2. SUMMARY STATEMENT: As established by Council, this date has been set for
the public hearing on the confirmation of the final assessment roll for LID 356. The
City has determined that certain properties are specially benefited by the sanitary sewer
system and has proposed to proportionately assess these properties in accord with those
special benefits. Because the proposed final assessment roll affects specific, individual
property owners, the Council sits in a quasi-judicial capacity as a board of equalization
for this matter. The Public Works Director will make a presentation, followed by a
brief informational statement from the City Attorney before opening the hearing.

AN ORDINANCE of the City of Kent, Washington,
approving and confirn ing the assessments and assessment
roll of Local Improvement District No. 356 for the
construction of an 8" sanitary sewer system with 6" side
sewer stubs to the right-of-way line, as provided by
Ordinance No. 3657, and levying and assessing a part of the
' cost and expense thereof against the several lots, tracts,
parcels of land and other property as shown on the
assessment roll
RECITALS
A. The assessment roll levying the special assessments against the property
located in Local Improvement District No. 356 in the City of Kent, Washington (the
i "City"), has been filed with the City Clerk as provided by law
' B. Notice of the time and place of the hearing to make objections and protests
to the roll was published at and for the time and in the manner provided by law fixing the
time and place of the hearing for September 21, 2004, at 7:00 p.m., local time, in the
Council Chambers in the City Hall, Kent, Washington, and further notice of the hearing
' was mailed by the City Clerk to each property owner shown on the roll.

C. At the time and place fixed and designated in the notice, the hearing was
held, all written protests received were considered, and all persons appearing at the
hearing who wished to be heard were heard, and the City Council, sitting and acting as a
Board of Equalization for the purpose of considering the roll and the special benefits to be
received by each lot,parcel, and tract of land shown upon that roll, including the increase
and enhancement of the fair market value of each parcel of land by reason of the
improvement,overruled all such protests.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
I WASHINGTON, DO ORDAIN as follows:
ORDINANCE '
SECTION]. - Roll Confirmation The assessments and assessment roll of '
Local Improvement District No. 356, which has been created and established for the
purpose of constructing an 8" sanitary sewer system with 6" side sewer stubs to the nght- i
of-way line, as provided by Ordinance No 3657, as the same now stands, is approved
and confirmed in all things and respects in the total amount of$165,000.

SECTION2. - Special Benefit. Each of the lots, tracts, parcels of land, and
other property shown upon the assessment roll is determined and declared to be
specially benefited by this improvement in at least the amount charged against those
properties, and the assessment appearing against them is in proportion to the several
assessments appearing upon the roll. There is levied and assessed against each lot,
tract, or parcel of land and other property appearing upon the roll the amount finally
charged against the same.

SECTION 3. —Notice of Roll. The assessment roll as approved and confirmed
' shall be filed with the Finance Director of the City for collection, and the Finance
Director is authorized and directed to publish notice as required by law stating that the
roll is in the Director's hands for collection and that payment of any assessment or any
portion of that assessment can be made at any time within thirty (30) days from the
date of first publication of that notice without penalty, interest or cost, and that
thereafter the sum remaining unpaid may be paid in ten (10) equal annual installments
of principal and interest The estimated interest rate is stated to be six (6.0)% per
annum,with the exact interest rate to be fixed in the ordinance authorizing the issuance
' and sale of the local improvement bonds for Local Improvement District No. 356. The
first installment of assessments on the assessment roll shall become due and payable
during the thirty (30) day period commencing one year after the date of first

publication by the Finance Director of notice that the assessment roll is in his or her
hands for collection, and annually thereafter each succeeding installment shall become
1 due and payable in like manner. If the whole or any portion of the assessment remains
unpaid after the first thirty (30) day period, interest upon the whole unpaid sum shall
be charged at the rate as determined above, and each year thereafter one of the
installments, together with interest due on the unpaid balance, shall be collected. Any
installment not paid prior to expiration of the thirty (30) day period during which that
i installment is due and payable shall become delinquent. Each delinquent installment
■ shall be subject, at the time of delinquency, to a charge under Kent City Code Section
I3.22.030 of a penalty levied on both principal and interest due upon that installment
equal to the rate fixed in the ordinance authorizing the issuance and sale of the local

improvement bonds for Local Improvement District No. 356, plus five (5)percent. All '
delinquent installments also shall be charged interest at the rate as determined above. t
The collection of delinquent installments shall be enforced in the manner provided by
law.
SECTION 4. - Severability If any one or more section, subsections, or
sentences of this ordinance are held to be unconstitutional or invalid, such decision
shall not affect the validity of the remaining portion of this ordinance and the same
shall remain in full force and effect.
SECTION S. - Effective Date. This ordinance shall take effect and be in force
five (5)days from and after its publication as required by law.

SUBJECT: L.I D 356 111`s Avenue Sanitary Sewers (SE 256h Street to 850 feet north)
Public Hearing on the Confirmation of the Final Assessment Roll
September 21, 2004 has been scheduled for the confirmation hearing on the Final Assessment Roll for
the above referenced L.I.D.project.

BACKGROUND
1 The City received a petition for the installation of sanitary sewers in the vicinity of I I Id' Avenue SE
and SE 256 h Street in the residential plat of Coates Addition as shown on the attached map. Eight of
the eleven lots (73%) signed the petition. Subsequently, all property owners within the project area
were contacted and there was adequate support to proceed with the L.I.D. formation. The project area
is inside the city limits and Kent's sewer service area.
' The proposal was reviewed by the Public Works Committee on July 7, 2003 and the Resolution of
Intent was passed by City Council on July 15, 2003 setting the hearing date for August 19, 2003. One
protest (9%) was received at the hearing. City Council passed Ordinance No. 3657 on September 2,
2003 forming the LID and ordering the construction of the sewer system.
1 Bids we opened for the project on March 25, 2004 and the construction contract was awarded to King
Construction Co.,Inc. Construction is near completion and we are ready to finalize the LID.
NEED FOR SEWERS
The project area consists an older residential plat (1965) developed with septic systems. Five of the
1 eleven lots remain vacant needing sewer to be developed It is not known how many existing septic
systems are technically in a state of failure, however, we understand from the residence that there are
septic problems in the area. One owner said his septic system is near total failure and needs frequent
pumping of the septic tank. He is unable to get a perrrnt to rebuild his drain field.

The soil type within the project area is poorly rated for septic system use. According to the soil
Conservation Service (US Dept. of Agriculture) Soil survey for King County, the soil type as mapped
is rated severe limitation for septic dram fields. The soil series is designated as AgB (Alderwood
gravelly sandy loam, 0 to 6% slopes). This soil exhibits very slow permeability below a depth of 24-
40 inches and a seasonal high water table. Effluent and drainage move laterally over the imperious
layers. Effluent may come to the surface in yards and in roadside ditches.
Usually it is difficult to repair septic problems, especially on small lots such as these with limited
space. Sanitary sewers are usually the most feasible, economical and long term method for addressing
these problems, especially when numerous property owners in a neighborhood support sewer
installation as is the case with this project.
The Department of Public Health has told us that the life expectancy of a septic system is 20 to 30
years depending on use and maintenance and that they are a short term disposal method until public ,
sewers become available The project area has greatly exceeded this time frame and the reports of
failures substantiate that these systems are at or are near the end of their useful life. They also say that
the cost of septic repairs may be as high as converting to public sewers. The latest state codes make
septic repairs, if allowed,more difficult and expensive.
Five of the eleven lots in the proposed L.I.D. are vacant Sanitary sewer is needed to make these lots '
developable Without sewer, the owners cannot develop the lots or realize the full value of the
property upon selling. During the LID formation process an owner of an undeveloped lot (has only a
garage, no house) protested since he has only a garage. This property and the other vacant lots need ,
the sewer as explained above and therefore benefit fully from the sewer installation.
The project area is adjacent to a stream and mapped wetland which is tributary to Upper Mill Creek.
Septic systems are a threat to water quality.
SANITARY SEWER IMPROVEMENTS '
The project constructed an 8" sanitary sewer system with 6" side sewer stubs to the right-of-way line
for each of the 11 properties included in the L.I.D.boundary. '

The total final L.I.D. assessment of$165,000 is the same as the preliminary assessment. All lots are
platted single family lots receiving one side sewer connection so all are assessed equally. The final
assessment is $15,000 per lot.
There are no City owned properties within the project,therefore no assessments to be paid by the City.
However, the City is contributing approximately $70,000 in sewer utility funds. Nine of the twenty
lots along the sewer have already obtained service from a sewer east of the plat. Therefore, there are
1 only 11 of the 20 lots remaining to share the cost of the sewer. If all 20 lots were included, the
estimated assessment would be approximately $15,000 per lot. The City will fund the costs in excess
of the $15,000 per lot assessment.
PAYMENT OF ASSESSMENT
1 Upon Council passing the Ordinance confirming the Final Assessment Roll, there is a 30-day period in
which any portion or all of the assessment can be paid without interest charges. After the 30-day
period, the balance is paid over a ten-year period wherein each year's payment is one-tenth of the
principal plus interest on the unpaid balance. The market determines the interest rate at the time the
L.I.D bonds are sold to the public
iMANDATORY SEWER CONNECTION
The City Code states that all residences, whether within or outside the City limits, located within 200
feet of a City of Kent salutary sewer shall be required to connect to the sewer and shall be billed for the
service. The Code provides that compliance with this provision be within 90 days after the date of
1 official notice In the case of a public health or safety hazard, compliance shall be within 20 days of
official notification.
1 Following acceptance of the construction of the project, the City will send each property owner an
official notice that the sanitary sewer service is available to the parcel and is within 200 feet of the
house. Following the compliance period, all developed properties that have not yet applied for a side
' sewer permit will automatically be added to the sewer billing list.

Public Hearing on the Confirmation of the Final Assessment Roll
September 21, 2004 has been scheduled for the confirmation public hearing on the Final
Assessment Roll for the above referenced L I D project
BACKGROUND:
The City received a petition for the installation of sanitary sewers in the vicinity of SE 256`i'
Street and 12e PI SE as shown on the attached map. Subsequently, all property owners within
the project area were contacted and there was adequate support to proceed with the L.I.D.
formation. Four of the six lots (67%) signed the petition. The project area is inside of the City
limits and Kent's sewer service area.
The proposal was reviewed by the Public Works Committee on August 4, 2003 and the
Resolution of Intent was passed by City Council on August 19, 2003 setting the hearing date for
September 16, 2003. There were no protests received at the hearing. City Council passed
Ordinance No 3662 on October 7, 2003 forming the L.I.D and ordering the construction of the
sewer system.
Bids were opened for the project on March 2, 2004 and the construction contract was awarded to
' King Construction Co., Inc. Construction is near completion and we are ready to finalize the
L.I.D.
NEED FOR SEWER:
The project area is an older residential area developed with septic systems. All six lots have
homes. It is not known how many existing septic systems are technically in a state of failure,
however, we understand from the residence that there have been septic problems in the area Our
understanding is that there are no serious septic problems at this time. Due to the age of the
septic systems and the potential for problems, the petitioners wanted to upgrade to sanitary
sewer.
The soil type within the project area is poorly rated for septic system use. According to the Soil
Conservation Service (US Dept. of Agriculture) soil survey for King County, the soil type as
mapped is rated severe limitation for septic drain fields. The soil series is designated as AgB
(Alderwood gravelly sandy loam, 0 to 6% slopes). This soil exhibits very slow permeability

below a depth of 24-40 inches and a seasonal high water table. Effluent and drainage move ,
laterally over the imperious layers. Effluent may come to the surface.
Usually it is difficult to repair septic problems, especially on small lots such as these with linuted
space. Sanitary sewers are usually the most feasible, economical and long term method for
addressing these potential problems, especially when numerous property owners in a
neighborhood support sewer installation as is the case with this project.
The Department of Public health has told us that the life expectancy of a septic system is twenty '
to thirty years depending on use and maintenance and that they are a short term disposal method
until public sewers become available. The project area has exceeded this time frame, therefore,
these systems are at or are near the end of their useful live. They also say that the cost of septic
repairs may be as high as converting to public sewers. The latest state codes make septic repairs
more difficult and expensive than in the past.
In addition to the need for sewers in this area to replace the old septic systems, there are
environmental concerns. The project area is located near two mapped wetlands located along the
northwest tributary to the west fork of Soosette Creek. Septic systems are a threat to water
quality.
SANITARY SEWER IMPROVEMENTS '
The project constructed an 8" sanitary sewer system with 6" side sewer stubs to the nght-of-way
line for each of the 6 properties included in the L.I D. boundary. ,

L I.D. $90,000
The total final L.I.D. assessment of$90,000 is the same as the preliminary assessment. All lots
are single farmly lots receiving one side sewer connection so all are assessed equally. The final
assessment is$15,000 per lot. There are no City owned properties within the project ,
PAYMENT OF ASSESSMENT
Upon Council passing the Ordinance confirming the Final Assessment Roll, there is a 30-day
period in which any portion or all of the assessment can be paid without interest charges. After
the 30-day period, the balance is paid over a ten-year period wherein each year's payment is one-
tenth of the principal plus interest on the unpaid balance. The market determines the interest rate
at the time the L.I.D. bonds are sold to the public.

1 The City code states that all residences located within 200 feet of a City of Kent sanitary sewer
shall be required to connect to the sewer and shall be billed for the service. The Code provides
that compliance with this provision be within 90 days after the date of official notice. In the case
1 of a public health or safety hazard,compliance shall be within 20 days of official notification.
Following acceptance of the construction of the project, the City will send each property owner
an official notice that the sanitary sewer service is available to the parcel and is within 200 feet
of the house. Following the compliance period, all properties that have not yet applied for a
sided sewer pernut will be subject to paying the City's monthly sewer service charges as the
penalty for not connecting.
WATER MAIN CONSTRUCTION
For sometime the water main on 120 PI SE has been in need of replacement. The City funded
1 and constructed a new water main in conjunction with the sanitary sewer. The road restoration
costs were shared between the water and sewer projects, thereby reducing the sewer construction
costs.

The regular meeting of the Kent City Council was called to order at 7:00 p.m. by Mayor White.
Councilmembers present: Clark, Harmon, Peterson,Ranniger, Raplee, and White. Council
Member Thomas was excused from the meeting. (CFN-198)
CHANGES TO AGENDA
A From Council, Administration,or Staff. (CFN-198) Mayor White added Consent Calendar
Item L and it was agreed that discussion of Other Business Item 7A would take place prior to
public hearings.
PUBLIC COMMUNICATIONS
A. Employee of the Month. (CFN-147) Mayor White announced that Kathleen Studer,
Prosecutor Assistant, was chosen as Employee of the Month.
B. Introduction of Appointee. (CFN-198) Mayor White introduced Pauline Thomas, his
appointee to the Civil Service Commission.
OTHER BUSINESS
A. Motorized Wheeled Transportation Devices Ordinance. (CFN-1294) The proposed
ordinance regulates the use of motorized scooters and other similar motorized devices that are not
already regulated by state law. The Public Safety Committee approved the ordinance at its
August 19, 2004,meeting. In addition,the Committee asked the Law Department to provide
Council with language for impounding these devices, which is in a memo dated August 31, 2004.
RANNIGER MOVED to adopt Ordinance No. 3707 regulating the use of motorized scooters and
other similar devices in the form proposed to Council but deleting the words "except paved trails"
in Subsection 9.44.020(a)(1). Harmon seconded. The City Attorney explained the details of the
ordinance. Comments regarding safety and age issues, as well as of appreciation, were made by
James Larkin, 5029 S. 233rd Place, Leslie Holland, 23928 57 Ave. So.,D. Evans, Paul Peterson,
28116 122nd Place, and Nancy Rudy, 4219 S 247 Court.
CLARK MOVED to make emails on this issue part of the record. Peterson seconded and the
motion carved.
After a brief discussion by Councilmembers, the motion to adopt Ordinance No. 3707 carried. It
was noted that the ordinance will take effect in thirty days.
PUBLIC HEARINGS
A. LID 355, SE 216th and 104th Place SE Sanitary Sewers, Final Assessment Roll.
(CFN-1279) The City has determined that certain properties are specially benefited by this
sanitary sewer system and has proposed to proportionately assess these properties in accord with
those special benefits.

Public Works Director Wickstrom explained the project and noted that the neighborhood
requested the LID due to system failures. He said that two protests have been received but that no
evidence was provided for Lot 21 and that, although an appraisal was done for Lot 22,it did not
compare similar lots. PETERSON MOVED to make the protests from Matthew and Catrine Ross
and Scott and Jami Moser a part of the public record. White seconded and the motion carried.
Mayor White opened the public hearing. Matt Ross, 10412 SE 219, Lot 21, said the sewer system
is unnecessary. Scott Moser, 10411 SE 219, Lot 22 agreed. Loren Bonholzer, 10426 SE 219, Lot
19, Renee Ford, 21905 105 Ave. SE,Barry Ford, 21905 105 Ave. SE, Lawrence Shoemaker,
21915 105 Ave. SE, Catrine Ross, 10412 SE 219, spoke in opposition, saying the cost was too
high and the process was unfair. There were no further comments from the audience and
PETERSON MOVED to close the public hearing. Clark seconded and the motion carried.
Wickstrom addressed the issues brought up by the speakers, including the length of time to pay the
assessments, and answered questions from Council members.
WHITE MOVED to adopt Ordinance No. 3708 which approves and confirms the final assessment
roll on Local Improvement District 355 and amend Section 3,Notice of Roll, to strike 10 equal
annual installments and replace that with 15 equal annual installments, and to modify the
assessment roll for Lot 22 to $8,000 pursuant to the appraisal provided by the property owner.
Raplee seconded. The motion failed with Clark,Harmon,Peterson and Ranniger opposed, and
White and Raplee in favor. PETERSON MOVED to adopt Ordinance No. 3708 which approves
and confirms the final assessment roll on Local Improvement District 355. Clark seconded.
WHITE MOVED to amend the motion to modify Section 3 by striking 10 equal annual
installments and changing it to 15 equal annual installments. Harmon seconded and the motion
carved with Clark and Peterson opposed. The main motion to adopt Ordinance No. 3708 then
carried unanimously.
B. Six Year Transportation Improvement Plan Resolution. (CFN-164) Each year the City is
required to update the Six-Year Transportation Improvement Plan. Cathy Mooney, Senior
Transportation Planner, explained the proposed plan. Mayor White opened the public hearing.
There were no comments from the audience and HARMON MOVED to close the public hearing.
Clark seconded and the motion carried. WHITE MOVED to adopt Resolution No. 1684
approving the 2005-2010 Six-Year Transportation Improvement Plan. Harmon seconded and the
motion carried.

Public Hearing Date. (CFN-102) Resolution No. 1685 scheduling a public hearing for
November 2,2004, for a Street Vacation Application and Petition filed by the Kent School
District, to vacate a portion of McMillin Street between State and Kennebeck was adopted.
J. Boeing Development Agreement. (CFN-1273) Ordinance No. 3710, authorizing the Mayor
to sign the Pacific Gateway Development agreement for the Boeing Kent Space Center property
with the Boeing Company was adopted.
K. Civil Service Commission Re-appointment. (CFN-122) The Mayor's re-appointment of
Ms. Pauline Thomas to continue serving as a member of the Kent Civil Service Commission was
confirmed.

L. Council Absence. (CFN-198) An excused absence from tonight's meeting for Council
Member Thomas was approved.

Administrative Reports. (CFN-198) Martin reminded the Councilmembers of an Executive

CONTRACT—APPROVE
2. SUMMARY STATEMENT: As recommended by The Kent Lodging Tax Advisory
Board, approve a three-year interlocal agreement with Seattle Southside Visitor Services
(SSVS) for$300,000, in addition to a onetime charge of$25,200 to update the Seattle
Southside Vacation Planner.
Seattle Southside Services is a program offered jointly by the cities of SeaTac and Tukwila that
competitively markets South King County as an ideal travel destination. Kent hotels, tourist
attractions, events, retail destinations and City venues would be featured in SSVS marketing
materials, (see Exhibit 1 for a detailed list of services). In addition, as a result of Kent's
participation, SSVS would be able to hire a business community marketing liaison.
Partnering with SSVS is consistent with the City's tourism strategy as articulated in the City of
Kent Economic Development Strategic Plan 2003-2008. This partnership with Seattle
Southside was initiated by the City of Kent and has been the subject of numerous LTAB
meetings and presentations. SSVS' total budget for 2005 is proposed at $840,000; Kent's
portion would be $100,000.

Tourism and Marketing Services with Seattle Southside Visitor Services
Following are the list of services available to the City of Kent if Kent signs the 2005-2007 interlocal
agreement for tourism and marketing services ($100,000 annually) with Seattle Southside Visitor
Services. These services are also available to the Cities of Tukwila and Sea-Tac, which currently
make up Seattle Southside Visitor Services.

program, some businesses (but not hotels, major City venues or major tourist attractions) will pay a
small fee for marketing strategies in which they choose to participate. These activities are noted

Vacation Planner:
SSVS publishes a 40+page, four-color Vacation Planner that promotes the area's reasonably priced
hotels, great shopping and dining, central location and easy access to major attractions in the Seattle
& Tacoma area Hotel amenities are featured in an easy-to-use grid format. Over 80,000+ are
distributed annually. Hotels,motels, RV parks,festivals, attractions and full services restaurants are
listed in this publication. The City of Kent would supplement the $100,000 annual contact with
SSVS with an additional $25,200(from 2004 unallocated funds) to update and add rages to the
vacation planner to reflect Kent's hotels,restaurants, attractions, etc. The vacation planner would

BETWEEN SEATTLE SOUTHSIDE VISITOR SERVICES AND CITY OF KENT
This Interlocal Agreement, made and entered into this _, 2004, by and
between the Seattle Southside Visitor Services, a tourism marketing program offered by the i
cities of Tukwila and SeaTac, hereinafter called SSVS and the City of Kent, a municipal ■
corporation, hereinafter called Kent.
RECITALS
WHEREAS, Kent desires to purchase professional tourism & marketing services for the
purpose of increasing awareness of Kent and the surrounding area as a tourist destination;
WHEREAS, SSVS is willing to expand the scope of Its existing tourism and marketing
services to Include Kent;
WHEREAS, it is agreed that the most desirable arrangement for conducting this operation
is an Interlocal Agreement;
NOW THEREFORE, for the reasons recited above, and in consideration of the mutual
covenants contained in this agreement, the parties agree as follows:
SECTION ONE. t
SCOPE AND DESCRIPTION
In accordance with the interlocal agreement provisions of Chapter 39.34 RCW, SSVS
agrees to provide tourism and marketing services for the cities of Tukwila, Sea Tac, and Kent
(the "combined cities") beginning January 1, 2005. This Interlocal Agreement shall be conducted
under the program title of Seattle's Southside Visitor Services (SSVS) from a place of service
located in the building known as Fairway Center, Building A, 14220 Interurban Avenue South,
Suite 130, City of Tukwila, County of King, and State of Washington. Services include but are not
limited to providing comprehensive visitor information services to tourists and facilitating input
from area tourism businesses for the purpose of developing, implementing and evaluating '
annual marketing and media plans, as more fully described under Section Three. The marketing
and media plans include budget information, implementation schedules and evaluation
strategies. SSVS is designated as the Administrator responsible for administering this joint
agreement.

SECTION TWO.
CONTRIBUTIONS
Program Expenses: Kent will contribute to program expenses for SSVS (including but
not limited to overhead, salaries and benefits, rent, utilities, supplies, meetings, postage, travel
and education, associations fees, phones, media campaigns, special projects and other misc.
expenses). Kent's contribution for the first year's (12 months) program expenses is valued at
ONE HUNDRED THOUSAND DOLLARS ($100,000)to be paid to SSVS in twelve equal
payments of EIGHT THOUSAND, THREE HUNDRED AND THIRTY THREE DOLLARS AND
THIRTY THREE CENTS ($8,333.33). KENT will pay SSVS at the beginning of each month
beginning February 1, 2005. The annual program contribution for Kent for 2006 and subsequent
1 years may be adjusted for inflation and will be determined annually during the budget process.
Kent will reimburse its proportionate share of SSVS's program commitments for the duration of
the Interlocal Agreement. Tukwila will invoice Kent monthly.
iIn addition, Kent will contribute a maximum of TWENTY FIVE THOUSAND AND TWO
HUNDRED DOLLARS ($25,200.00) toward an update of the vacation planner and a new map to
include Kent as described below. Kent will pay SSVS at the completion of the vacation planner
update, estimated to be by December 31, 2004. Tukwila will invoice Kent at the completion of
this project.
Kent Specific Projects: Kent will implement Kent specific projects. Kent will manage and
assume 100% financial responsibility for all Kent specific tourism projects. At such time as Kent
and SSVS mutually agree, SSVS may advise or assist Kent or, with Kent's prior approval, the
Kent Chamber of Commerce, regarding Kent specific projects (including sport tournament bids
and Kent's specific lodging website: www.kenthotels.org, etc,).
SECTION THREE.
CONDUCT OF INTERLOCAL AGREEMENT
SSVS shall have following responsibilities as administrator of this Interlocal Agreement.
SSVS will:
(a) conduct, manage, operate, and arrange all business affairs of the tourism and marketing
services, hire a Business Community Liaison and other employees as necessary to carry
on the business, determine the wages and make contracts with the employees, enter into
other contracts in the name of and for SSVS, and in general do anything ordinarily done
by the manager of a business.
j (b) facilitate the involvement of Kent tourism businesses into the existing SSVS Tourism
Networking Committee, which will be known as Seattle's Southside Tourism Networking
Committee for the purposes of creating awareness, support and participating in SSVS
various marketing activities.
(c) regularly attend Kent's Lodging Tax Advisory Committee meeting.

(d) prepare and implement annual marketing and media plans.
(e) prepare and submit quarterly outcome reports to the Tukwila Lodging Tax Advisory
Committee, SeaTac Hotel Motel Tax Advisory Committee, and the Kent Lodging Tax
Advisory Committee.
(f) select subcontractors and vendors.
(g) determine and oversee creative production of all marketing materials.
(h) incorporate Kent hotels, shopping destinations, restaurants, tourist attractions, key City
venues and park and recreation facilities, and events into the SSVS vacation planner,
website, coupon book and restaurant concierge book. For non-hotel, non- major tourist
attraction and non-City venues, the following estimated charges will apply to businesses
that choose to participate in the following services: Website coupons, $100; Website links,
$100; Coupon book, $250; Restaurant Concierge Book, $600 per business for 2 pages;
Restaurant listing in the Vacation Planner, $250). There will be no charge for hotels, major
tourist attractions and City venues and City sponsored events to be included as part of
these marketing materials.
(i) Distribute brochures in their office for tourism related businesses within Kent (such as
hotels, restaurants, entertainment venues, transportation services).
Such authority may be increased or decreased from time to time on mutual written
agreement of the cities.
SECTION FOUR.
RECORDS AND ACCOUNTING
SSVS shall maintain or cause to be maintained books of accounts concerning the total
operation of the Interlocal Agreement, in which books shall be entered, fully and accurately, each
transaction pertaining to the Interlocal Agreement. All the books will be open during normal
business hours for inspection and examination by Kent.
The fiscal year of the Interlocal Agreement shall commence on January 1 and close on
December 31 of each year of operation. All accounting based on fiscal year figures shall be
completed within 45 days after the close of the fiscal year.

SECTION FIVE.
TERM
jThe effective date of the Interocal Agreement shall be January 1, 2005, and this Interlocal
Agreement shall continue in effect for a period of three years from that date. On or before April
30, 2007, the cities will determine if this Interlocal Agreement may be continued for another
periodof three years, or for such time as the parties may then see fit.
SECTION SIX.
TERMINATION OF INTERLOCAL AGREEMENT
It is agreed that either SSVS or Kent may terminate this Interlocal Agreement with 60
days notice prior to the beginning of each calendar year, and such termination shall be In writing.
However, the party initiating the termination shall be responsible for paying 30% of any
committed remaining office lease obligation and 30% of any remaining annual media buy.
Further, the agreement can be terminated at any time provided both parties are in agreement on
the terms of such termination. SSVS maintains ownership of all capital assets at the termination
of this Interlocal Agreement.

SECTION SEVEN
HOLD HARMLESS OF INTERLOCAL AGREEMENT
SSVS and Kent agree that each party shall defend, indemnify, and hold harmless the
other party and its officers, officials, agents employees, and volunteers from any and all claims,
injuries, actions, damages, losses or suites including reasonable attorney's fees, which arise out
of or are connected with any errors, omissions or negligent acts in the performance of this
Agreement.
In witness whereof, the parties have executed this Interlocal Agreement at the day and
year first above written.

The owner/subdivider shall implement all mitigation measures required by the
revised mitigated Determination of Nonsignificance for the proposed Village
Creek Estates preliminary subdivision, File #ENV-2001-10.
B. PRIOR TO RECORDATION OF THE FINAL PLAT
1. The Owner / Subdivider shall pay all Charges in Lieu of Assessments
and/or Latecomer Fees, if any, prior to the scheduling of the Pre-
Construction Conference and/or prior to recording the plat, whichever

b. A water system meeting domestic and fire flow requirements for all

need to be in order to provide 5 gpm flow at 20 psi at the plumbing
fixture with the highest elevation in the residence which is located
at the highest elevation within this subdivision while two or more
other plumbing fixtures are simultaneously flowing 5 gpm at 20 psi
or better in the same residence. The resulting plumbing sizing shall
be denoted on the face of the plat and all residential plumbing
i including service lines from the house to the main shall comply with
same. Should the analysis denote that the sizing is just not
reasonable for residential plumbing as concurred with by the City,
then a private booster pumping system at the individual residences
may be an option the City would consider. In such cases said
subdivision lot would be denoted on the face of the plat where a
booster pumping system would be required. Further it would also
be denoted on the face of the plat that the individual Owner of said
lot is solely responsible for all operating and maintenance costs
thereof. The face of the plat shall also be denoted with the
provision that approval of water service to each individual lot will be
subject to compliance with these plumbing conditions. All language
i denoted herein to be placed of the face of the plat shall be subject
to review and approval by the City's Public Works department.
Existing wells — if any - shall be abandoned in accordance with the
requirements of the Department of Ecology.
1 C. Detailed Drainage Plans meeting the requirements of the City of
Kent Construction Standards, and City of Kent Development
Assistance Brochure #5-3, Detailed Drainage Plans. Initial
guidance is given in the conditions which follow:
(1) The Owner / Subdivider shall construct two on-site public
detention / retention pond systems in accordance with the
Kent Construction Standards to mitigate for potential impacts
to stormwater runoff quantity. The detention / retention pond
storage volumes and release criteria shall be that for the Hill;
the pre-development condition shall be assumed to be grass
i only unless otherwise determined by the Public Works
Director.

(2) An infiltration pond retention system is the preferred
alternative for mitigation of stormwater impacts and this
alternative shall be required unless proven unfeasible by the
Owner / Subdivider in the submittal of the Preliminary
Drainage Plan. I
(3) As development occurs within this subdivision, roof
downspouts for each roofed structure (house, garage,
carport, etc.) shall be directed to Roof Downspout Infiltration
Trenches, or Perforated Stubouts, meeting the requirements
of the City of Kent Construction Standards, and City of Kent
Development Assistance Brochure #5-5, Roof Downspout
Infiltration Trench Systems, Downspout Dispersion System,
and Perforated Stubout Connections. These roof downspout
conveyance and infiltration systems shall include overflow
pipes connected to an approved conveyance system. The
Detailed Drainage Plans will include an approved detail for
the Roof Downspout Infiltration Trench, or Perforated
Stubout, and will provide for private stormwater stubouts to
each lot for future connection from the Roof Downspout
Infiltration Trenches, or Perforated Stubouts. The face of the
recorded plat shall contain the following restriction:
AS A CONDITION OF BUILDING PERMIT ISSUANCE,
RESIDENCES CONSTRUCTED ON LOTS OF THIS
SUBDIVISION MUST PROVIDE ROOF DOWNSPOUT
INFILTRATION TRENCH (PERFORATED STUBOUT)

(4) A downstream analysis is required for this development, and
it will include an analysis for capacity, erosion potential, and
water quality from the point of discharge from the site
downstream a distance of at least one quarter mile or to the
point where stormwater discharges to the maintained portion
of the City of Kent stormwater drainage system, whichever
distance is farther. See City of Kent Development Assistance
Brochure #5-4, Downstream Analyses, for the specific
information required for downstream analyses.
(5) Unless otherwise determined by the Public Works
Department, the Owner / Subdivider shall provide public
downstream drainage system improvements and easements

Standards for the specified downstream reach where
adequate public drainage facilities do not currently exist.
(6) The Owner / Subdivider shall submit Landscape Plans for
within and surrounding the retention / detention facilities to
the Planning Department and to the Department of Public
Works for concurrent review and approval prior to, or in
conjunction with, the approval of the Detailed Drainage
Plans. These Landscape Plans shall meet the minimum
requirements of the City of Kent Construction Standards,
and the stormwater management landscaping requirements
contained within City of Kent Development Assistance
1 Brochure #5, Landscape Plans.
(7) The Owner / Subdivider shall execute Declaration of
Stormwater Facility Maintenance Covenants for the private
portions of the drainage system prepared by the Property
Management Section of the Department of Public Works
See City of Kent Development Assistance Brochure #5-17,
Declaration of Stormwater Facility Maintenance Covenants,
for information on what is contained within this document.
Id. An open-to-the-air public stormwater treatment system in
accordance with the requirements of the Kent Construction
1 Standards, and published City of Kent Development Assistance
Brochures dealing with stormwater treatment, to mitigate for
potential impacts to stormwater runoff quality. Acceptable
f stormwater treatment facilities meeting this requirement in their
preferred order include: infiltration after pretreatment; biofiltration
swales; wet ponds; extended detention ponds; and created
Iwetlands. See City of Kent Development Assistance Brochures #5-
1, through #5-15, for additional information on stormwater treatment
requirements.
1 (1) The stormwater treatment systems shall be within the
approved public stormwater management tracts.
(2) Easements for biofiltration swales across private lots will not
be acceptable to meet this requirement.
e. A Detailed Grading Plan for the entire subdivision meeting the
1 requirements of the Uniform Building Code, the City of Kent

Initial guidance for these plans is given below:
(1) These plans will include provisions for utilities, roadways,
retention / detention ponds, stormwater treatment facilities,
and a building footprint for each lot.
(2) These plans shall be designed to eliminate the need for
processing several individual Grading Permits upon
application for Building Permits .
f. A Temporary Erosion / Sedimentation Control Plan for the entire !
subdivision meeting the requirements of the City of Kent
Construction Standards, and the Washington State Department of
Ecology Stormwater Management Manual for the Puget Sound
Basin. These plans must reflect the Detailed Grading Plan
discussed above, and the Planning Department approved Detailed
Tree Plan.
g. The Owner / Subdivider has obtained Wetland Delineation Report
approval per Wetland File No. 01-14. The Owner / Subdivider must
receive approval of the wetland buffer averaging plan from the City
of Kent.
h. Private Street Improvement Plans for the Private Streets to be '
constructed within Tracts C, D, F and G. These Private Street
Improvement Plans shall meet the requirements of the City of Kent
Construction Standards and Development Assistance Brochure #6-
2, Private and Public Street Improvements, for Private Streets.
Initial guidance for the necessary street improvements is given
below: s
(1) Each private street section shall provide 20-feet minimum of !
asphalt pavement width.
(2) Each private street providing access to more than four lots !
(excluding stormwater management tracts) shall have a 5-
foot wide sidewalk constructed along at least one side.
(3) Each private street shall be marked and signed as a Fire
Lane, and no parking will be permitted within these fire
lanes.

guidance for the necessary street improvements is given below:
1 (1) This private access tract I easement shall serve Lots 14 and
15 only.
(2) This private street section shall provide at least 12-feet of
asphalt pavement width, and no more than 20-feet of asphalt
pavement width.
j. Street Improvement Plans for project frontage along Southeast
2481h Street. These Street Improvement Plans shall meet the
requirements of the City of Kent Construction Standards and
Development Assistance Brochure #6-2, Private and Public Street
Improvements, for a street designated as a Residential Collector
Arterial Street Augmented With Bike Lanes by the City of Kent
Master Plan of Roadways Initial guidance for the necessary street
improvements is given below:
(1) Combined curbs & gutters, a 5-foot wide planting strip
constructed between the back of curb and the f ront of the
■ sidewalk, and a 5-foot wide cement concrete sidewalk on the
north side of the street.
(2) A minimum of 23-feet of asphalt pavement as measured
from the approved roadway design centerline to the face of
curb on the north side of the street, plus at least 12-feet of
asphalt pavement as measured from the approved design
centerline to the edge of the traveled lane on the south side
of the street.
I (3) A City-approved shoulder on the south side of the street.
(4) A City-approved street lighting system.
i (5) Public stormwater conveyance, detention and treatment
facilities.

k. Street Improvement Plans for the two public subdivision streets.
Road A shall terminate with a permanent cul-de-sac at its west
terminus. Road B shall be designed to provide connectivity with the
properties to the west and shall include a temporary cul-de-sac or
turnaround as approved by the Public Works Department and Fire l
Department at the west property line for the subdivision. The Street
Improvement Plans for these subdivision streets shall be designed
in conformance with the requirements for a Residential Street as
required by the City of Kent Construction Standards, and City of
Kent Development Assistance Brochure #6-2, Private and Public
Street Improvements, for a public street at least 28-feet wide. Initial
guidance for these street improvements is given below:
(1) Combined curbs & gutters, a 5-foot wide planting strip
constructed b etween the back of curb a nd t he f ront of the
sidewalk, and 5-foot wide cement concrete sidewalks on
both sides of the street.
(2) A minimum of 28-feet of asphalt pavement, measured from '
face of curb to face of curb.
(3) A street lighting system with a maximum height of 18 feet,
designed, constructed and maintained by the IntoLight
Division of Puget Sound Energy; electrical bills shall be paid
for by a Home Owner's Association.
(4) A public stormwater drainage system, including provisions
for conveyance, detention, and treatment facilities.
(5) Curb return radii of 25-feet at the intersection of the
subdivision streets with Southeast 244"' Street and
Southeast 248"' S treet a nd a 4 5-foot r adius for t he c ul-de-
sac bulb(s).
(6) Street trees installed within the 5-foot wide planting strips.
These Street Trees shall be located at least 30-feet from
streetlights, and the species shall be selected from the
Approved Street Tree List maintained by the Department of
Public Works.
(7) Road A shall be located directly opposite 118t' Court
Southeast at the intersection with Southeast 244t' Street.

I. Streetlight plans for Southeast 244i" Street and Southeast 248t'
Street meeting the requirements of the City of Kent Construction
Standards, and City of Kent Development Assistance Brochure #6-
1, Street Lighting Requirements.
3. The Owner / Subdivider shall submit and receive approval of a Detailed
Tree Plan, meeting the requirements of the Kent Zoning Code, and City of
1 Kent Development Assistance Brochure #3, Detailed Tree Plans. Grading
plans cannot be approved by the Department of Public Works without an
approved Detailed Tree Plan.
4. The Owner/ Subdivider shall dedicate or deed all public rights-of-way, and
otherwise convey all private and public easements necessary for the
construction and maintenance of the required improvements for this
subdivision development.
5. The face of the recorded plat shall clearly identify which lots will be served
by each private roadway tract or easement, and state that other additional
or alternative access locations onto the public street system will not be
permitted for those lots served by a private roadway tract or easement.
6. Lots 14, 15, 16, 17, 3 0, and 31 shall be designed to provide adequate
driveway to street separation and to facilitate access to the new
subdivision streets instead of to the streets with a higher street
classification.
7. Direct vehicular access to Southeast 244t' Street from Lots 1, 2, 3, 4, 14
and 15 will be prohibited. Direct vehicular access to Southeast 248"' Street
from lots 16, 17, 18, 30 and Lot 31 will also be prohibited. The following
restriction shall appear on the face of the recorded plat:
RESTRICTION: DIRECT VEHICULAR ACCESS TO LOTS 1, 2, 3, 4, 14,
15, 16, 17, 18, 30 AND 31 SHALL BE RESTRICTED TO THE
SUBDIVISION STREETS (INSERT NEW PLAT STREET NAMES)
WHICH THEY ABUT.
8. The Owner / Subdivider shall create a Homeowner's Association for this
subdivision to ensure that the property owners within this subdivision are
advised of their requirements to pay for the provided street lighting system
and to maintain the landscape strips and private streets constructed within
private roadway tracts / easements. Those sections of the required
document written to govern that association as they relate to any Intol-ight
Division of Puget Sound Energy street lighting systems, and the

maintenance of private streets shall be reviewed and approved by the
Department of Public Works, prior to recording these documents. ■
9. The Owner / Subdivider shall permanently protect the approved and ■
preserved, and/or enhanced, or created wetland(s) and its buffer(s) by
creating a separate Sensitive Area Tract and deeding the tract in fee
simple to the City, OR by granting a Sensitive Area Easement to the City
for the entire sensitive area, in conformance with the requirements of the
City of Kent Wetlands Management Code. T his Sensitive Area T ract or
Easement shall be consistent with the wetland and wetland buffer map
contained within the approved Wetland Delineation Report and/or
approved Wetland Mitigation Plan as appropriate. The Owner/ Subdivider
shall provide a legal description of said easement or tract prepared by a
licensed land surveyor, prior to issuance of any Construction Permits. The
Sensitive Area Tract and the following language shall be included on the
face of the recorded plat:

from intrusion and/or disturbance through the use of landscaping or other
appropriate screens, as well as an approved permanent wildlife-passable
fence. In addition, Wetland Information Signs approved by the Department
of Public Works shall be placed at the wetland buffer edge to inform and
educate owners and nearby residents about the value of wetlands.
13. The Owner/ Subdivider shall provide the Department of Public Works with
a copy of an approved Hydraulic Project Approval (HPA), OR A WRITTEN
WAIVER THEREFROM issued by the Washington State Department of
Fish and Wildlife with the first submittal of Construction Plans. Contact the

14. Prior to release of any construction bonds, and prior to the approval of any
Building Permits within the subject subdivision, the Department of Public
Works must receive and approve As-Built Drawings meeting the
requirements of the City of Kent Construction Standards, and City of Kent
Development Assistance Brochure #E-1, As-Build Drawings, for: Streets;
Street Lighting System; Water; Sewer; Stormwater Drainage Facilities;
and all off-site improvements where the locations and/or elevations are
1 deemed critical by the Department of Public Works.
15. A fee-in-lieu of park dedication shall be paid by the owner/subdivider in
conformance with KCC 12.04.780.
C. PRIOR TO THE ISSUANCE OF A BUILDING PERMIT ON ANY LOT IN THIS
SUBDIVISION, THE OWNER/ SUBDIVIDER SHALL:
1. Record the Plat.
2. Pay the Environmental Mitigation Fee for that lot.
3. Construct all of the improvements required above.

2. SUMMARY STATEMENT: The total average monthly value of permit
applications in our permit center"pipeline"has more than doubled, from a monthly
' average last year of$25 to $30 million to a monthly average of$70 million for about
the last six months. Originally, City staff thought this was a temporary increase, but
' now it appears to be consistent and will be ongoing and perhaps even increase in the
future. As a result, these ordinances and resolutions increase certain permit fees and
adjust the budget accordingly, in order to hire nine full-time permit processing staff so
that the City can timely process permit applications. With the proposed fee increases,
the budget impact is neutral, and the budget remains in balance.

AN ORDINANCE of the City Council of the City
of Kent, Washington, (1) amending permit and inspection
fees relating to public works improvements. street and curb
cut permit, inspection, and permit renewal fees; street use
permit and inspection fees; sanitary sewer permit fees; (2)
j making other housekeeping revisions to street and curb cut
requirements and street use permits; and (3) repealing the
inspection fee provision for sanitary sewer permits
RECITALS
A. It is necessary to amend various permit fees related to public works
j department building and development permits in order to provide enough additional
revenue to fund the hiring of new permanent staff for the permit process Because the
ongoing level of permit activity has dramatically increased at a consistent level during
the past six (6) months, the City is hiring these employees to assist with timely issuance
of pending and new building permits.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
ORDINANCE
SECTION]. -Amendment Section 6 03.010 of the Kent City Code relating to
public works improvement plan approval and inspection fees is amended as follows-

See. 6.03.010. Fees designated.
A. The City's public works department is responsible for the, lannin
design, construction, maintenance, and operation of a complex network of right-of-
ways and public easements, including the placement of private utility facilities such as
gas, electrical, telephone, fiber optic, and other lines and conduits. TAs a result, the
public works department shall—beis responsible for the plan review, plan approval,
inspection, and acceptance of all construction within any public easement or nght-of-
way and all public works improvements, such as streets, sidewalks and walkways,
street lighting systems, storm drainage systems (public and private), and public and
private utilities; The public works department employs twenty-three (23) full-time
equivalent employees to accomplish plan review, plan consultation, plan inspection,
and onsite inspection of these third-party public works improvements. Accordingly, j
ach developer/applicant must paaplan review
and inspection fee in the amount of. The ehafge shall be siN «` eight 8 percent of the
estimated construction cost of the said improvements. This fee
will typically cover approximately one-half twe4hifds (24 1/2) the total cost for this ,
City staff time to review and inspect each individual application.;
B. In lieu of paving this eight (8) percent fee, the developer/applicant will have a
one-time only option to pay the City's actual costs for these services based on the
current average hourly rate of eighty five dollars ($85.00) per hour This option can
only be exercised at the time the fee is first imposed. If this option is selected, the
developer/applicant must pay for all time incurred by City staff for plan review, plan
consultation, plan inspection, and onsite inspection of the public works improvements
to be constructed at the hourly rate established above, even if the final total amount
exceeds the eight(8)percent fee.

agency of the state (including, without limitation, counties, other cities, or special
purpose districts) seeks to construct public improvements not intended for conveyance
to the City but that will provide a regional benefit, the public works department

The developer/applicant will be required to submit separate cost estimates for each

payable prior to starting the review with balance due and payable prior to the approval
of the construction plans.
E. Where the developer/applicant has opted to pay the City's actual costs based on
the above-stated hourly rate, a nonrefundable deposit of fifty((50) percent of the
estimated total cost as prepared by the public works department is due and payable
j before beginning review, the balance of this estimate is due and payable before the
City approves construction plans If the actual costs incurred are less than the monies
deposited, the City shall reimburse the difference upon the developer/applicant's
completion of the construction of the approved public works improvements Any
incidental interest earned on monies deposited with the City shall become the City's
sole property. If the City's actual cost exceeds the amount deposited by the
developer/applicant, the City shall bill the developer/applicant for the amount due and
the developer/applicant shall pay that amount within 30 days of the date billed Any
amounts unpaid after the 30-day due date shall be charged interest at a rate of twelve
(12) percent per annum, and the City may use any rights or remedies available under
the law to collect or seek reimbursement of the amounts due. In any event the
developer/applicant must pay all amounts due before staff will present the public

works improvements to the City Council for acceptance or before issuing a Certificate
of Occupancy for a develORment associated with these public works improvements.
BF. Two (2) re-reviews of the construction plans are included when the
developer/applicant pays in-the eight (8) percent fee described above, >a ieve-nett

SECTION 2. -Amendment Section 6.06.040 of the Kent City Code relating to
permit requirements for street and curb cuts fees is amended as follows:

A. Prior to issuance of any right-of-way permit for cutting any portion of City

BG. The issuance or granting of a permit or approval of plans and specifications
shall not be construed to be a permit for or approval of any violation of the provisions
of this chapter or any other ordinance or appropriate rule or regulation of the City.
CD. Every permit issued by the department of public works under the provisions of
this chapter shall expire ninety (90) days after issuance of the permit unless work has

E. The director of public works, or designate, may in writing suspend or revoke a
permit issued under the provisions of this chapter whenever the permit was issued in
error or on the basis of incorrect information supplied or in violation of any other
ordinance or regulation of the City.
SECTION 3. —Amendment Section 6.06.050 of the Kent City Code relating to
street and curb cut permit, inspection, and permit renewal fees is amended as follows.
Sec. 6.06.050. Permit and inspection fees and permit renewal.
A. The basic fee for a permit to cut a street, curb, sidewalk, or any portion of City
right-of-way, whether or not improved, shall be fwen4y- three hundred dollars

B. An additional time charge will be made where total review and inspection time
exceeds onesix (46) hours. Such extra charge will be invoiced to the applicant

than the average actual hourly cost for City staff employed to process these permits.

PC. Wherever work for which a permit is required by this chapter is commenced or
performed prior to obtaining such permit, the basic permit fee shall be doubled, but the
1payment for such double fee shall not relieve any person from full compliance with all

of the requirements of this chapter in the execution of the work, nor from any other
penalties which may be provided for in this chapter, including criminal penalties.
SECTION 4. —Amendment Section 6.06.060 of the Kent City Code relating to
specifications and special requirements for street and curb cuts is amended as follows:
Sec. 6.06.060. Specifications and special requirements.
A. Specifications All curb and street cuts shall be repaired to conform to the
requirements of Standard Specifications for Road, Bridge and Municipal Construction,
44"latest liedition, prepared by the Washington State Department of Transportation
and the American Public Works Association. Copies of such publication or any
additions or amendments thereto are on file with the City clerk and available to the
general public.
B. Permittee's performance responsibility In addition to all other requirements
specified by this chapter or the Standard Specifications for Road. Bridge and Municipal
Construction, adopted in subsection (A) of this section, the permittee shall be
responsible for restoration of the street_ or curb, and all disturbed public right-of-way
area to its original or better condition including any required overlays as approved by
the director of public works. The permittee shall finish-patch the street or curb cut
immediately upon completion of the project. The permittee shall be responsible for
defects or failure of the street or curb cut area for a period of one (1) year following
finish inspection.
C. Curb cut locations The location of each curb cut must be approved by the
department of public works. The City reserves the right to deny any request to cut any
curb.
D. Special conditions. At the discretion of the director of public works or
designate, one (1) or more of the following requirements may be specified when
conditions require their use. Wherever such special conditions are required, they shall
be set forth on the permit at the time of issuance or as an amendment to the permit in

those instances where conditions requiring their use become known after the permit has
been issued:
1. installation of-Curb cuts within the right-of-way shall be made only in
areas and by-a-_methods approved by the public works director, or his or her designee.

better condition;
2 Excavated material shall be completely removed from the street surface;
3. Signs, cones, barricades, and all other traffic control devices to protect
and control pedestrian and vehicular traffic in the construction area shall be used as
prescribed by the traffic engineer, and in accordance with the Manual on Uniform
Traffic Control Devices for Streets and Highways as amended, and shall be at the
expense of the permittee;
4. One (1) or more traffic lanes shall be kept open at all times Moving
traffic shall be properly controlled by uniformed flagmen, if specified. Hours of
operation during construction and restoration shall be as specified on the permit;
5 Ingress and egress for vehicles and personnel to abutting property shall
be maintained at all times;
6. Backfill and replacement of pavement or oiling of surface shall be done
to the satisfaction of the public works directorC_t�neer. Unless otherwise
specified by the public works directorC_�ty engineer, backfill material shall conform to
Standard Specifications for Road, Bridge and Municipal Construction, adopted in
subsection(A) of this section;
7. Filing of a surety indemnity bond approved by the department of public
works to protect the City and approved public liability insurance naming the City as an
additional insured in the amount specified on the face of the permit;

8. A cash deposit in the amount as specified on the face of the permit not to
exceed one thousand dollars ($1,000)to be made to the City;
9. Open cuts within the paved area will not be permitted;
10. The construction inspector shall require that a temporary patch be made
for thirty (30) days, and thereafter, a permanent patch will be placed by the permittee
within five (5) days.
SECTION S. -Amendment Section 6 06.070 of the Kent City Code relating to
enforcement and penalties for street and curb cuts is amended as follows:
Sec. 6.06.070. Enforcement and penalties.
A. Enforcement authority The public works director, or his or her designee,

nforce all provisions of this chapter.
B. Penalties It is unlawful for any person, firm, or corporation to cut a street or
curb, or cause the same to be done, in violation of any of the provisions of this chapter.

SECTION 6. -Amendment Section 6.07.010 of the Kent City Code relating to {
street use permits is amended as follows:
Sec. 6.07.010. Purpose. The purpose of this chapter is to establish minimum
rules and regulations relating to street use associated with property development utilityf
work not requiring cuts, and other uses of streets, sidewalks, public property, public
rights-of-way and other public places for private purposes, and to provide for
enforcement.

SECTION 7. —Amendment Section 6.07.170 of the Kent City Code relating to
street use permit and inspection fees is amended as follows:
Sec. 6.07.170. Permit and inspection fees.
A. The basic fee for a street use permit shall be as follows:
1. KCC 6 07 040. Construction and property development, including
utility work not requirin2 cuts f�ytwo hundred dollars ($4582LO).
2. KCC 6 07 060. Street vendors one hundred dollars ($100) per year.
Permits are issued annually.
3. KCC 6 07 070 Sidewalk cafes one hundred dollars ($100) per year.
Permits are issued annually.
4. KCC 6 07 090 Street closures fifty dollars ($50).
±I 5. KCC 6 07100 Master use permit one hundred dollars ($100).
B Where total inspection time exceeds two (2) hours, an extra charge shall be
invoiced to the applicant at an hourly rate to be established annually by the director.
SECTION 8. —Amendment Section 7 04.100 of the Kent City Code relating to
sanitary sewer permit fees is amended as follows.
Sec. 7.04.100. Permit fees.
A. The basic fee for each permit to connect with any public sewer or to construct,
extend, relay, repair, or make connections with a lateral or private sewer inside of a
property line is hereby fixed at two hundred twenty-five dollars ($225). An additional
charge will be made if review and inspection time exceeds three and one-half (3.5)
hours. The hourly rate for this additional staff time shall be paid at the rate of fifty
dollars (S50) per hour, which is less than the average actual hourly cost for City staff

employed to process these permits. The fee shall be paid to the finance department
who shall issue a receipt. Such receipt must be filed with the department of public
works before the permit is issued.
B. The fees for permits to construct, install or repair septic tanks shall be those
established by the Seattle-King County department of public health. These fees shall be
paid directly to that department. j
SECTION 9. —Amendment Section 7.04.240 of the Kent City Code relating to
sanitary sewer inspection fees is repealed in its entirety:

which will be amended by this ordinance, shall remain in full force and effect until the
effective date of this ordinance. i

SECTION 11. - Severability If any one or more section, subsections, or
sentences of this ordinance are held to be unconstitutional or invalid, such decision
shall not affect the validity of the remaining portion of this ordinance and the same
shall remain in full force and effect.
SECTION 12. -Effective Date This ordinance shall take effect and be in force

11 Permit and Inspection Fees
RESOLUTION NO.
A RESOLUTION of the City Council of the City
of Kent, Washington, amending the fee schedule and fee
schedule notes for planning and land use applications filed
with the City of Kent.
RECITALS '
A. The City of Kent Planning and Land Use Fee Schedule was originally
adopted in 1979, and since adoption a number of amendments have been made to the
schedule, with the most recent amendment passed by the City Council's adoption of
Resolution No 1594 on June 5, 2001.
B. It is necessary to amend the fee schedule and fee schedule notes in order
to provide enough additional revenue to fund the luring of new permanent staff for the
permit process. Because the ongoing level of permit activity has dramatically
increased at a consistent level during the past six (6) months, the City is hiring these
employees to assist with timely issuance of pending and new building permits.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:

RESOLUTION
SECTION 1. — Fee Schedule and Fee Schedule Notes The fee schedule and
the fee schedule notes attached and incorporated as Exhibit A are hereby established as
the fee schedule and fee schedule notes for all planning and land use applications filed
with the City of Kent.
SECTION 2. — Savings Resolution No. 1594 and the fees established in that
resolution,which are repealed and replaced by this resolution, shall remain in full force
and effect until the effective date of this resolution.
SECTION 3. — Severability If any section, subsection, paragraph, sentence,
clause or phrase of this resolution is declared unconstitutional or invalid for any
reason, such decision shall not affect the validity of the remaining portions of this
resolution
SECTION 4. —Ratifzcatron Any act consistent with the authority and prior to
the effective date of this resolution is hereby ratified and affirmed
SECTION S. — Effective Date. This resolution shall take effect and be in force
thirty (30) days from and after its passage.

(1) $50 fee is applicable for an attached accessory dwelling unit, an interior accessory dwelling unit or
for a detached accessory dwelling unit in a single-family residential zone. The fee includes the cost
of the Planning Services Office recording of the accessory dwelling unit covenant documents with
King County An accessory living quarters in a commercial or industrial zone is subject to the
applicable construction value-based fee
j (2) Any changes to an approved, but unrecorded Binding Site Plan are subject to the $300 fee for a
modification to a Binding Site Plan Any changes to a recorded Binding Site Plan are subject to the

e) The zoning permit fee for those development projects for which no building permit is required
but which requires site plan review and a zoning permit, shall be based on the value of the
proposed development to be undertaken The value of the proposed construction/
development shall be determined based on professional estimates by a licensed engineer,
architect, landscape designer or contractor These estimates may include, but are not limited
to, grade and fill of the site, paving, placement of utilities, lighting, landscaping, and other site
improvements The combined total of the cost estimates for all development on the site shall

A RESOLUTION of the City Council of the City
of Kent, Washington, amending the schedule of fees for
permits and plan review conducted under the provisions of
the International Fire Code.
RECITALS
A. By its adoption of Resolution No 1676 on May 4, 2004, the City
Council established a schedule of fees applicable to permits, certificates, and
inspections issued and conducted under the International Building Code, the
International Residential Code, the International Mechanical Code, the Uniform
Plumbing Code, and the International Fire Code
B. It is appropriate to amend the schedule of fees relating to these
International Codes in order to add additional fees for development plan review, land
use application review, and permit fees required under the International Fire Code
and/or the Kent City Code that were not included in Resolution No. 1676.
C. The amended schedule of fees in this resolution has been proposed by
the City's building code official and fire code official, and includes the cost of
administration involved in the review of land use applications and development plans
and in the processing, issuance, and renewal of permits.

D. International Fire Code—Fire permit and plan review fees Pursuant to
Section 13.01.110 of the Kent City Code, the fees to be assessed for development plan
review, land use application review, fire permits or certificates, and related inspections
under the International Fire Code shall be as set forth in Exhibit "D," which is
attached and incorporated into this resolution.
SECTION Z —Exhibit Superceded. On the effective date of this resolution, the
attached and revised Exhibit "D" shall supersede in its entirety Exhibit "D" attached to
Resolution No 1676.
SECTION 3. — Savings Resolution No. 1676 and the fees established in
Exhibit "D"to that resolution, which are repealed and replaced by this resolution, shall
remain in full force and effect until the effective date of this resolution.

IAN ORDINANCE of the City Council of the City
of Kent, Washington, amending the 2004 budget for
adjustments relating to development permit processing.
RECITALS
A. Approximately six (6) months ago, the City Council approved a
temporary increase to its staffing relating to development permit processing in order to
accommodate what appeared to be a temporary increase in building activity in the City
of Kent.
B. The previously approved temporary staffing increase was for a six
month period and is now coming to an end.
jC. It now appears that this increase in building permit activity is not
temporary, but rather is an indicator of increased and prolonged building activity in the
City of Kent.
D. Typically, City staff manage and process building permits for building
projects with a total value of approximately $25 to $30 million in any given month.
Recently, however, the total value of building projects in our building permit process
.,pipeline" has been averaging approximately $70 million per month. Similarly, the
jnumber of permit applications and the number of permits issued has increased in the

past year. Unfortunately, the City's rate of on time building permit review and issuance
has declined from ninety-five (95) percent to eighty-five (85) percent. This decline is
unacceptable both to City staff and our permit applicant customers, and additional full-
time employees are required to handle this dramatic increase in building permit activity
and to restore the City's building permit on time performance.
E. City administration intends to add nine (9) new permit development
review and approval positions, all of which will serve and enhance the building and
permit center process. Those positions are as follows:
1. Public Works Permit Coordinator.
2. Public Works Engineer II.
3. Public Works Construction Inspector.
4. Community Development Permit Center, Permit Tech. I.
5 Community Development Permit Center, Office Tech III.
6 Community Development Building Services, Plans Examiner.
7. Community Development Building Services, Combination
Building Inspector
8. Fire Department Plans Examiner.
9. Fire Department Inspector.
The City will also adjust an open, vacant Planning Assistant position to a
Planner position, and apply certain budgeted funds to hire an intem for the department.
The Mayor may clarify or amend job descriptions for these positions for that same
purpose, and these positions may be changed to more efficiently address the City's
permit review processing needs.
F. In order to pay for these full-time positions,the City will adjust a limited
number of plan review and inspection fees to increase revenues and maintain the
General Fund end balance.

OPERATIONS COMMITTEE MINUTES

The meeting was called to order by Tim Clark, Chair at 4:05 p in.
APPROVAL OF MINUTES DATED JULY 20, 2004
Bruce White moved to approve the minutes of the July 20, 2004, Operation Committee
meeting. The motion was seconded by Julie Peterson and passed 3-0.
APPROVAL OF VOUCHERS DATED JULY 30 2004 AND AUGUST 13 2004
Assistant Finance Director Cliff Craig presented the vouchers for July 30, 2004, and August
13, 2004, for approval.
Julie Peterson moved to approve the vouchers dated July 30, 2004, and August 13, 2004.
Bruce White seconded the motion, which passed 3-0.
SHOPPING CART ORDINANCE
Mayor Jim White and City Attorney Tom Brubaker presented the Shopping Cart Ordinance.
Mayor White stated that the City has encountered numerous abandoned shopping carts which
constitute a nuisance, create potential hazards to the health and safety of the public, and
interfere with pedestrian and vehicular traffic within the City of Kent. Mayor White stated that
on November 16, 2000, he sent a letter to area stores which provide shopping carts for their
customers requesting they be responsible for their carts. Mayor White stated the accumulation
of wrecked, dismantled, and abandoned shopping carts on public or private property also tends
to create conditions that reduce property values and promote aesthetic blight and property
deterioration in the City. The intent of this ordinance is to ensure that measures are taken by
store owners to prevent the removal of shopping carts from store premises and parking lots, to
make the removal of shopping carts from the limits of store owners' property a violation of this
Code, and to facilitate the retrieval of abandoned carts. Mr. Brubaker advised that no budget
impact is anticipated though nominal revenue may be generated in the event fines are issued in
accordance with the proposed ordinance.
Julie Peterson moved to table the Shopping Cart Ordinance to the first Operations
Committee meeting in October. The motion was seconded and passed 3-0.

Operations Committee Minutes
July 20, 2004
LODGING TAX ADVISORY BOARD MEMBER
Economic Finance Manager Nathan Torgelson presented the Lodging Tax Advisory Board
Member agenda item. Mr. Torgelson advised that the City of Kent Lodging Tax Advisory
Board has recommended that Greg Haffner be appointed to fill the present vacant position to
the Board for a three (3)year term. Mr. Haffner is a partner at the Curran Mendoza Law Firm
in Kent, is counsel to the Kent Downtown Partnership and the Civic and Performing Arts
Board, and is active in the Kent Rotary Club. Mr. Torgelson introduced Greg Haffner who
stated that he is happy and honored to serve on the Board.
Julie Peterson moved to recommend approval of Greg Haffner for a three (3) year term
on the City's Lodging Tax Advisory Board. Bruce White seconded the motion, which
passed 3-0.
2004 BUDGET ADJUSTMENT ORDINANCE
Assistant Finance Director Cliff Craig presented the 2004 Budget Adjustment Ordinance. Mr.
Craig requests authorization to approve the technical gross budget adjustment ordinance
totaling $13,155,204 for budget adjustments made between January 1,2004 and July 31,2004,
which he stated is primarily a housekeeping device and is not a requirement of the City.
Bruce White moved recommend Council approve the consolidated budget adjustment
ordinance for adjustments made between January 1, 2004, and July 31, 2004, totaling
$13,155,204. Julie Peterson seconded the motion,which passed 3-0.

Assistant Finance Director Cliff Craig presented a PowerPoint presentation of the 2"d r
Quarter 2040 Financial Report for informational purposes only and directed the Committee
to please contact him should they have further questions on the report. No action was
necessary.
