INFORMATION
BETWEEN
THE KENT POLICE DEPARTMENT AND
THE KING COUNTY HOUSING AUTHORITY
WHEREAS, President Clinton has mandated that Housing Authorities and local law enforcement
agencies work together in combined effort to combat and reduce crime within Public Housing
developments; and,
WHEREAS,this desire was affirmed and reiterated by(1)Congress,through passage of the Housing
Opportunity Program Extension Act of 1996, which requires the Housing Authority to perform
criminal history background checks on all applicants and to evict tenants involved in illegal criminal
activity, especially drug-related criminal activity; and, (2) new criteria established by HUD, which
requires the Housing Authority under the Public Housing management Assessment Program
(PHMAP)to track the incidence of crime within public housing communities and develop a system
of communication and cooperation with local law enforcement agencies for the mutual exchange of
information with regard to criminal activity occurring within public housing communities; and,
WHEREAS,the Housing Authority of the County of King is committed to providing safe, drug and
crime free housing to low income residents of King County; and
WHEREAS, the Kent Police Department is the law enforcement agency with municipal law
enforcement authority for the area in and surrounding the Housing Authority's communities of:

Mardi Gras Harrison House
NOW THEREFORE BE IT RESOLVED that the HOUSING AUTHORITY OF THE COUNTY
OF KING,WASHINGTON, (hereinafter referred to as the "Housing Authority") and the KENT
POLICE DEPARTMENT (hereinafter referred to as the "Police Department") set forth this
Memorandum of Release of Information in order to enhance interagency cooperation and
communication and to identify the process and guidelines through which information relating to the
occurrence of criminal activity within public housing developments owned by the Housing Authority
will be exchanged.
In a coordinated effort to reduce and eliminate criminal activity within and around the developments
cited above,the Police Department and the Housing Authority agree to the responsibilities outlined
below:

Responsibilities of the Housing Authority:
1. Provide to the Police Department a listing of the addresses for all Housing Authority
properties located in the jurisdiction of the Police Department.
2. Establish a system of regular communication between the Housing Authority and the Police
Department to communicate concerns for emerging problems, suspected drug activity and
other criminal activity which threatens to disrupt the peace and safety of the community.
3. Establish a single contact person within the Housing Authority's local Area Office to
coordinate the transfer of information to and from the Police Department.
4. Immediately notify the Police Department of specific incidents occurring within Housing
Authority communities or suspected of occurring within Housing Authority communities
relating to serious criminal activity, including drug related criminal activity.
Responsibilities of the Police Department:
1. Respond within a reasonable time to requests for reports of calls dispatched for service to
locations within the Housing Authority Communities.
2. Respond within a reasonable time to regular communications from the Housing Authority
expressing its concerns for emerging problems, suspected drug activity and other criminal
activity which threatens to disrupt the peace and safety of the community.
3. Establish a single contact person within the Police Department to coordinate the transfer of
information to and from the Housing Authority.
4. Provide case reports for specific incidents occurring in public housing communities relating
to drug activity and other criminal activity upon request by the Housing Authority, but only
to the extent such information is disclosable public information pursuant to Ch. 13.50 RCW,
Ch. 46.52 RCW, Ch. 10.97 RCW, and RCW 42.17.310(1)(e) or any other state or federal
law.
5. Notify the Housing Authority of criminal activity, including drug related criminal activity,
or other incidents threatening the life and safety of residents of the community or Housing
Authority staff only to the extent such information is disclosable public information
pursuant to RCW 59.18.075, Ch. 13.50 RCW, Ch. 46.52 RCW, Ch. 10.97 RCW, and RCW
42.17.310(1)(e) or any other state or federal law.
THIS AGREEMENT may be terminated by either side in the event of a change in the applicable
state or federal law or for cause, which is defined as a material breach of this Agreement. In the

event of a change in laws,this Agreement will be terminated immediately or amended by the parties
to conform with the change in law.
The failure of the Police Department to comply with any term or condition of this Memorandum of
Agreement for Release of Information shall not result in any liability on the part of the City of Kent,
including its employees, agents, and Police Department, nor shall any such failure give rise to any
cause of action by the Housing Authority against the City of Kent, including its employees, agents,
and Police Department.
The Housing Authority agrees to indemnify and hold harmless the City of Kent, its officers, agents,
and employees, from and against any and all loss, damages, injury, liability, suits, and proceedings,
however caused, arising out of or in connection with the Housing Authority's use of the information
disclosed by the City of Kent in items four and five of this Agreement. Such indemnification shall
include all of the costs of defending any such suit, including attorneys' fees.
The terms set forth in this document constitute the sole understanding by and between the parties
hereto.
