This Change Order amends the above-referenced contract; A other provisions of the contract that are
not inconsistent with this Change Order shall remain in effect, For valuable consideration and by mutual
consent of the parties, the project contract is modified as follows:
1. Section I of the Agreement, entitled"Description of Work," is hereby modified as follows:
Provide all labor, materials, and equipment necessary to:
1. Incorporate add alternates 2 & 3 into contract. Scope of work described in fax
dated 11/29/05 and is attached.
2. Build short one foot high brick wall around downspouts.
3. Reinforce planter wall using rebar and welded wire mesh combination plus
compacted crushed rock.
2. The contract amount and time for performance provisions of Section II "Compensation," and
Section III, "Time for Completion," are hereby modified as follows:
Original Contract Sum, $424,267.78
including applicable alternates and WSST.

all requirements of this Change Order by signing below. Also, pursuant to the above-referenced contract,
Contractor agrees to waive any protest it may have regarding this Change Order and acknowledges and accepts
that this Change Order constitutes final settlement of all claims of any kind or nature arising from or connected
with any work either covered or affected by this Change Order, including, without limitation, claims related to
contract time, contract acceleration, onsite or home office overhead, or lost profits
The parties whose names appear below swear under penalty of perjury that they are authorized to enter
into this contract modification, which is binding on the parties of this contract.
3. The Contractor will adjust the amount of its performance bond (if any) for this project to be
consistent with the revised contract sum shown in section 2, above.

Thank you for meeting with me this morning to discuss possible changes to the scope of work required
in Altemates 2&3 We will perform the work that we discussed for a total price of$63,000.00 plus tax.
Our understanding of the scope of work is to
1. Delete all electncal related work in Alt 2&3
2 Delete the majority of paving in Alt. 2 & 3 We would be required to install A/C ramps at the new
walkway, patches along the curbs, two parking lot infills and the handicap parking stall near the
police station,
3 Only minor irrigation modifications would be required to use the existing system in the parking area
and to modify the system around the new parking garage entrance.
4 Concrete curbs would be installed to match existing planters and extruded curbs can be installed at
the larger planter location
After reviewing this scope of work closer and knowng that the holiday season is upon us we would
require that the parking lot be shut down for 6 weeks Please let us know if this revised proposal is
acceptable
