May 19, 1987
Regular meeting of the Kent City Council was called to order at 7 : 00
p.m. by Mayor Kelleher. Present: Councilmembers Bailey, Biteman,
Dowell, Houser, Johnson and Woods, City Administrator McFall, City
Attorney Driscoll , Planning Director Harris and Public Works Director
Wickstrom. Councilmember White and Finance Director McCarthy were
not in attendance. Also present: Fire Chief Angelo and Police Chief
Frederiksen. Approximately 20 people were at the meeting.
PROCLAMATIONS Youth Week. Mayor Kelleher read a proclamation de-
claring the week beginning May lst as Youth Week
in the City of Kent.
Duwamish-Green River Cleanup Day. A Proclamation
was read by the Mayor declaring June 6 , 1987, as
Duwamish-Green River Cleanup Day in the City of
Kent.
United States Constitution Day. The Mayor read a
proclamation declaring September 17, 1987, as
United States Constitution Day in the City of Kent.
CONSENT BITEMAN MOVED that Consent Calendar Items A through
CALENDAR M be approved, with the exception of Items G, H
and K which were removed by Councilmember Bailey.
Woods seconded and the motion carried.
MINUTES ( CONSENT CALENDAR ITEM 3A)
Approval of Minutes. APPROVAL of the minutes of
the regular Council meeting of May 5, 1987 .
HEALTH & (CONSENT CALENDAR ITEM 3F)
SANITATION Carpinito Short Plat. ACCEPTANCE of the Bill of
Sale and Warranty Agreement for continuous opera-
tion of maintenance of approximately 930 feet of
sanitary sewer extension constructed in the
vicinity of 88th Avenue South and South 228th for
the Carpinito Short Plat.
LID 319 - 38th Avenue South Sewer Improvements._
At its meeting on April 17 , 1987, the Council
conducted a public hearing on the final assessment
roll for LID 319. Upon closing the hearing, the
Council referred certain matters concerning ob-
jections to the assessment formula. The Committee

met and determined that the protests were un-
timely and that the assessment formula was proper.
Biteman noted that he would abstain from voting
because he is a resident within that boundary.
JOHNSON MOVED to accept the report and recommen-
dation of the Public Works Committee for the
adoption of the final assessment roll for LID
319 and for the City Attorney to prepare the
necessary ordinance. Bailey seconded. The motion
carried with Biteman abstaining.
LID 319 - Financial Assistance. Mr. and Mrs.
Knapp, who were assessed under LID 319 , requested
Senior Citizen Lifeline assistance, pursuant to
Kent Resolution 993. A dispute arose as to the
timeliness of the request, and whether or not the
individuals were informed of their opportunity to
apply for Lifeline Assistance. The Public Works
Committee has examined the issue and determined
that, under the facts of the particular dispute,
the application timeliness in Resolution 993
should be waived. The request clearly meets the
intent and purpose of the Resolution and the
applicants meet the requirements for such assis-
tance. Mr. Knapp noted that his concerns have
been taken care of to his satisfaction. JOHNSON
MOVED that the application timeliness in
Resolution 993 be waived for Mr. and Mrs. Knapp
because of apparent lack of notice of the Senior
Citizen Lifeline Assistance Program and for the
City Attorney to prepare a transfer of development
rights agreement, as required by the resolution.
Woods seconded and the motion carried.
WATER (CONSENT CALENDAR ITEM 3E)
Regional Water Association-Critical Water Service
Area. AUTHORIZATION for the Mayor to execute an
interlocal agreement in conjunction with the Public
Water System Coordination Act which stipulates
the boundary limits of the City ' s Water Utility
future service area.

LID 316 - 94th Avenue South - Water Mains.
ADOPTION of Ordinance 2723 confirming the final
assessment roll for LID 316 for which the public
hearing was concluded on May 5, 1987 .

TRAFFIC CONTROL (CONSENT CALENDAR ITEM 3I )
Six Year Transportation Improvement Program
(TIP) . AUTHORIZATION to set June 2 as date for
public hearing on the City ' s six year Transpor-
tation Improvement Program.
GREEN RIVER (CONSENT CALENDAR ITEM 3J)
Green River Levee Improvement-SR 516 to Russell
Road. AUTHORIZATION to establish a budget for
this project in the amount of $100 , 000 from un-
encumbered drainage fund, as approved by Public
Works Committee.
CBD IMPROVEMENTS (CONSENT CALENDAR ITEM 3D)
CBD Improvement Project. AUTHORIZATION to
proceed with the placement of a directional sign
and six historic street lights along Titus and
the adjacent alley to be funded out of the balance
of CBD Improvement Project Fund No. 3183, as re-
commended by the Public Works Committee.
ANIMAL CONTROL Animal Ordinance. Pat Schriver, a resident of a
recently annexed area, voiced her concern about
the number of horses on her neighbors property,
and asked that the City limit the number allowed.
Harris noted that the Zoning Code presently allows
one horse per 20 , 000 sq. ft. He indicated that
he would review the situation, and since there was
no objection from the Council it was so ordered.
COMPUTER SYSTEM (CONSENT CALENDAR ITEM 3K)
REMOVED BY COUNCILMEMBER BAILEY
Deltasystems Contract. AUTHORIZATION for the
Mayor to sign a contract with Deltasystems, Inc.
which would provide the necessary software to
implement the computerized mapping system con-
templated in the City ' s Automation Plan. The
Deltasystems contract totals $50, 000 and includes
Delta Map Proprietary Software, User Manuals, In-
stallation, Training, System Testing, Software
System Maintenance for 1 year and certain
specified consulting services. When fully
operational the City ' s Computerized Mapping
Program will provide a parcel-based Geographic
Information system for use by City Departments .
Upon Bailey ' s question regarding software re-
visions, McFall noted that the City would have
the option of refusing upgraded software, but
that eventualy Deltasystems would no longer
support the older version of the software.
BAILEY MOVED that the Mayor be authorized to
sign the contract with Deltasystems, Inc.
Biteman seconded and the motion carried.

FIRE ( CONSENT CALENDAR ITEM 3H)
DEPARTMENT REMOVED BY COUNCILMEMBER BAILEY
Donation of Breathing Apparatus to Kent Fire
Department. ACCEPTANCE of the donation from
Norman G. Angelo, Fire Chief of the Kent Fire
Department , of one complete set of MSA 4500
Breathing Apparatus to the Kent Fire Department.
Bailey thanked Chief Angelo on behalf of the
City and commended him on his interest in the
continued development of the Fire Department.
BAILEY MOVED to accept the donation of the MSA
4500 Breathing Apparatus. Biteman seconded and
the motion carried.
FINANCE (CONSENT CALENDAR ITEM 3B)
Approval of Bills. APPROVAL of payment of the
bills received through May 21 after auditing by
the Operations Committee at its meeting at 7: 30
a.m. on June 1 , 1987.
PERSONNEL (CONSENT CALENDAR ITEM 3C)
Transportation Division Personnel. AUTHORIZATION
to increase a temporary part-time Signal Mainte-
nance Technician position to permanent part-
time for the remainder of 1987 and for it to be
included as a full time position in the Public
Works Department 1988 Budget requests, as
approved by Public Works Committee.
SHORT PLAT (CONSENT CALENDAR ITEM 3G)
REMOVED BY COUNCILMEMBER BAILEY.
Brooks Short Plat No. SP-87-4 Appeal.
AUTHORIZATION to set June 2 as the date for the
public hearing on the appeal of the Brooks Short
Plat No. SP-87-4 . Upon Bailey ' s question, Harris
noted that the Short Plat Committee had approved
this short plat with conditions, and that the
applicant had appealed the matter to the Council.
BAILEY MOVED to set June 2 as the date for the
public hearing on the appeal of the Brooks Short
Plat No. SP-87-4. Biteman seconded and the motion
carried.
H & CD ( CONSENT CALENDAR ITEM 3M)
Soames House - H&CD Block Grant. AUTHORIZATION
to contract with Z & J Roofing for reroofing of
the Soames House, in the amount of $5, 100 plus
tax, as discussed at the May 19 Parks Committee
meeting.

PRELIMINARY Walnut Park Phase I Preliminary Plat No. SU-87-1 .
PLAT - Walnut Walnut Park is proposed as a zero lot line develop-
Park ment. Phase I will consist of 82 lots on 14 acres
( 5. 85 dwelling units per acre) . Phase I and Phase
II (which will follow later ) will contain 115 lots
on 17. 9 acres ( 6 . 42 dwelling units per acre) . The
Hearing Examiner recommends approval with 15 condi-
tions. Included in the packet were copies of the
following: Location maps, Hearing Examiner Find-
ings, Minutes, Conditions and Staff Report, Recon-
sideration Request and Response. Woods requested
that comments from the residents of the area be
heard and made a part of the record.
Ed Heiser of the Planning Department described the
project and showed a short video of the area. He
noted that the Hearing Examiner had held a hearing
on this application in March. Heiser noted that
there were three requests for reconsiderations on
the Hearing Examiner ' s recommendation: one from
the City Planning Department, one from Jim and Leona
Orr and one from the applicant, Randy Brealey.
Brealey ' s request was received after the appeal
period and was disallowed by the Hearing Examiner.
Heiser noted that as a result of the request for
reconsideration, the Hearing Examiner made a revision
to Conditions 7 and 8. Heiser noted that the appli-
cant had submitted a letter to the Mayor and Council
and that the Planning Department is in agreement
with the applicant ' s request. He stated that
Brealey ' s letter suggested that in Condition 10
the words "and gutter" be deleted, and noted that
the Public Works Director feels that this is an
acceptable alternative. Brealey also suggested
in Condition 12 that the City permit Lot 65 access
to Street A. Heiser noted that this was discussed
at the Hearing Examiner ' s hearing, but that it
was not included as a part of her conditions, and
that the Planning Department would have no problem
with it. Upon Dowell ' s question, Heiser noted that
Condition 11 includes lights, hydrants, signs, etc. ,
and that the street profiles include an inverted
crown section, eliminating the need for a concrete
gutter. Wickstrom noted for Dowell that when
sewer repairs are made, the City, rather than a
homeowners association, would be required to restore
the street to its original condition. Upon Bailey ' s
question, Heiser explained that there is to be no
direct vehicular access to S.E. 252nd Street, S.E.

PRELIMINARY 248th Street and Street A, with the exception of
PLAT - Walnut Lot 65 since there is no other way to serve it.
Park Heiser noted for Dowell that Condition 7 deals with
how the stream would be reconstructed and pointed
out the area on the map. He noted for Biteman
that it would be culverted across Street A.
James Orr, 24909 114th Avenue S.E. , voiced his con-
cern regarding the tree plan and the safety of
children on S.E. 248th because of the increase in
traffic in the area. He also stated that the lots
should be 7200 sq. ft. , which would provide a
better transition from apartments to acreage.
Randy Brealey noted that because they are using the
inverted crown type street plan, a gutter would
not be appropriate. He said access to Lot 65 had
been discussed at the hearing and agreed to by the
City Engineer. Upon Bailey ' s question, Brealey
noted that the units range in size from 1127 sq. ft.
to 1557 sq. ft.
Leona Orr, 24909 114th Avenue S.E. , voiced her con-
cern regarding the stream, the potential dangers
of building homes so close together, and the pro-
posed buffer zones. Chief Angelo noted that the
development would have to meet all codes, and that
fire zones would have to be maintained. He noted
that a ladder truck may have problems getting through
the streets, but that they are considering purchasing
a different type of truck which would be easier to
maneuver. Laurie Sunsted, 24805 114th Avenue S.E. ,
stated that S.E. 248th should be upgraded before
the development is begun. Sheila Ridings, 25003
114th Avenue S.E. , noted that although the City is
cutting down large trees to build this development,
she was told that she could not cut down trees on
her property larger than 6" in diameter. She also
voiced concern about her liability. Harris noted
that developers must submit a tree plan, and that
the Planning Department reviews the tree plan and
allows removal of trees where there would be
buildings or streets. He noted that if Ridings
submitted a tree plan, the Planning Department would
review it. Woods noted that the City ' s tree ordi-
nance has worked well and that the Planning Depart-
ment has worked in a flexible, cooperative manner
over the years.

PRELIMINARY Ed Heiser noted for Ridings that Phase I and Phase
PLAT - Walnut II are completely separate applications, but that
Park the development is designed so that if both phases
are approved, they will fit together as one common
development. Upon Woods question, Heiser noted
that it would take approximately a year to process
Phase II.
Brealey noted that they had looked at trees on the
site before designing the project, and had worked
around some of the trees. He noted that when they
apply for a building permit for any particular lot,
the building permit has to deal with all the trees
on that site. He also noted that it is his desire
to either fence the property or use hedges .
Harris noted that City departments, including Police
and Fire, had been asked for input during the
development of the plat, and that the input was
reviewed by the Planning Department. Driscoll noted
for Bailey that Condition 1 speaks to coordination
with the Fire Department. Upon the Mayor ' s question,
Harris noted that there were no conditions requested
by the Fire Department which were not added by the
Hearing Examiner. Upon Dowell ' s question, McFall
stated that parking may have to be restricted, and
clarified that there would be a higher density of
dwelling units in Phase II because the common open
space is contained in Phase I.
Jim Singletary, 24823 114th Avenue S.E. , voiced his
concerns regarding liability and parking problems.
Heiser noted that it is the intention of the developer
to provide guest parking in Phase I . Driscoll
noted that the developer is aware of the potential
for liability and has taken it into consideration.
McFall noted for Mrs . Orr that enforcement of
recreational vehicle parking regulations on private
streets is difficult. Woods noted that one of the
conditions states that a homeowners association
must be established to be responsible for that type
of concern. Mrs. Ridings stated that guest and/or
recreational vehicle parking should be included
at the time the development is built, and inquired
as to when Phase II would be discussed. Woods
stated that since Phase II would not be ready for
at least a year, she would prefer not to consider
it at this time. BAILEY MOVED to continue the dis-
cussion to the second meeting in June. Dowell seconded.

PRELIMINARY Motion failed with Johnson, Houser, Woods and Biteman
PLAT - Walnut voting against it. WOODS MOVED to adopt the findings
Park of the Hearing Examiner and concur with the Hearing
Examiner ' s recommendation of approval with the con-
ditions and amendments outlined in the staff report.
Biteman seconded. Motion carried with Bailey voting
nay.
COUNCIL Operations Committee. Bailey noted that the
COMMITTEES Operations Committee would meet at 7: 30 a.m. on
June 1 , 1987.
Public Safety Committee. Houser noted that the
Public Safety Committee would meet on Tuesday,
May 26, at 7: 30 a.m.
ADJOURNMENT WOODS MOVED that the meeting be adjourned at 8: 45
p.m. Houser seconded and the motion carried.
