MUTUAL RELEASE OF CLAIMS
FOR AND IN CONSIDERATION of the City's dismissal of the forfeiture action
(Kent Police Department Case No. 00-6987) and the distribution of the seized funds on the
conditions stated below, the undersigned, James Brown ("Brown") and the City of Kent
("City'), mutually release and forever discharge one another from all claims, demands,
damages or causes of action, arising from or connected with the seizure and possession of
$76,820.00,U.S. currency, in the Kent Police Department Case No. 00-6987:
1. The City will return to Brown a total of$61,000.00 of the seized
funds. Payment will be issued by check within twenty-one (21)
days of full execution of this Release;
2. The City will retain$15,820.00 of the seized funds;
3. Brown agrees to hold the City harmless from any and all claims or
causes of action brought by a third party, whether known or
unknown, for the return of the funds seized or possessed in Case
#00-6987; and
4. This Release shall not be used against Brown in any future criminal
proceeding directly related to Case#00-6987.
IT IS UNDERSTOOD THAT THIS IS A FULL AND FINAL RELEASE, and full
compromise and settlement of any and all claims of every nature and kind, known or
unknown, suspected or unsuspected, involving the City of Kent/Kent Police Department and
James Brown arising from or connected with the seizure and possession of the U.S. currency
in the Kent Police Department Case No. 00-6987. It is further agreed that this is not an
admission of liability on the part of the settling parties,but rather a compromise, the express
purpose of which is to preclude any additional claims and to avoid the uncertainties of claim
disputes and litigation.

THIS RELEASE is being executed after having had an opportunity to consult with
an attorney. Each of the undersigned states that this Release has been carefully read and is
signed as that person's free act and deed. This release will become effective on the last date
entered below.
