HomeMy WebLinkAboutILA1974-008 - Original - Water District No. 111 - Rask Water Service Area - 09/20/1974 CITY CLERK SEP 2 7 J914 AN AGREEMENT BETWEEN WATER DISTRICT NO. 111 AND DENT FOR PROVIDING WATER SERVICE TO AN AREA DESCRIBED AS THE EDWALL RASK WATER SERVICE AREA, AN UNPLATTED AREA IN KING COUNTY,WASIIINGTON. WHEREAS, an unplatted area of King County, Washington, known for the purposes of this Agreement as EDWALL RASK WATER SER- VICE AREA, requires an adequate water supply to assure its orderly development, and WHEREAS, the area is Within the City's franchise area and the City's Comprehensive Water Plan contemplates that the City will serve the area with water, and WHEREAS, the City does not presently have the capacity to provide an adequate supply of water to the area from its exist- ing system, and WHEREAS, the District has the present capability to serve the area with water, NOW, THEREFORE, the City and the District here- by agree as follows : 1. The District shall temporarily serve the area known for the purposes of this Agreement as the EDWALL BASK WATER SERVICE AREA, described as: The southwest quarter of the northwest quarter of the southwest quarter; AND the south half of the southeast quarter of the northeast quarter of the south- west quarter; AND the northeast quarter of the southeast quarter of the north- east quarter of the southwest quarter; AND ALSO the north half of the north half of the southeast quarter of the southwest quarter, all in Section 33, Township 22 North, Range 5 E.W.M. , King County, Washington. with an adequate supply of water for domestic purposes. -1- 2. The District shall negotiate with the Developer of the area as if the area were within its franchise area, and shall be solely responsible for all de- tails of development including main extensions and taater Teeters . In the event that upon termination of this Agree- ment the District has any unamortized costs or expenses, directly related to its performance of this Agreement, the City shall reimburse the Dis- trict for said costs or expenses. 4. At such time as the City is able to provide ads- quat" water service to the area, the City shall give at least sixty (60) days advance notice to the District of its intent to serve the area after which time this Agreement shall terminate. 5. Upon termination of the Agreement, the City shall assume responsibility for maintenance of those portions of the system that are within its fran- chise area. The District will provide all necessary customer data to tie City so tnat the City will be able to assume the responsibility of billing and collecting for the water service.
