Corrections Facilitv Food Vendor Contract. (CFN-122) The Mayor was authorized to sign the jail food services agreement between the City of Kent and Consolidated Food Management, Inc. D. City of Auburn Interlocal Agreement, Fire Investigation Task Force. (CFN-122) The Mayor was authonzed to sign the Interlocal Cooperative Agreement between Auburn and Kent for the creation and operation of the South King Fire Investigation Task Force, with a minor revision on page 4 changing"prior sections"to "Section XIII hereof" E. City of Covington Interlocal Agreement, Fire Investigations. (CFN-122) The Mayor was ' authorized to sign the Interlocal Agreement between Covington and Kent relating to Fire Investigations. F. Department of Homeland Security/Office of Domestic Preparedness Grant. (CFN-122) The Department of Homeland Secunty and the Office for Domestic Preparedness FY04 Assistance to Firefighters Grant was accepted, the budget was amended and the Mayor was authonzed to sign any agreements necessary to accept the grant and spend funds related to the purchase and installation of the compressor/cascade fill system and thermal imaging cameras. 2 Kent City Council Minutes January 4, 2005 G. Diversity Advisory Board Ordinance. (CFN-1127) Ordinance No. 3732 amending KCC 2.56 040 to increase the Diversity Advisory Board's membership from seven(7) to nine (9) members was adopted. H. 2004 Accounts Receivable Write-Offs. (CFN-104) The write-offs of various accounts receivable in the amount of$42,477.39 was approved The Finance Department recommended write-offs of uncollectible accounts that are over one year old I. Udalov Environmental Services Contract. (CFN-1038) The Mayor was authorized to sign the Consultant Agreement Change Order with Udaloy Environmental Services for $64,995 to provide the City with technical assistance on the Landsburg Mine. J. United States Fish & Wildlife Services Contract. (CFN-1038) The Mayor was authorized to sign the contract with the United States Fish and Wildlife Services (USFWS) in the amount of S95,550 to provide assistance in the development of the proposed Habitat Conservation Plan (HCP) at Clark Springs & Rock Creek and for the preparation of the associated environmental documents including an Environmental Impact Statement(EIS) K. Littler Environmental Consulting, Inc. Contract. (CFN-1038) The Mayor was authorized to sign the contract with Littler Environmental Consulting, Inc. for$44,915 to provide technical assistance on the Landsburg Mine and Model Toxic Control Act (MTCA) issues L Washington State Law Enforcement Association Grant. (CFN-122) The Washington State Law Enforcement Association grant was accepted. The funds from this grant in the amount of$3,000 will be used to provide training for police personnel M. Wildwood Ridge I1 Final Plat. (CFN-1272) The final plat mylar for Wildwood Ridge Two was approved and the Mayor was authorized to sign the Mylar. N. Drinking Driver Task Force Re-appointment. (CFN-122) The Mayor's re-appointment of Mr. Rod Blalock to continue serving as a member of the Kent Drinking Driver Task Force was confirmed. His term will continue until 1/l/08. ADDED ITEMS 1 O. Land Use and Planning Board Re-appointment. (CFN-174) The Mayor's re-appointment of Mr. Greg Worthing to continue serving as a member of the Kent Land Use and Planning Board was confirmed. His term will continue until 12/31/07 ' P. Kent Human Services Commission Re-appointment. (CFN-873) The Council President's re-appointment of Councilmember Debbie Raplee to continue serving as the non-voting Council representative to the Kent Human Services Commission was confirmed Her term will continue until I/1/06. OTHER BUSINESS Downtown Strategic Action Plan Update, Comprehensive Plan & Zoning Amendments AND 2004 Annual Comprehensive Plan & Zoning Map Amendments. (CFN-462,377&131) This proposal includes an update of the Downtown Strategic Action Plan and adoption of regulations to i3 Kent City Council Minutes January 4, 2005 implement portions of that plan Following public hearings before the Land Use and Planning Board, the Planning& Economic Development Committee has recommended approval of the update as modified by the Committee Following a public hearing before the Land Use & Planning Board, the Planning &Economic Development Committee is forwarding their recommendations on the 2004 annual comprehensive plan and zoning map amendments. Charlene Anderson, Planning Manager, explained that this item(713) and the following item (7C) are part of one package, therefore both should be heard before taking action. Bill Osboume of the Planning Department explained both items 7B and 7C, and read a letter from Polygon Northwest withdrawing the Muth application. HARMON MOVED to make the letter a part of the record Clark seconded and the motion carried. Ranniger recused herself from voting Peterson recommended that staff do further research on the options and said Council needs time to analyze the options. CLARK MOVED to send Items 7B and 7C (Downtown Strategic Action Plan Update, Comprehensive Plan & Zoning Amendments, and 2004 Annual Comprehensive Plan & Zoning Map Amendments)to the Planning Committee with the intent that there be a public hearing on the Lotto proposal which would address 1)widening the buffer, 2) the impact of design review, including use and 3) a three-acre option. Peterson seconded and the motion carried , REPORTS Planning and Economic Development Committee. (CFN-198) Clark noted that, due to the holiday on January 17, the Committee will meet at 5 00 p.m. on Wednesday, January 19th Administrative Reports. (CFN-198) Martin reminded Council of an Executive Session of approximately 10 minutes regarding property acquisition with possible action afterwards EXECUTIVE SESSION The meeting recessed to Executive Session at 7.55 p.m. and reconvened at 8:02 p.m. (CFN-198) ACTION AFTER EXECUTIVE SESSION Property Acquisition. CONSULTANT SERVICES AGREEMENT between the City of Kent and Renton Technical College Basic Studies THIS AGREEMENT is made between the City of Kent, a Washington municipal corporation (hereinafter the "City"), and Renton Technical College organized under the laws of the State of Washington, located and doing business 3000 N E Fourth Street, Renton, Washington(hereinafter the "Consultant") 1. DESCRIPTION OF WORK. Consultant shall perform the following services for the City in accordance with the following described plans and/or specifications Provide instruction and testing to offenders supervised by the City of Kent Corrections Facility (CKCF) as a partner in the Opening Doors Project The Opening Doors Project is funded by the Department of Education,Fund for Improvement of Post Secondary Education grant Consultant will provide Adult Basic Education (ABE), General Educational Development (GED) instruction and GED testing Most classes will be located in the main corrections facility, with some located in the corrections annex building ' See Exhibit A for Scope of Work details Consultant further represents that the services furnished under this Agreement will be performed in accordance with generally accepted professional practices in effect at the time those services are performed II. TIME OF COMPLETION. The parties agree that work will begin on the tasks described in Section 1 above immediately upon the effective date of this Agreement Upon the effective date of this Agreement, Consultant shall complete the work described in Section I by September 30, 2007 This Agreement, however, is contingent upon the availability of funds to be allocated through the City's budget process During the term of this Agreement should the City determine that funds to support Consultant's services are no longer available, the City shall provide Consultant thirty (30) days advance written notice of summary termination. III. COMPENSATION. A The City shall pay the Consultant, based on time and materials, an amount not to exceed $141,920 for the services described in this Agreement This is the maximum amount to be paid under this Agreement for the work described in Section I above, and shall not be exceeded without the prior written authorization of the City in the form of a negotiated and executed supplemental agreement The Consultant agrees that the hourly or flat rate charged by it for its services contracted for herein shall remain locked at the negotiated rate(s) for a period of one(1) CONSULTANT SERVICES AGREEMENT- 1 (Over$10,000) year from the effective date of this Agreement The Consultant's billing rates shall be as delineated in Exhibit B B The Consultant shall submit monthly payment invoices to the City for work performed, and a final bill upon completion of all services described in this Agreement. The City shall provide payment within forty-five (45) days of receipt of an invoice. If the City objects to all or any portion of an invoice, it shall notify the Consultant and reserves the option to only pay that portion of the invoice not in dispute. In that event, the parties will immediately make every effort to settle the disputed portion IV. INDEPENDENT CONTRACTOR. The parties intend that an Independent Contractor- Employer Relationship will be created by this Agreement and that the Consultant has the ability to control and direct the performance and details of its work, the City being interested only in the results obtained under this Agreement V. TERMINATION. Either party may terminate this Agreement, with or without cause, upon providing the other party thirty (30) days written notice at its address set forth on the signature block of this Agreement After termination, the City may take possession of all records and data within the Consultant's possession pertaining to this project, which may be used by the City without restriction. if the City's use of Consultant's records or data is not related to this project, it shall be without liability or legal exposure to the Consultant VI. DISCRIMINATION. In the hiring of employees for the performance of work under this Agreement or any subcontract, the Consultant, its subcontractors, or any person acting on behalf of the Consultant or subcontractor shall not, by reason of race, religion, color, sex, age, sexual orientation, national origin, or the presence of any sensory, mental, or physical disability, discriminate against any person who is qualified and available to perform the work to which the employment relates Consultant shall execute the attached City of Kent Equal Employment Opportunity Policy Declaration, Comply with City Administrative Policy 1 2, and upon completion of the contract work, file the attached Compliance Statement ' VIL INDEMNIFICATION. To the fullest extent permissible by law, Consultant shall defend, indemnify and hold the City, its officers, officials, employees, agents and volunteers harmless from any and all claims, injuries, damages, losses or suits, including all legal costs and attorney fees, arising out of or in connection with the Consultant's negligent,reckless, or intentionally wrongful performance of this Agreement. The City's inspection or acceptance of any of Consultant's work when completed shall not be grounds to avoid any of these covenants of indemnification Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4 24 115, i then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Consultant and the City, its officers, officials, employees, agents and volunteers, the Consultant's liability hereunder shall be only to the extent of the Consultant's negligence. IT IS FURTHER SPECIFICALLY AND EXPRESSLY UNDERSTOOD THAT THE INDEMNIFICATION PROVIDED HEREIN CONSTITUTES THE CONSULTANT'S WAIVER OF IMMUNITY UNDER INDUSTRIAL INSURANCE, TITLE 51 RCW, SOLELY FOR THE PURPOSES OF THIS INDEMNIFICATION THE PARTIES FURTHER ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER CONSULTANT SERVICES AGREEMENT-2 (Over$10,000) The provisions of this section shall survive the expiration or termination of this Agreement VIII. INSURANCE. The Consultant shall procure and maintain for the duration of the Agreement, insurance of the types and in the amounts described in Exhibit C attached and incorporated by this reference. IX. EXCHANGE OF INFORMATION. The City will provide its best efforts to provide reasonable accuracy of any information supplied by it to Consultant for the purpose of completion of the work under this Agreement X. OWNERSHIP AND USE OF RECORDS AND DOCUMENTS. Original documents, drawings, designs, reports, or any other records developed or created under this Agreement shall belong to and become the property of the City All records submitted by the City to the Consultant will be safeguarded by the Consultant Consultant shall make such data, documents, and files available to the City upon the City's request The city's use or reuse of any of the documents, data and files created by Consultant for this project by anyone other than Consultant on any other project shall be without liability or legal exposure to Consultant XI. CITY'S RIGHT OF INSPECTION. Even though Consultant is an independent contractor with the authority to control and direct the performance and details of the work authorized under this Agreement, the work must meet the approval of the City and shall be subject to the City's general right of inspection to secure satisfactory completion. XII. WORK PERFORMED AT CONSULTANT'S RISK. Consultant shall take all necessary precautions and shall be responsible for the safety of its employees, agents, and subcontractors in the performance of the contract work and shall utilize all protection necessary for that purpose All work shall be done at Consultant's own risk, and Consultant shall be responsible for any loss of or damage to materials, tools, or other articles used or held for use in connection with the work XIII. MISCELLANEOUS PROVISIONS. A Recyclable Materials Pursuant to Chapter 3 80 of the Kent City Code, the City requires its contractors and consultants to use recycled and recyclable products whenever practicable A price preference Imay be available for any designated recycled product B Non-Waiver of Breach. The failure of the City to insist upon strict performance of any of the covenants and agreements contained in this Agreement, or to exercise any option conferred by this Agreement in one or more instances shall not be construed to be a waiver or relinquishment of those covenants, agreements or options, and the same shall be and remain in full force and effect C. Resolution of Disputes and Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Washington If the parties are unable to settle any dispute, difference or claim arising from the parties' performance of this Agreement, the exclusive means of resolving that dispute, difference or claim, shall only be by filing suit exclusively under the venue, rules and jurisdiction of the King County Superior Court, King County, Washington, unless the parties agree in writing to an alternative dispute resolution process In any claim or lawsuit for damages arising from the parties' performance of this Agreement, each party shall pay all its legal costs and attorney's fees incurred in defending or bringing such claim or lawsuit, in addition to any other recovery or award provided by law, provided, however, nothing in this paragraph shall be construed to limit the City's right to indemnification under Section VII of this Agreement CONSULTANT SERVICES AGREEMENT-3 (Over SI0,000) 1 D Written Notice. All communications regarding this Agreement shall be sent to the parties at the addresses listed on the signature page of the Agreement, unless notified to the contrary. Any written notice hereunder shall become effective three (3)business days after the date of mailing by registered or certified mail, and shall be deemed sufficiently given if sent to the addressee at the address stated in this Agreement or such other address as may be hereafter specified in writing E Assignment Any assignment of this Agreement by either party without the written consent of the non-assigning party shall be void If the non-assigning party gives its consent to any assignment, the terms of this Agreement shall continue in full force and effect and no further assignment shall be made without additional written consent. F Modification. No waiver, alteration, or modification of any of the provisions of this Agreement shall be binding unless in writing and signed by a duly authorized representative of the City and Consultant G Entire Agreement. The written provisions and terms of this Agreement, together with any ' Exhibits attached hereto, shall supersede all prior verbal statements of any officer or other representative of the City, and such statements shall not be effective or be construed as entering into or forming a part of or altering in any manner this Agreement All of the above documents are hereby made a part of this Agreement However, should any language in any of the Exhibits to this Agreement conflict with any language contained in this Agreement, the terms of this Agreement shall prevail H Compliance with Laws The Consultant agrees to comply with all federal, state, and municipal laws, rules, and regulations that are now effective or in the future become applicable to Consultant's business, equipment, and personnel engaged in operations covered by this Agreement or accruing out of the performance of those operations. Subcontractors ' Contractor shall include all subcontractors as insureds under its policies or shall furnish separate certificates and endorsements for each subcontractor All coverages for subcontractors shall be subject to all of the same insurance requirements as stated herein for the Contractor 1 i 1 City of Kent Corrections Facility Opening Doors Project (Abstract) "The number of inmates in state and federal prisons has increased more than six-fold from less than 200,000 in 1970 to 1,440,655 by the end of 2002. An additional 665,475 are held in local lads." (Bureau of Justice Statistics) The City of Kent ' Corrections Facility (CKCF) average daily population is 130. More than 1,300 people are released from south King County jails every month. ' Many offenders arriving at the CKCF have served time there before. "The vast majority of people currently in prison and jail tend to come from low-income households and often have a history of substance-abuse problems. In addition, prisoners tend to be ' poorly educated—only a third are able to read and write when they arrive." (The Sentencing Project) The CKCF Opening Doors Project will provide opportunities for inmates to improve their ability to transition back into the community as responsible citizens, obtain employment and open educational doors. The Kent Police Department is partnering with New Connections of South King County to provide life skills classes to offenders ' while they are incarcerated in the CKCF and community transition services to the offenders upon their release from jail. The Kent Police Department is also partnering ' with Renton Technical College to provide Adult Basic Education (ABE) and General Education Development (GED) test preparation and testing to offenders in the CKCF. ' These educational opportunities are rarely offered in a municipal jail setting. The CKCF Opening Doors Project will demonstrate the benefits of assisting offenders at local and municipal jails as opposed to inmates in prisons with longer City of Kent Opening Doors Project 1 sentences to transition from jail to the community as responsible citizens. This project will demonstrate how local jails can translate the lessons learned from longer term educational programs in prisons to time limited life skills and adult basic education instruction. Either party may terminate this agreement upon 30 days written notice The City agrees to purchase from the Reporter one full page (equivalent to 65 column inches at $21.31 per column inch) at a monthly rate of$1,385.00. This price will include printing in black ink plus one extra spot color, the color to be determined by the Reporter, in coordination with the City. Full color may be purchased for use in the ad at a cost of$150,per issue. The page shall be placed as far forward in the editions in which the City newsletter appears as possible, unless an alternate location is agreed to by both the City and the Reporter The City will have full control over the name, editorial content, and layout of the City newsletter, and will provide the Reporter with camera ready or electronic copy of the newsletter for production purposes In each edition of the Reporter that includes the City newsletter, the Reporter will provide the ' City with a front page teaser indicating that the City newsletter is included inside the newspaper The City and the Reporter will mutually review and determine postal carrier routes for the publication's delivery This review shall ensure that the entire incorporated boundary of the City receives the publication. These routes may be updated monthly as needed to accommodate changes in the City's incorporated boundaries The Reporter agrees to direct mail 28,000 copies of the Reporter to residents within the Kent city limits. Additional copies will be produced and mailed at a marginal cost of $240 per 1,000 copies. For 2005 these additional copies include homes, apartments and businesses within the City incorporated ' boundary. The parties agree that work will begin on the tasks described in Section I above immediately upon the effective date of this Agreement Upon the effective date of this Agreement, Consultant shall complete the work described in Section I during the year 2005 and ending on December 31, 2005 CONSULTANT SERVICES AGREEMENT- 1 (Over$10,000) III. COMPENSATION. A The Citv shall pay the Consultant, based on time and materials, an amount not to exceed$60,000 for the �crvices described in this Agreement, plus expenses as described below The City shall reimburse the Consultant for expenses incurred while doing business on the City's behalf, which shall be limited to meals, parking, lodging, mileage at the State of Washington's standard reimbursement rate, phone calls attributable to City of Kent business, legislative session office space and expenses, and other travel and conference/meeting expenses where such attendance is directed by the City. Where such expenses are incurred in connection with work on legislative or regulatory issues affecting the Contractor's other relevant clients, these expenses shall be pro-rated to the maximum extent practicable This is the maximum amount to be paid under this Agreement for the work described in Section I above, and shall not be exceeded without the prior written authorization of the City in the form of a negotiated and executed supplemental agreement The Consultant agrees that the hourly or flat rate charged by it for its services contracted for herein shall remain locked at the negotiated rate(s) for a period of one (1)year from the effective date of this Agreement B The Consultant shall submit monthly payment invoices to the City for work performed, and a final bill upon completion of all services described in this Agreement. Invoices shall be submitted monthly for one-twelfth (1/12) of the annual contract amount and any relevant expenses as detailed above The City shall provide payment within forty-five (45) days of receipt of an invoice. If the City objects to all or any portion of an invoice, it shall notify the Consultant and reserves the option to only pay that portion of the invoice not in dispute. In that event, the parties will immediately make every effort to settle the disputed portion IV. INDEPENDENT CONTRACTOR. The parties intend that an Independent Contractor- Employer Relationship-will be created by this Agreement and that the Consultant has the ability to control and direct the performance and details of its work, the City being interested only in the results obtained under this Agreement V. TERMINATION. Either party may terminate this Agreement, with or without cause, upon providing the other party thirty (30) days written notice at its address set forth on the signature block of this Agreement After termination, the City may take possession of all records and data within the Consultant's possession pertaining to this project, which may be used by the City without restriction If the City's use of Consultant's records or data is not related to this project, it shall be without liability or legal exposure to the Consultant VI. DISCRIMINATION. In the hiring of employees for the performance of work under this Agreement or any subcontract, the Consultant, its subcontractors, or any person acting on behalf of the Consultant or subcontractor shall not, by reason of race, religion, color, sex, age, sexual orientation, national origin. or the presence of any sensory, mental, or physical disability, discriminate against any person who is qualified and available to perform the work to which the employment relates Consultant shall execute the attached City of Kent Equal Employment Opportunity Policy Declaration, Comply with City Administrative Policy 12, and upon completion of the contract work, file the attached Compliance Statement CONSULTANT SERVICES AGREEMENT-2 (Over$10,000) VII. INDEMNIFICATION. Consultant shall defend, indemnify and hold the City, its officers, officials, employees, agents and volunteers harmless from any and all claims, injuries, damages, losses or suits, including all legal costs and attorney fees, ansing out of or in connection with the Consultant's performance of this Agreement, except for that portion of the injuries and damages caused by the City's negligence The City's inspection or acceptance of any of Consultant's work when completed shall not be grounds to avoid any of these covenants of indemnification Should a court of competent jurisdiction determine that this Agreement is subject to RCW 4 24.115, then, in the event of liability for damages arising out of bodily injury to persons or damages to property caused by or resulting from the concurrent negligence of the Consultant and the City, its officers, officials, employees, agents and volunteers, the Consultant's liability hereunder shall be only to the extent of the Consultant's negligence IT IS FURTHER SPECIFICALLY AND EXPRESSLY UNDERSTOOD THAT THE INDEMNIFICATION PROVIDED HEREIN CONSTITUTES THE CONSULTANT'S WAIVER OF IMMUNITY UNDER INDUSTRIAL INSURANCE, TITLE 51 RCW, SOLELY FOR THE PURPOSES OF THIS INDEMNIFICATION. THE PARTIES FURTHER ACKNOWLEDGE THAT THEY HAVE MUTUALLY NEGOTIATED THIS WAIVER The provisions of this section shall survive the expiration or termination of this .Agreement VIII. INSURANCE. The Consultant shall procure and maintain for the duration of the Agreement, �Y insurance of the types and in the amounts described in Exhibit A attached and incorporated by this reference IX. EXCHANGE OF INFORMATION. The City will provide its best efforts to provide reasonable accuracy of any information supplied by it to Consultant for the purpose of completion of the work under this Agreement X. OWNERSHIP AND USE OF RECORDS AND DOCUMENTS. Original documents, drawings, designs, reports, or any other records developed or created under this Agreement shall belong to and become the property of the City All records submitted by the City to the Consultant will be safeguarded by the Consultant Consultant shall make such data, documents, and files available to the City upon the City's request. The city's use or reuse of any of the documents, data and files created by Consultant for this project by anyone other than Consultant on any other project shall be without liability or legal exposure to Consultant XI. CITY'S RIGHT OF INSPECTION. Even though Consultant is an independent contractor with the authority to control and direct the performance and details of the work authorized under this Agreement, the work must meet the approval of the City and shall be subject to the City's general right of inspection to secure satisfactory completion. XII. WORK PERFORMED AT CONSULTANT'S RISK. Administration and staff desire to increase the membership of the board from seven (7) to nine (9) members in order to broaden the perspective and increase the input on issues relating to diverse cultures being considered by the board Mr. Brubaker advised that this is a housekeeping matter to establish the approval as was previously approved per Ordinance 3570 Bruce White moved to recommend Council adopt the proposed ordinance increasing the Diversity Advisory Board members from seven (7) to nine (9) members. Julie Peterson seconded the motion,which passed 3-0. i 2005 BUDGET ADOPTION ORDINANCE Finance Director Bob Nachlinger presented the 2005 Budget Adoption Ordinance Mr Nachhnger advised that the Operations Committee has previously reviewed the Proposed 2005 Annual Budget in two of its meetings. The Budget has also been discussed at two public hearings and been reviewed by the City Council twice in workshops. The Proposed 2005 Annual Budget now comes to the Operations Committee for its recommendation to the City Council at its December 14, 2004, meeting. Incumbent Public Works Director Larry Blanchard addressed the Operations Committee regarding the critical areas consultants and the proposed new critical areas engineering in the sewer drainage fund with questions by the , Committee. Bruce White moved to restore the consulting fees as part of the budget and remove the critical area engineering full time employee position from the budget, and move the consulting fees from the General Fund to the Sewer Drainage Fund. Tim Clark seconded the motion, which passed 2-1. i 1 1 Operations Committee Minutes December 7, 2004 Page. 3 2004 ACCOUNTS RECEIVABLE WRITE OFFS Finance Director Bob Nachlinger presented the 2004 Accounts Receivable Write Offs to the Operations Committee recommending approving the write-off of seven (7) miscellaneous accounts receivable in the amount of $3,388 88, three (3) utility billing receivables in the amount of $5,673.24, two (2) LID penalties in the amount of$9,622 27, and an Engineering bill in the amount of$23,793 00 for a total of$42,477 39 Thirteen (13) accounts im oked in the requested write-off amounts for the 2004 fiscal year Of these accounts, four (4) are bankruptcies, two (2) are writing off the penalties for late payments of LID bills, four (4) relate to repairs to guardrails, two (2) are NSF checks, and the last is a dispute with a contractor on a construction project. The amount requested to be written off represents approximately 1% of the total billings of the City annually The budget impact of this transaction will be a failure to collect the $42,477.39 which would otherwise be included in City revenues. COMPREHENSIVE PLAN AMENDMENT CAPITAL IMPROVEMENT PLAN 2005- 2010 - ORDINANCE Assistant Finance Director Cliff Craig presented the Comprehensive Plan Amendment — Capital Improvements Plan 2005-2010 Ordinance. as well as a PowerPoint presentation. The Ordinance relates to CPA-2004-3 amending the Capital Facilities Element of the Comprehensive plan to include the Capital Improvement Plan for 2005-2010 Julie Peterson moved to recommend approval of an ordinance adopting the 2005-2010 Capital Improvement Plan with incorporation into the Capital Facilities element of the Comprehensive Plan. The motion was seconded by Bruce White and passed 3-0. 3 Operations Committee Minutes December 7, 2004 Page: 4 COMPREHENSIVE PLAN AMENDMENT AND REVISIONS TO KENT CITY CODE 12.13: SCHOOL DISTRICTS' CAPITAL FACILITIES PLANS—ORDINANCE Planning Manager Charlene Anderson presented the Comprehensive Plan Amendment and Revisions to Kent City Code 12.13• School Districts' Capital Facilities Plans The amendment incorporates the 2004/05 — 2009/10 Capital Facilities Plans of the Kent, Federal Way, and Auburn School Districts, including updated School Impact Fees, as recommended by staff The school districts are required to submit for annual Council review their updated capital facilities plans Kent, Federal Way, and Auburn submitted their updated Plans and a public hearing was held on November 16, 2004. Ms Anderson noted that Auburns plan was increased and Kent and Federal Ways plans decreased. Fred High of the Kent School District and Mike Newman for the Auburn School District each addressed the Operations Committee Julie Peterson moved to add the December 3, 2004, letter from Kent School District Superintendent Barbara Grohe as part of the record. KENT REPORTER CONTRACT Multimedia Manager Dea Drake presented the 2005 Kent Reporter Contract Ms DrakeWaldrop advised that the City of Kent began publishing the Kent Connections city newsletter in the Kent Reporter in 1998 The content and design are completed in-house and forwarded to the Kent Reporter for publication and distribution The Kent Reporter is distributed to approximately 68,000 Kent area businesses, homes and apartments Community feedback on the newsletter in the 2004 citizen sure ey indicates that 76% of respondents read L the newsletter occasionally or every issue Among those who have read Kent Connections, 75% rate the value as excellent or good It was also noted that respondents who have voted in city elections in the last two years are more likely to read "every" issue Communicating with our citizens has been a high priority item for council This continues to be a more cost effective solution than direct mail options Staff recommendation is to continue this publication in 2005, which is not to exceed S60,000 00, including sales tax. Julie Peterson seconded the motion, which passed 3-0. 1 Operations Committee Minutes January 4, 2005 Page: 2 RENTON TECHNICAL COLLEGE CONTRACT- APPROVE ORDINANCE Deputy Police Chief Chuck Miller presented the Renton Technical College Contract Deputy , Chief Miller advised that that the contract provides Adult Basic Education (ABE) and GED instruction and testing to offenders supervised by the City of Kent Corrections Facility as a partner in the Opening Doors Project The City is contracting with Renton Technical College as a sub grantee to the C ity's grant award from the Department of Education, Fund for the Improvement of Post Secondary Education. Julie Peterson moved to recommend the City Council approve and authorize the Mayor to sign the Consultant Services Agreement with Renton Technical College and placing this on the Consent Calendar of the January 18, 2005 City Council meeting. GOVERNMENT RELATIONS SERVICES CONTRACT ' Chief Administrative Officer Mike Martin presented the Government Relations Services Contract with Outcomes by Levy. Mr. Martin advised the City contract with Doug Levy of Outcomes by Levy annually for government relations consulting services The services provided by Mr. Levy are the same kinds of lobbying services previously provided on critical City legislative issues and are outlined further in the agreement. The agreement as previously is the same as in year's past. The agreement calls for a monthly fee of $5,000 00 plus expenses, which is an increase over last years monthly fee of$4,166.67 Bruce White moved to recommend the City Council approve and authorize the Mayor to sign the Consultant Services Agreement with Outcomes by Levy by 2005 government relations consulting services. United States Fish and Wildlife Services Contract Bill Wolinski, Environmental Engineering Manager stated this contract will allow the USFWS to assist the City of Kent in the development of the Clark Springs Habitat Conservation Plan and associated environmental documents Debbie Raplee moved to authorize the Mayor to sign the contract with the United States Fish and Wildlife Service(USFWS) in the amount of$95,550 to provide assistance to the City of Kent in the development of the proposed Habitat Conservation Plan (HCP) and for the preparation of the associated environmental documents including an Environmental Impact Statement (EIS) upon concurrence of the language therein by the City Attorney and the Public Works Director.
