MOTION: Recommend Public Works Committee forward the 2006-2011 Six-Year
Transportation Improvement Program (TIP) to full Council and set a Public Hearing before the
City Council for October 18, 2005.
SUMMARY: The 2006-2011 Six-Year Transportation Improvement Program includes 38
projects with estimated project costs totaling $329,341,000.00
BUDGET IMPACT: As itemized in attached Project Descriptions
No Unbudgeted Fiscal/Personnel Impact
BACKGROUND The 2006-2011 TIP has 9 new projects for a combined
$96,560,930. This includes $50 million for the two Railroad Grade Separation projects on South
2121h Street and almost $13 million for widening the last section of West Valley Highway that
remains a choke point(Meeker Street to South 218`11 Street) Including these projects in our Six-
Year TIP allows the City to begin looking for funding partners and apply for grants to see if
these projects will be feasible.
Seven projects from last year's TIP have been dropped,
incorporated into other projects, or will be completed by the end of this year.

A. After proper notice,the city council of the city of Kent held a public hearing
at the regular meeting of the city council at 7:00 p in. on October 18, 2005, to consider
I public testimony on the city's proposed 2006 through 2011 Six-Year Transportation
Improvement Plan.

SIX YEAR TRANSPORTATION IMPROVEMENT PROGRAM
2006-2011
PURPOSE
Mandated by State Law
State law requires that each city develop a local Transportation Improvement
Program (TIP) and that it be annually updated (RCW 35.77.010). It also requires that
' projects be included in the TIP in order for cities to compete for transportation funding
grants from most Federal and State sources. Federal grant funded and regionally
significant projects from the first three years of the City's TIP are submitted to the
Regional TIP, which is assembled by the Puget Sound Regional Council for King, Kitsap,
Pierce and Snohomish Counties. The regional TIPS (RTIP) from around the state are
then combined to form the State TIP (STIP), which is approved by the Governor and then
submitted to the Federal Highway Administration and Federal Transit Authority for their
review and approval.
What is the Six Year Transportation Improvement Program (TIP)?
The Six-Year Transportation Improvement Program (TIP) is a short-range
planning document that is annually updated based on needs and policies identified
through a variety of sources. It represents Kent's current complete list of needed projects
for the next six years. The document also identifies secured or reasonably expected
1 revenue sources for each of the projects included in the TIP. Typically, projects listed in
the first three years of the document are shown as having secured funding while projects
in the last three years can be partially or completely unfunded. Since federal and state
' funding can only be awarded to projects if they are included in an adopted TIP, the City
lists some potential projects in the City's TIP. Once a project is listed in the City's TIP,
it becomes eligible for inclusion in the City's Capital hriprovement Program (CIP) which
is updated as part of the City's budget process.
I Development of the Six-Year TIP is an On-Going Process
TIP project and financial development involve interactions with many groups and
agencies at the local, regional, state and federal levels. Public Works Engineering
Design, Traffic Engineering, Transportation Planning, and Accounting all contribute to
the process. On-going transportation planning activities, such as updating the
Transportation Element and traffic model, coordinating with the City's Comprehensive
Plan and the development of sub-area plans, such as the Downtown Strategic Action
Plan, and the Kent Station Plan, play an important part in identifying and prioritizing
transportation improvement projects State and regional transportation projects also play
ii
an important role such as those involving King County Metro Transit, Sound Transit, the
Washington Transportation Plan, Destination 2030, and the Burlington Northern Santa Fe
and Union Pacific Railroads.
Within the City of Kent, there are actions and interactions involving other
departments and divisions, the private sector, and the City Council and Administration
which strongly influence the direction of the transportation program.
For example, the transportation program is significantly impacted by land use
decisions, private development proposals and by public water and sewer extensions
which increase transportation demand by making possible higher density and/or intensity
of land uses. Such proposals need to be monitored and analyzed in regard to how they
individually and collectively create the need for transportation improvements.
At the City, State and Federal level there are new laws and regulations that create
the need for new or different kinds of transportation projects and programs. Examples
include the Transportation Efficiency Act(TEA-21), the Growth Management Act, the
Clean Air Act,the Commute Trip Reduction Law, the Endangered Species Act and the
Surface Water Management Ordinance. All of these laws have tremendous impacts on
the development and costs of transportation projects.
With its heavy dependence on many different and unpredictable sources of
outside funding and with the significant impacts created by on-going local, regional and
state-wide decisions, transportation project development is a continuous activity
comprised of land use development, financial, environmental, legislative, regulative,
economic, political, visionary, and practical elements.
Structure of the Program
The 2006-2011 Six-Year Transportation Program is divided into three general
sections. The first section covers Projects 1-14. These are projects which are currently
underway or expected to be underway by the end of 2006.
The second section covers Projects 15-34. These are projects which are expected
to begin in 2007 or later.
The third section, Projects 35-38, are ongoing city-wide projects or programs in
which the City is making continuous improvements and enhancements. ,

JUSTIFICATION: The project will lead to a seamless connection between major freight
handlers and their pnmaiy destinations. This project will support freight
moving through Kent to the Ports of Seattle and Tacoma, Sea-Tac Airport '
and the freeway system. Grade separating the arterial will increase both
rail and roadway capacity, decrease congestion, enhance safety, and
improve freight mobility in the corridor and throughout the region. This
project will provide regional connections between thousands of
businesses, employers, and 40 mullion square feet of warehouse,industrial
space. The level of freight and passenger rail traffic on the BNSF
Railroad mainline is rising as a consequence of increased traffic in the
Puget Sound area, and new Sound Transit and Amtrak service.

of stormwater in the street along the seam line, which Increases the
failure rate of the roadway pavement Sidewalks do not currently exist
throughout the length of the project area.

DESCRIPTION: City of Kent Engineering and Transportation Planning staff support '
towards the Washington State Department of Transportation's project to
widen State Route 167 from State Route 512 to South 180th Street. This
project is to include an additional general purpose lane in each direction
and to complete the HOV system.

PROJECT
JUSTIFICATION: While this Washington State Department of Transportation (WSDOT)
project is a multi-million dollar improvement consisting of State and
RTID funding, the City of Kent has provided, and will provide, hundreds ,
of hours of transportation planning, data gathering, and preliminary
engineering in support of this critical transportation corridor. The
congestion on SR 167 resulting from inadequate capacity creates
spillover congestion onto Kent arterials and jeopardizes the future of our
local and regional economy. Kent is the second largest
warehouse/distribution center on the west coast, containing over 40
million square feet of warehouse/industrial space. Many Kent businesses
ship to national and international customers and need reliable travel time
to the ports. With the planned extension of SR 167 to the Port of Tacoma ,
and planned completion of SR 509 connecting Kent to the Port of Seattle,
this project would complete the freight corridor, shifting thousands of
daily truck trips from I-5 and SR 18 to the Valley Freeway (SR 167).

South 196th Street, and South 212th Street intersections along West Valley
Highway. It also provides improved access to the South 196`l' Street
corridor from industrial development along 72nd Avenue South.

DESCRIPTION: Construct grade separation of the Union Pacific Railroad mainline tracks
at South 2281" Street. The project will include the construction of a
railroad bridge structure, a bicycle and pedestrian bridge, and a road
underpass; full-width paving; concrete curbs, gutters and sidewalks, street
lighting; utilities and appurtenances.

PROJECT
JUSTIFICATION: The project will lead to a seamless connection between major freight
handlers and their primary destinations. This project will support freight
' moving through Kent to the Ports of Seattle and Tacoma, Sea-Tac Airport
and the freeway system. Grade separating this arterial will increase both
rail and roadway capacity, decrease congestion, enhance safety, improve
freight mobility in this corridor and throughout the region. This project
will provide regional connections for thousands of businesses, employers,
and the 40 million square feet of warehouse/industrial space in the valley.

Green River Bridge to East Willis Street (SR 516)
DESCRIPTION: Remove and rehabilitate the existing roadway pavement to add additional
service life to the roadway, between the Green River Bridge and East
Willis Street (SR 516). This project will include the removal and
replacement of the upper two inches of the existing pavement in the curb
lanes in both directions, and a full-width asphalt concrete overlay of the
entire roadway, and will also include the selective replacement of catch
basin inlets, and driveway approach aprons, as well as curbs, gutters and ,
sidewalks.

JUSTIFICATION: The existing paving along this section of Central Avenue South is
exhibiting signs of distress, as demonstrated by "alligatoring:,
longitudinal cracking, and cracking of the curbs and gutters. The service
life of this roadway has been reached, necessitating reconstruction of the ,
pavement to extend the service life of the roadway, and prevent further
pavement degradation.

PROJECT
JUSTIFICATION: This project is required in order to interconnect the existing street signals
with the railroad crossing signals It will eliminate potential conflicts
where traffic could back up across the railroad tracks. Most of the cost of

crossing signal equipment to provide sufficient warning time of an
approaching train.

Provide transit and HOV Direct-Access between South 272"d St and 1-5
DESCRIPTION: Phase I would reconstruct the east half of the South 272nd Street/I-5
interchange to provide transit and HOV Direct-Access to South 272nd
Street. S ound T ransit a nd K ing C ounty M etro Transit h ave in ajor p ark
1 and ride facilities in the area with over 1,200 parking stalls. Transit and
HOV traffic would be able to turn onto South 272nd Street from I-5
without weaving through traffic on I-5. The project includes a new
northbound 1-5 bridge and reconstruction of approximately one-half mile
of northbound I-5. The improvements would be constructed to match
projects on South 272nd Street that would be built between Pacific
Highway South (SR 99) and Military Road.

PROJECT
JUSTIFICATION: Traffic volumes between Pacific Highway South and Military Road
South have reached the point where improvements supporting HOV-
added capacity are required to reduce congestion at the intersections and
reduce backups approaching 1-5. The HOV lanes will provide access to
the Star Lake Park and Ride lot and the Redondo Heights Park and Ride
lot. Adding HOV lanes and HOV access to I-5 supports various county
and City of Federal Way transportation and transit improvement projects.

five lane roadway section is required to provide safe left turn access into
the adjoining properties Further, concrete curbs and gutters are required
to provide control of roadway drainage and to prevent impacts to adjacent

construction of a modem roundabout at the 1161h Avenue Southeast
intersection rather than a traditional traffic signal. Improvements to
vertical roadway geometry for sight distance and safety will also be
addressed.

of congestion. The railroad crossing will no longer impede freight and
other traffic flow. Reductions in traffic congestion on adjoining streets
and reduced environmental impacts caused by traffic congestion is also
expected. This project will enhance Kent as an economic generator and
provide regional connections for thousands of businesses, employers, and
commuters.

JUSTIFICATION: This project will relieve congestion at all intersections between SR 516
(Kent Kangley Road) and 116t" Avenue SE by improving access to the
intersection by means of left turn lanes. This project has two-way left
turn lanes for its entire length which allow motorists to not block traffic
while w aiting t o t um. This n ew 1 ane will s top t he b ack-ups along S E
j 256th Street at the intersection with 1091h Avenue SE, 1111h Avenue SE,
114th Avenue SE and 116thAvenue SE The widening of SE 256th Street
also alleviates traffic on SR 516 (Kent Kangley Road) as the two roads

JUSTIFICATION: This project will relieve congestion at the Y- intersection of 1041h
Avenue SE (Benson Highway) (SR 515)/ Kent Kangley Road (SR 516)/
SE 256" Street by improving the traffic flow along SR 516. It will
eliminate the left turn pocket from SR 516 to SE 256th and redirect that
traffic along SR 516 to 108'b Ave SE. There will be a new left turn
pocket constructed for motorists wishing to travel north on 108th Ave SE
to SE 256th Street. By moving these left turning movements further to the
east, away from the congested Y- intersection, all directions of traffic will
be able to flow more efficiently. This extension will also provide another
way for East Hill residents to have direct access to the business-by-pass
route and better access to the commercial area south of the Kent Kangley
Road/104'h Avenue SE intersection.

Ongoing Citywide Programs
DESCRIPTION: Continue to provide enhanced transit service to meet the needs of the
community through the use of fixed-route shuttle service, with demand-
responsive routing capabilities, Routes 914 and 916 serve the Kent
Transit Center, Regional Justice Center (RJC), Kent City Hall, Green
River Community College's Kent Campus, and local shopping and
medical facilities. Route 918 service includes the Kent Transit Center,
RJC, Green River CC Kent Campus, and the manufacturing and industrial
area in the valley. The City plans to add two new routes to demonstrate
the value of c irculator transit s ervice connecting the residential areas o f
the east and west hills with the regional bus and commuter train services at

JUSTIFICATION: The Shopper Shuttle provides mobility and independence to many of the
city's seniors and reduces the need for expensive Access service for
many wheelchair lift service trips. It addresses a significant transit
market that may not be able to use the county's more traditional routes
and encourages community participation of all citizens without the
isolation and pollution of the automobile for every trip. Commuter
Shuttles enhance the regional transit and train service by providing the
vital link from the home to the Transit Center and from the Transit Center
to the workplace, encouraging people to leave their vehicles at home,
avoiding the cold start impacts to air quality, and reducing congestion on
local streets.

SUMMARY: John Hodgson, Director of the City of Kent Parks & Community Services
Department, 220 — 4`h Avenue South, Kent WA 98032, requests vacation of a portion of South
108th Street in order to develop park amenities that will connect two existing parks Staff
recommends approval without conditions of the street vacation for the reasons outlined below.
BUDGET IMPACT: Because the City is the adjoining property owner, no compensation will
be required for the right of way to be vacated.
BACKGROUND: That portion of 108rh Avenue Southeast extending approximately 630 feet
north of Southeast 2481h Street is unopened public nght-of-way which was dedicated to King
County in 1905, and subsequently annexed to the City of Kent in 1987. The property abutting
said right-of-way is owned by the City of Kent There are no existing public utilities lying
within the property to be vacated. Section 6 09 060 of the Kent City Code enables the City to
require compensation at the full appraised value of the right of way to be vacated However,
because the abutting property is already owned by the City, compensation will not be necessary.
The Parks Department will be required to construct half street improvements (including curb &
gutter, sidewalks and other related improvements) along the entire frontage of their property in
conjunction with the development of the site
STAFF RECOMMENDATION:
Staff notified the following departments and agencies of this proposed street vacation.

A RESOLUTION of the City Council of the City
of Kent, Washington, regarding the vacation of a portion of
108s' Avenue Southeast, located in the City of Kent,
Washington; and setting the public hearing on the proposed

RECITALS
A. A petition, attached as Exhibit A, has been filed to vacate a portion of
108`h Avenue Southeast in the City of Kent,Washington.
rB. The petition is signed by the owners of at least two-thirds of the real
property abutting that portion of 108`h Avenue Southeast to be vacated.

INOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
RESOLUTION
SECTION 1. —Public Hearing. A public hearing on the street vacation petition
requesting the vacation of a portion of 108s' Avenue Southeast, shall be held at a
regular meeting of the Kent City Council at 7:00 p.m., Tuesday, October 18, 2005, in

SECTION 2 -Notice. The City Clerk shall give proper notice of the hearing
and cause the notice to be posted as provided by state law, Chapter 35.79 RCW.
SECTION 3. - Information The Planning Manager shall obtain airy other
necessary information from appropriate departments and shall transmit the information
to the Council so that the Council may consider the matter at its regularly scheduled
meeting on October 18,2005.
SECTION 4. - Severabiiity. If any section, subsection, paragraph, sentence,
clause or phrase of this resolution is declared unconstitutional or invalid for any
reason, such decision shall not affect the validity of the remaining portions of this
resolution.
SECTION S. -Ratf cation. Any act consistent with the authority and prior to
the effective date of this resolution is hereby ratified and affirmed.
SECTION 6. -Effective Date. This resolution shall take effect and be in force
immediately upon its passage.

of the petition to vacate a portion of South 188th Street, as referenced in Resolution No 1709,
and to direct the City Attorney to prepare the necessary ordinance upon compliance with the
conditions of approval .
SUMMARY: Daniel K. Balmelli of Barghausen Consulting Engineers, Inc., 18215 72nd Avenue
South, Kent WA 98032, on behalf of Trammell Crow Company, requests vacation of a portion
of South 188th Street in order to facilitate development of the site. Staff recommends approval
with conditions of the street vacation for the reasons outlined below
BUDGET IMPACT: Section 6.09.060 of the Kent City Code enables the City to require
compensation at the full appraised value of right of way to be vacated.
BACKGROUND: South 188`h Street between 80th Avenue South and 80th Place South was
deeded to King County as a public roadway in 1946. An additional fillet of right-of-way at the
intersection of South 188`h Street with 80`h Avenue South was deeded to the City of Kent in
January of 1975 There are no City of Kent public utilities lying within the right-of-way to be
vacated at this time Soos Creek Sewer & Water District owns a 24 inch diameter interceptor
sewer which is situated within said right-of-way extending from 801h Place South to 80th Avenue
South Puget Sound Energy also has facilities within the right-of-way.
Springbrook Creek, owned in fee by King County Drainage District #1, crosses South 188th
Street in a culvert at the location depicted in Exhibit `B' of the street vacation application A
boundary line clarification document for Springbrook Creek was recorded in 1993 in order to
establish the actual field location of the creek Any future work within the property owned by
King County Drainage District#1 will require their approval and permits as may be applicable
The Drainage District also may need access to the creek for maintenance purposes.
The City plans to develop a trail system next to Springbrook Creek, to which the right of way to
be vacated would have provided access As a proposed condition of approval of this street
vacation, staff is requiring the applicant to provide public access to the trail. The City also needs
access to the trail for maintenance purposes, and to the creek as needed for future restoration
projects.
STAFF RECOMMENDATION:
Staff notified the following departments and agencies of this proposed street vacation.

■ Fire and Life Safety

1) The City shall be compensated in U.S. currency the full appraised value of the property
to be vacated
2) The petitioners shall deposit $3500 with the City to be used to obtain an M.A.I. appraisal
of the subject property in order to determine the fair market value of the area proposed to
be vacated Any funds not expended on an appraisal shall be applied to the compensation
due the City for the vacated right of way
3) The City reserves easement rights over, under and upon said property to be vacated for its
public utilities including ingress and egress that either presently exist or may exist in the j
future therein, AND for any existing public, private or quasi-private utilities including but
not limited to sanitary sewer, power, gas, telephone or cable TV The City shall retain
the rights to grant to said utility operators an easement for the operation and maintenance
of same In any case, the City's rights shall be paramount over any other easements
reserved herein
4) The City shall retain easement rights over, under and upon said property to be vacated for
public pedestrian and maintenance vehicle ingress and egress. Should any owner of the
S. 188 , Street right of way provide alternative public pedestrian access and maintenance
vehicle ingress and egress on its private property that is acceptable to the City of Kent,
the City shall release the easement in the S 188`h Street right of way.

Councilmembers present Clark, Harmon, Ranmger, Raplee, Thomas and White. Councilmember

Item 6Y. The City Attorney noted that there are five items of pending litigation for discussion during
the Executive Session.

PUBLIC COMMUNICATIONS
A Emplovee of the Month. (CFN-147) The Mayor noted that Scott Schroeder, Maintenance
Worker 4 in the Operations Department, has been named October Employee of the Month.
B. Economic Development Update. (CFN-198) Economic Development Manager Torgelson
noted that the State has denied the application of Cancer Treatment Centers of America, and that the
decision will be appealed. John Hines, Project Manager for Kent Station, then gave a brief update on
the project.
C. Government Finance Officers Association Award Presentation. (CFN-155) Finance Director
noted this is the 15th year that Kent has received this award, and commended the budget staff on their
work.
D. Recreation Equipment, Inc. (REI) Donation Presentation. (CFN-104) David Jayo, Corporate
Giving Manager. and Mike Miller of the Kent Parks Foundation, presented the Mayor with a check in
the amount of$14,306 to fund a component of the Extreme Park.
E. Proclamation—Robert& Araceli Gonzales Month. (CFN-155) Mayor White read a pro-
clamation recognizing the contributions of Mr & Mrs. Gonzales to the community
F. National Association of Telecommunication Officers and Advisors Award. (CFN-155) Sue
Lester, Acting Information Technology Director, announced that Kent's Bike Festival Video received
' a first place award from NATOA and presented the award to Kevin Sprotbery.

the City Attorney; and expenditure of funds in a new Center for Advanced Manufacturing budget was

O. Sub-Grantee Contract with the Kent Chamber of Commerce for the Center for Advanced
Manufacturing. (CFN-825) The Mayor was authorized to sign a sub-grantee agreement with the
Kent Chamber of Commerce, subject to final language acceptable to the City Attorney, to study the
feasibility of and create a business plan for the Center for Advanced Manufacturing.
P. King County Performance Network Grant for 2005 Performances. (CFN-118) The 2005
King County Performance Network grant of$6,800 00 from King County to fund 2005 perform-
ances was accepted, and the expenditure of funds in the Kent Arts Commission's budget was
authorized.
Q Washington State Arts Commission 2006 Organizational Support Program Grant for
Canterbury Arts Festival. (CFN-118) The 2006 Organizational Support Program grant of
$6,000.00 from the Washington State Arts Commission to fund the 2006 Canterbury Arts Festival
was accepted, and the expenditure of funds in the Kent Arts Commission budget was authorized.
R. King County Arts Facilities Grant for Portable Staging. (CFN-118) The Cultural Facilities
grant of$12,500 from King County to fund the purchase of portable staging was accepted, the
expenditure of funds in the Portable Stage budget was approved, and the Mayor was authorized to
sign the agreement, upon review by the City Attorney.

expenditure of funds in the Street Tree Replacement budget was approved

was accepted, the expenditure of funds in the Land Acquisition budget was approved, and the Mayor

X. Outcomes by Levy Contract. (CFN-1216) The Mayor was authorized to sign the Consultant
Services Agreement with Outcomes by Levy for 2006 government relations consulting services.
Y. Excused Absence. (CFN-198) An excused absence for Councilmember Peterson from tonight's
Council meeting was approved.
REPORTS
Planning and Economic Development Committee. (CFN-198) Clark noted that the next meeting
will be held at 4.00 p.m on Monday, October 17.
Administrative Reports. (CFN-198) The City Attorney noted that the Executive Session is ,
expected to take approximately 20 minutes.
CONTINUED COMMUNICATIONS
A. Municipal Lot Block Parking. (CFN-198) Bob O'Brien, 1131 Seattle St., expressed concern
about the loss of parking spaces. The Mayor noted that parking for the Regional Justice Center will ,
be addressed in the future.
B. Water District 111. (CFN-198) Patrick Hams, 27601 145 Place SE, stated that he has not
received any records indicating that Water District 111 customers are in favor of the City's
assumption of the District After the Executive Session, Clark assured Hams that he is aware of
customers who are in favor. '

dollars are being wasted.
D. Leadership Issues. (CFN-198) Upon a question from Sandy Amodt, 22633 141st Ave SE, the
Mayor noted that the Martin issue will be forwarded to King County upon completion of the Police
investigation. Amodt then commented on the procedure for adding items to the agenda.

MOTION: Recommend Council authorize the Mayor to sign the Joint Funding Agreement
between the City of Kent and the U.S. Geological Survey upon concurrence of the language
therein by the City Attorney and Public Works Director, for $38,360 for the U.S Geological
Survey to provide operation, maintenance and data collection at the Spnngbrook Creek, Mill
Creek and Rock Creek Gaging stations.
SUMMARY: The Public Works Department requests authorization to establish a budget for
the funds to be spent for the cooperative data-collection program with the U.S Geological
Survey.
BUDGET IMPACT: No Unbudgeted Fiscal/Personnel Impact
BACKGROUND: This is an on-going program with the City of Kent and the U.S Geological
Survey for stream data-collection. The City of Kent will contribute $38,360 to the annual
program costs of$76,720 with the U S Geological Survey providing the remainder
These gages provide valuable information on stream and weather conditions, including water
surface elevations, flow levels and amounts of precipitation. This information is used to
calibrate stream flow models and increase the accuracy of City design of storm water flood
protection projects. The gages, through their link to internet web sites, allow staff to monitor
stream flow levels from a remote location and determine stream flow levels.
I This contract will provide for operation, maintenance and data collection at five gages Two are
located on Mill Creek, one on Springbrook Creek and two on Rock Creek.

1.The parties hereto agree that subject to the availability of appropriations and in accordance with their respective authorities there
shall be maintained in cooperation a fixed-price agreement for operation,maintenance,and data collection at the Springbrook,
Mill Creek,and Rock Creek gaging stations, hereinafter called the program
2.The following amounts shall be contributed to cover all of the cost of the necessary field and analytical work directly

part to insure the required standards of accuracy subject to modification by mutual agreement
6 During the course of this program, all field and analytical work of either party pertaining to this program shall be open to
the inspection of the other party, and if the work is not being carried on in a mutually satisfactory manner,either party
may terminate this agreement upon 60 days written notice to the other party.
7.The original records resulting from this program will be deposited in the office of origin of those records. Upon request,
copies of the original records will be provided to the office of the other party
8.The maps, records or reports resulting from this program shall be made available to the public as promptly as possible.
The maps, records or reports normally will be published by the party of the first part However,the party of the second
part reserves the right to publish the results of this program and, if already published by the party of the first part shall,
upon request, be furnished by the party of the first part, at cost, impressions suitable for purpose of reproduction similar

THIS AMENDED AND RESTATED LICENSE AGREEMENT (the "Agreement") is

CITY OF KENT, a Washington municipal corporation (the "Licensor"), and KENT STATION,

' referred to as the "Purchase Agreement"). All capitalized terms contained herein that are not
otherwise defined shall be given the definition contained in the Purchase Agreement.
' B. Pursuant to the terms of the Purchase Agreement, the Property that is the subject
of the Purchase Agreement will be developed in phases and will be known collectively as "Kent
Station" or the "Kent Station Project" Effective as of June 22, 2004, Kent Station, LLC,
assigned a partial interest in the Purchase Agreement to Tarragon-Kent Station Phase 1, LLC
("TKSP") for purposes of acquiring the Initial Takedown Parcel. Pursuant to a Memorandum of
Operation Agreement executed by TKSP on June 29, 2004, TKSP has delegated to Licensee the
responsibility and obligation for constructing and developing the Kent Station Project.
C. Accordingly, Licensee will cause certain improvements to be constructed on the
' Initial Takedown Parcel in accordance with the terms of the Purchase Agreement and the
Development Agreement and MPD.
' D. The Licensee desires to use a portion of the Licensor's property (hereinafter the
"License Area") as a construction staging and storage area, as an area within which to park
construction and employee vehicles, for ingress and egress to the abutting public street and for
the other purposes set forth in Section 2 below. The License Area that Licensee desires to use
for such purposes is identified on the map attached by "Exhibit A", and is included within the
legal description attached as "Exhibit B" ("Licensor's Property"), both of which is attached
' hereto and made a part hereof.
E. Pursuant to Article 5.1 of the Purchase Agreement, Licensor has agreed to operate
Licensor's Property in such a way that is consistent and compatible with the development
associated with the Kent Station Project. Licensor and Licensee now desire to enter into this
Agreement for purposes of facilitating the construction of improvements on the Initial Takedown
Parcel and for future development of and construction of "Phase II" (i.e. development on the
remaining Takedown Parcels) on Licensor's Property.
' F. This License Agreement amends and restates in its entirety that certain License
Agreement entered into by the parties dated as of June_, 2004

NOW THEREFORE, in consideration of the mutual terms, covenants and conditions ,
contained herein and for other good and valuable consideration the receipt and sufficiency of
which is hereby acknowledged, the Licensor and Licensee hereby agree as follows. '
1. Incorporation The above Recitals are incorporated herein as if set forth at length '
at this point.
2 Grant of License, Use.
a. Subject to the terms and provisions of this Agreement, the Licensor hereby
grants to the Licensee, and the Licensee hereby accepts, an exclusive license (the "License") to
use the License Area for the following purposes.
i. A construction staging and storage area for the storage of normal '
and usual construction materials.
ii. Construction and employee vehicle parking '
iii Installation of temporary leasing signage for the Project. Leasing
signage shall be located on Licensor's Property at the locations defined for "site identification
features" on the approved MPD Site Plan, or at such other locations as may be approved from
time to time by Licensor These areas are part of the License Area but will not be barricaded or
separated from the general public except during such time as work is being performed in these '
areas
iv. Providing ingress and egress to the public streets abutting the ,
License Area.
V. Construction of certain permanent and temporary common area '
improvements as contemplated by and required under the Development Agreement and MPD as
a condition to the acquisition and construction of the Kent Station Project on the Initial
Takedown Parcel and on the Phase II property. '
vi. Construction and grading activities necessary to prepare the Phase
II development of the Kent Station Project for construction of permanent buildings and '
improvements.
b The portions of the License Area used by Licensee from time to time, and '
the portions of the License Area for which Licensee shall be responsible under this Agreement
shall be separated and/or barricaded from the general public during such time(s) as construction
activity is occurring in the respective areas as denoted on the map attached hereto as Exhibit A.
During these periods, separation or barricading shall be provided by fencing, construction
barricades, and/or tape, except as otherwise noted herein
C. All Licensee's personal property of every kind of description which may at
any time be upon the License Area shall be at Licensee's sole risk and Licensor shall not be ,

liable for any damage to or loss of said property caused m any manner p
extent caused by Licensor's sole negligence.
3. Term This Agreement and the Licensee's rights hereunder, shall expire on the
earliest to occur of (a) purchase of the Phase II Property, (b) December 31, 2005, or (c) the
-t termination of the Purchase Agreement due to Licensee's failure to timely purchase the Phase [I
property under the Purchase Agreement. Notwithstanding the foregoing, Licensor agrees to
amend this License Agreement to extend the term thereof to a mutually agreeable date if
necessary pursuant to Licensee's rights under the Purchase Agreement. The portion of
Licensor's Property to be included in any such amendment shall be mutually agreed to by
' Licensor and Licensee, acting reasonably and in good faith.
4. Insurance and Indemnification.
a. Licensee shall, at its sole cost and expense, procure and continue in force a
Commercial General Liability Insurance policy providing limits of not less than
combined single limit of liability
applicable to both bodily injury and property damage per occurrence in aggregate. Any
insurance policies required hereunder shall name Licensor as an additional insured and Licensee
shall furnish Licensor evidence of said insurance coverage prior to Licensor's execution of this
Agreement.
' b. In addition to the foregoing, Licensee shall indemnify, defend and hold
Licensor harmless from and against any loss, cost, damage, injury, expense (including reasonable
attorney's fees), cause of action, arbitration, claim and/or lien arising, filed or made against or
incurred by Licensor arising or incurred by reason of the acts or omissions of Licensee, its
agents, employees, contractors, sub-contractors, invitees or licensees in the actual use of the
License Area or the exercise of the License rights granted hereunder and/or the failure of the
' Licensee to promptly perform all or any of its obligations under this Agreement. The foregoing
indemnification shall not cover any loss, cost, damage, injury, expense (including attorneys'
fees), cause of action, arbitration, claim or lien to the extent the same is caused by the negligent
act or omission of Licensor, Its employees or agents, nor shall it apply to use of the License Area
by third parties unrelated to Licensee, and/or not under contract with Licensee for the
construction or development of the Kent Station Project The provisions of this Section 5(b)
' shall survive the expiration or earlier termination of this Agreement.
5. Removal of Licensee's Property and Restoration and Repair of License Area.
Prior to the expiration of this Agreement, and within thirty (30) days after the earlier termination
of this Agreement (if applicable), and except for the permanent improvements described in
Section 2.a.v-vi above, the Licensee shall remove all of the Licensee's equipment, materials,
vehicles, and other property located on the License Area and shall restore the License Area to a
level, graded surface All such removal and restoration work shall be undertaken by Licensee in
a good and workmanlike manner, without liens or cost to the Licensor.
6. Specific Performance, No Consequential Damages. In the event of a breach or
default, or threatened breach or default, by Licensee under this Agreement, the Licensor shall

have the right, in addition to all other rights under law or in equity, to obtain an injunction and ,
enforce specific performance against Licensee.
7. Time. Time is of the essence under this Agreement.
8. No Interest in Licensor's Property. The Licensee recognizes and agrees that
Licensee has a license only and has no real property, leasehold or easement rights in the
Licensor's Property, including but not limited to the License Area, by reason of this Agreement
or the License rights created hereunder. Neither this Agreement nor any memorandum, short
form or other document directly or indirectly referencing this Agreement or the License rights
created hereunder shall be recorded by Licensee. ,

This Amended and Restated Cross Easement Agreement (this "Agreement"),
dated for reference purposes the _th day of , 2005, is by and between
TARRAGON-KENT STATION PHASE 1, LLC, a Washington limited liability company
i ("TKSP-I") and THE CITY OF KENT, a Washington municipal corporation ("City").
RECITALS
A. TKSP-I owns the real property described in attached Exhibit A (the
"TKSP-I Property"), which TKSP-1 Property was acquired from the City.
B. City owns the real property described in attached Exhibit B, (the "City
Property"), as well as the right-of-way shown on the attached site plan, Exhibit C (the
"right-of-way")
C The City Property together with the TKSP-I Property are collectively
referred to as the "Kent Station Project". The legal lots within the Kent Station Project
are referred to as "Parcels".
D The City and TKSP-I, and their respective successors and assigns are
referred to individually as a"Party" or collectively as the "Parties".
E. The City and TKSP-1 entered into that certain Cross Easement Agreement
recorded under King County Recording No. 20040629001163 (the "Agreement")
F. TKSP-I and the City desire to amend and restate the Agreement with this
reciprocal Amended and Restated Cross Easement Agreement (the "Amended
Agreement") in order to confirm and amend certain reciprocal, cross and non-exclusive
easements which benefit and burden each property for the benefit of their respective
owners, tenants, successors and assigns.
Now, therefore, for and in consideration of the mutual covenants and conditions
set forth herein, TKSP-I and City hereby agree as follows
1. Reciprocal Easements.
iA. Platted Lots. TKSP-I and the City each hereby reserve, establish
and grant to and for the benefit of themselves, future owners and occupants of space in
the Kent Station Project, their successors and assigns and their respective customers,
invitees and employees, non—exclusive easements (the "Reciprocal Easements")
through each legal lot within the Kent Station Project on the areas as shown on the
attached Site Plan (attached hereto as Exhibit C (and as it may be amended from time to

time) for (a) vehicular and pedestrian ingress and egress and for passage of motor
vehicles including bicycles into, out of, on, over and across all private streets, roadways,
driveways, bicycle paths and sidewalks now or hereafter located on the Kent Station
Project, including but not limited to 2nd Place South, which shall connect with James
Street on the north and Ramsay Way on the south, (b) parking of motor vehicles on all
surface parking lots now or hereafter located on the Kent Station Project which are
developed with office, commercial, or retail use, (c) installation and maintenance of
landscaping, and (d) installation, operation, maintenance and repair of water and storm '
water drainage systems or structures, including underground storm water detention
vaults, water mains, sewers, water sprinkler systems, telephone, cable, fiber optic or
electric conduits or systems, gas mains and other public and private utility lines, ,
connections, hydrants, drams, meters and appurtenances thereto. All utility systems,
structures, mains, vaults, conduits, lines and other utility facilities (a) shall be installed
and maintained below the ground level or surface of the Kent Station Project, (b) shall be ,
located within five (5) feet of the boundary of each legal lot constituting a part of the
Kent Station Project to the extent feasible, (c) shall not interfere with the use, occupancy
or development of any parcel constituting a portion of the Kent Station Project, or the
occupancy of any parcel by any owner or occupant thereof, (d) shall not interfere with or
diminish the usefulness, capacity or functionality of such utility services to any burdened
owner's parcel, and (e) shall be constructed by the TKSP-I, as it is developed, in
compliance with all requirements of law, including, but not limited to, the MPD, the
PAO, the SEIS and the Development Agreement for the Kent Station Project, the terms
and conditions of which are incorporated herein by reference However, before TKSP-I '
implements or constructs within any of the easements described above on City-owned
property, the TKSP-1 shall first obtain written approval from the City, which approval
will not be unreasonably withheld.
B. Right-of-Way.
i. Pedestrian Crossing. The City hereby grants TKSP-1 an f
easement for pedestrian ingress, egress and access across Ramsay Way at the locations
shown on the attached site plan (Exhibit Q. TKSP-1 shall install a raised and decorative
concrete crossing area in this location.
w ii Underground Utilities The City also grants TKSP-I an
easement under Ramsay Way for the installation, operation, maintenance and repair of
water and storm water drainage systems, water mains, sewers. water sprinkler systems,
telephone, cable, fiber optic or electric conduits or systems, gas mains and other public
and private utility lines, connections, hydrants, drains, meters and appurtenances thereto.
m. Awnings. The City hereby grants TKSP-I an easement to
install awnings on TKSP-I's buildings (at locations shown on the site plan — Exhibit C)
that extend over the City's sidewalks

1 iv. Landscaping The City hereby rants TKSP-I an easement

to install, maintain and replace landscaping within the City's right -of -ways along
Temperance and First Avenue at the locations shown on the site plan (Exhibit C) and in
accordance with the landscape plans dated and in other plans as approved by
the City in connection with the Kent Station Project.
41 V. Sidewalk. The sidewalk being constructed by TKSP-I
along West James Street is located partially in the right-of-way and partially on TKSP-I
real property. The portion of the sidewalk in the right-of-way is identified on the site
plat, Exhibit C, and TKSP-I has agreed to maintain this area in conjunction with its
maintenance of the portion of the sidewalk located on the private property.
vi. Modification of Right-of-Way. The execution of this `
Amended Agreement shall not affect the City's right to modify the right-of-way as part of
a street realignment or widening project. If the City should at any time determine that a '
1r portion, segment, or all of the affected areas shown on the site plan (Exhibit C-1) should +
be removed, replaced, or modified to permit either the realignment or widening of the 4
It street within the right-of-way for public purposes (provided that any such street widening 4,
. ` leaves legally adequate sidewalks adjacent to existing buildings), then the City shall .}
v provide TKSP-I at least one hundred twenty (120) days written notice that TKSP-I must +
remove, replace, or modify the improvements allowed in subsection (1) through (v) above
(hereafter the "Improvements") If TKSP-I fails to act in accord with the written
notification, the City may take the required action and TKSP-I shall reimburse the City
within thirty (30) days of demand for all reasonable and necessary costs and expenses
incurred to remove, replace, or modify the Improvements. The liability of TKSP-I shall
extend only to the costs of removing, replacing, or modifying the Improvements and not
to the costs and expenses associated with the street realignment or widening project
vii. Maintenance Obligations. In order to ensure the proper
maintenance of the Improvements within the City's right-of-way, the City shall have the
right as provided below, but not the obligation, to maintain the Improvements should
TKSP-I fail to do so within ten thirty (30) days of receipt of written notice from the City
that maintenance is necessary However, no notice shall be required in the event that the
City determines that an emergency exists that may cause damage to person or property if
the situation is not remedied in a time period shorter than the time required for notice If
the City provides notice in writing, but TKSP-I fails or refuses to perform any necessary
maintenance as reasonably requested by the City, the City may undertake the necessary 4
1 maintenance to the City's reasonable satisfaction. If the City reasonably exercises its
rights under this subsection (vii), then TKSP-I shall reimburse the City within thirty (30)
days of written demand for all reasonable and necessary related expenses, including all
reasonable legal costs, attorney's fees, and reasonable administrative costs. If TKSP-I
fails to pay the required amount the City shall to attach and collect a lien as per Chapter
35.67 RCW. In addition, if TKSP-I fails or refuses to perform the necessary

maintenance, the City may enjoin, abate, or remedy the breach or a continuation of
breach by appropriate proceedings, and may bring action for penalties as provided by
law.
2. Term of Reciprocal Easement. The Reciprocal Easements regarding the
platted lots per Section 1 A above shall commence on the date hereof and shall terminate
only upon agreement of all of the owners of the Parcels located within the Kent Station
Project, but in no event sooner that the termination of the Kent Station CC&Rs recorded
on even date herewith. The Easements regarding the right-of-way per section 1 B shall
run with the land in perpetuity until and unless a release of the Easements is recorded by
the parties.
3. Use of the Reciprocal Easement. The use and maintenance of the
Reciprocal Easement areas within the Kent Station Project shall be in accordance with
the Kent Station CC&Rs. The Reciprocal Easement areas are deemed to be "common
areas" under the Kent Station CC&Rs. Costs for the maintenance and repair of the
Reciprocal Easement areas shall be addressed as set forth in Section 7 4 of the Kent
Station CC&Rs.
4. Relocation of Utility Easements. Except as set forth in Section 1.B.ii ,
above, the property owner of each Parcel burdened by these easements within the Kent
Station Project shall have the right to relocate and adjust any utility easement at its sole
cost and expense, provided that any such relocation shall be performed with the prior '
written consent of the owners of any Parcels benefited by these easements, which consent
shall not be unreasonably withheld or delayed so long as the party seeking to relocate a
utility also (a) does not cause any disturbance to any existing occupants and businesses
located on the benefited Parcels; (b) indemnifies, defends and holds the benefited Parcel
owner harmless from and against any and all damages, claims, injuries and costs
(including attorneys fees and costs) with respect to activities related to the relocation; (e)
immediately repairs and replaces any area disturbed by the relocation with the same or
comparable improvements as have been disturbed; and (d) complies with all applicable
laws, rules and regulations as well as all applicable terms of the Kent Station CC&Rs.
5. Latecomer Fees. The easements granted herein are reciprocal and there
will be no further consideration paid or reimbursement of costs incurred for such
easement rights, provided, however, that TKSP-I or any subsequent private-party
purchaser of a parcel within the Kent Station Project shall be entitled to enter into
latecomer agreements to the extent allowed under the Development Agreement, recorded
of even date herewith.
6. Indemnification. To the extent permitted by law, each Party and its
successors and assigns hereunder shall indemnify, defend and hold harmless the other ,

1 Party, its successors and assigns (for the purposes of this Section 6, the "Indemnifying
Party"), from and against any and all claims, losses, causes of action, suits, damages,
liabilities, costs and expenses (including reasonable attorneys' fees) incurred by or
asserted against the Indemnifying Party, including without limitation claims for bodily
' injury, death, or property damage, arising out of, related to or in any way connected with
(i) the use of the Easements granted herein caused by the negligent acts or omissions of
the Indemnifying Party, its agents, contractors or employees and (n) breach of this
Agreement by the Indemnifying Party, its agents, contractors or employees.
Notwithstanding the foregoing, with respect to the City only, and not with respect to any
of the City's successors or assigns, the City's indemnification obligations hereunder shall
1 be limited to matters arising out of the City's sole negligence. CITY AND TKSP-I
EACH EXPRESSLY AND SPECIFICALLY WAIVE THEIR IMMUNITY AND
DEFENSES AS AN EMPLOYER UNDER INDUSTRIAL INSURANCE TITLE 51
R.C.W., DISABILITY BENEFIT, AND SIMILAR LAWS, BUT THIS WAIVER IS
SOLELY FOR THE PURPOSE OF GIVING FULL FORCE AND EFFECT TO THE
FOREGOING INDEMNITY AND IS NOT INTENDED TO BENEFIT ANY THIRD
1 PARTIES, INCLUDING EMPLOYEES, NOT A PARTY TO THIS AGREEMENT.
THIS WAIVER HAS BEEN MUTUALLY NEGOTIATED BY THE PARTIES.
7. Notices. Any notice required by the terms hereof shall be delivered or
sent by: (i) first class, registered or certified mail, postage prepaid, return receipt
requested, (u) nationally recognized overnight carrier, or (in) personal delivery and shall
be addressed to the address of the party set forth below with copies to the parties
designated below or to such other address as either party may designate by notice
pursuant to this Section. Any notice transmitted in the manner described above shall be
deemed given when personally delivered, upon delivery by the designated carrier, or on
the third(3rd) business day after mailing, whichever occurs first.

8. Counterparts, Bindm Eg ffect. This Amended Agreement may be executed
in one or more counterparts, each of which shall be deemed an original and all of which
taken together shall constitute one and the same document
9. Run with the Land. This Amended Agreement constitutes a covenant
running with the land and shall benefit and burden the City Property and the TKSP-I
Property respectively, and shall pass to each successor and assign of such TKSP-I
Property and the City Property as a right and obligation of title and ownership
10. Right to Enjoin. In the event of any violation or threatened violation of
any of the provisions of this Amended Agreement by a party hereto, the other party shall
have the right to apply to a court of competent Jurisdiction for an injunction against such
violation or threatened violation.
11. Amendments No alteration, modification, or interpretation of this
Amended Agreement shall be binding unless in writing and signed by both parties If any
interest created by this Amended Agreement would, but for the operation of this clause,
be void under the Rule Against Perpetuates or a related rule, then the interest shall vest at
the end of the maximum period allowed by such rule.
12. No Waiver No covenant, term or condition of this Amended Agreement
other than as expressly set forth herein shall be deemed to have been waived by TKSP-I
or City unless such waiver is in writing and executed by TKSP-I or City, as the case may
be. No delay or omission on the part of TKSP-I or City in exercising any rights, power or
remedy provided in this Agreement shall be construed as a waiver of or acquiescence in
any breach of this Agreement.

AN ORDINANCE of the City Council of the City
i of Kent, Washington, relating to the vacation of 100
square feet of I" Avenue North, located in the City of
Kent, Washington.
iRECITALS
A. A petition has been filed to vacate 100 square feet of ls`Avenue North in
the City of Kent, as legally described in Exhibit"A,"attached and incorporated by this
reference.
B. The city's Planning Services Office processed this petition and, after
consulting with all appropriate city departments, secured technical facts regarding the
proposed vacation.
C. The city council fixed a time for a public hearing on the petition and the
hearing was held with proper notice on August 16,2005,in the city council chambers of
Kent City Hall.
D The city's Planning Services Office recommended that the city council
approve the petition, with conditions.

E. After the public hearing on August 16, 2005, the city council approved
the vacation with the conditions recommended by staff. Those conditions have since '
been met.
F. The city council finds that the portion of the avenue/street sought to be
vacated is- (1)a dedicated alley/street that is presently unused; (2)not abutting on a body
of water and, therefore, not suitable for acquisition for port purposes, boat moorage or
launching sites,park,viewpoint,recreational or education purposes, or other public use;
and(3) a vacation which is in the public interest.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
ORDINANCE
SECTION 1. —Recitals. The foregoing recitals are incorporated as if fully set
forth herein.
SECTION 2.— Vacation. 100 square feet of I"Avenue North in the city of Kent,
as legally described in Exhibit "A," which is attached and incorporated, is hereby
vacated.
SECTION3.— Vested Rikht No vested rights shall be affected by the provisions
of this ordinance.
SECTION 4. — Severability. If any one or more section, subsections, or
sentences of this ordinance are held to be unconstitutional or invalid,such decision shall ,
not affect the validity of the remaining portion of this ordinance and the same shall
remain in full force and effect.

BACKGROUND: On November 3, 2004, the Hearing Examiner issued Findings,

conditions. On November 10, 2004, the Hearing Examiner issued a Response to Request
for Reconsideration revising two of the conditions. The applicant has complied with the
conditions required prior to recording.

On November 3, 2004, the Hearing Examiner approved the Clark Lake Estates
preliminary plat with the following conditions
tA. PRIOR TO RECORDING PHASE I OF THIS SUBDIVISION:
1. The Owner / Subdivider shall pay all Charges in Lieu of Assessments
and/or Latecomer Fees, if any, prior to scheduling the Pre-Construction
Conference and/or prior to recording this plat, whichever comes first.
2. The Owner / Subdivider shall provide Public Works with a digital plat map
prepared with a CAD program. The digital information can be formatted in
either * DWG (AutoCad) or * DXF (Drawing Exchange File), but must be
based upon State Plane coordinates an assumed coordinate system is
not permitted The State Plane Coordinates shall be on the NAD 83/91
datum and relate to at least two City of Kent reference points within one
half mile of the subdivision In addition, the project shall be tied into at least
two City of Kent NAD 88 vertical benchmarks and two additional
permanent benchmarks shall be established within the project The
elevations of these benchmarks will be reported at the time as-built
drawings are submitted along with field notes sufficient to verify their
accuracy.
3. The Owner / Subdivider shall submit and receive City approval of
engineering drawings from the Department of Public Works, and shall then
either construct or bond for the following
a. A gravity sanitary sewer system to serve all lots. A portion of the
proposed subdivision can be served on a gravity basis from the
existing sanitary sewer system which presently terminates near the
northwest corner of the subject property. Where gravity service is
not possible individual grinder pumps will be allowed to serve a
maximum of five lots on a temporary basis The individual force
mains required to service said lots shall not lie within, across, under
or over any public right of ways.
Prior to recording of the final plat of Phase II and when the public
sewer system is extended, by others, in accordance with the City's
Comprehensive Sewerage Plan to the intersection of 120th Avenue
Southeast and Southeast 240th Street, the Developer/ Owner will
be required to further extend the system across Southeast 240th
Street and along the entire property frontage of 120th Avenue

Conditions of Approval
Southeast to serve all of the lots which cannot be served on a
gravity basis from the existing system.
All sanitary sewer system extensions shall be sized to serve all off-
site properties within the same service area; in addition, the gravity
sanitary sewer system shall be extended across the entire
subdivision as needed to serve adjacent properties within the same
service area
The septic system serving the existing home within the proposed
plat - if any - shall be abandoned in accordance with King County
Health Department Regulations.
b. A water system meeting domestic and fire flow requirements for all
lots
The City water system shall be extended and sized in accordance j
with the Water Comprehensive Plan This will include water main
extensions along SE 2401h Street and 1201h Avenue SE as well as
within the new subdivision in order to provide for a looped system
and water availability to adjacent properties within the same service
area Alternative alignments will be considered subject to approval
by the Public Works Department.
Existing wells — if any - shall be abandoned in accordance with the
requirements of the Department of Ecology.
C. A stormwater system. The Engineering Plans must meet the
minimum requirements of the City of Kent Construction Standards
and 2002 City of Kent Surface Water Design Manual (KSWDM).
Initial guidance for the Engineering Plans are given below (See
Chapter 2 of KSWDM for detailed submittal requirements).
(1) The Engineering Plans will include at a minimum- Site
improvement plans which include all plans, details, notes
and specifications necessary to construct road, drainage,
and other related improvements The engineering plans shall
include a technical information report (TIR) which contains
all the technical information and analysis to develop the site
improvement plans.

Conditions of Approval
(2) An erosion and sedimentation control (ESC) plan shall be
included in the engineering plans. The ESC shall meet the
requirements of the City of Kent Construction Standards,
and the 2002 City of Kent Surface Water Design Manual.
These plans must reflect the Detailed Grading Plan
discussed below, and the Planning Department approved
Detailed Tree Plan.
(3) The retention / detention and release standard that will be
met by the subdivision is Level Two. The water quality
menu that will be met by the subdivision is the Resource
Stream Protection Menu.
(4) The site improvement plans and technical information report
will contain drainage calculations and a drawing of the
retention / detention pond tract at an appropriate engineering
scale to show that the proposed on-site or off-site retention /
detention tract is large enough to contain the required
minimum stormwater storage volume and water quality
facility. The site improvement plans will also show that all
required stormwater management facilities will be outside of
delineated wetlands and their buffers, as well as outside of
creeks and rivers and their buffers.
(5) A downstream analysis is required for this development, and
it will include an analysis for capacity, erosion potential, and
water quality Refer to the requirements of Technical
Information Reports in Section 3: "Offsite Analysis", of the
2002 City of Kent Surface Water Design Manual for the
specific information required for downstream analyses.
(6) As development occurs within this subdivision, roof
downspouts for each roofed structure (house, garage,
' carport, etc ) shall be directed to Roof Downspout Controls
per Chapter 5 1 of the 1998 King County Surface Water
Design Manual
(7) The Owner / Subdivider shall submit Landscape Plans for
within and surrounding the retention / detention facility to the
Planning Department and to the Department of Public Works
for concurrent review and approval prior to, or in conjunction

with, the approval of the Engineering Plans These
Landscape Plans shall meet the minimum requirements of
the City of Kent Construction Standards, and the stormwater
management landscaping requirements contained within the
1998 King County Surface Water Design Manual.
Landscape Plans are required to show adjacent Street Trees
so that the City arborist can assess potential adverse stress
upon all types of vegetation.
(8) The Owner / Subdivider shall execute Declaration of
Stormwater Facility Maintenance Covenants for the private
portions of the drainage system prepared by the Property
Management Section of the Department of Public Works.
See Reference 8-F, Declaration of Stormwater Facility
Maintenance Covenant, to the 2002 City of Kent Surface
Water Design Manual for information on what is contained
within this document.
d. A Detailed Grading Plan for the entire subdivision meeting the
requirements of the Uniform Building Code, the City of Kent
Construction Standards, and City of Kent Development Assistance
Brochure #1-3, Excavation and Grading Permits & Grading Plans.
Initial guidance for these plans is given below:
(1) These plans will include provisions for utilities, roadways,
retention / detention ponds, stormwater treatment facilities,
and a building footpad for each lot.
(2) These plans shall be designed to eliminate the need for j
processing several individual Grading Permits upon
application for Building Permits.
e. Interim Street Improvement Plans for 1201h Avenue SE along the
entire property frontage thereon. These Street Improvement Plans
shall meet the requirements of the City of Kent Construction
Standards, and City of Kent Development Assistance Brochures
#6-2, Private and Public Street Improvements, and # 6-8, Street
Improvement Plans, for a street designated as a Residential
Collector Street by the City of Kent Master Plan of Roadways. Initial
guidance for the necessary street improvements is given below

Conditions of Approval
(1) Combined concrete curbs & gutters, a 5-foot wide planter
strip, and a 5-foot wide cement concrete sidewalk along the
west side of the street.
L (2) A minimum of 18-feet of asphalt pavement as measured
from the City-approved street centerline to the face of curb
on the west side of the street, plus at least 12-feet of asphalt
pavement as measured from the approved centerline to the
edge of the traveled lane on the east side of the street.
' (3) An approved gravel shoulder on the east side of the street
(4) A City-approved street lighting system.
(5) Public stormwater conveyance, detention and treatment
facilities, as applicable.
(6) Street Trees installed within the 5-foot wide planting strips
constructed between the back of curb and the front of the
cement concrete sidewalk These Street Trees will be
located away from street lights, and the species shall be
selected from the Approved Street Tree List provided in the
City of Kent Development Assistance Brochure #14, City of
Kent Street Trees.
f. Street Improvement Plans for the new public Residential Street
connected to 120`h Avenue SE and terminating with temporary cul-
de-sacs at their southerly termini The Street Improvement Plans
for this street shall be designed in conformance with the
requirements for a Residential Street as required by City of Kent
Construction Standards, and City of Kent Development Assistance
Brochures #6-2, Private and Public Street Improvements and City
of Kent Development Assistance Brochure # 6-8, Street
Improvement Plans for a street 28-feet wide. Initial guidance for
these street improvements is given below:
(1) Combined curbs & gutters, a 5-foot wide planting strip
constructed between the back of curb and the front of the
sidewalk, and then 5-foot wide cement concrete sidewalks
on both sides of the street.

September 19, 2005
■ COMMITTEE MEMBERS PRESENT: Committee Chair Bruce White and
Committee Members Ron Harmon and Debbie Raplee. The meeting was called to order
at 5:15 P.M.
Approval of Minutes Dated August 15, 2005
Committee Member Ron Harmon moved to approve the minutes of August 15,
2005. The motion was seconded by Debbie Raplee and passed 3-0.
Montessori School Request to Lease City Property
Larry Blanchard, Public Works Director, stated that the City is putting in a parking lot for
the water tower and cell tower. The parking will be used by the City for trainmgs and
event parking The Montessori Plus school asked to lease the space when it was not
being used by the City The lease was brought before the Council and Council asked
that the item be brought back to the committee for further discussion.
Dana Ralph, 23307 98`h Ave. South addressed the Committee stating her concerns over
the lease. She stated the Hearing Examiner had found that 18 stalls would be sufficient
for the Montessori School and she believes the findings should stand.
Dick Kromck, 23307 98`h Ave South stated he has owned property in this area for over 30
years. He was present at the hearings for the Montessori School and was told there
would not be a problem with congestion. The Hearing Examiners said there would be no
more then 18 parking stalls and the permits were issued with these findings.
Sharlet McClurkin, Director of Montessori Plus School stated the Hearing Examiner
allowed for 68 students at the school. With that number of students it would be
beneficial to the students and parents if they could park for a short time when picking up
and dropping of students Staff take up approximately 6 or 7 spaces during the day the
rest of the traffic is parents dropping off and picking up students The school has
investigated other options for parking but there are none close by The school uses an
offsite facility for large gatherings as to not have too many cars parking at the school.
The school is being a good neighbor and concerned about the neighborhood traffic.
Ron Harmon said he thought the City should pursue the parking lot and the Montessori
School should go back to the Hearing Examiner and follow the process to have the
parking spaces increased. It was suggested the issue be referred back to the Hearing
Examiner to clarify his findings.
Pat Fitzpatrick, Deputy City Attorney said the issue could be sent back to the Examiner
and he could chose to re-interpret or not. Pat suggested the City Legal department could
review the lease agreement along with the Hearing Examiners findings and report back to
' the Committee.
The item was referred to the Legal Department for review.
Kent Reservoirs Seismic Strengthening & Painting Protect—Accept as Complete
Tim LaPorte, Design Engineering Manger said this project consisted of the seismic
retrofitting of three City of Kent water reservoirs There were two change orders
covering four revisions. The revisions were made to enhance the seismic survivability of
the three reservoirs. The change resulted to an increase cost to the City of$7,375 the
remainder of the cost was covered by the FEMA grant

Debbie Raplee moved to recommend the full Council acceptance of the project as
complete upon standard releases from the state and release of any liens. The
motion was seconded by Ron Harmon and passed 3-0.
S. 277`h Street Trail Filling and Grading Project—Accept as Complete
Tim LaPorte, Design Engineering Manager said the trail is part of the S. 277`" Street
Corridor project. It was necessary to modify the plans and construct the retaining walls
prior to paving the trail. The total cost for this project although over the original bid was
less than the total amount estimated for the work.
Ron Harmon moved to recommend full Council acceptance of the project as
complete upon standard releases from the state and release of any liens. The motion
was seconded by Debbie Raplee and passed 3-0.
Fund Authorization Agreement for S. 2281h St. BNSF Grade Separation Project
Mark Madfai, Sr Project Engineer said this grant agreement is for the preliminary
engineering phase of the S. 2281" St. BNSF Grade Separation project.
Debbie Raplee moved to authorizing acceptance of the Fund Authorization
Agreement for the S. 2281h St. BNSF Grade Separation Project and authorize the
establishment of the budget for same along with directing staff to spend the money
accordingly. The motion was seconded by Ron Harmon and passed 3-0.
Fund Authorization Agreement for Downtown Sidewalk Improvements
Mark Madfai, Sr. Project Engineer said this grant agreement is for the preliminary
engineering phase of the Downtown Sidewalk Improvements project.
Ron Harmon moved to recommend authorizing acceptance of the Fund
Authorization Agreement for the Downtown Sidewalk Improvements—Kent TOD
Access Project and authorize the establishment of the budget for same along with '
directing staff to spend the money accordingly. The motion was seconded by
Debbie Raplee and passed 3-0.
Dept. of Communitv Trade and Economic Development Agreement for Emerging
Issue Grant—Critical Areas Ordinance Appeal
Kelly Peterson, Environmental Engineer stated the grant is in the amount of$10,000 and
will be used to complete an analysts of the wetland classification adopted by the City of
Kent vs. the Washington State Department of Ecology system.
Debbie Raplee asked if the funds are accepted will this hinder the Council's decision on
the Critical Areas Ordinance Kelly answered that accepting this grant would not
obligate the Council to anything
Debbie Raplee moved to recommend authorizing the Mayor to sign the Washington
State Department of Community Trade and Economic Development Emerging Issue
Grant in the amount of$10,000 directing staff to accept the grant and establishing a
budget for the funds to be spent within said project. The motion was seconded by
Ron Harmon and passed 3-0.

Six-Year Transportation Improvement Program 2006 - 2011
Steve Mullen, Transportation Engineering Manager presented the 2006-2011 Six Year
Transportation Improvement Plan Steve said this is an optimistic look at the projects
and the projects listed in the top 10 have funding in hand.
Ron Harmon asked if there was a way to move up projects #29 and 30 the Meeker Street
Widening Steve explained that the projects could be moved up but there was still no
funding for these projects
Larry Blanchard said the Transportation Master Plan was being developed and that would
give staff a better evaluation of the projects and timelines.
Ron Harmon said he just wanted to be sure these projects would not be dropped from the
list.
Ron Harmon moved to recommend the Public Works Committee forward the 2006
— 2011 Six—Year Transportation Improvement Program (TIP) to full Council and
set a Public Hearing before the City Council for October 4, 2005. The motion was
seconded by Debbie Raplee and passed 3-0.
2005 Asphalt Overlay Change Order
Tim LaPorte, Design Engineering Manager said the 2005 Asphalt Overlay project went
very well, and came to approximately $29,000 under budget. Public Works decided to
include the paving of the South 277`h St Trail to the existing 2005 Asphalt Overlay
contract allowing the paving to be done this season. The additional cost to finish the trail
will make the final change order S 178,446.59.
