Home My WebLink AboutCAG2001-0424 - Amendment - #1 - Kent-Meridan Disposal Company - Solid Waste Collection & Disposal, Recycling & Processing - 03/01/2002 FIRST AMENDMENT TO SOLID WASTE COLLECTION AND DISPOSAL, RECYCLING AND PROCESSING CONTRACT (Kent-Meridian Disposal Company) THIS FIRST AMENDMENT TO SOLID WASTE COLLECTION AND DISPOSAL, RECYCLING AND PROCESSING CONTRACT is made between the CITY OF KENT, a Washington municipal corporation ("City"), and KENT-MERIDIAN DISPOSAL COMPANY, a Washington general partnership whose partners include Fiorito Enterpnses, Inc , a Washington corporation, and Rabanco Companies, a Washington general partnership ("Contractor") WITNESSETH: WHEREAS, City and Contractor entered into that certain Solid Waste Collection and Disposal, Recycling and Processing Contract, dated February 15, 2001, ("Contract') wherein the Contractor agreed to provide solid waste collection and recycling services, including processing and distribution of recyclable matenals to end markets, WHEREAS, City and Contractor express their mutual intent and desire to amend the Contract in order to adjust the roll-out charge the Contractor may charge commercial customers, NOW THEREFORE, in consideration of the mutual intent, desire and promises of the parties and other good and valuable consideration, City and Contractor agree as follows 1 Appendix "C" to the Contract is hereby amended to reduce the roll-out rate chargeable to Commercial customers from $38 05 per month to a flat fee of$20 00 per month, effective March 1, 2002 A revised Appendix "C" is attached and shall be incorporated into the Contract, as if originally set forth therein 2 Contractor certifies to City that the Contract is in full force and effect and that there exist no uncured defaults on the part of the Contractor under the Contract The City certifies to Contractor that the Contract is in full force and effect, that there exist no uncured defaults on the part of the City under the Contract 3 Except as specifically amended, all remaining provisions of the Contract shall remain in full force and effect FIRST AMENDMENT TO SOLID WASTE COLLECTION AND DISPOSAL, RECYCLING AND PROCESSING CONTRACT-1 (Kent Meridian Disposal Company—February 14,2002) 4 The effective date of this First Amendment is March 1, 2002.
