HomeMy WebLinkAboutCity Council Meeting - Council - Minutes - 01/04/1982 Kent, Washington January 4 , 1982 Regular meeting of the Kent City Council was called to order at 8: 00 o' clock p.m. by Mayor Hogan. Present: Mayor Hogan, Council- members Bailey, Kelleher, B . Johnson, J . Johnson, Mooney, City Administrator Cushing, Public Works Director Wickstrom, Planning Director Harris, Finance Director McCarthy, Acting City Attorney Heavey. Also present: Administrative Assistant Webby, Park Director Wilson, Fire Chief Angelo and Planning Commissioner Brooks . Approximately 25 citizens were in attendance. OATH OF The City Clerk administered the Oath of Office to OFFICE Mayor Hogan and Councilmembers Berne Biteman, Tim Leahy and Jon Johnson, all elected for four year terms . Councilmt-mber Dan Kelleher was sworn in on December 2 for a two year unexpired term. COUNCIL BAILEY MOVED to elect Billie Johnson as Council PRESIDENT President. Mooney seconded . Motion carried. AND NEW B. Johnson made the following committee appoint- COMMITTEE ments: ASSIGNMENTS Community Development Committee - Meets as announced. Tom Bailey, Chairperson, Billie Johnson, Dan Kelleher, Mike Powers representing the Planning Commission and Ford Kiene renresenti-nc; the Chamber of Commerce. Disability Board - Meets 1st Wednesday of each month at 3: 00 p.m. Billie Johnson, Chairperson, Council Representative Tim Leahy, Council Representative, Officer Holt, elected by the Police Department, Lt. Tilley, elected by the Fire Department, one citizen residing j in Kent to be appointed by the four noted above. Finance & Personnel - Meets as announced. In recognition of the honors bestowed upon these talented musicians, Mayor Hogan proclaimed Saturday, January 16, 1982 as KENT-MERIDIAN JAZZ FESTIVAL DAY. CONSENT B. JOHNSON MOVED to approve Consent Calendar Items CALENDAR A through E. J. Johnson seconded. Motion carried. MINUTES (CONSENT CALENDAR ITEMS 5A) Approval of Minutes_. APPROVAL of the minutes of the regular Council meeting of December 21, 1981 . WATER (CONSENT CALENDAR ITEM 5C) LID 303 - S. E. 270th Water Mains . ADOPTION of Ordinance No. 2330 and the summary thereof, confirm- ing the final assessment roll for LID 303. The public hearing was held on December 21, 1981 . PARKS (CONSENT CALENDAR ITEM 5D) Joint Recreation Program - King County. AUTHORIZATION for the Mayor to sign the contract with King County for the 1982 Joint Recreation Program in the amount of $19 , 320 . WASHINGTON (CONSENT CALENDAR ITEM 5E) NATURAL Washington Natural Gas Comprehensive Plan. The GAS franchise Ordinance No . 2267 for Washington Natural COMPREHENSIVE Gas adopted January 5, 1981 called for Washington PLAN Natural Gas to develop a comprehensive plan within a year from adoption of the ordinance. They have submitted same and the Public Works Director recom- mends approval . VIP VIP Health Spa - Business License Revocation. In HEALTH SPA - compliance with Council action on December 21 , the REVOCATION City Attorney has prepared Resolution No. 948 setting OF LICENSE forth the findings of the City Council, and providing for the revocation of the business license for the VIP Health Spa. B. JOHNSON MOVED that Resolution No. 948 be adopted, Bai.l.ey seconded. Wes Hohlbein, attornev for the Spa, stated that he had a copy of the resolution and raised the questions of "illegal proceedings" and "due process" . He stated - 2 - January 4 , 1982 VIP that the City ' s ordinance covering revocation of a HEALTH SPA - license required that a written compliant be filed REVOCATION by a citizen, and that such a complaint had not OF LICENSE been filed. He stated that the City ' s findings referri nq tosexual misconduct on the property has not been supported by any conviction. Hohlbein noted that the corporation had a four year lease on the property which represented a substantial investment. He noted his legal question as to whether the business was exempt from the license under state law was still pending. He further ob- jected to the City ' s finding, in the resolution, that acts of unlawful sexual conduct is conduct injurious to the health and welfare of the citizens of Kent. Hohlbein stated that his client had been denied due process and that the City had failed to follow its own ordinances . The motion to adopt Resolution No. 948 revoking the business license of the VIP Health Spa, effective January 15, 1982 at 5: 00 p.m. carried unanimously. EAST HILL East Hill Moratorium. On December 21, 1981, a MORATORIUM motion to extend the East Hill Moratorium to June 1, 1982 was tabled to this date to allow time for additional input. BAILEY MOVED to remove this item from the table. J. Johnson seconded. Motion carried. It was noted that no correspondence had been received. BAILEY MOVED to extend the moratorium to April 15, 1982, Mooney seconded. Bailey noted that originally the moratorium started in January of 1981, and that the East Hill study started in April and that it would be unfair to builders to extend it further. Suzette Cooke of the Chamber of Commerce noted that she had surveyed eleven Chamber members and builders and while concern was expressed, none had desired to provide input. John Selig and Richard Grandwohl ob- jected to further extension. Grandwohl noted that the economy had itself restricted the growth pattern. He stated that a report should be given on the pro- gress of the East Hill study committee and noted that he had offered his services on the project. Mayor Hogan asked Harris to note Grandwohl ' s interest in serving on one of the committees . Donna Dansenberg noted that residents of the East Hill needed many services before further development is allowed and favored extending the moratorium. 3 - January 4 , 1982 EAST HILL Harris noted that the Council had received a progress MORATORIUM report on the East Hill Study. He noted that the plan was almost on schedule and pointed out that the work on the Plan did not qet underway until April . He pointed out that the extension would allow time for the Plan to be scheduled for hearings before the Planninq Commission. Upon Kelleher ' s question, Jim Hansen of the Planning Department gave a tentative schedule includinq completion in May. Biteman noted the City ' s responsibility to the citi- zens., pointing out that we had set the time and that extra people had been hired to work on the Plan. Upon Leahy ' s question, Harris pointed out that the Planninq Department could live with the April 15 date instead of the June 1 date he requested. He noted that the moratorium would not preclude build- iilia Gii NiGpei Ly already zoned. B. Johnson spoke in favor of Bailey ' s motion and Kelleher stated he would support it althouch it would have a negative impact on business and on construction. He noted that the East Hill Plan was needed and must be pro- perly completed, and asked Harris ' assurance that staff would proceed as rapidly as possible on the Plan. Bailey ' s motion to extend the moratorium to April 15, 1982 carried unanimously. ALLEY Alley Vacation - Block 3 , Kent Addition. A public VACATION hearing was conducted on June 1 , 1981 upon the pro- posal to vacate an alley south of Morton Street between S. Railroad and S . Bridges . The City Attorney has prepared Ordinance No. 2231 approving said vacation . Wickstrom noted that the petition received on December 17 from six property owners objecting to the vacation had been considered. He pointed out that the objections had been satisfied in that the proposed ordinance is for the vacation of the entire alley, and that Mr. Fields, who sought the vacation, had paid half of the appraised value as is required. MOONEY MOVED to adopt Ordinance No. 2331, Bailey seconded. The motion to adopt the ordinance carried. FIRE A letter was read from Jim Wiley, Director of King DEPARTMENT County Housing Authority complimenting the Kent Fire Department for the prompt response and expert action in dealinq with the Springwood Apartments fire on December 28 . B . JOHNSON MOVED to make the letter a part of the record and to send a copy to the Fire Department . Mooney seconded . Motion carried. 4 - i January 4 , 1982 AWC Mayor Hoaan noted that the Association of Washing- WORKSHOP ton Cities was sponsori.nq workshops for newly elected officials on January 16 in Everett and on January 23 in Tumwater. Arrangements for registration may be made through the City Administrator ' s secretary. COUNCIL Public Works . Mooney announced that the Public COMMITTEES Works Committee would not meet this week. Parks . Bailey noted that the next meeting of the Parks Committee would be on Wednesday, January 13 . at 8 : 15 a .m. FINANCE (CONSENT CALENDAR ITEM 5B) Approval of Bills . Approval of payment of the bills received through January 5, 1982 after auditing by the Finance Committee at its meeting at 3: 00 p.m. on January 15, 1982 . CLOSED At 8 : 45 p.m. the Council adjourned to a closed SESSION session to discuss labor negotiations . UNION The meeting reconvened at 8 : 55 p.m. and BAILEY MOVED CONTRACTS to authorize execution of contract with the United Steelworkers for the Police Clerks from January 1, 1982 to December 31 , 1983 and to authorize execution of the contract with Teamsters Local 117 for the main- tenance, public works and parks maintenance employees from January 1, 1982 to December 31 , 1982 .
