HomeMy WebLinkAboutPK08-116 - Original - King County - MOU: Regional Justice Center Mitigation Issues - 03/10/1995 MEMORANDUM OF UNDERSTANDING 3/10/95 i i This memorandum is intended to address the issues of mutual concern between the City of Kent and the King County Executive regarding the construction and operation of the Metropolitan/ King County Regional Justice Center in Kent, Washington. It is recognized by both parties that the issues are varied, complex and require extensive interjurisdictional cooperation and commitment. For purposes of organizational clarity within this document the main issues and agreement areas will be categorized and identified under the following general titles which are incorporated herein: 1. RJC Mitigation Issues List - Appendix A 2. Traffic/Construction Mitigation Agreement - Appendix B 3. Human Services Mitigation Agreement - Appendix C 4. Environmental Impact Mitigation Conditions - Appendix D Therefore, the following terms of understanding are agreed to between the County Executive and the Mayor of Kent: I. RJC MITIGATION ISSUES LIST-Appendix A The City and the County agree that Appendix A representing resolution of the collection of mitigation issues developed on 3/8/94 after a series of City Official, Public and CBAG(Citizen and Business Advisory Group) and City staff meetings during which the Regional Justice Center was discussed. Appendix A identifies each issue, the process used to resolve or negotiate the issue, identifies who participated in the process, and the outcome of each issue. Attachment of Appendix A to this MOU(Memorandum of Understanding) is additionally intended to provide a historical perspective on the breadth of issues, document interjurisdictional cooperation and provide a basis from which the agreements on Traffic/Construction and Human Services Mitigation can cross-referenced. Issues falling under the general categories of traffic/construction, human services and environmental were assigned to separate groupings of City and County representatives in order to conduct further research, collect data, and seek additional input prior to any specific negotiation sessions and development of written agreements. MOU-1 2. TRAFFIC/CONSTRUCTION MITIGATION AGREEMENT- Appendix B The Traffic/Construction Mitigation Agreement (Appendix B)to this MOU represents resolution of such issues as LID participation, specific road improvements, street expansions, parking, CTR Plan (Commute Trip Reduction), turn lanes, signalization, on-site vehicle turnaround, deceleration lanes and payment of fees etc. The traffic/construction mitigation agreement also has six (6) graphic attachments which depict specific City and County responsibilities associated with the execution of some portions of this agreement. 3. HUMAN SERVICES MITIGATION AGREEMENT- Appendix C The Human Services Nitigation Agreement (Appendix C)to this MOU represents final agreements and resolution of issues such as the establishment of a RJC Citizens Advisory Committee; release times for sentenced prisoners; provision of clothing, bus passes and home community referral information to released inmates. Appendix C further includes a listing of RJC staff positions who duties specifically include linking up released inmates with social, medical and human service agencies prior to release. Also included within Appendix C is a provision of a one time block grant, and a process for accessing annual funding to augment social/human services within the City of Kent, as the City deems appropriate. 4. ENVIRONMENTAL MITIGATION CONDITIONS -Appendix D A list of potential environmental impacts associated with the construction and operation of the Regional Justice Center(RJC)were identified in the project's Environmental Impact Study(EIS) documents. Appendix D is a chart which restates the EIS's list of potential impacts, identifies probable mitigation measures and reflects appropriate actions already taken or to be taken to mitigate each impact. Mitigation actions may include documentation of conditions which have been applied to permits for demolition, remediation and site preparations already completed on this project. In addition, mitigation conditions to be applied to upcoming permits may be listed or a referral to the construction or human services mitigation agreements may be noted. This MOU, including it's appendices and attachments, represents the total and final entire mitigation package associated with the Regional Justice Center. MOU-2 It is agreed by both the City and the County that all issues of mitigation have been raised and addressed within this MOU, and that only those appropriate code requirements and conditions/ mitigations set forth within this document shall be attached to or.made a condition on any City permits associated with construction and/or operation of the Regional Justice Center in Kent, Washington. It is further agreed that this MOU fully satisfies the requirement for additional information and analysis on potential impacts from the development of the RJC to Social and Human Services in the local area, and that no addendum will be required. TRAFFIC: 1. In order to most effectively and efficiently mitigate the impacts of the Regional Justice Center(RJC) traffic, the City of Kent has determined that it is in the public's best interest to combine, enhance or expand the City's future planned road improvements for North 4th Avenue and East James Streets with necessary RJC mitigations; rather than implement preliminary mitigations presented in the County's January 1992 EIS documents. The City's planned road improvements shall be completed not less than 30 days prior to completion of construction for the RJC and will include the following: a. Design and construction of the following road improvements on East James Street. A vehicle deceleration lane, bike path (only along RJC property), sidewalk, left in and out staging lane and right turn lane at North 4th Avenue. Complete demolition of existing sidewalks/roadbed and any necessary adjustments to or replacement of electrical, irrigation or landscaping areas or mechanisms within the shaded areas. (See Exhibit (A) Site Maps, Sheets 1-6) b. Design and construction of the iollowing improvements on North 4th Avenue. A short southbound right turn deceleration lane on North 4th Avenue leading into the east RJC site entrance; a traffic island at the RJC North 4th Street entrance to prohibit left turns onto or off of North 4th Avenue to or from the RJC site. (See Exhibit(A) - Sheet 5) C. Design and construction of curbing at the Smith street where the access road leads from Smith Street to the Southwest corner of the RJC site. This curbing would enable right turns exits only from the Southwest side of the RJC site onto Smith. (See Exhibit A- Sheet 6) d. Completion of approximately six (6) signal optimizations. APPN B-1 I. TRAFFIC (CONT.) e. Provision of permanent easements on the Kent Commons' property to provide for the following: (See Exhibit A- Sheets 1-6) 1. A right turn lane on East James Street. 2. A deceleration to RJC Driveway off North 4th Avenue. 3. Provide to the County sufficient space on the south Commons (staff) parking lot to accommodate construction of a turnaround and a new joint RJC/Commons entrance and exit off of 4th Avenue. The turnaround will be positioned as equally as possible between the south Commons surface parking lot and the north surface parking lot of the RJC. 2. The City will require the following from King County to mitigate RJC traffic impacts and enable the City to accomplish the aforementioned necessary road improvements and the required contribution to the 272nd/277th Street corridor. a. A one time mitigation payment to the City of Kent totaling $600,000. (six hundred thousand dollars) for offsite RJC street improvements and participation in the 272nd/277th Street corridor. The County shall pay $500,000 (five hundred thousand dollars) as a condition of receiving a building permit and the balance within 30 days after satisfactory completion of all agreed upon road improvements. b. Provision of fee title for approximately a 20 ft wide strip of property along the entire north side (East James Street) of the RJC property. To be used as discussed in La. of the preceding section. However, the County shall be responsible for completing any necessary adjustments to or replacement of any electrical, irrigation or landscaping areas or mechanisms on or planned for RJC property adjacent to these road improvements. (Also see Attachment B Map)For any future development on the RJC site, the City shall allow the County to use the original property lines in the determination of setbacks. APPN B-2 1. TRAFFIC (CONT.) C. Provision of fee title for approximately a 10 ft wide strip of land along the entire east side(North 4th Street) of the RJC property. To be used as discussed in Lb. of the preceding section. For any future developments on the RJC site the City shall allow the County to use the original property lines in the determination of setbacks. d. Payment of all costs associated with the design and construction of the onsite turnaround which is being developed to redirect the majority of RJC traffic off the RJC site onto East James Street. This turnaround will be created using parts of both the north RJC surface parking area and the southern (staff parking area) of the Kent Commons. The County agrees to work closely with the City in the design of this turnaround to minimize impacts to the Commons. The County will also designate an equivalent number parking spaces in the R-TC parking structure to replace any Commons' staff parking spaces eliminated by the turnaround design. e. Completion and implementation of a Traffic Demand Management (TDM) plan for the RJC. This includes making the following physical provisions in the site and building design: at least two male and female showers for staff use in both the RJC courts and detention buildings to promote use of bicycle transportation; provision for parking of bicycles in the RJC parking structure and designation of a minimum of two surface parking slots on the north side of the RJC courts building for taxi's. II. PARKING: 1. King County agrees to: a. Not charge for displaced Commons staff parking at the RJC site. (Relates to item listed in 2.b.1. listed below.) b. Allow the Commons to share the RJC parking structure for public events; weekdays between 5:30 p.m. and 11:00 p.m. and weekends from 7:30 a.m.-11:00 p.m. APPN B-3 I 2. The City of Kent agrees that: a. The County will not participate financially in any future widening or other improvements to North 4th Avenue. This expense is roughly equivalent to three years of RJC parking revenues. b. In the event that the City of Kent institutes pay parking, the County will retain all future proceeds from RJC parking if three years of operation has been completed. If three years of operation has not passed, the County will turn over the parking income (minus parking lot attendant costs) for the balance of the threeyears and will retain all proceeds thereafter. 1. The County will never charge the City for any of the Commons staff parking spaces in the RJC parking structure which were displaced by the turnaround. (Also see parking item: La.). These parking spaces shall be specifically designated and marked as directed by the City of Kent. III. RAILROAD PROPERTY (ICE HOUSE) If the County obtains the railroad property adjacent to the SW corner of the RJC site, the following agreement will apply. 1. The County agrees to: a. Demolish the building (icehouse). b. Level the property and provide either ground cover or blacktop surface. Ensure that the total finished impervious surfaces do not exceed present conditions. C. Limit egress from Smith Street onto the access road leading to the SW "Secure" access gate to the RJC property to only official law enforcement vehicles and judges. All other traffic will remain exit only as per the RJC design documents. APPN B-4 d. Grant the City appropriate right of way and frontage along Smith Street to widen the access road leading from Smith Street to the Southwest corner of the RJC property line and to widen Smith Street. 2. The City agrees to: a. Widen the access road from Smith to the Southwest corner of the RJC site to allow two way traffic on the access road, allow only left turn in's from Smith onto the access road and right turn out's from the access road to Smith, construct a hammerhead turnaround at the end of the access road nearest the RJC property line, and remove any previously installed curbing or other improvements that restrict turn movement's off/onto Smith Street from this access road. b. Allow the requested official law enforcement vehicles and judges vehicles to enter left in off Smith Street onto the access road. C. Not require the County to complete any further street improvements to Smith Street. d. That the RJC storm water retention and treatment capacity is sufficient to accommodate any additional runoff from the property. IV. DEMOLITION AND CONSTRUCTION TRAFFIC To offset the potential for public complaint calls (stone damaged windshields and dings) and to ensure that truck traffic and street condition mitigations for demolition, pre-load and construction are monitored. This requires approximately one hour's worth of Kent Police Officer time each day from demolition through construction. 1. The County agrees to make a one time payment of$25,000 (twenty five-thousand dollars) as a condition of receiving a building permit for these extra law enforcement services. I I I APPENDIX C REGIONAL JUSTICE CENTER PROJECT Human Services Mitigation Atireement 3/10/95 The City and the County agree that the following represents the final resolution and formal mitigation agreement on all potential social, human service, emergency and other related services which may be impacted by the construction and operation of the Regional Justice Center in Kent. This agreement is based upon considerable input from the public, elected officials, CBAG and the City and County's collective analysis, research and discussions during an intensive five-month issue clarification and resolution process. Items' 11 and 12 specifically respond to, fully address and represent final resolution to the following three addenda matters<set forth in the City ofKent's`11/23/94 "Determination of Significance and Adoption of Existing Environmental Documents." 1. The framework, timelines, and potential funding for standardization of data collection, review and assessments regarding potential impacts of the RJC on human service agencies; 2. The framework, timelines, and potential funding for tracking services mandated by the judicial function of the Regional Justice Center facility; 3. Development of a framework and mechanism for setting aside funds for potential human service impacts, including potential funding for legal advocacy for domestic violence victims. HUMAN SERVICE ISSUE AGREEMENTS 1. The County agrees to provide interview spaces for use by human service agency professionals, volunteers, and ministerial visitation within the detention facility. The County has stated that 89 spaces will be provided within the RJC detention facility upon completed construction. Use of these spaces is subject to security clearance, scheduling, and attendance at a facility orientation. 2. The County will employ a full-time Volunteer Coordinator at the RJC to be funded from the inmate benefit fund. This position will generally have the same scope of work as currently performed at the King County Correctional Facility in Seattle. Office space will be provided in the detention facility. 3. Support staff for the Volunteer Coordinator will be provided at the same level as currently provided at the King County Correctional,Facility in Seattle. APPN C- 1 4. The inmate benefit fund will support programs and services at the detention facility similar to programs and services at the King County Correctional Facility in Seattle. 5. Sentenced inmates will be released at a time requested by the City of Kent Police Department, which shall consider human service, schools, and business needs. 6. The County will provide transportation vouchers and clothing to inmates upon their release as deemed appropriate by the staff of the detention facility. 7. A Citizen Advisory Committee for the RJC shall be created as described in the following: A Citizen Advisory Committee (CAC) shall be created by King County and the City of Kent to operate in conjunction with the Regional Justice Center (RJC). The CAC shall consist of seven (7) members whose makeup shall consist of: three (3) appointed by the Mayor of Kent; three(3) appointed by the King County Executive; and one (1) selected by the six appointed members of the CAC. The CAC shall elect a Chair and Vice-Chair from its membership. Terms of services shall be determined by the County Executive and the Mayor of Kent. The appointments should be community-based persons representing the community at large, with a suggested focus on business interests, residential/community interest, social services interests, and diversity considerations. The CAC shall meet quarterly or more often as needed. The CAC shall have an open agenda with the responsibility to address issues arising in the community in relation to the operation of the RJC. The CAC may address all aspects of the Regional Justice Center including the courts and their related offices as well as the detention facility The CAC's responsibilities shall be broad in range. An important component of those responsibilities shall be to assist in evaluating the effectiveness of the agreed upon mitigation in addressing identified impacts for specific issues. In addition, the CAC can make recommendations concerning any issue regarding the operation of the RJC. The Committee shall serve as a clear statement to the County, the City, and the immediate surrounding community that good relations and open communications are a priority. To this end, the CAC will provide either a written or oral report to both the Kent City Council and the Metropolitan King County Council at least semiannually. The CAC shall establish and publish a process for community members to bring issues to the CAC, which includes a review, assessment, and resolution process. 8. Semiannual training will be provided by the King County Department of Human Services to judiciary, criminal justice, legal system, and corrections personnel to inform them of the availability of human services. APPNC-2 9. The County will develop human services material for use by RJC staff'Members. Outreach materials pertinent to their home community will be provided to inmates upon their release. 10. The County agrees that outreach services for inmates will be provided by the County. The following is an explanation of how these services will work within the RJC's "Direct Supervision" detention facility which is a significantly different operation and environment than any other King County Correctional Facility. This explanation is immediately followed by a listing of RJC detention staff positions who will carry out these responsibilities. To efficiently and actively link RJC-related individuals with needed or mandated human services in appropriate referrals will be completed by various professional and/or certified staff throughout the different departments within the Regional Justice Center. Anger management classes, community service activities, and alcohol treatment may be conditions imposed upon a defendant by the judiciary. It is often incumbent upon the defendant to return to the court and show proof of attendance or completion of a program. Staff from the Superior Court or the prosecutor's office may give defendants literature indicating where the service may be obtained, but it is the obligation of the defendant to seek the service provider. As is the typical current practice, defendants select a service provider close to their residence or place of employment. The majority of these services are paid for by the defendant themselves. While a prisoner is in the custody of the detention facility, the King County Department of Adult Detention staff conducts initial screening, makes assessments, counsels,.and provide referral services as required. Inmates released during the first eight hours of incarceration receive "release assessments" by the Release Officer. In-custody detention programs consist of alcohol and substance abuse, education, religious, and several volunteer coordinated activities. As these programs are for in- custody inmates, they are not available once the inmate is released. However, mental health, and medical outpatient referrals are made routinely by mental and medical professional staff within the department based upon individual needs of the inmate. During incarceration, ministerial and program volunteers identify inmates with needs that can be met by church or program assistance. Other confidential information may be referred to the Volunteer Coordinator for further follow-up based on the individual needs of the inmate. During the release procedures inmates are assessed regarding clothing and transport- action needs, and are then issued a bus pass or clothing when deemed appropriate. They are also provided with information on programs from the inmate's home community. APPNC-3 i 11. King County agrees to provide a one time block grant of$200,000 (Two hundred thousand dollars) to the City of Kent, upon the County's receipt of the RJC Construction Permit, to use at its discretion for purposes of: a) Augmenting existing social, emergency, or other service program in the City of Kent, and/or; b) Establishing a framework for and initiating baseline and standardized annual data collection of City of Kent social, emergency, or other service programs, and/or; c) Investment for future augmentation of social, emergency, or other any other service programs within the City of Kent. 12. King County agrees to make available to the City of Kent, starting one year after RJC opening, a fund totaling up to a minimum of$38,000 for the City's distribution on an annual RFP basis. a. These funds will be made available from the inmate welfare fand and shall be re- assessed each year based on the annual RJC Average Daily Population(ADP) at a rate of$63.00 per ADP up to a maximum of 1,200 ADP for a maximum amount of $75,600 (seventy five-thousand six-hundred dollars). b. All allocations of this fund (from the inmate welfare funds) by the City of Kent shall be only on an annual RFP (application) basis. C. Submission dates for all RFP's (applications) each year will be established jointly by the City of Kent and King County, with funding to run from January through December of the following year. An RFP (application) City/County Award Review Committee shall be appointed by the Mayor and the County Executive- Two thirds of this committee shall be appointed by the Mayor. Funds will be awarded by this City/County Review Committee subject to the following: 1. Any individual RFP (application) request for funding shall not exceed $10,000 (ten thousand dollars). No single agency shall receive funds for more than one RFP (application) request in the same year. 2. RFP (application) funding requests will be limited to one year, and must provide services specifically related to the RJC detention population. 3. A new RFP (application) must be submitted each year. 4. Prioritization, endorsement, and granting funds from this annual RFP account by the City of Kent shall be subject to the review and auditing processes of King County and the State of Washington. Any baseline and annual data collection methodology associated with the City's endorsement of any annual RJC detention-related RFP (application) request is subject to specific prior review by the County. d. I could take the time to explain. but I am not sure anyone should know about the process that we followed to respond to you. City of Kent staff agrees with your clarification of the conditions of the mitigation agreement between the City of Kent and King County for the RJC project as follows: North Fourth Avenue Right of Way: The County agrees to locate the Right of Way twenty-two feet (22') west of the existing traffic flow line (street side of existing curb). This will be measured from the RJC southeast property line and run north along the S 01° 04' 41" W bearing, 550.29' to the northeast property line, as indicated in your Attachment A. The City of Kent will allow the designed stairs, light pole, and base to remain within the Right of Way approximately three and one half feet (3'6'). This location is within the City's planned ten foot (10'- 0") sidewalk. In the event that the City of Kent's development plans for North Fourth Avenue requires modifications to the stairs, light pole, and base, the County will not participate financially. Such modifications will be subjected to the County's review and approval. East Smith Street Access Road: The City of Kent agrees to provide fee title for that portion of land within the RJC's southwest fence line. This is the northern portion of land(approximately 12'-0" x 83'-0") purchased by the County from the railroad and deeded to the City of Kent as indicated in your Attachment B. The City of Kent will also provide a permanent easement for purpose of locating and maintaining a card reader and intercom island to control site access. Dear Arthur, As I stated in our phone discussion,I was suprized to receive a letter from Mr. John Hillman requesting payment for"escalation"costs associated with our Memorandum of Understanding(M.O.U.). Any escalation issues associated with the M.O.U.were addressed within that agreement; any requests for additional payment will be denied. However,this is a good time to address an outstanding M.O.U. issue. The issue relates to payment of $6,000. (Six thousand)dollars to the City of Kent for purchase of truck scales. These new scales were needed to specifically verify truck weights associated with construction of the RJC. The intent to purchase and receive reimbursement for these scales was discussed and agreed to during the M.O.U.negotiations. However,given the urgency of preparing and signing the final document before the deadline this item was inadvertently omitted. The error was not discovered until after the documents were signed.Upon discovery, the issue was discussed and I agreed to create an amendment to the M.O.U. at a later date. To clear up this issue,we require a letter acknowledging this letter as an amendment to the M.O.U. and request payment for the scales. If you have any questions regarding this matter please contact me.
