Approximately 15 people PROCLAMATION A proclamation was read by the Mayor honoring retiring Councilperson Baffaro for 26 years of public service consisting of IS years as a mem— ber of the Kent Park Board and two terms as a member of the City Council . MINUTES It was noted that the minutes of the last Council meeting reflecting the bids for street sweeping for 1976 were incorrect. The bids should have been reported as follows: CORE & EXTRA PARKING LOT RESIDENTIAL SvJEEPING PER BIDDER _^ PER MONTH PER HR. -_HOUR Sanco—NW Lot $ 1090 $20.00 $42. 12 Placo Ent . 1400 24.00 36.85 Clean Sweep 1394 24.50 42. 12 The cost per month for 1975 was $ 1099 and extra sweeping was $21 per hour, so the low bid for as 1976 is less than the 1975 cost, not more, reported. KITTO MOVED that the minutes of December 15, 1975 be approved as corrected, Storment seconded. Notion carried. HEALTH & SC_S_Project_ The Mayor noted that the Council SANITATION should discuss the aspects of the proposed SCS projects at the workshop on January 12 an . that Mr. Wannamaker would attend also. STREETS Curb Replacement — SE Corner of Gowe and Central . The Skip Jacobson Construction Company has completed the curb replacement project at the SE corner of Gowe Street and Central Avenue. In accordance with the recommendations of the Engineering Department, KITTO MOVED to accept as complete the Skip Jacobson Construction Company contract for the curb replacement at the SE corner of Gowe and Central , and that after receipt of the necessary releases from the State, the retainage be paid, Masters seconded. Upon Storment 's question, the City Attorney deter— mined that the contractor should replace the curb around the flower bed, since he broke it during the course of the project . Motion carried. ANNEXATIONS Suburban View. A Notice of Intent to annex approximately 43 acres lying within the northerly one—half of the " Island" has been received and certified. A meeting with the initiators should be scheduled to determine acceptability and bonded debt service assump— tion by the petitioners. JUST MOVED that such a meeting be held at 7:00 o' clock p.m. on January 12, 1976. Storment seconded. Motion carried. January 5, 1976 ANNEXATIONS Johnston Annexation. A petition of Notice of Intent to annex approximately 30 acres of land adjoining the Kent City limits lying south of South 218th Street , west of the 9400 block, and north of South 222nd Street has been received and certified. A meeting must be scheduled with the initia- tors to determine acceptability of the petition and the bonded debt service assump- tion. KITTO MOVED that such a meeting be held at 7:00 o'clock p.m. on January 12, 1976. Upon a question. from the audience, Ulett noted that this was near Garrison Creek Reservoir. He explained that two petitions must be submitted in every annexation request. The first, or initiating petition, must con" tain signatures of owners of a minimum of 10% of the total assessed valuation of the property to be considered for annexation. After filing of this 10% petition, a meeting is held with the initiators to determine if the City will agree to the annexation and what will be required of the property owners. Ulett further explained that following the informational meeting, a petition must be filed containing the signatures of the owners of 75% of the valuation. Motion carried. PRELIMINARY Suncrest Lane. On December 23, 1975, the PLAT Planning Commission held a public hearing on the Suncrest Lane Preliminary Plat and recom- mended approval with conditions. A public meeting should be set for January 19 to con- sider adoption or rejection of the Planning Commission's recommendations. If, on January 19, the City Council deems a change in the recommendations is necessary, a public hearing will be scheduled for February 2 for the Council to consider its own recommendations, and to then approve or disapprove the prelimi- nary plat. KITTO MOVED that a public meeting on the Suncrest Lane Preliminary Plat be held January 19, 1976, Storment seconded. Motion carried. CITY PROPERTY Office Space Lease for State Electrical Inspector. It was noted that the State Department of General Administration has proposed to renew their lease of space in the City Warehouse for the State Electrical Inspectors at $75 per month. Street noted that the amount is the same, although the office space now being used is smaller. In accordance with the recommendations of the Administration, JOHNSON MOVED that the lease with the State of Washington at $75 per month be approved, Kitto seconded. Motion carried. CLAIMS Ruth Mudd. A claim has been filed by Francis R. Mudd, as guardian of Ruth E. Mudd, for alleged injuries sustained by her in an I auto accident on September 1 , 1975. McCAUGHAN MOVED that the claim be submitted to the City's insurance carrier for action, Masters seconded. Upon Johnson's question, it was determined by Street that the accident occurred on Central Avenue and was allegedly caused by a faulty drain in the street. Motion carried. January 5, 1976 LICENSES Eugene Bremner spoke from the audience, noting that it appeared that a business was operating at 736 — 3rd Avenue So. in a residential neighborhood. He stated that he had observed approximately 35 cars parked near this address and that the police had checked the area several times. He commented that if this was a junk yard operation he thought the law required a 6' fence. Planning Director Harris stated that his department would check on the matter as it appears to be a violation of the Zoning Code. AMERICAN A letter was read from Anthony P. Zecca, Deputy REVOLUTION to the Mayor of the City of Philadelphia, BICENTENNIAL thanking the City for the Kent flag sent COMMITTEE for display during Philadelphia's Bicentennial celebration. MASTERS MOVED that the letter be accepted and made a part of the record, Just seconded. Motion carried. COUNCIL Street noted that the new councilpersons would be sworn in at the workshop meeting of January 12. FEDERAL Parks_Department. Mayor Hogan noted that John REVENUE Van Zonneveld of Vanco, Inc. wished to speak SHARING on the subject of the relocat.able restroom which had been discussed at the December 15 revenue sharing hearing. Van Zonneveld read a statement referring to comments made by City Attorney Mirk and Fire Marshall Bryant at the last Council meeting regarding the relocatable restroom, stating that Mirk was wrong in stating that the unit in question did not comply with State codes. He pointed out that application for approval had not as yet been made for this State, and that require— ments differed in each State. I With regard to Fire Marshall Bryant 's comments on December 15, Van Zonneveld pointed out that the State had not decided whether rules for modular structures or rules for factory built housing would apply to this type of facility. He noted that the manufacturer, Colt Industries, had not been afforded the opportunity to apply for State licensing, as this was not the usual procedure. He stated that their attorney had not said that the requirements for the handicapped could not be met, and that the specifications showed that these requirements could be met. He further declared that the Fire Marshall did not have the current specs, and pointed out that the Company did not need to ask the State for approvals until an agency is ready to purchase. He further stated that codes and rules, as well as equipment, may change, thus making some approvals obsolete. He stated that the Department of Labor & Indus— tries is not writing up deficiencies on the unit; that this is only done if approval has been requested by the manufacturer, and subse— quently denied by the State. January 5, 1976 FEDERAL Van 7onneveld described how the relocatable REVENUE restroom works, and further described the SHARING physical circumstances under which the facility would be particularly appropriate. He noted that his firm was first contacted about this facility in 1973 by Barney 'lvilson. Follow-ups were made in 1974 and the existing specifica- tions were furnished in May, 1975. He noted that the traveling display unit was shown in Kent at Mr. Wilson's request. Van. Zonneveld noted that he had offered the unit for sale on November 10 but had withdrawn the offer on November 17 when he saw that a smaller unit could be used, although the price of the larger unit would be a substantial savings to the City. He stated further that if funds were appropriated for such a facility, that Vanco would then apply for approval from the appropri- ate agencies. He pointed out that the reasons that Vanco had not as yet applied for State approvals were because the new and current specifications were not ready until December I , 1975, and because each community seems to have a different code approval system. He noted that Vanco had not even been aware of the Code mentioned by Bryant. He noted that he felt there was no question of a conflict of interest problem, as he had been doing business with Kent for about six years, and that the business transacted in 1974, amounting to about $ 10,800, was concluded before Betty Van Zonneveld started to work for the Kent Parks Department. He noted that business transacted in 1975 was $8,000 less than in 1974. It was noted that the Finance Committee had reviewed the proposed Federal Revenue Sharing projects at its meeting on December 31 , 1975 and that since time was needed for additional information, the report on priorities will be presented at the January 19 Council meeting. POLICE Reverend Isaac Sims spoke from the audience, DEPARTMENT giving his address as the King's Arms Motel on 30th Avenue South. He stated that his rights had been violated when police officers entered his apartment with drawn guns without knocking and failed to immediately identify themselves as police officers. Mr. Sims was asked to give further details to the proper authorities immediately following the Council meeting. ( Immediately fol ;owirn the Council meeting, it was determined that Mr. Sims' apartment is not within the Kent City limits, although the mailing address is Kent. No Kent police officers were involved in the incident, but the Des Moines police officers brought the Sims to the Kent jail under the terms of Kent's contract with the City of Des Moines for jail service. City Attorney Mirk advised Mr. Sims that they could contact the ACLU if they thought their rights had been violated. ) X. January 5, 1976 FINANCE JUST MOVED that the bills received on or before January 5, 1976 be paid after approval by the Finance Committee at its meeting to be held Thursday, January 15, 1976 at 8 a.m. , McCaughan seconded. Notion carried.
