREEMENT GCA 4205 on January 3, 2005,
whereby the CITY agreed to include STATE funded work in the CITY's improvement project on
SR 516 as described in the AGREEMENT, and
WHEREAS, unforeseen conditions resulted in increased costs for the work, exceeding the
AGREEMENT estimate by more than 25 percent, and
WHEREAS, Section IV of the AGREEMENT requires a supplemental AGREEMENT to cover
increases in cost over 25 percent, and
NOW, THEREFORE, by virtue of RCW 47.28 140 and in consideration of the terms, conditions,
covenants and performances contained herein, or attached and incorporated and made a part
hereof,
IT IS MUTUALLY AGREED AS FOLLOWS:
The STATE shall provide an additional $5,786.24 to cover project cost increases, originally
estimated at $11,797.20 in Exhibit"A" to GCA 4205, now amended to by this
SUPPLEMENTAL AGREEMENT to a total AGREEMENT amount of$17,583.44.
All other terms and conditions of the original AGREEMENT shall remain in full force and effect
except as modified by this SUPPLEMENTAL AGREEMENT.
