HomeMy WebLinkAboutLAG97-001 - Original - McKinney Mobile Modular - Lease of Building at 24058 Russell Rd - 10/10/1997 LEASE This Lease is entered into on the date fully executed below by and between McKINNEY MOBILE MODULAR, a Division of McKinney Vehicle Services, Inc., a Washington corporation, ("Lessor"), and THE CITY OF KENT, a Washington municipal corporation("Lessee") pursuant to Title 35A RCW. Lessor leases to Tenant, a modular building to be used in the City of Kent at 24058 Russell Road, Kent Washington, and not to be removed therefrom without written permission of Landlord. Lessee agrees to pay rent in the sum of$565.00 per billing cycle, payable in advance on the first day of each cycle, at McKinney Mobile Modular, Kent, Washington with rental to commence October 10, 1997 and to end on the day said property is returned to Lessor at McKinney Mobile Modular, Kent, Washington. A security deposit is not required. Said property is leased on a month to month basis. Lessee agrees to pay the same rental on the same terms until property is returned to Lessor. Either party may cancel this lease at its option upon ten(10) days written notice. Failure to provide ten(10) days notice will result in further rental charges. Lessee agrees to insure the property against all physical loss or damage while property is in the care and custody of the Lessee and while parked on the job site. Lessee further agrees to notify Lessor immediately of any damages or accidents and to cooperate with and/or aid Lessor in every way in any litigation arising from or involving said property. Lessor disclaims liability for any damage, loss or delay beyond Lessor's control. Any additional costs owing to site delays shall be charged to Lessee. Lessee agrees to use said property for the agreed purpose only and within its capacity and design, and not to permit the same to be used for any illegal purpose not to encumber or create any lien upon said property. Lessee further agrees to keep said property in the same condition in which it was received and to reimburse Lessor on the return thereof for all damage other than ordinary wear and tear not covered by insurance. It shall be the responsibility of Lessee to: (a) secure a permit; (b) provide a suitable site, including unobstructed access, level grade, good soil compaction, and good drainage; (c) to provide outside utility hook-up; (d) to provide foundation (designed by lessor) if other than solid timbers or concrete blocking. The property will remain the personal property of Lessor at all times and will not be annexed to realty. Lessee agrees that Lessor shall not be liable to Lessee or any other person for any claims, damages, obligations,actions,penalties, or suits of any kind,whatsoever, arising from or in any way connected with Lessee's possession, use, or operation of the lease property. Lessee agrees not to remove said property nor to assign this lease or sublease said property without written advance approval of Lessor. No alternations or installations shall be made without the advance written approval of Lessor. If default is made in payment of any monies hereunder due to Lessor by Lessee or in the performance of any covenant herein, or if Lessee makes assignment for benefit of its creditors, is declared bankrupt or if a receiver or trustee of Lessee is appointed, then Lessor may terminate this lease without notice to Lessee; whereupon, Lessor may enter the premises in which said property is located and without hinderance on the part of the Lessee, take possession of the property and remove the same therefrom. Lessee agrees to pay all expanses, including a reasonable attorney fee for repossession, rent collection. A late charge of 1.5%percent per billing cycle will be due on all rental not paid within thirty (30) days after the due date. Any judicial proceeding brought by Lessor against Lessee concerning this lease agreement may be brought in any court of competent jurisdiction, County of King, City of Kent, Washington, and Lessee ascents the non-exclusive jurisdiction of such court. Time is of the essence hereof and the full agreement between Lessor and Lessee is set forth herein. This Lease shall be construed and governed in accordance with the laws of the State of Washington.
