The regular meeting of the Kent City Council was called to order at 7:00 p.m. by
Mayor Cooke. Councilmembers present: Albertson, Harmon, Higgins, Perry,
Ranniger, Raplee, and Thomas. (CFN-198)
CHANGES TO THE AGENDA
A. From Council, Administration, Staff. (CFN-198) Harmon said he would like
agenda Item 10, Continued Communications, to be moved to the end of Item 4,
Public Communications. After a brief discussion by Councilmembers, Harmon moved
to relocate Continued Communications Item 10 to Public Communications as Item 4H.
Albertson seconded and the motion carried.
B. From the Public. (CFN-198) There were no changes from the public.
PUBLIC COMMUNICATIONS
A. Public Recognition. (CFN-198) Mayor Cooke recognized the outstanding service
provided by everyone involved in the Memorial Day ceremony at Hillcrest Burial Park.
B. Community Events. (CFN-198) Ranniger announced the opening of the
Saturday Farmers Market, the dedication of an artwork called Sweet Suite, and
National Trails Day at Clark Lake Park. Thomas announced a breakfast being held on
June 2 by SKCAC Industries.
C. Drinking Driver Task Force Poster Contest Awards. (CFN-122) Cesi Velez
introduced the winners of the annual Drinking Driver Task Force Poster Contest, who
range from preschool through sixth grade, and displayed their posters.
D. Yangzhou Sister City Gift Presentation. (CFN-155) John Holt, co-chair of the
Yangzhou Sister City Committee, described his recent trip to China and presented
Mayor Cooke with a decorative plate which was presented to him by the Mayor of
Yangzhou for the City of Kent.
E. National Trails Days in Kent at Clark Lake Park Proclamation. (CFN-155)
Mayor Cooke presented a proclamation declaring June 5, 2010, National Trails Day at
Clark Lake Park to Victoria Andrews of the Parks Department. Andrews encouraged
anyone who is interested in working at the park that day to contact her.
F. Economic and Community Development Report. (CFN-198) Economic and
Community Development Director Wolters noted that the manufacturing sector
expanded for the tenth consecutive month, that the downtown post office building has
been sold, and that Adam Smith is holding a Small Business Forum at ShoWare on
June 3, 2010.
G. Public Safety Report and Awards. (CFN-122) Police Chief Strachan updated
statistics for May and reported on crime rates between 2005 and 2009. He and Sara
Wood described the Adopt-a-Spot Graffiti program, and the Chief presented awards

for ongoing diligent work to Sgt. Hemmen, Sgt. Majack, and Marla Platt for their
efforts in working with IT to build a computer-based staff scheduling system.

Communications.
PUBLIC HEARINGS
A. Goldfinch Communications LLC Cable Television Franchise. (CFN-274)
Mayor Cooke noted that this date has been set for the first introduction and public
hearing on a proposed cable television franchise agreement between the City and
Goldfinch Communication, LLC. She explained that no action will be taken at the
close of the public hearing, since State law provides that a cable television franchise
may not be granted by the City the same day it is introduced to the City Council.
Information Technology Director Mike Carrington explained that an application from
Goldfinch Communications to construct, operate and maintain a cable communications
system was received on February 16, 2010, and that the City contracted with Kenyon
Disend to lead franchise negotiations on the City's behalf. He said it is staf 's
contention that consideration for this competitive franchise application would benefit
the City by providing consumer choices for cable related services, establishing
favorable terms and conditions, and providing for the deployment of advanced
technology. Chris Bacha of Kenyon Disend gave a brief overview of the franchise
agreement, noting that it was designed to provide the highest level of protection for
the City, including appropriate relocation and insurance requirements.
Mayor Cooke opened the public hearing. There were no comments from the
audience. Perry moved to close the public hearing, Thomas seconded, and the motion
carried.
CONSENT CALENDAR
Perry moved to approve Consent Calendar Items A through C. Thomas seconded and
the motion carried.
A. AoDroval of Minutes. (CFN-198) Minutes of the regular Council meeting of
May 18, 2010, were approved.
B. Approval of Bills. (CFN-104) Payment of the bills received through March 15
and paid on March 15 after auditing by the Operations Committee on April 6, 2010,
were approved.

C. One Regional Card for All (ORCA) Agreement. (CFN-171) The Mayor was
authorized to sign the One Regional Card for All (ORCA) Agreement for 2010-2011.
OTHER BUSINESS
A. Temporary Flood Protection Structures Ordinance. (CFN-1318) Economic
and Community Development Director Wolters noted that last September an
ordinance was passed waiving certain permitting requirements for temporary
structures constructed for flood protection purposes, and that the waiver is applicable
until July 1, 2010. He said that because of the continually changing flood threat as
repairs at the Howard Hanson Dam continue, staff now recommends adoption of an
ordinance which would extend the permit waiver by one additional year to July 1,
2011. He added that the barriers do not pose any life safety threat, and that the City
is facing another flood season since repairs to the dam will not be complete this year.
Thomas moved to adopt Ordinance No. 3959 which extends the waiver provided by
Ordinance Nos. 3932 and 3933 of certain permitting requirements for temporary
structures constructed for flood protection purposes from July 1, 2010, to July 1,
2011. Raplee seconded. Higgins stated that the Federal government has a
responsibility to make the necessary repairs, but in the meanwhile the City and
property owners must protect their investments, which means keeping the barriers in
place. The motion then carried.

B. Deferral of Develog)ment Fees Ordinance and Resolution. (CFN-1000)
Ben Wolters explained that deferring development fees is an effort by the City Council
to try and provide assistance to the residential building industry during the national
recession. He noted that the school districts have had questions and concerns about
the deferral of school impact fees and that many meetings have been held with them
to address the concerns. City Attorney Brubaker explained the four specific clarifica-
tions as follows: (1) changing the word "resale" to "initial sale", (2) specifying that
the lien for deferred fees will be a "first priority" lien, (3) stating that the seller, not
the buyer, will pay the deferred fees at closing of the sale, and (4) removing the
notice to buyer provisions because the lien will be paid by the seller/builder at closing
and notifying the buyer of this transaction could potentially cause confusion. Wolters
emphasized that this is a temporary measure which sunsets in two-and-a-half years.
Perry moved to adopt Ordinance No. 3960 which amends Titles 7 and 12 of the Kent
City Code related to the timing of development mitigation fee collection and to adopt
Resolution No. 1828 which amends Resolution No. 1740 by establishing a fee
concerning the deferral of certain development mitigation fees. Raplee seconded.
Harmon moved to amend the motion to exclude the deferral of school impact fees
from the proposed ordinance. Higgins seconded. Harmon noted that neighboring
cities still collect school impact fees and that there is no assurance the deferral will be
extended in the future. He said deferring school impact fees affects the school
district, not the city, and that it's important for the school districts to make plans in
advance.
Thomas spoke in opposition to the amendment, stating that the main motion is more
fair. Higgins said that although mitigation fees are crucial, the City should exempt
the school district fees since that money belongs to them. Perry said that many
concerns were taken care of in the underlying ordinance, and that she cannot support
the amendment for the following reasons: she does not feel the ability to pass a bond
or levy would be lessened; she does not agree that fees would be less reliable; she
does not agree that the school district would receive less money, other than losing
12-18 months interest; she does not agree that the deferral would inhibit the school
district's ability to plan for future growth; and she does not agree this is a veiled
attempt to end impact fees. She said the proposed ordinance makes sense, but she
will not support the amendment. Albertson spoke in favor of the amendment, saying
that the city doesn't have the right to defer the school district's money.
Upon a roll call vote, the amendment to remove school impact fees from the fees
being proposed for deferral passed 5-2 with Albertson, Harmon, Higgins, Ranniger
and Raplee in favor, and Perry and Thomas opposed. The main motion to adopt
Ordinance 3960, as amended to exclude the deferral of school impact fees, then
passed unanimously.
REPORTS
A. Council President. (CFN-198) Perry noted that both the 2010 amended budget
and the 2010 annexation budget will be on the next Council agenda.

B. Mayor. (CFN-198) Mayor Cooke noted that the Greater Kent Historical Society
held a birthday party for the City of Kent on May 28, the 1201h anniversary of
incorporation.
C. Ooerations Committee. (CFN-198) No report was given.
D. Parks and Human Services Committee. (CFN-198) Ranniger announced that
the committee will meet on June loth.
E. Economic & Community Development Committee. (CFN-198) Perry noted
that the committee will be discussing the interlocal agreement with King County
regarding the Panther Lake annexation at their next meeting.
F. Public Safety Committee. (CFN-198) No report was given.
G. Public Works Committee. (CFN-198) No report was given.
H. Administration. (CFN-198) Hodgson advised that Council will have a report on
the Regional Fire Authority interlocal agreement at their next workshop.
ADDED ITEM
I. SSvecial Committees. (CFN-198) Albertson announced that the Human Services
Commission will hold their final workshop on Friday, June 4, to finalize funding
recommendations.
