Inc., d1h1a Tetra Tech✓KCM. Inc. on December 16, 1999 and as modified on July 26, 2000 for Contract Modification #L All provisions in the Contract shall remain in full force and effect except as expressly modified by this document Whereas an additional task to address future agency comments was requested by the City of Kent, KCM, Inc, d/b/a Tetra Tech/KCM, Inc., desires to modify the contract as further described in the attached Scope of Work For valuable consideration and by mutual consent of the parties, the modifications to the Contract are as follows I. Section I. Description of Work is modified as follows See Amended Scope of Work, dated February 4, 2002 and attached as Addendum No 2 Section II. Payment , is modified as follows The original contract amount was Seventy Two Thousand Three Hundred and Ten Dollars ($72,310.00} The current contract amount, including all previous amendments is Ninety Five Thousand Nine Hundred Twenty Two Dollars ($95,922.00). The City shall pay the Consultant for the additional work described above, based on time and materials, an amount not to exceed Seventeen Thousand Two Hundred Twenty Three Dollars ($17,223.00) for a total amended contract amount of One Hundred Thirteen Thousand One Hundred Fortv Five Dollars ($113,145.00), including this Contract Modification Section III. Duration of Work , is modified as follows The Consultant shall complete the work described in this Contract Modification Agreement by December 31, 2002 Section IV. MERIDIAN VALLEY CREEK IMPROVEMENTS ADDENDUM NO. 2 Agency Requested Modifications and Contract Extension INTRODUCTION This scope of work reflects modifications requested to the contract documents resulting from agency reviews that were not scoped in the original contract and to revise the contract duration from the original 9-month duration to 36 months The contract is now set to terminate December 2002 A new task reserved to address future agency comments is also created Due to the uncertainty, unpredictable nature, and timing of Agency comments, further contract addenda may be required if additional comments are created Otherwise, the final contract documents are completed, only signing of the drawings remain DURITION The project budgeting and fee estimate are based upon a concurrent work effort with the existing contract (City project number 97-3002) and scheduled for termination on December 31, 2002 This termination date represents an extension of the original contract by 27 months SERVICES The time estimates for the tasks discussed below represent additive time to the existing contract KCM shall perform services and furnish material necessary to accomplish the following work items I Project Administration This task includes administration of the contract between KCM and the City of Kent, preparation of status reports with each monthly invoice, and quality control This task includes all administration efforts needed to coordinate with the City and to complete the project on time and within budget 2 Respond to Agency Comments This task includes responding to Agency comments to date on the BA This includes responding to the second round of Agency comments Responding includes preparation of a written response and input to the preparation of Agency requested schematics/drawings budgeted in the following task The existing comments are based on the Corps review Additional comments could result from subsequent reviews by NMPS and USFW Responding to these comments are not part of this scope 2 1 Review comments from the Agencies Prepare responses 2 2 Discuss responses with the City/Agencies as requested 3 Drawing Revisions Revise construction drawings to meet the latest Agency comments and prepare schematics/drawings requested by the Agency to aid in their understanding of the project 3 1 Interpret and clarify Agency requested 4 Specification Revisions Agency modifications result in changes in material, quantities and construction requirements The specifications are revised in this task to reflect those changes As with previous specification submittals,KCM will provide the City with the special provisions and the City will compile this information into the specification document for bidding and construction use 4 1 Revise specifications to respond to Agency comments and required design changes NOTE No changes are budgeted in this addendum 5 Quantity/Cost Estimate Revisions Revisions to the quantities and cost estimates are developed under this task 5 1 Quantities will be revised to reflect Agency comments NOTE No changes are budgeted in this addendum 6 Responding to Agency Comments A $5000 budget is created under this task to provide responses to potential future agency comments Since this budget is arbitrary and is established for possible future and as yet unknown agency comments, the City will be notified when Tt/KCM starts to use these funds Due to the uncertainty, unpredictable nature, and timing of Agency comments, further contract addenda may be required if future comments require work
